In March of 2019, I entered into what was presented contractually as a $900 loan from a company identifying themselves as “Niswi, LLC d/b/a Amplify Funding”, as an “economic arm of, instrumentality of, and limited liability company wholly-owned and controlled by, the Lac du Flambeau band of Lake Superior Chippewa Indians (“Tribe”)”…with a P.O. box given as an address, in Wisconsin. I made three timely, monthly payments totaling $725 and called to pay off the loan at approximately 90-days, only to learn that my loan balance was still $936. I called phone numbers given within the contract for customer support and, over the next several weeks, was led through a spiral of inconsistent, contradictory and shocking discovery of unethical business practices on behalf of this “Tribe”. I began researching the terms of the 22-page contract, lending practice, Wisconsin and Mississippi (my state) lending practices, U.S. and Tribal regulation cases, usury laws, a recently filed class-action against the Tribe, and consumer protection information on short-term loans. I called the State of Mississippi and Wisconsin’s financial commerce, the Secretary of State and Attorney General in both Mississippi and Wisconsin, the Consumer Financial Protection Bureau, the Wisconsin Dept. of Financial Institutions (WDFI.org) and the U.S. Department of the Interior, Indian Affairs, and have researched to understand the language and meaning of Sovereign Immunity and “Tribal Law”, which led me to understand the unfairly-balanced, misleading, contextual omissions and lack of clarification and definition within the the contract.
Several very alarming findings surfaced, I’m listing only a few: 1. Within the state of Wisconsin, there is no LLC entity named “Niswi, LLC” nor does a dba of “Amplify Funding”, yet my contract uses these names as the entities as named on or within the contract.. 2. It’s generally understood that to obtain a state LLC, an entity must agree that their business will be governed by the laws of that state. A tribe cannot be an LLC entity, and claim that tribal sovereignty governs a business contract. I could not find any tribal LLC’s listed either, in spite of diligent efforts. Even if in existence, it’s unreasonable for a consumer to be expected to understand a set of laws or rules exist to which they must adhere when there is no definition, link or information about such laws and/or policies written within the contract; 3. When I called the customer service centers of “Amplify Funding” on approximately three different occasions (June 18th, 21st and 28th), I noticed that the reps all had European dialects. One of these calls was with a Supervisor named “R” who told me that they are on pacific time zone, are an outsourced call center for Amplify Funding, and are located “out of the country”. Further, this Supervisor told me she does not know anything about Tribal operations/law and she did not know what “Sovereignty” or “Sovereign Immunity” are when I asked her to please help me better understand. A tribal business, with outsourced call centers in another country, whose Supervisor knows nothing about the “Tribe”, and that is contractually present to me as a dba of an LLC, both of which do not exist, in Wisconsin. Not to mention that the company APR’s are 10-20-times higher than allowed in WI and MS, among other states ; 4. The Amplify Funding web site states that they are LDF Holdings, LLC, yet nowhere within my 22-page agreement is LDF Holdings, LLC mentioned. There is however an LDF Holdings, LLC registered with the state of WI. If this entity is the Tribe, it would stand to reason that business is then governed by WI law and not tribal sovereignty. Amplify funding web site also gives a mailing address of Las Vegas, yet there are no business entities listed with the Nevada Secretary of State under any of the names involved. I sent a letter to the address, and it was later returned and marked "undeliverable"; 5. It was explained to me by a representative within the Attorney General’s office in Mississippi, that, as a resident of Mississippi, the terms of my agreement are non-compliant with usury laws and that a business lending money in this state must have small loan license (75-67-103b)(dbcf.ms.gov). No such license is on record from any of the entities listed on the agreement.
I have summarized only a few of the countless concerns and issues encountered within the terms and language of my contract, each are layered with ambiguity and gaps that are left wide-open to the vulnerability of polar-ended interpretation. The use of contextually unclear and misleading practices are questionable, to say the least. I respectfully ask for immediate relief from the contract and ask that any and all collection practices cease instantly as well.

I have reviewed the response and proposed solution presented by the business that is recognized as, among other names: Niswi, dba Amplify Funding, LDF Holdings, and Business Development Council (BDC) of the Lac de Flambeau Band of Cherokee Indian Tribe. In reference to complaint ID, I find that their resolution response and proposal to be satisfactory to my complaint. I will follow-up with them per the phone number provided within their response by the end of this week to discuss final steps toward finality of the proposed resolve.

I requested a payoff amount from amplify funding and when they responded they wrote in email that as long as my payment on 7 Nov 2019 was processed that the payoff a mount would be $x amount of money. They asked me if I authorized this and I responded in email stating I authorized the payment amount they stated. Two days later I get an email from them stating that my payment could not be processed because I did not confirm it. Which I did and responded immediately after they asked me if I authorized the transaction. The email said that they couldn't process my payment and that because it was a holiday weekend that the payment would go up another $120. When I called them to figure out why this didn't happen she tells me that I never responded to the email(which I did) over and over again and that they never received the authorization for the transaction. After about 10 minutes on the phone and on hold she says she sees the email I was talking about but that I didn't send it until way later. Well problem with that is that Gmail doesn't lie about when emails are sent and she said there was no email from me at all until I read when I sent it then she changed her story. This is extortion and it is not right and they are trying to steal more money from me for interest in a loan I requested to payoff and they agreed upon it and didn't come through on their end of it. I've read that this has happened multiple times to other customers and also being told their supervisor would help me then saying "she" was busy in a meeting and couldn't help me like other people have said on this Revdex.com site as well.. This is not right and is completely and totally am extortion scam and I want this taken care of. I have all the emails they sent me and I sent them. Someone needs to do something about this before they steal more money from other people like myself!

I initially took out a small loan in the amount of $600. The agent said I needed to pay the loan of 600, back by october 9, 2919. If I did not pay the loan back by then. The loan would be 750. It was never mentioned that the balance of the loan would accrue, not monthly, but daily. The want me to pay 12 installments of 161.07, adding up to $1,932, and change. No mention of daily accruement if the loan was ever mentioned or explained to me. This is a scam

I have poor credit, I needed funds for an emergency. I was approved right away for 800 dollars. That was 3 weeks ago. I called to pay the loan off today. I was only charged 78.92 interest. I would def go through them again in a pinch.

I borrowed 800 from this lending company...when I talked to lady I understand it would be only a couple of payments...then when I looked back these people want 3500 back and I only borrowed 800..these people are scamming and taking from people..this has put me in great anxiety and depression which I already suffer from..this has made it worst

This company began calling us a week ago, insisting that we applied for an online loan and they need to verify additional information. Despite us advising that they are mistaken and have the wrong number, the phone calls have persisted. We have asked to speak to a manager repeatedly. We have asked them to stop calling us repeatedly. They state it is their company policy that they cannot stop the "loan" process unless we verify personal information. We get anywhere from 5-10 phone calls per day, sometimes starting as early as 7:15 am until as late as 7 pm. We would prefer to give them a zero star rating but we are unable to leave a review unless we give them at least one star.

Amplify Funding has called my home number around 75 times. I answered about 4 calls telling them to stop calling but they won't. I have a disabled adult son and the constant ringing is upsetting him. Please make them STOP! Thank you!

Revdex.com:I never applied for a loan. That is an outright lie. They must have called my house around 125 times when I last checked. I even answered a few times to ask them to stop calling, but to no avail. They have now stopped calling thanks to you. I appreciate what you did for me.

I took out a loan for $1100 needing emergency cash to help me pay my rent after missing some work due to an emergency. I didn’t even really think about them 600% interest thinking I could pay it off quickly. After two biweekly payments of $306.56, $613.12 a month, I can’t afford to pay extra. Payments are more than I pay on my car payment! I have already skipped one payment because I couldn’t afford it, reached out to see if I can arrange a different payment option and they basically refuse smearing they cannot change the payment arrangements. I’m going into debt worse than I was before. I’ve already paid $1226.24, which is more than my loan principal. My payoff amount if I paid in full would be another $1600! $3600 for a $1100 loan. This is so unfair to consumers.

I don't know who these people are. I did not apply for a loan with them. I don't know how they got my information . I want them to stop emailing and calling me multiple times per day.

This is a SCAM! I was contacted by Amplified Funding stating I took out a loan for $1200 and they deposited $1200 into my checking account. They had all my information except my email and the bank that they "deposited" $1200 was ***, but I don't even have a *** account. There's not even a *** anywhere near me! I didn't take out this loan. I don't need this loan. They sent me the loan agreement I "signed" (which I didn't) and has 760.81% interest rate!!!!!!!!! I would NEVER borrow $1200 to pay back $4589!!!!!!!!! I have filed a police report with my local police. When I called Amplified Funding to let them know, they proceeded to THREATEN me stating they would RUIN MY CREDIT RATING if I didn't pay. This is a RACKET and a SCAM. I have checked my credit report and there was no hard inquiry on there about this "loan". I'm not sure if this is a case of identity theft. I'm thinking its a case of Amplified Funding trying to scam me.

If the complainant believes he/she hasbeen the victim of identity theft, he/she can provide the following to the Company to further investigate:(1) A completed identity theft report, which can be found at the Federal Trade Commission’s website,https://www.identitytheft.gov/Assistant# or a police report outlining the alleged identity theft; and (2)proof of identification, such as a copy of a driver’s license, a copy of a government-issued identificationcard, or social security number.

This company has turned a supposed loan that I have supposedly taken out with them to Zen resolve collection agency for me to pay. When I contact the company to ask when the loan was taken out or what the loan was used for or any other information about it they tell me they cannot provide me with that information and I need to call *** resolve. Space but when I contacts and resolve they never answer the phone. So it appears that these people have submitted a false request for collection for a loan that I did not take out. I asked the customer service person to speak to a supervisor and they told me three times in a row that none were available to speak to and all I could do was call *** resolved and pay them the amount I owe. They have my first and last name, date of birth, and last four of my social security number but do not have my phone number or address on file. When I checked my credit history with the three reporting agencies nothing has been turned in on my credit report even though they are trying to collect a large sum of money from me through a third-party provider ***.

This company failed to verify important information when their client applied for a loan under my name and therefore my identity was stolen

The customer may have us confused with another company that offers a 90 day same as cashpayoff. He contacted us twice and was advised we do not offer that option. It is stated in the loanagreement that this is an expensive form of borrowing as this is an installment loan with high annualpercent rates calculated daily. The customer agreed to the terms of the loan and signed the loan. I received multiple phone calls in one day asking me to confirm some information so they could process the loan I requested on line. I told them that I did not request any loan and hung up. These calls continued until I picked one up and asked what was the loan for. They responded that it was a personal loan for $1,000 thru them Amplify Funding and that they were a tribal lender. I again stated that I did not apply and that application was fraudulent. They insisted that they needed my date of birth and the last four digits of my social security number in order to verify me and cancel the loan application. I refused siting identity theft concerns. They claimed to already know that information but needed me to verify. I did not and when asked what would happen if I didn’t I was told they might process the loan anyway. When I reminded them that we were on a recorded line and that the person they called at the home address (me) instructed them that the application was fraudulent how could they process the loan? Their response was that if the applicant could verify the information then they would lend them the money. The email address and bank account information that they gave me was not mine so it was beyond a reasonable doubt fraudulent. I insisted that they cancel the request and the representative put me on hold to ask their supervisor if they could given my concerns. The supervisor came on the line and again asked for my DOB and last 4 digits of my SS in order to remove the application. At this point I was beyond frustrated and pointed out that I was not prepared to give the information. The manager then said if I would not give her the info she was going to hang up and the annoying calls would continue until I gave them the info. I said no, she then hung up on me. It’s important to note that I asked the original rep what would happen if they gave the loan and then the fraudulent borrower did not pay it back, what would they do? Her response was that they would eat the loss. I pointed out that they could avoid that by taking the word of the person on the phone that they called unsolicited. She said she knew that but she could not do it. So now it appears enough of my personal information has been stolen to file a loan request and the company who will be on the hook for the non payment is only concerned with harassing me, the victim, at this point! This has to stop and this company has to be held accountable for possible aiding in fraudulent practices and consumer harassment.
The one star rating is the absolute lowest I could provide and still get this published. I would rate this company a minus 10 stars!

It has come to my attention though contact with the office of the Attorney General of the State of New Jersey that payday loans and tribal installment loans are illegal in New Jersey because interest rates exceed the 30% allowed under law. It is criminal usury if a lender charges an interest rate of 30% or more to an individual .Your interest rate on this loan is is 467.77%. Because the loan agreement was signed electronically on a computer in New Jersey it is governed by NJ law, Not Tribal. Tribal laws apply to tribal members and people living on the reservation.
Therefore, the loan contract that I have with you, according to my state's laws, is illegal and not enforceable. Although I am not required to do so, I have repaid the principal balance of the loan. To date, I have received $1,000 and have made 3 payments of $344.24 for a total of $1037.72. This results in an overpayment of $32.72. I am a 80 year old veteran living on social security and a part-time job, I can not make these payments and keep up with the rest of my obligations each month.
At this time I am requesting a return email acknowledging that my loan has been paid in full and my account has been closed. Also, I would like a refund of the $32.72 overpayment. A refund check of $32.72 should be mailed to me at the address you have on file.
I am revoking ACH authorization, per Federal law, Regulation E Section 205.10 concerning pre-authorized transfers. I am also revoking any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.I demand that any contact be made through email only. I prohibit you or your affiliates to contact me via telephone at my place of employment or my home telephone number.

I've been trying to resolve a debt with Amplify Funding since May of 2019 when I called and said I wasn't going to be able to make any additional payments because of Financial Hardship due to payday loans and a disability from long term depression (since 2008). The IRS was also pushing for payment of more than $9,000 of back taxes from years during my serious depression, when I had always files taxes, but had been unable to meet the full amount. I borrowed $800 from Amplify Funding during a time when I was experiencing extreme depression and the inability to pay my bills because of my recurring severe depression, for which I still receive ongoing psychiatric treatment for medication management and twice a month cognitive therapy as needed during high stress times. I have so far paid Amplify Funding $1,376.95, and asked them to accept that as payment in full. In June, when I proposed this, they said they wanted an additional $841.23 for a payoff. I just did not have it. I had never been late on a payment having given them $1,376.95. When I asked for help, I was told nothing could be done until I missed two payments, then it would go into default. Then a payoff could be discussed. I did not want that on my credit report. They said not to worry, it would not be reported. I saw online that they had settled with several people who had paid back less and borrowed more, and I was concerned by I was not received the same consideration. I'm 70 years, left work before I was 65 on social security disability, cannot work now to supplement my income, and just don't understand. I wrote them a letter again pleading for their help, and it was returned unopened and my file was given to a collection agency, who emailed me that the Amplify told them I had an outstanding balance of $1,205.55, that went into default on 9/12/2019. I am sure I did not understand the loan agreement, because I've never heard of anything so outrageous. I've just paid of two Payday Loans which were most cooperative when I explained my situation and they worked with me instead of pressuring me and turning me over to a collection without even trying to help me. This truly feels abusive and frightening. I live alone as an older single woman and do not have anyone to assist me either financially or emotionally because my family has moved away. In the letter they returned, unopened and unread, I had attached a copy of the information from the IRS showing what I owe them, hoping they would take that into consideration. That's it. I can provide more dates and notes and names from telephone conversations if you need that, but it's very painful going over these discussions over and over. as it is with the IRS. I'm struggling out here and do not know where else to turn. Thank you for reviewing this complaint.

On 01/16/2019, our first contact with *** was over the telephone when she took out aloan. Ms. agreed to the terms of the loan and signed the loan agreement. On 07/08/2019, Ms.called asking to pay less on her loan, she was advised of an early pay off, and was advised on steps todefault loan and make a payment arrangement once in collections. On 08/21/2019, Ms. calledasking to settle loan, she was advised the steps to default, and to call back on 9/12/19 to discuss a newpayment arrangement or settlement. On 09/12/2019, Ms. called requesting to settle account for$500.00, we advised we can settle for $881.66 to be paid in 3 months, or set up payments of $50.00monthly. Nothing was set up, customer declined. On 09/18/2019, Ms. was transferred to our thirdparty collections. No other correspondence (phone, email, or web chat) has been received regarding thisloan. Although not required to do so, as a courtesy, the Company will reach out to the customer with an offerto resolve their loan.The customer can call the Company at *** if there are further questions or concerns

Took out a payday loan, was told they would only charge me Ohio laws. Receding loan documents charging me 644% on 300. Found out they are not licensed in Ohio.

Too high of interest. I borrowed $300.00 and repaid them a total of $1,238.88

I keep getting emails saying to go to their site to "complete" my application. WHAT application??? So after several of those, I logged onto their site and see old information (an old address that is 5 yrs out of date!). So I tried to speak with an agent using their chat feature. What a joke. It kept saying they were transferring me to another section, which never happened. I took a screenshot of my attempt to notify them of fraudulent info using my name in case something happens. I would NEVER use something like this kind of predatory lending.
