Initial Business Response / [redacted] (1000, 8, 2015/08/17) */ Thank you for the opportunity to respond - In regards to the siding complaint, the siding is warped due to a manufacturers issue and all claims need to go through the manufacturerOakwood has attempted to assist the homeowner by offering to install a screen on her neighbors window that is causing the sun glare to reflect on her siding causing it to meltThe neighbor has refused thisAs far as any settling, it is the homeowners responsibility to maintain the grade - Please see attachedThe driveway is cracking at the seams/ control joints - this is what it is designed to do, and according to Oakwood Homes Performance Standards caulking of the control joints would be considered homeowner maintenanceThe garage floor is a new item and was never mentioned during the warranty periodThe distance that the hot water has to travel through the pipes to get from the hot water heater to the faucet will determine the amount of time it takes the water to get hotIn regards to the plumbing in this home, minutes would be standardAs for the concerns with the heating in the home, If the thermostat is set at and the main level is degrees, this falls within performance standards of plus or minus to degrees from room to room (please see homeowner guidebook)The basement in this home is unfinished and therefore considered non-conditioned spaceThe HVAC system was not designed to heat the basementIf the homeowner wanted a heated basement this was an option to be purchased during the sales processThe homeowner did not select this optionWe have this documentation on fileThe 1st year material and workmanship warranty expired on Thank you - Oakwood Homes LLC Initial Consumer Rebuttal / [redacted] (3000, 10, 2015/08/20) */ (The consumer indicated he/she DID NOT accept the response from the business.) Your sales staff misleads and does not give all the necessary facts in my opinionI purchased a NEW home thinking I would not have issues, and though I expected to have a few, not to this extent and with an insulting response to the Revdex.com Concerning the siding issue: I received the following email on Aug 17th and they have maintained this since my first reporting the issue-before my one year mark "Hello ***, We cannot fix your siding until we put something on your neighbors window to eliminate the sun glareYour neighbor does not want screens put on her window, and the window installers that we work with do not offer a tinted windowOnce we are able to resolve the issue with your neighbors window then we will fix your siding Thank you, [redacted] Customer Care Coordinator [redacted] Office: XXX-XXX-XXXX" Just fix my siding and the back piece that fell off and was told "we will be back tomorrow to fix properly" but never showed [redacted] said it would get fixed when the warped siding was replaced As far as the ground settling problem, I did landscape in a timely fashion and was actually held up due to Oakwood's' sprinkler install which I wrote in my complaint-severe settling and when they came to fix, they flooded my basement and leftThe side of my house which has settled the most, I have rockAnd for all my landscaping, I followed Oakwood's instructions of not disturbing their gradeIt was well known in my neighborhood that you do not mess with the grade-because Oakwood will void your warranty The concrete issue-I read the statement of homeowner's responsibility for caulking, but why is it acceptable to have joint cracking throughout driveway and garage floor during the length of time I have been the homeownerThe home I sold for this one, had a large car garage and driveway, and I left with no-none-null cracks in any jointThis speaks to the poor quality and lack of any standards for workmanship and productThere are standards but Oakwood chooses not to follmesh or fiber concrete and even their people have stated, it is sub-parI was told by a construction professional that my cracking was extremeAnd my bad for not mentioning the garage floor...You cover all your bases so you don't have to be held accountable!!! Heating and plumbing issues-how was I to know your heating and plumbing would stinkYour homes are energy efficient-prove it to meHow would I know the upstairs would be an oven while the main level is degrees cooler-you expect you sale staff to really acknowledge this? Of yes, within StandardsYour sale staff did not go into detail how my unfinished basement would be cold and it would take "only" minutes to obtain any hot waterHow is that efficient? I don't want to waste water and is Oakwood going to pay my water bill??? It again speaks volume when your heating contractor cannot correct the problems and says you do not listen to them and they hate going on service calls for your homeownersHomes with basements should have heating and plumbing in basement and air vents on floorsCan you show me the standards you describe in your response? What is see are excuses, and I see no accountability or apologies on Oakwood's partThey never have addressed the overall concerns their unhappy homeowner's have-like poor quality workmanship, poor quality products, overpriced design center options and now ignoring warranty issuesOakwood places blame on the homeownerThere is no phone number to call, when I have asked for contact information for management, I am ignoredI truly understand you are in the business to make money, but do it honestly and for the benefit of the people who purchase your homesJust be accountable - humble yourself and talk to your homeowners in person and just do the right thingBut in the end, shouldn't my Oakwood home be that "quality" home from day one and beyond one year? Though Mr [redacted] and Mr [redacted] did come to my home and we discussed my home issues, I was told Mr [redacted] would be contacting me, so I have been waiting for that communicationThey said the siding would be replaced however, we did not come to any resolution on the driveway cracks or heating issuesThere were discussion how concrete cracks, though I continued to state, not in such a short amount of time and to expect such is due to poor quality of workThe heating and length of time to acquire any hot water was also talked about, but, in my opinion, no resolution was addressed, expect in my words-"live with it"Ideas were given, but at my costStill not feeling the love for Oakwood

Oakwood's next scheduled work date is 8/for his fencing issues and Landscaping issues Sept 6th is a scheduled work date for the drywall issues

Complaint: [redacted] I am rejecting this response because:Hello, We still have not gotten our issues resolved [redacted] came by to check things out on 8-10-On August he sent this email:"***,I do apologize, I just figured out today that many emails I sent last week did not go out Is there any way that I could get one of our punch companies in your home to knock out most of the caulking, painting and drywall repairs? If I can then likely the only items that wouldn’t be completed would be the hump in the basement floor, grout at the master bath floor and assessment and adjustment of the garage doors Please let me know so I can get the appropriate paperwork out today if tomorrow can work I would also come by for the humidifier as well[redacted] "The company came by to do some things and to date have not rectified Humidifier and now other items from the walk throughWe have not heard back from [redacted] Thank you for your time regarding this matter, [redacted] Sincerely, [redacted]

Oakwood has been in contact with the homeowner Oakwood understands the homeowners frustration and is working to take care of the outstanding items

Complaint: [redacted] I am rejecting this response because: 1. The number of boards ordered only reflects the boards that need to be replaced. On two occasions, Oakwood flooring representatives came out and attempted to fix the boards that needed to be replaced. It was determined on both occasions that the size of the boards did not match the current boards. Therefore, in order to replace one board several full rows of boards would need to be taken out and replaced. In other words, to fix one board, approximately 25 boards would need to be replaced. It was determined that the boards on my floor do not match the size of the replacement boards. This is why it was determined on several occasions that a new floor would be more cost effective. 2. If you plan on "fixing" the floor, several more boxes will need to be ordered. 3. The transition pieces still need to be ordered because they also need to be replaced. 3. I am NOT agreeing that fixing my floors once resolves this issue. I was told these floors would last 20 years. It has only been one year and they look terrible. I am very unhappy with the response of Oakwood homes. To have a $8,000 floor in a relatively small area only last one year is completely unacceptable. If the floors are "fixed", they will need to be fixed again in a year. At that point, I will need to look at replacing them again. This is unacceptable. I was charged a large amount of money for these floors and was sold on the promise that they would last 20 years. I know that several home owners in my development alone are having the same issue with this same exact floor. This floor needs to be replaced and a refund should be given to me in order to replace it with appropriate flooring. Sincerely, [redacted]

The amount that was agreed upon between the homeowner and the vice president of warranty has been proceed and the concerns with the master bathroom has been addressed and reported complete

Thank you for your concern, Again we have had the installer as well as the manufacturer inspect the floor and determine that there is not a manufacturing defect, The trade has agreed to replace the or so boards that show a concernAs we cannot predict what if any additional issues should arise going forward, we can only address the existing concern and revisit should additional concerns present themselves, Oakwood and the trade partner are willing to repair the affected area if given permission to do so, if we do not receive permission we will consider the matter resolved.Regards,

Thank you, I have received the electric bills as of today and once an amount is determined will submit to accounting for a reimbursement check, this process takes approximately two weeks But I will try to expedite it.Regards,

Thank you for your correspondence,A warranty representative reached out to the Home owner today to resolve the remaining concerns,In regards to the dead tree it is on our spring log, in the system it had been noted that the depression was taken care of due to response from our landscaper that they had taken care of it It will be noted on the spring log as well landscaping does not start up again for spring items until April As for the electric, we have had [redacted] check the breakers for the homeowner since many of the exterior receptacles are GFCI protected to the basement outlets We have ask for a schedule date for the Electrician to be out there thanks and have a great day

Thank you, my records indicate the tile repairs took place July 10th thru the 13th and were completedthe siding concern has been brought to the attention of the manufacturer and they are working thru a resolution, I do see where they have it on a spreadsheet but no date for repairs has been set, the home owner can also file a claim thru them by contacting [redacted] as they are handling direct Oakwood does not have dates and times of repairThe siding representative contact handling the claim is [redacted] at [redacted] and we have reached out to him for an update as to this specific claimbest regards,

Complaint: [redacted] I am rejecting this response because:The work and service here is just awful I can't believe we are being left with this work!! I would've rather had our driveway with the displacement than looking like it does We live in a nice area, paid a lot of money for this home, and it is purely 100% unacceptable to be left with our driveway and patio looking like this!! What happens when HOA notices the driveway? They won't think this is an okay way to present the neighborhood! Others right around us have had entire driveways replaced for similar reasons as our displacements--what did they have to do to get Oakwood to make things right? When here at my home in September, the Regional Manager [redacted] Woodroof said that they would get an expert opinion on the driveway before replacing anything to make sure it was done right and didn't, and the contractor's recommendation was ignored! [redacted] and [redacted] told me to tell them when the patio moved more so it could be addressedIt moved a LOT and is in terrible condition, so I let them know and now I'm being told it's and nothing will be done! No one can explain why they, and Oakwood, are going back on their words! I'm at a complete loss Sincerely, [redacted]

Complaint: [redacted] I am rejecting this response because: This is the same thing they have been telling repeatedlyThey say someone will be contacted me and nothing happens There are times that they do schedule for someone to come by but noone shows upThis is my major frustrationI jsut want everything to be completed Sincerely, [redacted]

I spoke to Mrs. [redacted] 1/20/17. [redacted] ***, our manufacturer's representative has submitted this claim to his technical department for possible reimbursement for the proposed work of siding replacement. We were also finally able to install the screen on their neighbor's home which will help reduce the reflection which created the siding issue initially. [redacted] is supposed to communicate back to me once he has received information regarding the reimbursement. We did set the expectation of having a decision the first week of February and I plan on following up with the [redacted] 's no later than February third regardless of what information we have.

Oakwood has assigned a new representative to work with the homeowner to complete the outstanding issue with the Humidifier

We received their response and immediately followed up that day (12/18/15)and are now waiting yet againThis process is taking a ridiculous amount of timeWe will not accept any response through this avenue until our concerns are appropriately and adequately addressed
