I am rejecting this response because:
One of my animals just died.  I have not been given a date, you refuse to answer phone calls.  I have to give my animals away because they have no home for the winter and I have no place to store feed or hay.  I paid a deposit in good faith on April 29, 2014, 170 days ago.

In regards to [redacted]'s complaint,  Our delivery system is based on "Eligibility" for delivery.  It's a first come first serve based system that starts when your PDQ's (Pre-Delivery Questions) are established.  This spring and winter for that matter,...

backed us and most everyone in construction up about 6 weeks from the normal beginning of the busy season.  Meaning, many more were not ready during a more usual seasonal cycle. Then all at once many more were ready than usual from May-June.  We've brought on more labor and like most are continuing to hire drivers to field this year’s unusual rush.  The good news is we are pushing for our customers in every way to meet this year’s challenges, and extinguish the effects of last winter/spring. His  "Eligibility Date" began June 30th and with our system that would mean approximately 8 weeks from that date would be your target delivery time frame.  Sooner than 8 weeks is certainly possible, but that is the time table based on the system which is far better than others we've seen out there which are not as fair and effective as our own. The "Thank You Letter" and yellow PDQ card we sent out explain this.  You can imagine the problems that would occur if there were not a systematic way to handle the ebbs and flows of volume, and its demands.   During the heights of the economy in 2006-2007, we had Lead Times of 12-14 weeks plus. Customers didn't flinch because our quality and fair price remained steadfast.  In response to your engineered drawings, in order to get these drawn up by the engineer we must have your door layout. Your door layout was not received until April 24. There are somethings that we as the company can do for our customers but then there are other areas that we rely on the customer. In this case the customer was the only one who could do this. This is all stated in the "Thank you" package that is sent out when you sign up.  Due to the overload of this summer season we are trying our best and doing everything possible to get the materials delivered and builders out on site in a timely manner.

Since National Barn Company has not taken the initiative to follow-through on any of the actions contained in their responses to the Revdex.com with respect to the construction of a pole barn at my residence, I took the initiative to contact The Pennsylvania Attorney General’s office as advised on your Revdex.com website.  The representative suggested that I try one final email to National Barn to attempt to resolve the situation before filing a complaint with their office.  The following is a copy of the email that I sent to Lowell T[redacted] (president) with copy to Ron B[redacted] (sales) on 8/28/14 for your records.  If National Barn Company fails to respond to my email by Wednesday September 3, 2014 I plan to contact Citibank and dispute the $5,432 deposit made to National Barn and move on.  If Mr. T[redacted] chooses to seek arbitration with the American Arbitration Association as per the terms of his contract, I feel that I have a strong enough case to prevail.  I appreciate your assistance as a representative of the Revdex.com in attempting to resolve my dispute with National Barn Company.

Nearly 17 weeks have passed since I was site-ready for my National Barn.  Although there was little or no communication from National Barn, I demonstrated great patience and composure until I felt it necessary to file a complaint with the Revdex.com.  Since my filing there has been little communication on the part of National Barn.  A simple hello, you’re on our list, or expect your barn to be delivered in “x” weeks would have been sufficient.  Your most recent written communication stated that my barn would be delivered during the week of July 28th but it never appeared....no explanation.  Had the reason been that you were unable to locate a crew to construct the barn at my location, I would have worked with National Barn to find a crew, even if it resulted in additional cost to me.  National Barn’s backlog of orders has apparently prevented you from being responsive to your customers.  In speaking with a representative from the State of Pennsylvania Attorney General’s Office, it was suggested that I contact you by email before registering a complaint to see if a satisfactory resolution can be reached.  I truly appreciate that National Barn has more than enough orders to fill without having to be concerned about my order.  National Barn builds a great product at a fair price, however after such a length of time, National Barn’s advantage has vanished.
 
We have arrived at a point where maybe we should explore avenues to end our business relationship on an amicable basis.  Naturally, this would entail the refund of my $5,432 deposit with me absorbing the cost of the building permit set to expire in just over one month.  I harbor no ill feelings towards yourself, your staff or your company but am disappointed that National Barn did not have the courtesy to respond to my repeated inquiries.  Please advise at your earliest convenience how you prefer to resolve this situation.

I am glad to see a response from Mr. T[redacted]. I first talked to Mr. T[redacted] in September 2013 when he contacted me to see if he could assist me with any information to help me make a decision in selecting National Barn to build my pole barn. I again spoke to Mr. T[redacted] on or about 9 June 2014 in reference to delivery of building material and start of my pole barn, he asked that I contact his assistant/employee Ms. Rachel P[redacted] ( a very polite and nice young lady). I was to receive building material on 11 June 2014 - I was contacted by Ms. P[redacted], who informed me that delivery would not be made until 12 June 2013 because Mr. T[redacted] had drive making an unscheduled stop before my delivery. No product or building material was received on either date or to date. I have tried to contact Mr. T[redacted] at the very number provided as well as other numbers provided for National Barn Company. I have left five (5) voice mails since 11 June 2014 on his cell phone ((717) 309.7711)with no reply to date. I have sent an email with no reply to date. I would be pleased if I could make contact with Mr. T[redacted]. He has my contact information as well, which I will provide again, C: 937.471.0029. My contact information is on my contract paperwork he could have reach me at any time, he has more information on me than I do him. As for Mr. Jeff C[redacted], I have spoken to him. I contacted the National Barn in TN trying to find out if Mr. T[redacted] had a boss or if there is anyone higher I could contact. Mr. C[redacted] provided no advice or course of action. He never advised me to file a complaint, I decided to do that after Mr. T[redacted] would not return my calls or email. Mr. C[redacted] never recommended that I cancel any deals, Mr. T[redacted] has planted that seed with no return calls or email. Mr. T[redacted] claims he didn't receive all required paperwork from me until February, even at that, it has been four (4) months with no movement. Mr. T[redacted] please contact me, [redacted], I will keep trying to contact you. Thank you.

I am rejecting this response because:It makes no sense. First off, there is no permit needed. National Barn has built two bigger buildings next door, at my father's house with no permits, surveys or anything. The neighbor, on the other side of us, built a barn twice the size of the building we ordered with no permit...I checked because he is right on my property line and didn't have any setbacks. Also, what apartment is National Barn referring to. All we ordered was a pole barn with three 10 x 10 doors to be used for farm equipment. We sent the only drawing that was asked of us. Again, this building is in the middle of 22 acres, in a big open field, on a farm. If National Barn wants to claim that they are waiting on something from us, then they should prove that they have actually requested something from us. We have not received one phone call or email from them asking for anything. The few emails that we have received just say the builder will get to us when he finishes his other jobs, of course, it doesn't state if there are two jobs in front of us or two thousand. The rep that responded to this complaint obviously didn't even look at our file or is responding to someone else's complaint.

I am rejecting this response because: This is the same excuse and run around that I have been getting from the company.  They have told me on multiple occasions different delivery dates that have came and gone. The reason the delivery was passed in march had nothing to due with the site not being finished, the site was ready, however was covered with snow and ice. The site was not suitable for equipment to go in and out without being stuck. The owner Lowell T[redacted] and I have had communications, with no resolve to the issue. He as well as assured me if delivery dates that have came and gone. I have attempted to contact both him and his representative with no resolve. They will not return my phone calls. It is my belief that Mr T[redacted] has no intention of delivering the building.  I simply want my money refunded so we can go our separate ways. If further proof is required I have multiple emails that can be sent.

[redacted] was spoken to for delivery several times. We are not able to deliver until the permit is received and as [redacted] knows we do not pay or complete the permit process. Our customers are responsible for permits, which is standard construction practice.  The [redacted]s have not given the...

permit office permission to approach them with questions to help them with the process anyway.  I spoke with [redacted] and explained we have to use his custom ordered materials that are ordered for his building size and colors on another job if possible and it may take a little time to do so.

I am attaching the certificates of insurance to show they are active policies for us.  [redacted] did have a request for policies, as well as a few other customers, at a time where we were readying ink our company to switch to a new policy for Workers Comp, which is...

a part of our shopping process. These policies have been forwarded to [redacted], by Amy in my office and show they have been received.  The resolution to this issue we hoped would not be an issue, is to complete the contract as described within our agreement.  [redacted] is a repeat customer who expressed to me personally prior to the policy switch time period, his satisfaction and superior product and that is why he is having us build the new one.  We apologize for any misunderstanding.  We need to schedule [redacted] for delivery and complete our project together.  I can be reached directly at ###-###-####.

I am rejecting this response because: National Barn has never communicated with me since they received my down payment in Early June. I sent them a check on June 6, which was deposited on June 14. When I called to inquire about when they would begin construction, I was told that they would not proceed without a signed agreement. That agreement never reached me until July 16 and I never heard anything from them.
I have called National Barn repeatedly —sometimes several times a day — to speak to the owner. He has never taken my calls, nor has he returned my calls. I recently sent him a letter by certified mail outlining my concerns and dissatisfaction with his company and have received no response.
I do not believe that National Barn will ever contact me or respond to my requests for information. I do not believe they will deal with me in a forthright manner and build my barn.
I do not wish to continue business with National Barn Company and I want my down payment refunded in full.

I am rejecting this response because:  I would like the company to explain what they have done/are doing to "correct the lack of communication".  I have never received one return phone call.  I would like to the company to provide me with a construction start date, and stop blaming the "fluidity".  The company has had my down payment for over 2 months.

I am rejecting this response because: The response presented by the business is not accurate. In his response the business states that I am a repeat customer. I am not a repeat customer. The business states that in a conversation with me I stated, "my satisfaction and (their) superior product and that is why I am having us (National Barn) build the new one." This is not true. I have never done business with National Barn. While I have built two of these pole barn buildings in southern Maryland, they were not done by National Barn. National Barn also states that they need the last documents for the pre-delivery questionnaire to schedule the delivery date, and ask for this post haste from me. This is also not true. All of the required documents were sent to the business on or about 12/20/13 and I have an email from "Katrina" of National Barn acknowledging the receipt of my documents. However, FYI I have yet to be given a copy of the signed terms and conditions (agreement) signed by National Barn and myself. I have a copy of the purchase order but not the multi-paged terms and conditions contract.
In closing I will say that National Barn did provide copies of their insurance certificates on or about 3/10/14. That part of the builder's response is true and had he not embellished the circumstances (see above) I would have accepted National Barn's response.
