While I don't know for sure whether or not you assessed the garage door because I wasn't home (my wife was and she doesn't recall Maronda looking at it), I will take your word for it, though I do appreciate a second look when you come to fix the floor squeaks. I will caulk the second floor window as you describe. If water still penetrates, then we will have to go from there.

Dear Mrs. [redacted]I have been able to review the customers issues with our service manager who was at the home, as well as our flooring contractor. As of this letter, our flooring contractor is reaching out the padding manufacture again to find information for the claim. The claim has been submitted,...

and the manufacture should reach out to us before weeks end. At that point I can forward any information over the customer. The window in the lower level of the home is installed correctly. This is a hopper style window as installed in all of our basement homes to meet code. The window has been checked by our service manager and is properly installed and sealed on the exterior. Maronda Homes does not install other styles of windows in this situation, nor do we schedule inspections with the manufacture. Should the homeowner wish to do this, the information is in the homeowners guide /Warranty manual they received at closing. Our production supervisor has been able to review the driveway as well as my self, and a picture is included for reference. The area in question appears to be the very edge of the driveway where it meets the yard. This may be caused by settlement and would need to be filled and sealed according to the warranty manual. This is typically a maintenance item, but I would be willing to have our service manager stop at the home and fill the crack with asphalt filler. I did not see any other issues with driveway at that time.  I have spoken to our roofer in the area and he will stop at the home by 3/16/16 as long as the weather allows to make repairs to the flashing. Our service manager has been to the home and addressed to the best of our ability the HVAC vent noises.  The HVAC duct work when the unit is turned on, The ducts are expanding and contracting causing a ticking/clicking noise. There is nothing further that can be done as the metal expanding makes this noise and the unit is operating properly. We have tried to make some changes for the customer.  The electrical issue has been corrected at this point. Thank You,Bob G[redacted]Maronda Homes

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear belowin response to Mr [redacted], we have been in communication three times now with no timeframe of how or when this will be resolved. In fact, last week at my 6 month warranty inspection, [redacted], a Maronda employee in charge of service and warranty issues told me that my issue wasn't even registered in Maronda's system or he would know. I find that hard to believe as he personally responded to my initial service complaint on August 18, 2014. It is clear that I am being sold a bill of goods. ** Floors, the flooring contractor has plenty of time on their schedule to complete new construction floor installs, but no time for warranty issues. 5 houses have been fully completed across the street from my house since the August 18 complaint. I have begun legal proceedings. My wife and I read all the complaints but still were sold on the sincerity of the Salesman and his promise. I regret ever building with Maronda and would advise anyone to do their homework and be very careful who they trust with a project of this scale involving such risk and cost.

We have been able to look into the yard issues at the [redacted] residence. What we would like to do is to go back to the home, with the permission of the homeowner, and shoot measurement's to see weather he or his neighbors yard is high or low. While we do see...

the ponding of water, it is unclear weather it is due to the sinking or height of one or the other yard. I spoke with the supervisor of the plan, and we can do this shortly after the first of the year. If the issue is on Mr. [redacted]s side, and requires corrective action, Maronda Homes will regrade this section, but it will be up to the homeowner again to water and fertilize the seed. This portion of the problem would not be done until spring time due to the weather currently. We have been promised resolutions to so many problems that Maronda was to fix but never responds to.  We've owned the house for eight months and since our 6 month inspection none of the work to be done has yet to even be scheduled, so understand that we are not accepting that yet another phone call to Maronda can fix this as we've been calling and emailing for months with no resolution.
As stated previously, we had to have the grading fixed by last week so that we could get have the yard reseeded, so having the topsoil they promised since January was crucial.  We even stated we would fix it ourselves if they supplied the promised free topsoil.  None of that occurred, so we are asking for the reimbursement for the topsoil we had to buy which cost more than the $100 they are offering.
We are requesting payment for the topsoil (per the actual invoice supplied by the landscaper who separated the charge in our final bill) in full.

First, the floor squeaks have not settled.  There are still significant squeaks in the kitchen by the basement steps and near the front door by the 2nd floor steps. The squeak in the kitchen is most noticeable. I request that Maronda seek out the cause of the problem and fix it.Second, it was determined that the water is coming through the window above the front door. This issue has been occurring since day 1. Therefore, it is not the homeowner's responsibility. Maybe Maronda did not properly install or seal the window. Water should not be passing through and dripping between my front door and storm door. There is most likely water damage to the house because of this. I expect this to be investigated and fixed.Third, I would like someone to come to my house and assess the garage door. It clearly wasn't installed correctly.

Maronda Homes was willing to return to the home to review the issue with the homeowner. While we may disagree on the procedures and corrective action, Maronda would have, and has returned to correct this. In our prior emails, we stated we would go to the home, but found the issue was corrected by the homeowner previously. Maronda Homes will not be able to reimburse the homeowner for work that they have had done. It is not a matter of the larger company, our amount of money. This is our policy, and stated in our warranty manual. No further action is needed on our behalf. Without being able to view the issue, we do not know what was needed or what had been done.  Thank You,[redacted] Maronda Homes

Dear Mrs. [redacted] While I understand the homeowners frustration, I have been to the home to on the initial call as well as have seen the regarding, and repairs. Without first seeing the problem by preforming a water test and interior block scope we will not dig up the foundation. I was able to review the outside of the home and the grading is correct. I am willing to review this issue again, but form the pictures it appears there is leftover effervescence. If the weather permits we could also stop by after a  rain to see the damp block should there be water intrusion.Thank You,Bob G[redacted] Maronda Homes

Dear Mrs. [redacted],   I have been able to review the customers file on these complaints. As the homeowner states we are going to be replacing the door for them, and was notified this morning the new door has been delivered to our office. That should be in line soon.  As for the yard, we...

received a complaint  07/07/2015 that There are a number of patches, and some areas that were washed away by heavy rains. We need grass seed for these areas.  Maronda Homes did give the customer seed for these areas. As per our warranty manual we do not warrant weather related issues to the yard. We do offer seed and a service load of soil on a one time basis for storm run off, or patching. A copy of our warranty is attached pertaining to the yard, starter lawn, and soil conditions. I was able to find a complaint on 11/30/15 stating they are having issue with the Nest thermostat and asking how to control the nest thermostat. The issue was resolved by our HVAC contractor. We received another complaint for the thermostat on 04/04/16 stating : Please send someone to replace my nest thermostat as soon as possible. We haven't been online in months and it has a mind of its own. . we again had our HVAC contractor to the home, to resolve. The work ticket stated All past tickets have been resolved. the last visit to the home resulted in repairing damage to the connections of the back of the thermostat made by the homeowner. We can not warrant any further labor to the resident. The last ticket was completed just short of the one year warranty period. Based on the findings at the home at that time, the unit is not covered under the warranty. Our third party HVAC contractor is a repair center and supplier for the NEST thermostats for warranty. The customers are out of the one year warranty at this point, and would need to contact the manufacture for warranty purposes.  Thank You, Bob G[redacted] Maronda Homes

Dear Mrs. [redacted]  I have reviewed the customer complaint, and while I do understand his concerns the unit is out of Maronda Homes warranty. Looking at the pictures, the water appears to be under the unit and not inside, from the picture available, and directly below the condensation line which would lead me to believe the elbow may have a leak in it. It does not appear to be inside the unit. This would show why the water is on the floor int hat area. The homeowner also states that the tech he had come to the home, had found grass and other debris from the outside possibly during the grass cutting season. We have not had any other complaints throughout the warranty period other than the bird issue in 2014, and the unit was working properly at that time. Should he like to have our company go to the home, we can facilitate the service as they install and service the same units and may have more insight. This will be a billable call to the homeowner though. The manufactures warranty information on parts would be included in the homeowners handbook he received at closing, and if a malfunctioning part, it may be covered under the 5 yr parts warranty.   Thank You,  Bob Goettel  Maronda Homes

Mrs. [redacted]     Maronda Homes has been to the home to review the step issue. The homeowner is the second homeowner, and a warranty is not provided to second homeowners. While at the home we did not find fault on the construction of the steps. The statement of the board attached to...

the steps is incorrect. The 2x4 is as wide as the steps and still attached to the brick stoop. This is standard construction during the home building process in 2007. In the attached pictures, it does show the steps have fallen, and the header board is still attached to the stoop. In the second picture, it shows why the steps failed and fell. The screws have rusted and broken off, as evidence of the rusted broken section still in the header board on the brick. While this is the cause, Maronda did offer to build a new set of steps, in the same original fashion as was supplied on the house , as a courtesy to the homeowner. She had refused this in our conversation last week, as she wanted a different style of step and contractor to build or replace them. The steps the selves, as well as the header boards, and stringers are in tact, and only the rusted screws are broken off. While this is a homeowner maintenance issue, we di offer the new steps to be build with new lumber, and new railing where needed. most of the original railing is ok, with the exception of some pieces that have cracked to angle stress.   Maronda offers a one year warranty to the original home owner. I did offer to talk to the insurance company if need be as well, as the steps where built in February of 2007, and the house was inspected for occupancy.  Thank You,Bob G[redacted]Maronda Homes

Maronda indicated that they would repair the concrete on a "one time basis" .  Although I accept Maronda replacing the concrete, I am concerned about their indicating this will only be on a "one time basis".  The reason for this request to begin with is because their last repair was not made correctly. If the repair is not made correctly by Maronda this time, I would not want them indicating that they only agreed to One time only.  I would appreciate if Maronda would simply indicate that they will replace the concrete.
