I am rejecting this response because: How many miles I drove the car has nothing to do with what happened to meThe lack of concern for my family lives shows how much your company cares about their costumersI had Meador Chrysler pick it up to do WHATEVER they had to do to fix the car as it almost caused my to lose my lifeI did not tell tell them I just wasn't paying because I didn't careI told them I should not be liable for paying any charges for a car that I'm leasing and clearly was issues because of common recalls with this carWhat they fixed is irrelevant as long as the repairs were needed to fix because the car the almost killed meWhy should I be liable for paying a early termination fee when the lease is being terminated because of a major deadly recall that is clearly known as you can look it up on the webpeople has died because of this issues on the car and all they care about is how many miles I drove and paying him to end a lease that clearly needs to be terminated

We have been in contact with the customer regarding the disputed informationWe purchased the vehicle on 5/15/through a rental fleet providerIt is our policy to never purchase or sell vehicles that have had serious damage and never to sell vehicles with structural issues. The report I have
attached was generated this morning showing no issues with the vehicleThis report is also run at the time of inspection when we take delivery from our vendorMs*** is indicating that the information she was provided from the dealership was through CarFax? We requested a copy of that report from Ms*** but she did not provide us with a copy. The vehicle has a clean title, if there was structural issues to the frame, and was deemed salvage, the State of Texas would have not issued a clean titleThe vehicle would have been issued a salvage title to ensure that anyone, regardless of whether they use a vehicle inspection service would be aware of any issues.Ms*** is stating that she was informed that there was structural damage, this information was provided to her by a salesperson at the Dealership she attempted to trade the vehicle toStructural damage is not frame damage in all instances, structural is a term used to define any damage to the structure of the vehicle? Again, the reporting we use did not reflect that today or at the time of delivery? Any newer vehicle with low miles still has a significant amount of depreciation in the vehicleTo attempt to trade a vehicle after only months of payments on a month term is very difficult due to the continued depreciationTypically, a month term vehicle is not to break even until it reaches halfway through the loan due to the nature of financing. We did offer to trade her out of the vehicle with $to offset the depreciation, this was still going to put us in a position where we would lose money on the deal, but her satisfaction was our top priorityWe were going to initiate a new loan with no down payment with the exception of the County UPTV fee of approximately $? In addition, we offered her a discount off the payoff in the amount of $as a gesture of goodwill if she decided she did not want to trade the vehicle. If Ms*** would like to discuss taking the vehicle to an agreed upon third party Collision Repair facility to inspect the vehicle, I would be more than happy to pay for that service to ensure that the vehicle is safe to drive

the deferral was processed on 12/12/16, so I am not sure why the complaint was filed with the Revdex.comFor the record, the deferral was to assist with past due balance and assist in getting back on trackThe account is currently in default again after we processed the deferral

The contract submitted was tampered withI have the original and will be providing it to my lawyer.?

Our records indicate we spoke with the customer regarding the issues with the vehicle on 11/4/We scheduled an appointment for 11/12/to address the issues but the customer failed to show for his appointmentThe customer returned the vehicle on 11/18/We did attempt to handle the issue
again, at the time he returned the vehicle, but the customer refused and surrendered the vehicle. If the customer would like us to resolve the issue, we are still more than happy to do that

We have not received payment on the vehicle since 9/There are two outstanding payments remaining as well as the disposition fee and possibly fees for mileage and excess wear and tearI understand that she is unable to return the vehicle, we are sending a truck to pick up which is an additional
cost that we should not incur.? We have sent notifications via email regarding the accountWe are willing to accept payment over the next days to avoid the repossession and the customer can call us at *** *** *** to get final fees and total payments required in order to avoid any negative reporting of the payment experienceWhile we have reported every payment that was made, we are required to provide accurate information to the credit reporting agencies on the overall loan history and as of now, that loan history is incomplete due to the unpaid paymentsThe lease has not been satisfiedWe would like to report positively and will make e very effort to do that, but it does require a plan from the customer to complete this over the next daysWe requested the fee for the tow yesterday, $100, but the customer stated she had no money at all to make the payment

Ms*** returned the vehicle due to repair issues and indicated that she had purchased elsewhere and no longer wished to keep the vehicleAt the time of sale, there was no hail damage to the vehicleEvery vehicle we sell, if it has hail damage, which is rare, is required to have a "hail damage
disclosure" signed by the customer. We will honor the request and have the negative account removed from MsBlack's credit report.? Kind regards,*** ***General ManagerMCMC Auto, Ltd

the deferral was processed on 12/12/16, so I am not sure why the complaint was filed with the Revdex.com. For the record, the deferral was to assist with past due balance and assist in getting back on track. The account is currently in default again after we processed the deferral.

We are in receipt of the complaint and are actively trying to reach Mr. [redacted] to respond directly to him with regard to satisfying the complaint. The check was issued this morning, I have stopped it from going in today's mail to see if delivering it to one of our locations may expedite the matter.If...

I fail to hear from Mr. [redacted] today, we will place the refund check in the mail first thing tomorrow. [redacted], Director of Customer Service, spoke directly with Mr. [redacted] on 4/17/2015 in reference to the issues surrounding the account and I believe that resolved any concerns that Mr. [redacted] had. I have instructed Mr. [redacted] to follow up with Mr. [redacted] directly. The account will not be reported as a repossession per the request, I have directed Mr. [redacted] to make sure that happens. As far as the repair, the vehicle was no longer covered under any warranty, we involved ourselves at the customers request and provided the customer with a NO INTEREST payment plan for the repairs. We paid the repair facility in good faith with the expectation that we would be paid back by the customer. If there was issue with the repair, Mr. [redacted] could have taken that up with the facility that actually performed the work.

I am rejecting this response because:We purchased this vehicle at the time of MCMC closing so I don’t know if the salesman was rushing but we specifically asked about this insurance we asked the salesman if this insurance would cover us if we got pulled over and he said YES [redacted] had us watch the video while he went to go pick up the vehicle from another location and the video actually froze and stopped so we didn’t even watch the full video this company had been a joke since I got this vehicle I want to be let out of my contract and cut all dealings with MCMC.
Regards,
[redacted]

As previously stated, documentation is in file that clearly shows the customers knowledge of the product at time of delivery. If she wishes to return the vehicle, that is certainly her choice but it will be reflected as a voluntary surrender. If she would like to get her own full coverage insurance listing MCMC Auto as lienholder, she is certainly within her rights to do so and we will close out the optional CPI protection that she elected at the time of delivery. As a gesture of goodwill, I will provide a discount on payoff of the vehicle for the $1200 that she has paid in toward the CPI, up to this point, once a full coverage policy is produced. No actual monies will be exchanged, we will simply close account as paid in full once the account reaches a payoff balance of $1200

The conversation regarding the payment arrangement occurred on 4/7. The agreed upon date, that was specifically stated was Saturday 4/9/16. When the payment was not made, we waited several days prior to assigning for repossession. Please note that not only was the account delinquent, but the vehicle was not properly covered by insurance. In addition, we continue to be verbally harassed by Ms. [redacted]. Ms. [redacted] has called in cursing at representatives and threatening to "blow us up". We take pride in our ability to work with people to establish or re-establish credit and we provide quality vehicles and back those vehicles up with warranties to ensure customer satisfaction.

Complaint: [redacted]
I am rejecting this response because: How many miles I drove the car has nothing to do with what happened to me. The lack of concern for my family lives shows how much your company cares about their costumers. I had Meador Chrysler pick it up to do WHATEVER they had to do to fix the car as it almost caused my to lose my life. I did not tell tell them I just wasn't paying because I didn't care. I told them I should not be liable for paying any charges for a car that I'm leasing and clearly was issues because of common recalls with this car. What they fixed is irrelevant as long as the repairs were needed to fix because the car the almost killed me. Why should I be liable for paying a early termination fee when the lease is being terminated because of a major deadly recall that is clearly known as you can look it up on the web. 169 people has died because of this issues on the car and all they care about is how many miles I drove and paying him to end a lease that clearly needs to be terminated.

We have been in communication with Ms. [redacted]. She was in the other night. We presented the options to replace existing vehicle with 2014 Mazda 2 or 2014 Chevy Spark. In addition, the offer to defer 2 payments in June and waive $500 off the existing vehicle payoff was also offered. Ms. [redacted] informed us at that time that she would discuss with Mr. [redacted] and they would be in on Saturday to decide on options provided. As far as the gas, the vehicle was serviced at an outside facility, I am sure they had to test drive the vehicle after the repair, but I cannot speak further to the fact that Mr. [redacted] believes we used all his fuel.

We have been in communication with Ms. [redacted] regarding the total loss of the vehicle. The towing and storage charges for the vehicle total $651.46. This includes storage charges that we incurred from the impound location the vehicle was retrieved from. In addition, there was a past due insurance...

payment due in the amount of $44.50 as well as a past due car payment that was due at the time of the wreck. As a courtesy, we are willing to provide any dealership that requires, a letter stating we are going to accept the outstanding fees as well as the CPI insurance settlement amount and waive any deficiency balance. Ms. [redacted] is correct in stating that she has guaranteed Auto Protection that, in normal circumstances, would clear the deficiency. However, according to the police report, Ms. [redacted] was  cited with DWI and as well failing to maintain liability insurance on the vehicle. Either of those two infractions is cause for denial by the GAP company and we will not be getting any payment towards the deficiency balance on the loan from them. We will submit for a cancellation refund of the GAP premium, which will be prorated over the period of time that Ms. joens had the vehicle. Our offer still remains that we will not pursue Ms. [redacted] for any additional deficiency balance and will report the account as satisfied if she pays the amount required. As far as a letter to that effect, we would be willing to work directly with any finance company or car dealership to provide them with documentation supporting the fact that the vehicle will be reported as satisfied.Regarding what has been reported to the credit reporting agencies, our records indicate that there has been repossession reported on her credit with regard to the accounts with MCMC. If that is incorrect, I would request that a dispute of the information be submitted to us to correct. Again, nothing to indicate it has been reported as repossessed. We can produce a letter for Ms. [redacted] once we receive payment from the CPI insurance settlement, the past due payments, as well as the storage and towing charges we incurred stating that the account is satisfied and we have communicated that to Ms. [redacted] already. I believe this is a very generous offer given the circumstances surrounding the total loss of the vehicle and the fact that we will be incurring a significant deficiency.
