Please note, Midland Credit had no information that it was contacting a wrong number for the consumer until receipt of the complaint through your office
*** *** phone number *** *** has been marked “Do Not Call” in Midland Credit’s computer system for the referenced account. *** *** will no longer receive calls at that number from Midland Credit representatives regarding the referenced account. Midland Credit provided all of the account identifying information in its previous letter response to your office dated July 13, 2015. Mr*** now disputes the balance of the account due to interest. As stated in its previous response, the account was purchased from the seller with all rights. Interest charged by the original creditor is allowable by law. Likewise, any interest added by Midland Credit is permissible and was provided for in the contract with the original creditor when the account was purchased. This information would also normally be included in the paperwork the consumer receives when the account is initially opened.
Midland Credit acted in a timely manner and has complied with all applicable laws. However, in keeping with its Consumer-First policy, Midland Credit made the business decision to close the account. There will be no further collection activity, credit reporting or sale of this account. In addition, the three credit-reporting agencies will be notified to delete Midland Credit’s reference to the collection account in question from Mr***’s consumer credit files

which Midland Credit Management, Inc(hereinafter “Midland
Credit”) received the same
day via E-mail.
Midland Credit appreciates the opportunity to answer your questions
*** *** filed a similar complaint through the Consumer Financial Protection
Bureau (“CFPB”). Given that Midland
Credit’s response to the complaint from your office would be the same as the
response which Midland Credit previously provided to the CFPB, a copy of that
response is enclosed
As
stated in Midland Credit’s earlier response, an investigation of this matter
indicates that Midland Credit became the servicer of the above-referenced
account on behalf of purchaser, Midland Funding, LLC (“Midland Funding”) on
September 20, 2011. Information provided
by the seller, *** *** *** ***., at the time of acquisition indicates this
account was originated on July 25, as a *** *** *** *** *** *** *** account number ending in ***, in the name of *** * ***, under the
last four of the social security number ***
Subsequently, the account was charged-off as an unpaid delinquent-debt
on January 31, 2010. The balance at the
time of purchase was $649.30.
*** *** expresses concern that the above-referenced account is reporting as “past
due” on her consumer credit files.
Although Midland Credit submits updates to the reporting agencies each
month, Midland Credit does not report accounts as “past due” to the credit
reporting agencies. Depending on the
current condition of a given account, Midland Credit will report that account
as either “Account assigned to internal
or external collections,” or “Account
paid in full, was a collection account.”
Midland Credit’s business records indicate that it was appropriately
reporting the above-referenced account to the three major credit reporting
agencies as required
*** *** is encouraged to communicate directly with the credit bureaus should she
have any further concerns about the nomenclature that Midland Credit is
compelled to use in credit bureau reporting.
In addition, if *** *** obtained her credit report from a compilation
source, the information being reported may appear to vary. The credit bureaus have advised that it
appears this way because they do not directly populate the fields on credit
reports pulled from any source other than directly from the credit bureau
itself
With
that said, while Midland Credit has acted timely and within the guidelines
defined by applicable law, in keeping with its Consumer-First policy the
account has been closed. There will be
no further collection activity, credit reporting or sale of this account. In addition, the three credit-reporting
agencies will be notified to delete all reference to the account from *** ***’s consumer credit files

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (hereinafter “Midland Funding”), on September 4, 2013. Information provided by the seller, Asset Acceptance, LLC, at the time of acquisition indicates this account was originated on February 19, as a *** *** *** *** credit card account number ending in ***, in the name of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on February 10, 2009. The balance at the time of purchase was $703.16.
Mr*** writes that Midland Credit told him it is illegal to delete the account from his consumer credit files according to the Fair Credit reporting Act (“FCRA”), and expresses concern that the statement is in violation of the FCRA. Midland Credit fully respects consumers’ rights and privacy and has established policies and procedures designed to protect those rights. Please note that the alleged conduct described by Mr*** has been investigated, and Midland Credit has determined that no violation of company policy occurred, and its representatives acted appropriately pursuant to applicable law
Mr*** also expresses a desire to have the above-referenced account deleted from his consumer credit files upon resolving the balance. Please note that it is Midland Credit’s policy to report all accounts accurately. Should Mr*** pay the full balance, Midland Credit will report the account as “Account paid in full, was a collection account.” Should Mr*** pay less than the full balance, Midland Credit will report an additional memo stating “Account paid in full for less than the full balance.” If Midland Credit were to delete the account, its correct and accurate status would not be reflected

They are not a reputable company and instead are scam artistsThey are on the verge of being sued because they have been committing FRAUDThe credit bureaus have repeatedly for the past year written Midland funding asking them to VERIFY and show proof that the account is legitimateI personally have written and called Midland Funding on numerous occasions requesting proof that this is my accountShow me what I supposedly purchased, where I signed for it and whenBoth Midland funding and *** have refused to provide any information or any proof at allInstead they reply with "our records show this is a legitimate account" SHOW ME THE PROOF!
I contacted the supervisor at Midland funding and provided her with the case # I had filed identity theft with in *** *** with the *** Police departmentI explained to her at the time, that *** Police take reports over the phone and there is no paper report available and I gave her the case #She told me that would help to expedite their investigationNot one time did she tell me I needed to fill out any form or submit any reportThat is their new ploy to kick the can down the road because Midland is aware that I no longer have the case# information with me because after I gave it to Midland Funding, my house was robbed and my notebook stolen which had the information written on itThey know this and this is their scam, to try and bully consumers
Midland funding is upset because they purchased an account that is not legitimate, and they cannot provide any legal proof that I ever ordered or signed for anythingThey say that they mailed something to me and I never repliedHow do I know they mailed something? It could be yet another one of Midland Funding's lies or scams as they do not have a very reputable track recordAs well, things do get lost in the mailIt is funny how a credit repair company has been disputing this account since February and yet Midland says I contacted them in May
Midland stated in their response that they were provided with warranties when they purchased this account from webbankThat would mean that webbank/*** has legal proof that this account is actually mine and that I actually ordered, received and signed for something and can provide me with that proofTo this date, Midland funding cannot and will not provide me with anything at all and that violates the law as wellThey send me a bill and say you owe $I say again, I owe $for WHAT? I never ordered anything from ***, I never received anything form *** and I damn well never signed anything from ***
When I told Midland Funding customer service rep that I was going to speak with an attorney about possibly filing a lawsuit against them because they refused to show me legal binding proof I owed anything on this account and I had already provided them with a case # for this account filed with the *** Police department for identity theftis response to me, was instead of spending that money on an attorney, just pay the balance and be done with itThat clearly and plainly shows their scamming and bullying tactics

A review of Midland Credit’s business records indicates that *** *** has now submitted three Revdex.com submissions. Please note that Midland Credit provided all relevant account identifying information in its previous letter response to your office, dated March 10, 2014.
In his follletter inquiry, *** *** expresses concern regarding the nomenclature that Midland Credit is compelled to use in credit bureau reporting. Midland Credit’s system is designed to code accounts in a specific way upon receipt of each complaint. In this case, the account was coded to an account queue designed for disputed accounts. Due to *** ***’s continued Revdex.com submissions, Midland Credit’s monthly updates to the credit reporting agencies did not reflect that the account was in a settled account queue, but rather that it was in a disputed queue. As such, an update reflecting the accounts as having been settled was not being triggered. The credit reporting issue should now be corrected as Midland Credit has now had enough time between disputes to trigger the appropriate credit reporting update

I am repeatedly getting phone calls from this company for a person who must have owned the phone number before meThey call my home phone line after my children are in bed and wake them up, and despite me repeatedly informing them that they have the wrong number, they seem to keep calling

*** *** states the account is being reported by *** as “Paid, was a collection account, insurance claim or government claim or was terminated for default”. As previously advised, depending on the current condition of a given account, Midland Credit will furnish an account as either “Account assigned to internal or external collections,” “Account paid in full, was a collection account,” or “Account paid in full for less than the full balance.” Midland Credit’s business records indicate that it is furnishing the account information as “Account paid in full, was a collection account,” to the three major credit reporting agencies.

Midland Credit maintains its stance that it is furnishing the same “Account paid in full, was a collection account” status to all three major credit reporting agencies and that the information being furnished is accurate. *** *** is encouraged to communicate directly with the credit bureaus should he have any further concerns. Additionally, if *** *** obtained his credit report from a compilation source, the information being reported may appear to vary. The credit bureaus have advised that it appears this way because they do not directly populate the fields on credit reports pulled from any source other than directly from the credit bureau itself

Thank you for your follletter inquiry dated August 7, 2014, regarding Ms***’s complaint, which Midland Credit Management, Inc(hereinafter “Midland Credit”) received the same day via E-mail. Midland Credit appreciates the opportunity to answer your questions
Midland Credit provided all the relevant account information in its previous letter response to your office dated July 31, 2014. Ms*** writes that Midland Credit never ceased collection activity during the validation period, and states that reporting on her consumer credit files is considered collection activity. As mentioned in its previous response, Midland Credit sent Ms*** a validation letter on December 2, 2010, and did not receive a request for validation within days of her receipt of the letter. As such, upon receipt of her May 15, correspondence, Midland Credit appropriately mailed Ms*** a response and resumed regular collection activities as allowed by the Texas Finance Code and/or the Fair Credit Reporting Act.
Midland Credit was not required to provide validation of debt pursuant to the Fair Debt Collection Practices Act as the validation request was not made within days of Ms***’s receipt of the initial validation letter. However, Midland Credit marked the account “Cease and Desist” to ensure Ms*** no longer received correspondence or calls from Midland Credit unless a response was required by law.
Ms*** also writes that she did not receive a response to her May 15, 2014, correspondence from Midland Credit. Please note that Midland Credit mailed its response letter to Ms*** on June 13, 2014. The response letter was mailed to the same address listed within her initial complaint, and was not returned as undeliverable.
Midland Credit maintains its position in that it has acted appropriately pursuant to applicable law, and therefore respectfully denies Ms***’s request to have Midland Credit’s tradeline removed from her consumer credit files.
In the meantime, the account remains marked “Cease and Desist.” While it remains due and owing, Ms*** will continue to no longer receive correspondence or calls from Midland Credit representatives unless a response is required by law

Midland Credit appreciates the opportunity to answer your questions.
Midland Credit provided all the
relevant account information in its previous letter response to your office
dated June 24, 2014. Mrs*** writes
that she previously had an arrangement to pay $a month. The agreement to which Mrs*** makes
reference was indeed for $a month.
However, this arrangement was offered as a temporary payment agreement
in order to give Mrs*** time to make arrangements to settle the balance on
the account. Mrs*** did not make any
of the scheduled payments, therefore the agreement was voided for
non-payment.
Considering the balance of the account,
$a month would not normally be considered a reasonable payment
amount. However, as stated previously,
Midland Credit is sensitive to Mrs***’s situation and is willing to work
with her. Mrs***’s account has been
referred to Account Manager *** ***.
Ms*** remains ready to assist
Mrs*** in reaching a resolution that will be both beneficial to her, as well
as settle the account balance. Please

Thank you for your letter inquiry regarding *** *** complaint, which Midland Credit Management, Inc(“Midland Credit”) received June 22, 2015. Midland Credit appreciates the opportunity to answer your questions
An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on April 23, 2013. Information provided by the seller, *** *** *** ***, at the time of acquisition indicates this account was originated on May 26, 2011, as a *** *** account number ending in ***, in the name of *** * ***, under the last four of the social security number *** Subsequently, the account was charged-off as an unpaid delinquent-debt on July 23, 2012. The balance at the time of purchase was $801.00. Final payment on the account was received by Midland Credit on November 15, 2014. *** *** has no further financial obligation for this account
*** *** expresses a concern that she was advised the account would be deleted from her consumer credit reports upon resolution of the account. Midland Credit has finished conducting its investigation regarding the alleged conduct of its employees, and has determined that no violation of company policy occurred. *** *** was advised that the account would report as paid upon payment.
With that said, in keeping with its Consumer-First policy, Midland Credit made the business decision to close the account June 30, 2015. There will be no further collection activity, credit reporting or sale of this account. In addition, the three credit-reporting agencies have been notified to delete Midland Credit’s reference to the collection account in question from *** ***’s consumer credit files
*** *** also expresses a concern with the way she was spoken to by another Midland Credit representative. Midland Credit has conducted an additional investigation and has no record of the representative being rude or unprofessional during that call
Additionally, upon receipt of *** ***’s complaint, a Midland Credit representative was able to contact *** *** and provide a resolution to her complaint over the phone. On June 25, 2015, *** *** was notified that Midland Credit would be removing the tradeline for the account and to allow 30-days for the credit reporting agencies to reflect the same. A subsequent call was received on June 30, 2015, from *** *** wherein she confirmed with the same Midland Credit representative that her credit report no longer reflected Midland Credit reporting the account.
With that said, *** ***’s account will remain in a paid status within Midland Credit’s system of record; however, as stated above, the account is no longer reporting.
Midland Credit considers consumer complaints a serious matter, and fully respects consumers’ rights. Midland Credit apologizes for the inconvenience caused to *** ***

*** *** expresses concern that she received a notice from Midland Credit but believes she should not have been contacted because of a recent settlement. Please note that the settlement does not affect the collectability of *** *** account. For additional information, she may visit the website referenced in the postcard she received: ***
*** *** also expresses concern that the account is over seven years old. As referenced above, the account for which she received correspondence from Midland Credit was opened in and charged off in 2015. Midland Credit was servicing another account on behalf of Midland Funding which *** *** paid in and which is over seven years old. However, the last letter regarding that account was sent to *** *** was on November 18, 2010, and confirmed that the account had been paid. *** *** may be associating the account which she previously paid with the correspondence she recently received. A review of Midland Credit’s business records indicates that the seven-year Federal Reporting period for account no*** will expire in July at which time account information will cease being furnished to the credit reporting agencies.
A copy of the verification information provided by the seller is enclosed for *** *** records. If she is ready to resolve this debt, she may qualify for a reduction in her account balance. Please have *** *** call Midland Credit Account Manager *** *** at *** *** *** *** to assist her in reaching a resolution of the account balance
Per *** *** request to stop being contacted by Midland Credit, the above-referenced account has been marked “Cease and Desist.” While it remains due and owing, *** *** will no longer receive correspondence or calls from Midland Credit representatives unless a response is required by law

I dispute Midland Credit Management’s response to my non-compliance complaint for various reasonsAgain, as per my original complaint and rebuttal to their response, my primary reason is that upon submission of my validation request, which was received by *** * *** *** *** on July 17, 2015, (per my Certified Mail Receipt), no response was received from *** * *** *** ***Midland Credit Management continues to argue that *** * *** *** *** sent a “verification” letter to me on September 25,
However, IF such a letter was “supposedly” formulated by *** *** *** ***, it was never received by myselfIt appears that Midland Credit Management and/or *** * *** *** *** are unable to provide me with a certified mail receipt or any other form of confirmation that their “supposed” letter responding to my request for verification was even sent and more precisely, that their “supposed” letter was delivered to my addressSince I have never received such a letter, I strongly believe that the “supposed” letter, if sent, was either delivered to an incorrect address or misdirected by the Postal ServiceOnce again, if *** * *** *** *** or Midland Credit Management have such receipt confirmation, I would ask that they please provide me with such and, again, I will further investigate the issue with the Postal Service
Secondly, I had requested that Midland Credit Management and/or *** * *** *** *** provide me with "competent evidence," validating said debt and that "I" have any legal obligation to pay this debtThe request was to provide me with a copy of an agreement that bears my signature wherein I agreed to pay the creditorI have not received a copy of such an agreement and therefore will continue to dispute this debt that has not been validated in a “timely” manner, as *** *** alluded to, or in any manner, due to the fact that I have never received the letter that *** * *** *** *** supposedly sent on September 25, As such, Midland Credit Management’s most recent "attempt to collect a debt"...an unvalidated/disputed debt, which is a violation of USC 1692g Sec(b) of the FDCPA, is most definitely a non-compliant actionTherefore, due to non-compliance with my request, as reflected within USC 1692g Sec(b) of the FDCPA, I unwaveringly request that this account’s final resolution be that all references to this supposed debt be deleted and completely removed from my credit reports and a copy of such deletion request being sent to me.Regards,*** ***

Thank you for your follletter inquiry dated October 23, 2014, regarding *** ***’s complaint, which Midland Credit Management, Inc(“Midland Credit”) received the same day via E-mail. Midland Credit appreciates the opportunity to answer your questions
*** *** states that she does not understand how a letter could be returned as “undeliverable” when she has lived at the same address for years. It appears *** *** misunderstood Midland Credit when it advised her that the validation letter it mailed to her on June 2, was not returned to Midland Credit as “undeliverable.” The statement was to let her know that Midland Credit adhered to the Fair Debt Collection Practices Act in providing the validation letter, and has every expectation that the letter was delivered to *** ***’s address
Further, in its previous response, Midland Credit advised it had not called more often than is allowable pursuant to applicable law and the statement was meant to show that Midland Credit had acted appropriately. In her complaint, *** *** indicated that she did not wish to receive calls from Midland Credit and, as such, Midland Credit responded by marking the account as “Direct Mail Only.” While the debt remains due and owing, in updating the status of the account in this way, *** *** will no longer receive phone calls from Midland Credit representatives
Her last concern is that she was not advised that providing supporting documentation of her financial situation would result in lowering the garnishment amount, rather than ceasing the garnishment altogether. Midland Credit inquired with Internal Legal about the matter. They have advised that previous requests to adjust the garnishment received in May and June of from *** *** asked that the garnishment be reduced to an amount of $a week or less, and not to eliminate the garnishment entirely.
On September 25, 2014, an Internal Legal representative spoke with *** *** and explained that she had not provided documents to support her contention that she could not afford the initial garnishment amount. Internal Legal also advised that evidence of financial hardship had apparently also been requested in a June 20, conversation with *** ***. As stated in its previous response to your office, the appropriate documentation was received on September 29, 2014. In response, a garnishment modification was generated, signed by Internal Legal and *** ***, and mailed to the court and *** ***’s place of employment on October 13, 2014.
If *** *** has any further concerns, Midland Credit encourages her to continue working with Internal Legal. For ease of reference, their mailing address and phone number remain PO Box 939033, San Diego, CA and *** ***
