In response to MrsMcelroy’s claim, Journey Homes LLC (“Journey”) respectfully disagrees with her position. Journey acknowledges MrsMcelroy’s concerns, however, MrsMcelroy and Journey are bound by the terms of the Agreement for Purchase and Sale and the Limited Warranty Agreement entered into by the parties on 6/23/2014. Both of those legal documents dictate that flatwork is not covered under warranty. Specifically, paragraph 14(c) of the Agreement for Purchase and Sale and paragraph F(2) of the Limited Warranty Agreement. The parties to these agreements are bound to and must honor the obligations created under said agreements. In good faith, we will contact the homeowner and discuss her other concerns regarding the window wells

This is a follow up to a previous Revdex.com complaintI initiated the complaint on 11/15/Journey Homes told me that they would resolve my issue so I closed the complaint as satisfactoryUnfortunately, Journey Homes has not resolved my issue by their promise dateThis is becoming absolutely ridiculous and as a customer I feel very disrespectedPlease review the complain posted on Revdex.com's website on 12/9/Long story shortI submitted a warranty claim on 05/07/regarding my garage service door padIt had sank a significant amount (a few inches)Journey Homes dragged their feet on repairing the padTheir delay in replacing the pad became so unacceptable that I had to contact the Revdex.com about the problemThrough conversation (that's posted on the Revdex.com's website) Journey finally agreed to replace the padThe direct quote is "we will contact you to replace the garage walk pad concrete prior to June 1, " June 1,has come and gone and no one from Journey has contacted meOn June 14th I emailed Andrew, the main point of contact for this, and asked about the status of getting it replacedIt has been two weeks and I haven't heard a word from AndrewThe lack of customer service is simply unacceptableI'm not being unreasonable hereIt's been well over a year since I submitted the warranty claim and Journey Homes still hasn't fixed the issuePlease help Revdex.com!Desired Outcome:I simply want the pad replacedI've invested a significant amount of time and effort in trying to get Journey to fix their product and they have failed to do so, even when I have a written letter from Journey (and its posted on Revdex.com) promising that it will be replaced

We have reviewed the file and will contact the homeowner no later than Tuesday, September 30, to inspect the concrete and work with them to resolve their concern

Landscaping is covered by our one year limited warranty. However, the landscaping subcontractor has the right to evaluate the health of the tree during the one year warrantyThe subcontractor believes that the tree is living and may recover next spring.A complaint to the Revdex.com does not change the terms and conditions of the Limited Warranty Agreement you signed at closing. While you certainly have the right to replace the tree, Journey Homes will not be liable for the associated costs. lz cc: Revdex.com

I am rejecting this response because:This is not a small crack in a sidewalk This is a major flaw caused by lack of ground preparation and poor craftsmanship nor is it flat workI have multiple concrete companies come out to review this and all have given me the same description on what happened with this pourI know that this was work that was contracted out by Journey but I would think that Journey would be holding their vendors accountable for issues as big as this is I have been told multiple times by Journey that if I wanted a home I could complain about that I should have paid more for a custom home This answer is also unacceptable I get that this is not a million-dollar home but I do work hard for the money I make and I have worked hard to make that money to spend it with Journey Homes The "you get what you pay for" answer is not acceptable This is not a small crack and it is something that shows from the street in a bad way You would think that Journey Homes would not want such a poor example of their construction on display for everyone to see Bottom line, I know that my measly 250K home does not mean much to Journey, but it is a great accomplishment in my lifeJourney Homes has fixed all minor issues but have always reminded me that if I wanted better I should have paid moreThey have also never provided me with a letter before my warranty expired Every warranty claim I had on this home was fixed but I also had to sign off on every visit one of your vendors made Please provide that letter that shows my signature back in telling me that one of your vendors or Journey representative came to my home to discuss this issue You do not have one because it never happened I would not have signed off on it then and I most certainly will not sign off on it now

We have been in contact with this homeowner, unfortunately, when there is water damage, repairs cannot be completed until the humidity within the home has reduced. As of today, it is still too high to make an adequate repair. This repair is in process according to industry standards

I am rejecting this response because: Journey Homes sent someone out to make me happy is what I feel. They have no intentions with helping me out. With talking with a lawyer the builder is responsible for any defects in building material which the lawyer said that concrete does fall in that area. These problems were not there when we did our home inspection and if they were we would have address the problem. As of the weeds growing in the living room through the carpet in a home inspection you do not pull up the carpet to look underneath. Its not just my house that is having these issues as its happening in the whole subdivision. I am not demanding that you pay for the whole thing but willing to compromise and go half and half. It would cost more to hire lawyers and court cost then to just help each other out.

[redacted] [redacted] Dear Mrs. [redacted], After our onsite inspection, our Warranty Tech will contact you to re-install the carpeting that was lifted to perform our inspection.  As stated in our October 23, 2017 letter, "The Limited Warranty is NOT TRANSFERRABLE and is offered only to the original Purchaser. This warranty shall not transfer to subsequent owners of the home." When you purchased this home, you were entitled to an inspection process with the previous homeowner. During such inspection process, any concerns discovered should have been addressed at that time.
