According to Nutrisystem’s records, on February 10, *** *** contacted Nutrisystem via telephone regarding a promotional offer that she had seen for Nutrisystem. The offer that *** *** indicated she saw was for 40% discount off all orders. According to Nutrisystem’s records, *** *** spoke to multiple representatives on February 10, 2015. It appears that there was a misunderstanding between *** *** and the representatives that she spoke withIt appears that *** *** believed that the 40% off was calculated based on 40% off of $which was not the case. *** ***’s call was eventually escalated to supervisor for a return call. A supervisor contacted *** *** and informed her that the 40% discount was calculated based on the Full Retail Value of the program which was $424.95. This would give *** *** a price of $Please see the attached screenshot from the Nutrisystem webpage which shows the Full Retail Value and the price of $In addition to the 40% off price the supervisor offered to give *** *** an additional $off of her initial order which would give *** *** a price of $for her initial order. *** *** declined the offer and no order was placed for *** *** at this time

Nutrisystem records all calls for quality assurance and training purposes and will be reviewing the calls when *** *** spoke with Nutrisystem. Vampire squid business practices encountered I tried the service for a month and decided that it wasn't for me Logged into my account on the Nutrisystem web site and was not able to find an option to cancel After initiating the online chat with a customer service rep, I was told that I had to call in order to cancel Called the number provided and was informed about a $fee for cancelling early I paid the man and won't be coming back Providing this feedback in hopes that others won't be caught unaware by this company's business practices Buyer beware

Nutrisystem does show that *** *** has an active account with Nutrisystem. *** *** purchased the NutriSystem Auto-Delivery Program on March 11, and has been receiving monthly orders since she purchased the program. With Auto-Delivery Program, customers receive a 35% discount off the regular one-time rate of a 4-week plan with an auto-delivery purchaseThey also receive free shipping (Continental US). Prior to each shipment, our customers receive a telephone call or a series of emails indicating their shipment is being processed and sent to them. On August 29, *** *** was sent the first of three (3) emails indicating her September order was being processed for her. *** *** was asked in the email to contact Nutrisystem on or before August 31, at 6pm EST to make any changes to her order. *** *** did not contact Nutrisystem on or before August 31, at 6pm to make changes to her account On September 1, 2016, *** *** was sent a second email confirming her order On September 2, 2016, *** *** was sent an email indicating the ready to go portion of her order was shipped. That same day, *** *** contacted Nutrisystem to apply gift cards to the order that was already in transit to *** ***. *** *** was informed by the customer service representative that he spoke with that she could not apply the gift cards because the order already shipped. *** *** was informed that he could refuse or return the order for a refund. *** *** shortly thereafter disconnected the call. The frozen portion of *** ***’s order was shipped to her on September 6, The information that *** *** was provided during the telephone call on September 2, was correct. Nutrisystem does not have the ability to change the type of payment used to purchase our products once they are shipped to our customers. If our customers contact us prior to their orders being shipped, we can change the payment type. After receiving *** ***’s complaint, Nutrisystem reviewed *** ***’s order history. *** *** contacted Nutrisystem to apply gift cards to one of his orders prior to his order being shipped to him on June 1, 2015. Nutrisystem was able to cancel the order at that time because it hadn’t shipped yet and the gift cards were applied This was not the case for *** ***’s order. *** ***’s order was already in transit when *** *** contacted Nutrisystem on September 2, 2016. Nutrisystem cannot adjust *** ***’s account for the gift cards. On October 10, *** contacted Nutrisystem via telephone and requested that his Auto-Delivery program be cancelled. *** was informed he would be charged for the discount he received on his first order ($93.74) if he chose to cancel his Auto-Delivery program before accepting and paying for his second order. *** informed the customer service representative that he would cancel the card and disconnected the call.
Under the terms and conditions of the Auto-Delivery Program that *** enrolled in *** was required to purchase two (2) orders in order to receive the discounted price that he received on his first order. As indicated above this information is posted on the website and *** indicated he agreed to the Terms and Conditions of the program when he submitted his order. However, in the spirit of good consumer relations Nutrisystem has issued *** a refund for the discount he was charged for in the amount of $93.74. We wish *** continued success with his weight loss goals

After reviewing ***’s complaint I contacted our Customer Service Department to determine if they had a listing for *** or his email address ***. ***’s email address is not registered with Nutrisystem and Nutrisystem has no profile for *** in its database. Based on the information that *** provided, he appears to be receiving emails from third party which contain some type of Nutrisystem advertising.
Nutrisystem takes spam emails and the sending of them very seriously. Nutrisystem is unable to determine the origin of the emails from ***’s complaint, but if *** could forward the actual emails to me, we would be in a better position to determine who the third party is that is sending them. In the meantime, Nutrisystem has placed ***’s email address on its own “Do Not Email” list

After reviewing *** ***’s complaint I contacted our Customer Service Department to determine if they had a listing for *** *** or his email address ***. According to Nutrisystem’s records, *** *** created a profile on Nutrisytem’s website on March 16, at 12:16:08. This prompted Nutrisystem to begin sending marketing emails to *** *** based “on an established business relationship” under current Telemarketing Rules. However, any request to unsubscribe from a customer is handled immediately, but it usually takes 7-day to go through our internal systems and update accordingly. Nutrisystem customers’ are informed of the time it takes to be removed via a reply email once they unsubscribe from the site
According to Nutrisystem’s records *** *** opted out of all emails on April 7, at 11:00am. *** *** called Nutrisystem on April 11, and indicated he was still receiving emails As indicated above it usually takes 7-days for email addresses to be completely removed from the Nutrisystem internal system. Nutrisystem confirmed that *** ***’s email address was put on the Nutrisystem “Do Not Email” list on April 16, 2014, which was nine (9) days after his initial request was received by Nutrisystem

With our Nutrisystem Auto-Delivery Program, customers receive a 35% discount off the regular one-time rate of a 4-week planOur customers also receive free shipping (Continental US only). By clicking the Submit My Order, customer’s authorize us to automatically charge and ship their order every weeks unless they cancel. If they are not 100% satisfied, they can call ###-###-#### within days of delivery of their order and send the remaining non-frozen food back to us for a full refund, less return shipping. *** *** submitted his order and agreed to the terms and conditions prior to his purchase. *** *** received his first shipment on January 29, *** *** received four (4) shipments between January 29, and May 31, 2016. On May 31, *** *** delayed his next shipment online at www.nutrisystem.com until July 25, On July 26, 2016, *** *** contacted Nutrisystem via telephone. At this time, *** ***’s next auto-delivery shipment was delayed until September 19, On September 15, *** *** was sent the first of three (3) emails indicating his shipment was being sent to him. On September 20, *** *** was sent his next shipment. *** *** received this shipment on September 23, according to FedEx records. On October 4, Nutrisystem received a credit card dispute regarding the shipment that was delivered to *** *** on September 23, 2016. Nutrisystem provided the documentation that Nutrisystem had on that shipment to the *** ***’s credit card company for review Nutrisystem records all calls for quality assurance and training purposes and reviewed the call when *** *** contacted Nutrisystem on July 26, 2016. Although the customer service representative (“CSR”) that spoke with *** *** did inform *** *** that he was putting the order on hold and he provided *** *** with the next shipment date of September 19, it was not clearly articulated what was being done. Therefore, Nutrisystem issued *** *** a full credit in the amount of $for the shipment he received on September 23, on October 18, 2016. *** *** should see the credit applied to his account within 5-business days depending on his financial institution. *** *** does not have to return the order that he received, he can keep the food products with our compliments. In addition, the Nutrisystem Auto-Delivery and Turbo Shake program for *** *** was cancelled on October 17, 2016. We wish *** *** continued success with his weight loss goals.
