According to Nutrisystem’s records, on April 11, 2015*** enrolled online in the NutriSystem Auto-Delivery Program. With the current Auto-Delivery program, customers get a 20% discount off the month to month program price and free shipping within the Continental US when they remain on the program for at least shipmentsCustomers are automatically shipped their 28-Day order once every four weeks, and charged accordingly, unless they cancel. Customers are sent an e-mail reminder or given a telephone call when their next order is to be shippedCustomers can edit, customize or delay their Auto-Delivery order, simply by calling ###-###-#### or visiting nutrisystem.comTo cancel their Auto-Delivery order, customers must call ###-###-####. If a customer cancels prior to paying for their second 28-Day program delivery, their payment method is charged for the amount of the auto delivery discount they received on their first 28-Day program delivery. *** was shipped his first order on April 16, 2015.
On April 20, 2015, *** contacted Nutrisystem and indicated he wanted to cancel his Auto-Delivery Program and return the first order he received. ***’s Auto-Delivery program was cancelled and he was issued a *** label to return the unused food products to Nutrisystem for a refund.
***’s order was returned to Nutrisystem’s warehouse on May 4, 2015. It appears that *** spoke to two representatives following the return of the food to determine when credit would be issued to his account. However, the credit was not issued to his account in error.
We apologize to **. *** for any delay in getting his credit issued. It is unclear as to why his credit was not issued when the return was received at Nutrisystem’s warehouse. Nutrisystem issued *** a full credit in the amount of $on June 15, 2015. *** should see the credit applied to his account within 5-business days depending on his financial institution. The representative that *** *** spoke with explained that she purchased the auto-delivery program and received a discount on her first order because of the auto-delivery. The representative also informed *** *** that she would be charged $if she chose to return the second order under the terms and conditions of the auto-delivery program. *** *** requested to cancel the auto-delivery program and she asked to return the order that was in transit to her. The representative reviewed *** ***’s order and explained that the ready to go food items could be returned, but that the frozen items that were in transit to her were non-returnable and non-refundable. *** *** responded indicating “that she would take the hit on this one, but she wanted all future orders cancelled.” *** ***’s auto-delivery was cancelled as requested and *** *** disconnected the call. Nutrisystem has no record of *** *** returning the second order to Nutrisystem, nor did she indicate she was going to return the order when she called Nutrisystem. Based on the information that *** *** provided, it appears that she received an email from a third party which contains some type of Nutrisystem promotional offer.
Nutrisystem takes spam emails and the sending of them very seriously. Nutrisystem is unable to determine the origin of the emails from *** ***’s complaintIf *** *** could forward the actual emails to me, we would be in a better position to determine who is sending them. In the meantime, Nutrisystem has placed *** ***’s email address on its own “Do Not Email” list

On January 29, 2014, a representative from Nutrisystem contacted *** in response to her email. The representative left a voicemail for ***. ***’s program was cancelled and *** was charged for the discount she received on her first order ($61.50) as she did not accept and pay for her second order under the terms and conditions of the Auto-Delivery Program.
On February 5, 2014, Nutrisystem received a return package from ***. *** was issued a full refund in the amount of $on February 5, for the return package. In addition, Nutrisystem issued *** a credit for the $that was charged to her account on January 29, 2014. Depending on ***’s financial institution she should see the credits applied to her account within 5-business days
Nutrisystem records all calls for quality assurance and training purposes. In addition, if a customer contacts Nutrisystem the calling system notates the customers’ profile. Nutrisystem does not have a record of *** contacting Nutrisystem by telephoneUnder Nutrisystem’s day Money Back Guarantee Nutrisystem clients can try the Nutrisystem program for days and if they are not completely satisfied they can contact Nutrisystem within days of receiving their order and return it for a full refund of their purchase price. Nutrisystem is also currently paying for our clients’ return shipping charges at this time. Nutrisystem does have a refer a friend program (see attached). When Ms*** enrolled with her sister both she and her sister should have been given a $coupon towards their orders under the refer a friend program. The representative that Ms*** spoke with did not apply the coupons to Ms*** and her sister’s accounts in error. Ms*** contacted Nutrisystem on March 2, and spoke to a Customer Service Representative about this issue. The Customer Service Representative apologized, issued Ms*** the $refer a friend coupon and gave Ms*** an additional $off of her next order.
Ms***’ sister’s Auto-Delivery program was cancelled on March 2, and she was issued a label to return the food products she did receive. Nutrisystem will issue Ms***’ sister a full refund when she returns the order. Nutrisystem appreciates that Ms*** referred her sister and we sincerely apologize for the experience that they had. We wish both Ms*** and her sister continued success with their weight loss goals

Thanks for your responseI would like to point out that their was NO MISUNDERSTANDINGI asked your staff a SPECIFIC question and was given SPECIFIC responsesI informed your staff that I received a 40% offer off ALL ORDERS;She initially did not have a clear knowledge of whether she could a) give me the 40% discount because that offer did not show up in her system; b) secondly she was also not sure whether she could take the order over the telephone; c) thirdly, she was not sure of what went along with the discount...e.gone week free food; Fast etc
My next question was, WHAT ARE THE PRICES FOR THE PROGRAMS? I was told $for the Basic, $for the CoreI asked what was the difference between the two programs and the staff informed me that in the Basic program, I could not SELECT my own foods but rather, it was pre packaged, however, in the Core Program for $279.99, I could SELECT the foods I wantedI CHOSE the $packageBefore going any further the staff informed me that she needed to speak with her Manager, she then put me on hold for several minutes and went to have a discussion with her Manager (In fact she had more than one consultation with her Manager about my order during my very lengthy call)She eventually returned with the news that her Manager informed her that she could take the order over the phone etcI again asked her what was the cost and she again told me $I calculated that 40% of $is $My cost would then be $Now, I noticed you signed your email as 'Senior Corporate Paralegal'Well, I am an Attorney and I like SPECIFICSI wanted SPECIFIC answers and to ensure I DID NOT MISUNDERSTAND, I called and spoke to your staff rather than completing the order onlineI assume that a trained professional would have knowledge of what she was doingIt seems, I assumed incorrectly because AFTER REPEATEDLY asking the price of the program and being told REPEATEDLY that the Core was $Right after completing my order, the staff informed me that she had to speak to her manager about putting in the right code that would enable the 40% discountI waited for sometime and then she came back on the line and asked for my credit card number and I asked what was the amount, it was ONLY THEN she told me it was $I then told her what my calculations were, she in turn informed me that her Manager told her the full fee of $had to be chargedI want to be very clear, the staff was VERY FURTIVE, one would expect the staff would inform me of the price that she was going to charge to my card but she chose not to, rather she asked for my card number insteadWhen I asked her what was the amount and she told me $I queried that and reminded her that she QUOTED $279.99, she actually fumbled (LISTEN TO THE RECORDING OF THE CONVERSATION) before telling me her Manager said it was $Nutri System is COWARDLY and is NOT taking ANY RESPONSIBILITY for what transpired with what appears to be an untrained staff and equally untrained or deceptive ManagerI want to be VERY CLEAR, I did not have a MISUNDERSTANDING, rather your staff MISLED me by providing me with AN INCORRECT PRICE QUOTATIONThat is called DECEPTIONEven when she realized she had quoted me A price (based on that I proceeded to waste an hour placing an order based on PRICING), rather than coming back on the phone and explaining that she had quoted me the wrong price and to check if I wanted to still continue, she did not give me that courtesy but rather asked for my card to charge itWHAT DO YOU CALL THAT KIND OF BEHAVIOR? By clicking the Submit My Order, customer’s authorize us to automatically charge and ship their order every weeks unless they cancel. If they are not 100% satisfied, they can call ###-###-#### within days of delivery of their order and send the remaining non-frozen food back to us for a full refund, less return shipping. If our customers decide to cancel before the second shipment and after the day guarantee period, they authorize us to charge a $early cancellation fee. The terms and conditions of the auto-delivery program have always been posted throughout the website (please see the attached page)However, in response to customer complaints and inquiries Nutrisystem has added additional language and information throughout the website to make it clearer to our customers that they are choosing the Auto-Delivery program and agreeing to the terms and conditions of the program, including the $cancellation charge before they make their purchase. Specifically, the auto-delivery terms and the cancellation fee are conspicuously displayed at the “submit my order” button (please see the attached page) and if the customer clicks on the Auto-Delivery option the benefits of auto-delivery as well as the cancellation fee are clearly stated (please see the attached page). *** *** placed her order and agreed to the terms and condition prior to her purchase. *** *** received her shipment on June 16, On July 3, *** *** was sent an email indicating her second shipment was being processed for her. *** ***’ second shipment was shipped to her on July 6, 2016. On July 7, 2016, *** *** contacted Nutrisystem indicating she did not want the order that was in transit to her and she wanted to cancel her auto-delivery program.
