I have spoken to
the homeowner and indicated that lot is graded to the ** *** County approved grading and drainage plan. The lot grade was certified by an independent surveyor at the time of closing. The grading of the lot cannot be changed.We committed to replacing the tree no later than July 24, 2015.The homeowner also indicated that he has other warranty issues. I have attached photos to clarify the issue of our 3xconcrete slab which show that Journey was aware of the issue from the beginningThe file labeled "Walk Through Agreement June 2011.jpg" is a photo of our copy of the Walk Through Agreement Form that we and Journey Homes signed prior to
closing on the homeItem number on this form indicates the 3xconcrete slab would be repaired and/or corrected prior to closing or at a mutually agreed upon time between partiesI have other photos which show a thin patch of concrete was spread over the crack in order to conceal it (rather than repair the actual problem)I also have photos showing the separation which has continued to worsen to this present day.The second file labeled "Journey Statement November 2014.jpg" is a photo of the last correspondence we had with Journey Homes Warranty Department in this matterThe first paragraph refers to an on-site inspection they made for the 3xslab in addition to other problems with the garage, driveway and front steps (we are contesting these other issues and additional problems that have been discovered as part of a pending large group litigation). If is the final paragraph which states that Journey Homes would "in good faith, and as stated in [their] letter dated July 31, 2014, [they would] resolve the issue with the 3xconcrete slab...". This work has not been completed in the 4+ years since our original request

I am rejecting this response because: as discussed several times, this is not a warranty issue While warranty may not cover concrete, we still deserved for it to be laid correctly to begin with We saw the home when the newly poured concrete was in fridgid conditions and Journey only heating a portion of it when the house was builtWe bought a home with a driveway we expected to have wear and tear and cracksOur driveway has been falling apart since the 3rd month we moved in After reaching out via email and phone calls we have been strung along for nearly two years told you would come out here when you have someone in the areaAll we are asking for, is for you to fix it up to par with what you sold us

Front porch hairline crack does not warrant repair Concrete flatwork is specifically excluded per the Limited Warranty Agreement. Flashing on roof has been caulkedDone. We could not identify any roof sagging. Five pipes have been sealedDone. Closure flashing has been installedDone. Drainage has been graded per the ** *** approved grading and drainage planThe lot grade was certified by an independent surveyor at the time of closingGrading of the lot cannot be changedWe have previously explained the grading and drainage of the lot. I am rejecting this response because: The response of the life of the tree was a opinion rather than a factTo say that the tree "may recover next spring" is strictly an attempt to avoid the year warranty as that will be the time it runs outIn the meantime they expect us to deal with the aesthetics of a dead tree in our front yardAs mentioned in the original complaint, if the work that was suppose to be done during our closing/walk through would have been done, we could have easily blue tapped the tree and had it replacedInstead this was not accomplished until several days after our closing and a tree that shouldn't have been used or planted was installed(All of which was said to be guaranteed under warranty if there were any problems)Here are pictures of the tree as well as the surrounding trees of our neighbors which were planted at the same time. Journey Homes has review our records and do not have any documentation of receiving anything concerning this homeowners fence We have received individual warranty requests which I attached and are both completed This home is still under our warranty program and will not expire until
1/24/ The program requires a written warranty claim form to be submitted which there is no such request in our system I asked all my staff and cannot find that anyone has talked to this homeowner Our warranty does not cover damage which happens after possession of the property and if the wind blew down part of their fence it may not be covered unless it was built incorrectly My Customer Service Manager has called them and will contact them Once we find out what their problem is we can determine a path to resolve this issue We will also remind them how to access their warranty program

Once the moisture level subsided to industry acceptable levels, the repair was commenced on Saturday, December 17, The vinyl has been ordered and the repair has been scheduled to be fully completed on Friday, December 23, 2016. Journey Homes is working diligently to complete the repair this week prior to the holidays

additional information on my case I would like to add and have located the log of all warranty claims and repair requests that were made within the warranty periodOf those claims you will find one that was submitted on 11-30-about the exterior inspection results noting that "Some loose siding pieces observed on the south side"The south side of the home is where the siding is that has fallen off our homeI am including the entire repair log, the wind speed history for the date of damage for our siding showing the wind speeds of mph (which is a result of not having it properly installed or repaired as we are warrantied to mph per the home contract)Finally, I am submitting a letter that was sent to Journey, 8-28-requesting their action and including pictures to the significant damage to our concreteThank you for adding this further information to our file. I met with Andrew G***, Engineer at Journey Homes at my home on Tuesday, January 17th I am currently waiting for MrG*** to contact me with some type of resolution, after he meets with the builders

There is no homeowner information listed in this complaint. We need homeowner name and address in order to research this further

The concrete company did speak with my husband on the 11th of AugustHe was told they would be out to replace our concrete by the end of the month I spoke with the concrete company directly today and was told they have had some delays and are hoping to have the work done before the end of SeptemberI would like the concrete work done with in business days or have the option to hire someone else to do the work, at Journey homes expenseAs we have been put off for over a year and a half now!
