Mr*** states his credit card was charged before he got to use the service. He states he was then asked to submit documentation regarding his identity and he refused. Mr*** is upset that he was not allowed to cancel the service over the phone after being on the line over an hour. He demands to be cancelled and to have his money refunded. Mr*** enrolled for an IdentityShield (IDS) membership by an online application on 4/6/16. When Mr*** tried to activate the monitoring through his IDS online portal account, he could not answer the required security questions. This resulted in being directed Kroll , the monitoring company for the service, for phone assistancePer information relayed by Kroll, Mr*** could not verify specific information related to his credit report. Because he could not confirm the required information, additional documentation was necessary. Before Mr*** would be able to access his credit report information, he was requested to submit an official document which would confirm his identity, such as a copy of his driver’s licenseThis procedure is not unique to Kroll or to IDS, all credit monitoring service companies and credit bureaus require similar procedures to validate the identity of an individual attempting to access confidential information. Mr*** refused to comply with the request. Upset that he could not proceed regarding his credit report information, he demanded to be cancelled and be refunded. Our company also received an email from Mr*** the same day, using profanity demanding cancellation and refund. Mr***’s request was promptly processed upon receipt; his membership was cancelled and his fee of $was credited back to the credit card which was billedIt is indicated the same day as his call to Member Services, Mr*** filed a complaint through the Revdex.com. A review of Mr***’s file, all company policies and procedures where correctly followed. Security of our member’s personal information is a primary concern and is the basis of many of our procedures. As Mr***’s membership is cancelled and his fee refunded, there are no further actions to be taken by our companyShould you have any further questions, please feel free to contract our officeRespectfully, *** *** Consultant, Regulatory Compliance

This letter is in response to the above
referenced complaint
Mr***'s complaint is that he was referred to an attorney who he had paid a retainer feeHe was supposed to go to court regarding visitation and custody of his daughter, but somehow the opposing party got the court date delayedHe says he doesn't know what he is supposed to do now; and states the attorney didn't do what he was paid to doHe is wanting a refund of the $retainer he paid to the attorney
Mr*** *** first became a member with LegalShield (LS) (formerly Pre-Paid Legal Services Inc.) on 6/18/LS has investigated the matter referred to in his complaint to your officePer review of his file, over the period he held his membership, Mr*** used his benefits for several legal issuesHe was referred to attorney *** *** in August for a child custody issueSubsequently, his membership cancelled due to non-payment on 9/18/Until receiving this Revdex.com complaint, neither the Provider Attorney Firm "Riggs, Abney, Neal, Turpen, Orbison & Lewis" or LegalShield Member Services had any notice that Mr*** had any problems regarding this matter or with this referred attorney
After our review of all available information, we have determined Mr***'s legal matter was handled in accordance with the provisions of his membership contractHe was referred to a network attorney for services at a discounted rate benefitMr*** states he had a retainer agreement; this would outline expected services and fees for his caseAs we do not have that confidential attorney-client information, we strongly recommend Mr*** contact Attorney Burleson directly regarding the current status of his case, a summary of his fees, and the possibility of a refund for his retainerAlthough we empathize that his legal matter has not yet been resolved , there are no continued services available under this cancelled membershipAs there is nothing more we can do for Mr*** on this matter, we consider this complaint closedShould you have any further questions regarding this matter, please feel free to contact our office

This is in
response to further correspondence you received regarding the above referenced
complaint.Ms*** continues
to be unsatisfied, stating she did not get the service expected and demands a
full refundOur plans provide specific areas of benefits; these benefits are
restricted by
the laws of the state having jurisdiction of the legal matter. Unfortunately, in the state of Virginia the
law requires a year separation in order to file for an "uncontested divorce" .Furthermore, should the law in a particular state not provide to have a legal separation, benefits of our LegalShield plan cannot override the law.As in our initial
response, Ms***'s full refund has been issued back to her credit card
on 4/24/17; this should be reflected on her next account statementAs there is
nothing more we can do on this matter, we consider this file closed

I am rejecting this response because: They still have not resolved all my issues, which is a violation of my member services agreement and terrible customer serviceI do not recall ever receiving such poor customer service in my life

Mr***'s complaint is that LegalShield (LS) is not providing appropriate coverage for the citations he receivedHe states the benefits for this matter should be a free service, not referred under the discounted rate
Mr*** *** became a member with LegalShield (LS) on 3/16/15for a Commercial Driver Legal PlanThe contract covers moving violation citations and specific DOT and non-moving violationsThe plan also provides benefits for tragic accident criminal charges of manslaughter, involuntary manslaughter, negligent homicide or vehicular homicideAll benefits are subject to contract general provisions and exclusionsPer the Contract General Provision: C: Exclusion 5: Any violation issued at a stop which is excluded will also exclude any violations otherwise covered
Mr*** filed a service complaint through our offices regarding his Provider AttorneyWe have a very efficient attorney complaint resolution system, in which LegalShield investigates all complaints filed by members against Provider Law Firms and Provider AttorneysPer available information in Mr***'s file, his complaint was researched and the result discussed between our office, Mr***, and the Provider AttorneyPer review of Mr***'s files, he contacted his Provider Attorney Firm regarding having received citations at one stop while drivingOne citation was for careless driving, the other for disorderly conductThe citations were issued by the same officer at the same stop; therefore, are reviewed as one, for determination of contract benefitsAs the disorderly conduct violation is a criminal charge, and not one of the specifically listed criminal charges covered under free representation, the legal services are at the discounted rateA referral for services was made for Mr*** at the discount rate benefit for assistance for both violations
After a review of this complaint and of his membership files, we have determined that Mr*** was provided benefits according our contractual responsibility and that the Provider Attorney correctly and adequately assisted the memberIt is indicated that Mr*** has been assigned an attorney, which upon being retained, can assist with this legal issueIt does not appear as further action regarding this complaint is needed at this timeShould you have any further questions, please feel free to contract our office

(The consumer indicated he/she DID NOT accept the response from the business.)
When I spoke with the supervisor *** she informed me that the situation the I was dealing with was not throughly explained in the contract before purchaseWhich means if I am told by an employee that the contract doesn't fully explain what is covered and what is not how is a purchaser to know, that makes the contract misleading before purchasingThe attorney in which I was referred to talked to meHe informed me himself that legal shield could just pay him to represent me for what I was just covered underMe and the attorney held a forty five minute conversation about the situationWhen I informed legal shield of the legal advise I was given from the attorney that they appointed me, I was hollered at and treated very rudely, I was even told I was not telling the truth (called a liar) which is very poor customer serviceOnly because I was calling back to provide the information to legal shield with information from the provided attorneyAfter finally speaking to the supervisor of the office in OK, *** she finally informed me that it was legal shield choice not to pay the attorney to represent him for what he was covered under his contractShe also admitted the I would not have exactly know what I am cover for under my contract because it does not go into detail on exactly what is covered and what is notTherefore, that is the reason for my complaintThe contract are misleading, you are not told correctly about the contracts before purchasing and what you are covered/ or what are not covered for is something that you will not know until you contact them with the problemAll I want is a refund, for the months I have been a member of legal shield, if I have to pay a pre paid legal service for and the turn around and pay a lawyer retainer fee, it's obvious I can scrap up my pennies and just a lawyer retainer fee with paying legal shield money tooThis a huge way to continue to get money from people that are underprivilegedSo of course legal shield is not going to admit fault after this claim, but admitting fault is something they have already done is which is another reason why the claim was filed

This is in response to further correspondence you received regarding the above referenced complaint
Mr*** states that the Commercial Driver Legal Plan contract does not fully explain his benefits, and continues that he would not know his current situation wasn't covered until he contacted his Provider AttorneyHe continues that since coverage was not explained before he purchased the membership, that he was misledMr*** is requesting all of his membership fees refunded and says the membership is not beneficial
Mr*** was sent his membership contract on 3/20/upon enrollment for the Commercial Driver Legal Plan , and has had the opportunity to review and call LS for any questions he may have hadMr*** has used the membership for an earlier legal issue regarding representation for a traffic ticket; thereafter, indicating he was satisfied with his plan benefitsMr***'s current traffic matter of receiving two citations at one stop is specifically explained as an exclusion in the General Provisions of his contract: General Provision: C: Exclusion 5: Any violation issued at a stop which is excluded will also exclude any violations otherwise coveredA disorderly citation is a criminal matter and excluded from traffic benefitsThis impacts the coverage for the 2nd citation of careless drivingAdditionally, per the initial paragraphs of his membership contract, in order to receive benefits under this Contract, the Covered Person must advise the Provider Attorney by telephone regarding receipt of the citation within three (3) business days after receipt of same, and the Provider Attorney's office must have at least five (5) days before the court date to help with the benefitsMr*** contacted the Provider Attorney on 1/18/regarding these citations, with a court date of 1/20/16; less than days before a court appearance dateUpon notice of the two citations, Mr*** was offered representation at a discounted rate by a referral, which he declined
Mr***'s service issues and determination of benefits have been thoroughly addressedIt was found that he has had contract coverage available and the appropriate services have been provided for his legal mattersPer review of this complaint and Mr***'s request for a refund of his membership fees, we have concluded that there is no portion of the monthly membership fees eligible to be refundedAs the membership fees are being deducted from his payroll through his employer, Mr*** is advised to contact his payroll representative to cancel his deductions if he wishes to terminate his membership
As we cannot further assist Mr*** on this matter, we consider this file closed

(The consumer indicated he/she DID NOT accept the response from the business.)
3/20/2016? Today is only 2/17/how could I have received a contract on a future date? That further proves they will tell you anything...My advice for future buyers do not invest in this bogus mess!!! I will be spreading the word!! For any drive to purchase their own personal lawyer like I did for a cheaper rate, I got my own case solved!! I just ask for a full refund which they are refusing to doWhy not give me refund? Haven't you already received enough of free money from hard workers!!! What makes matters even worse, my own personal lawyer retainer fee was six hundred and twenty five dollars cheaper than the one they referred me too, after I "supposedly" gotten a discount

This is in response to further correspondence you received regarding the above referenced complaint. Ms*** confinned she did receive the prorated refund of$She is still expecting the remainder of fees paid to also be refunded, $which is $for the month of October and the $enrollment fee. Stated in our previous response, Ms*** had the LegalShield membership beginning in October, had access to the benefits, and had used the membershipAs previously noted, per General Provision in our contract, the $enrollment fee is non-refundable, and fees paid are pro-rated from the date the cancellation is received to the membership's paid to dateThe appropriate refund of$has been issued. All company policies and procedures were followed on this membershipThere are no additional fees to be considered for reimbursementWe now consider this matter closed

disconnected before she was given info on where to send her written cancel request
Member Services tried to call her back but there was no answering machine
available to leave a messageAs a courtesy, a 30-day hold was placed on her

to try and keep it off her record, with legal services available under her 25%
discount for benefitsAfter Ms*** was referred under the discounted rate,
she requested another attorney located within the city of the traffic court
She was assured her referral was the closest attorney in the county and that he
handles the LS traffic matters for that courtUntil the call on 1/4/18, there
was no indication that there was a problem with the legal services. We want Ms*** to know that we
take our responsibilities very seriously and take pride in making sure that our

complaint
Ms***'s complaint is that she feels she was given incorrect advice by her Provider firm which was harmful to her caseShe states she was representing herself and that following the given advice cost her $in sanctions, which she has been paying while on a very limited incomeAfter reviewing the situation with other attorneys, she says the initial procedure she should have taken had not been discussed and requests that the Provider or LegalShield be responsible for reimbursing her the sanction expense
Ms*** *** first became a member with LegalShield (LS) formerly Pre-Paid Legal Services Incon 7/26/Her application was processed for $27.00, which was for the first month LegalShield (LS) membership fee of $and included a $enrollment feeCurrently her membership is drafted from a credit card for monthly payments of $on the 26th of the month
Upon enrollment, a member is assigned to a Provider Law Firm, which provides legal services to our members within a given areaWe do not provide legal services, but rather our plan provides for certain benefits which are provided by the member's Provider Law Firm or an attorney that they might refer him to for particular matters
After review of this complaint, we find that LegalShield has provided the services with access to her Provider Firm per her membership contractAs Ms*** has concerns about the legal services she was rendered by the Provider Attorney, that is a matter she would have to pursue through other sources, as we do not provide those benefits through our officesWe consider this complaint to be closed with our office

Initial Consumer Rebuttal /* (3000, 7, 2015/07/19) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The following quotes are excerpts from Legal Shield marketing used on their website to explain their service to current and prospective clients
"In 1969, our founder, *** *** had an epiphanyHe found himself financially unprepared for the legal costs he incurred from an accident even though it was not his faultFrom that day forward, he was determined to make sure everyone has access to legal protectionNo matter how traumatic or trivial the situation"
"Today, Legal Shield, continues our mission by providing legal protection to over a million members in states and four Canadian provincesOur network of dedicated lawyers works diligently to keep individuals, families and businesses safe, 24/7/365."
These two quotes are the quintessential explanation of the driving force behind Legal ShieldIn a nutshell they offer protectionThat protection comes in the form of their network of Provider Attorneys
But what happens, if instead of protecting Legal Shield clients, their dedicated network fails? In frustration, I contacted my Legal Shield attorney, *** *** with Parker Stanbury, on March 28, for adviceI explained my situation and gave her a copy of the MSA for her reviewShe told me that I had a clear cut case of Contempt of CourtWe discussed the possibility of my representing myself and she assured me that because my Marital Settlement agreement proved my case, representing myself would be a routineShe then gave me the form numbers I should use to represent myself in this actionShe never mentioned any other options, nor did she advise or suggest that I would be wise to hire an attorney as opposed to representing myselfI learned too late that a Contempt of Court order is NEVER to be used in Family Court, and that her suggestion that I would be able to represent myself in court had dire consequences for meI found out (again too late) that instead of filing a Contempt of Court, I should have filed a Request for Arrears
I trusted Legal Shield to protect meThat service to protect is the legacy that Legal Shield sellsThey promise to "take away the fear of lawyers"Parker Stanbury refused to admit to giving me bad advice even when I gave them written proof (transcripts) from two attorneys and the Commissioner presiding over my caseThat was when I contacted Legal Shield to arbitrate the situationHowever, they sent me back to Parker Stanbury who basically told me, we don't care about your written proof (transcripts), we did nothing wrong
Who should be responsible for insuring that Legal Shield clients receive the protection from Provider Attorneys as promised? Legal Shield makes the promiseLegal Shield markets that protectionLegal Shield needs to be responsible for policing the actions of the attorneys they hireIf no one takes the responsibility to police the actions of the Provider Attorneys, they have no incentive to fulfill their obligation to Legal Shield clients and all Legal Shield clients are in danger of being given advice that could be devastating to them
!!THE ONLY ENTITY THAT CAN FULFILL THAT OBLIGATION IS LEGAL SHIELD!!
I believe that nothing will come of this explanation, because I am just a single insignificant person
Why should anyone or any entity listen to me?
Legal Shield has shattered all the faith I had In them to fulfill their promise that their highly paid Provider Attorneys will protect me by advising and guiding me through my personal legal jungleI asked for professional adviceI asked for professional guidanceAnd I asked for professional protectionI was treated as though I was insignificant and unworthyI have always been a very well adjusted adultHowever, the ordeal I have been through with my divorce, being deceived by my ex into moving away from my family, and this situation has thrown me into a severe depression
Two corrections to Legal Shield response: 1) I was not representing myself when I contacted Parker Stanbury2) I have not been able to afford monthly payments to my ex-husband (who makes in excess of $100,000/yr compared to my $33,000/yr)I have a lawyer who has filed to get my payments reduced from $350/month to $100/monthEven if I get that rate, it will still be a hardship for me
