I am rejecting this response because: I will accept that this matter is complete as soon as all work orders have been completed to my satisfaction. I have already submitted my work order claims as well as a copy of the 3rd party inspection to the Revdex.com and to the **. Mr. B[redacted] would not give his email, so I could not forward him a copy as well.

While the homeowner may think our response was cute, his rejection is indicative of his difficult and argumentative attitude.  As clearly stated in our offer to correct identified issues, the homeowner was to contact me directly and I would coordinate the appropriate personnel and work.  Please see the attached letter.  The homeowner has not contacted me.  Nevertheless, we will attempt to reach the homeowner this week.Sincerely,Larry S B[redacted]General Counsel

I am rejecting this response because:
Revdex.com, it is a blatant lie that Journey Homes tried to contact me via telephone (I can pull my telephone records if you'd like to see my incoming calls).  I was not once contacted via telephone or email for an entire week.  I was ignored for a week until I had cc'd who apparently is the General Sales Manager.  This was the point of contact on the Revdex.com's website, and the only higher level person I could contact.  Like I said, I was contacted within an hour after including the General Sales Manager.  Furthermore, Revdex.com, you can clearly see the motif of Journey Homes pointing fingers instead of taking responsibility.  Journey Homes claims that the side of the house sank over 3 inches because I didn't landscape.  This is simply false.  It happened because the backfill compaction was insufficient.  I have attached a picture of the defect, so you can see for yourself.Nevertheless, what I want out of this is for the concrete pad to be replaced.  I am willing to wait until Spring of 2016, but I want this guaranteed in writing.  My fear is that Spring 2016 will come and Journey Homes will continue to indefinitely postpone it (keep in mind that Journey Homes had all summer to replace the pad, but neglected to do so).  Once I have a written guarantee that the concrete pad will be replaced in Spring 2016, I will accept the response.

We have attempted to contact the homeowner by phone over five (5) times during the last three (3) weeks.  To date, we have received one call back and have not been able to speak directly over the phone.  While we understand that the homeowner is a school teacher, regular business hours are 8-5pm, M-F and we are available anytime during that time to discuss her claims.  After completing a thorough review of the homeowner’s warranty claim [redacted], our review has concluded that this claim has been closed.  The hole in which the homeowner is claiming is that of the sump pump pit.  Every home built has a pit installed at the time of construction.  There is no requirement by code to close this hole in.  After the installation of the active radon system, a retest was performed with a passing result. Any additional remediation by homeowner can be performed; however, this does not fall under warranty and is not the responsibility of the builder.  In regards to homeowners’ flatwork claims, we have sent her communications regarding a solution and would like to have her contact us at the office by phone to discuss that communication. All warrantable items have been completed. Tell us why here...

We have scheduled an onsite meeting with the homeowner to review and address her concerns.  This on site meeting is scheduled for today, January 17, 2017.

I am rejecting this response because:There must be a confusion about who's job it is to do what.  I have done my job as follows; paid for home, found issues with the building of the home, submitted proper repair paperwork to the correct people.   Job doneYour job; receive repair paperwork, schedule repairs, complete repairs properly and in a timely manner.This is not meant to be cute or funny. this is completely absurd. Your company is unable to do its job.  If you want me to do your job and schedule repairs and get them done properly I will. However, you would also receive a bill for my time and the repairs. I'm not difficult, if appointments are scheduled i'm here waiting for workers. It's your workers who don't like showing up to scheduled appointments.Once again, my job is done. It is your job to schedule repairs and complete them. I will also be present when all repairs are done.

The majority of concerns have been resolved.  We are working towards a resolution with the homeowner for the remaining few concerns.

homes  have all went unanswered prior to filing a compliant. When the work is actual done, I will be satisfied.

This is the same complaint.I have spoken to the homeowner and indicated that lot is graded to the [redacted] County approved grading and drainage plan.  The lot grade was certified by an independent surveyor at the time of closing.  The grading of the lot cannot be changed.We committed to replacing the tree no later than July 24, 2015.The homeowner also indicated that he has other warranty issues.  I advised him to submit his claims through the normal warranty process and we would evaluate and correct the issues quickly.We consider this matter resolved.Larry S B[redacted]General Counsel

In response to Mr. [redacted]’s rejection Journey Homes, LLC and J&J Construction of Northern Colorado, LLC’s (“Journey and J&J”) respectfully disagree with his position.  While Journey and J&J fully acknowledge Mr. [redacted]’s concerns,   Mr. [redacted] and Journey and J&J are bound by the terms of the Agreement for Purchase and Sale and the Limited Warranty Agreement entered into by the parties on April 12, 2014 and July 25, 2014 respectively.  Both of those legal documents dictate that flatwork is not covered under warranty.  Specifically, paragraph 14(c) of the Agreement for Purchase and Sale and paragraph F(2) of the Limited Warranty Agreement.  The parties to these agreements are bound to and must honor the obligations created under said agreements.[redacted]

I am rejecting this response because:So the list was cute; the paperwork I got looked pretty professional. So where is that professionalism when it comes to building a home and getting repairs done? I'm still waiting patiently for action to be taken. Revdex.com, do you do anything? Or do just sit behind a desk; reading these emails between the two of us? I thought you said most complaints get taken care of in a month? Again I'm still patiently waiting

I am rejecting this response because:I sincerely appreciate the prompt action of Journey in resolving the paint and siding issue. The only reason I am rejecting this is because we have received a letter from Journey stating that they will fix the concrete of the front stairs and fallen landing out of good faith. We and sincerely hoping that this is a commitment that they will follow through on. Thus, we request to keep this claim open until the work has been done on the front concrete steps. Journey has not agreed to replace the driveway, and we have received many estimates from licensed concrete business this week and all of them have told us that the entire driveway needs to be replaced, and cannot be resurfaced as it is in such poor condition. Estimates for this work will cost us between $7500-9000. I will again reiterate that the condition of our concrete is in much poorer condition than that of our neighbors poured on the same day as ours. On the day our driveway was poured in December, I watched and saw they go down the line to pour our driveways. My home was the last to be poured. Ours is also in the worst condition in the line of 6 homes. I believe that the workers were tired and that the workmanship was lacking partially due to this. We are very disappointed that they will not replace this.In regards to all other warrantied items being complete, this is not the case. There is a final warrantied item that was never addressed. • [redacted] The basement concrete was never sealed (and there is a large hole in the floor) that was never addressed though filed in a claim. There is a hole in our basement floor that is not sealed. With the radon mitigation that was installed due to the high levels of radon in our basement, the inspector said that all the cracks should have been sealed with the radon mitigation, and that the hole in the basement floor should be sealed. It is a hole that goes down at least a foot. We are sure that this is most likely the bathroom rough in, however this whole should be sealed until we finish the basement. This has never been addressed and again, was filed on within the warranty period. In regards to contact, I have received a message from the Journey's lawyer who did call yesterday while I was attending my graduate class. As a teacher I am limited in time to respond. I will be returning that call on my lunch break today. Every time I have tried to call he is out of the office. Thank you for keeping my claim open as we work through final resolutions to this claim. Regards,
