A letter was sent to the homeowner.  See attached copy.  This is not our customer.  This homeowner did not purchase the home from us.

There is no "bait and switch".  All listings prices are subject to change until a final contract is executed.  MLS are not offers for sale.  Prices are also address specific.

I am rejecting this response because:I agree that I'm not an original customer of Journey Homes but in talking with a...

lawyer there is a state law that the builder is responsible for any errors with a house that is less than 6 yrs old weather you are the original owner or not. I feel like there could comprise in this situation. Regards,

I am rejecting this response because: The response again does not address any of the concerns submitted in my first two emails. They continue to push off this responsibility as a "he said so" without providing any factual information in regards to the health of the tree. Revdex.com - please review this request and provide any additional suggestions as it seems counter productive if they simply reply back to each response rejection with a cookie cutter response and no real substance to a solution.

The business wrote back and said they would be contacting us by 9/30 to work this out and we have yet to receive any type of communication from them which has been the reason I filed the complaint to begin with.  I am unable to reply to the complaint now.  Can we log

The homeowner submitted the Warranty Claim Form on 2/25/15.  The meeting the homeowner is referring to was held in November 2014.  The WCF was submitted 6 months after the warranty period expired.  Additionally, concrete flatwork is explicitly excluded in the Limited Warranty Agreement and Agreement for Purchase and Sale, both of which were signed by the homeowner.  Concrete replacement on other [redacted] and in other subdivisions is irrelevant to this particular situation.  We have diligently and fairly investigated the claim.  It is difficult to understand why the homeowner expects warranty coverage after review of the above facts.  The homeowner's expectations are unreasonable.  The claim in not covered under the warranty program the terms of which were clearly and unambiguously disclosed and described to the homeowner prior to the homeowner purchasing the home.

Per our letter from May 2013, in good faith we offered to replace your concrete. 
Please understand that the Limited Warranty Agreement as well as the Agreement for Purchase 
and Sale Agreement that you signed all clearly state that concrete is excluded from the Limited Warranty. 
We have inspected the concrete and there are no immediate health or safety issues. We are unsure of an exact date; however, the concrete will be replaced as time and weather permits.

I am rejecting this response because:Good afternoon. In response to Journey's note to me, I would like to say that the siding has been repaired (with the exception of waiting for the painters to come weather permitting). While I sincerely appreciate the prompt response to the siding issue, Journey has failed to address the before mentioned concerns about the concrete and the small claims that were submitted within the warranty period, yet to be fixed. I understand that both parties are bound by the contractual obligations established in the Contract to Buy and Sell executed by the parties on 12/22/2[redacted], this does not address the extreme damage to the flatwork and poor workmanship of the concrete when the home was built. As stated before, I would never submit a claim for something that was due to normal wear and tear, or even slight damage caused by weather or the ground settling. Our driveway damage is so significant that it has caused safety concerns for my family. We have submitted several claims for this within warranty, and no one has taken the claim serious. Additionally, every single time a Journey employee has come out to assess the claims, they have commented on the poor condition of the driveway and asked us if we submitted a claim for that. This same comment was made a week and a half ago when the damage to the siding was assessed. We were told by him that he would talk to Journey and tell them about the significantly poor condition of the stairs and driveway, and encourage that it is repaired. I also reached out to the lawyer at Journey Homes, Andrew G[redacted]. He finally called me last week and left a message, and I returned his call (again leaving a message), letting him know the best times to reach me and sadly he has still yet to respond. As I serve as a public school teacher, my hours to get in touch are limited, but gave him all times I had available, and have still not heard back from Journey or anyone regarding the driveway and falling stairs. It is with this, that I must reject the response from Journey and continue to pursue resolution. Thank you.

I am rejecting this response because:There was NEVER a hose hooked up there for the winter. We had did smores the night before and on sunday it was really nice and wanted to clean off and hose off the patio we went into our garage and got the hose out to hook up once we turned it on we noticed that water was leaking. There are other people in the area that are having issues  with their plumbing and also we are having other plumbing people to come out to look at it. After talking with others if I had of known about journey homes I would of never bought a house from them cause the quality is not good and then dont want to be responsible for getting the work done. Reading all the reviews  I have read more bad stuff than good stuff!!

Paragraph 14 of your Agreement for Purchase and Sale and Paragraph F2 of the Limited Warranty Agreement you signed at closing.  It is expressly and absolutely clear as to your warranty rights regarding concrete flatwork under the Limited Warranty Program. Furthermore, Journey Homes CS, LLC is not liable for any costs associated with repairs performed by homeowners. Regardless, the claimed damage is not the responsibility of Journey Homes CS, LLC. The settlement is caused by improper compaction of water/sewer services and fire hydrants by the developer. Journey Homes CS, LLC was not the developer of the project. While I appreciate your dilemma, we have no control or ability to force the City of Colorado Springs and/or the developer to fix/correct the settling problem. Sincerely, Larry B[redacted]cc: Dan W[redacted]

also see attached letter dated July 23, 2016, sent in response to Mr. [redacted]'s claim date. Since that time, only one additional claim was made in August, 2016. The response to that letter was dated 8/25/2016 as acknowledged by Mr. [redacted]. All of Mr. [redacted]'s claims have been responded to in a timely manner, however, Mr. [redacted] does not like the response received. Mr. [redacted] was made aware during closing, and through the contractual documents which bind the parties, that concrete flatwork is not covered under the one-year Limited Warranty. As always, I am available to discuss this matter on an individual basis with Mr. [redacted] and am available at the office. [redacted]

The builder has been in touch with the homeowners on the following dates:10/9/15, 10/12/5, 10/13/15, 10/15/15 and 10/16/15.The most recent email from the builder to the homeowner requested photos of their concerns.
