RESPONSE

Optima Tax’s management has made contact with the client to
discuss his concerns as outlined in the complaint. Although Optima Tax advertises
that it may be able to reduce a taxpayer’s outstanding liability, it also
clearly discloses that every taxpayer will not qualify for a reduction.
Additionally, our contract, which every client receives and signs, also
discloses that not every taxpayer will receive a reduction and any reduction
must be accepted by the tax authority. To ensure that every client we represent
fully understands the nature of our services, each client will go through a
recorded Verification Call that thoroughly covers all legal disclosures to
which they must acknowledge their understanding to the contracted services.
 
To be
clear, our services are broken down into two phases, an Investigation Phase
followed by our Resolution Phase. Before engaging our services, the client was
fully informed that the initial $995.00 that the client paid went towards
investigating his case only. In fact, this was acknowledged in both the signed
agreement and the voice recorded Verification call. During the Investigation
Phase, Optima Tax contacted the IRS and gathered extensive information which we
use to develop our proposed Resolution Services. Ultimately, the client makes
the final decision to move forward with our services or use the information we
obtained to satisfy the liability outside our services.
 
It’s
truly unfortunate that there was confusion regarding our services and the
actions Optima would take during the Investigation Phase. As we’ve stated, we
take all the necessary steps to make certain that there is no confusion and by
our review, we were very transparent with the actions taken on his case. However,
we are pleased to say that we were able to come to a mutual resolve that is
satisfactory to all parties involved.

SUMMARY - Optima Tax's management contacted the client to address the concerns outlined in the complaint and we’re working together in an effort to find a mutual resolve.     RESPONSE - Optima Tax’s management has established communication with the client to formally address his concerns....

As the client stated in their complaint, they hired Optima Tax to represent them before the IRS regarding an outstanding tax liability. After the conclusion of our initial Investigation, it had been determined that the client is at the highest level of collections with the IRS and time was of the essence. When discussing the case with the assigned Revenue Officer, Optima Tax was given an itemized list of requested documents for review. Although the client was prompt with sending in some of the requested documents, unfortunately Optima Tax did not receive a full and complete package of the financial documents. In turn, this delayed his case and is why his assigned team kept reaching out to obtain missing documents.   Unfortunately Optima Tax has no control over the IRS or the assigned Revenue Office showing up at the client’s place of business. Optima Tax’s Power of Attorney was filed with the IRS so we are unsure as to why the Revenue Officer would state otherwise. Moreover, without the complete list of requested documents from the client, Optima Tax could not proceed with establishing a resolve with the Revenue Officer. Although we are saddened to hear that the client had to shut down his business, this is no fault of Optima Tax. The client had reached out to Optima Tax with little time to resolve his case and Optima Tax cannot guarantee that a resolution will be established in a specific time period. We attempted to resolve his concerns and presented the client with what we feel is a reasonable resolution but the client became unresponsive thereafter.   At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy. Please save yourself money, time, and heartache and not use this company. They charged me $3000 for an $11,000 tax problem and did nothing but work me. They are useless. You would be better off putting yourself on an IRS payment plan.

I was very satisfied with the attention to details, and to my need to resolve this as quickly as possible. The staff at Optima were all very kind and caring.

My spouse and I am very pleased with Optima Tax Releif for getting us compliant with IRS. We were in debt, and IRS were sending letters to levy or accounts and foreclose on our home. I heard the advertisement on the radio and gave them a call. I am now on a payment plan with IRS and stress free. Thank You for all of the Optima Tax workers you all were a Godsend.

As the client stated, she hired Optima Tax for representation as she was seeking assistance regarding her IRS debt. To confirm, Optima Tax services are broken down into two phases. Phase one being the Investigation Phase and Phases two being the Resolution Phase. Both phases do require a separate servicing charge as explained and outlined in the Client Services Agreement the client must execute prior to their enrollment into each Phase.   Optima Tax makes it clear to our clients that no specific outcome regarding their case can be guaranteed or promised as ultimately the IRS has the final say to in accepting any proposed resolutions and requests made. Furthermore, at no point did Optima Tax refuse to provide the services as promised and outlined in the Client Services Agreement. As it was thoroughly explained to the Client prior to their enrollment, the initial payment made is paid towards the investigation of the client’s tax liability. This investigation entails the gathering of all information pertaining to the client's current tax situation so that Optima Tax may review all information and better understand the client's tax liability in order to suggest the most favorable resolution for client to solve their tax problems. As client was made aware, the investigation does not equate to an automatic levy release of the client’s wages. Optima Tax Associates that conduct the investigation will attempt to inquire into any and all wage levies that may be present in an effort to eventually discuss in detail with the IRS and negotiate a release during the second phase, the Resolution Phase, if the client chooses to enroll into the Resolution Phase.   As the client stated in their complaint, there was an oversight with our accounting. However, we immediately rectified the matter. Additionally, at no point did the client advise us that she accrued additional fees due to this oversight.   It is unfortunate the client feels that Optima Tax is the source of her stress and we understand that dealing with the IRS can be difficult.   At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. In fact, this is exactly how Optima duped me as a consumer - very clear and repeated verbal promises were made, based on which I agreed to proceed with the services. Yet as soon as the company received my money, they promptly changed their position and since that time they have been hiding behind "if you do not have it in writing, then you are out of luck !".
Furthermore, in an attempt to achieve a resolution, [redacted] (from Optima) and I agreed that the company would obtain a tax penalty abatement, the amount of which would then be deducted from the disputed amount of $10,000.00, and the balance would be refunded to me. Unfortunately the IRS refused to extend any penalty abatement, and although I repeatedly approached Optima after this resolution, all my emails have gone unanswered, as well as my last two messages that I have left.
Based on Optima's response to this complaint, it is very clear that the company has no interest in resolving the issue, and at this point I see no other alternative than to pursue a public media campaign and legal action in an attempt to put a stop to Optima's fraudulent business practices.

Optima Tax saved my life! I had 9 years in back taxes and owed over $20,000! Not only did they get it dramaticaly reduced, they made sure to keep me at ease during the whole process!

Contrary to the client’s statement, prior to the client's enrollment with Optima Tax she had been presented our Client Services Agreement that outlines the scope of our services. After receiving the Client Service Agreement, the client signed the Agreement that clearly states that a reduction is not guaranteed but Optima Tax will strive for the best possible outcome for the client. Additionally, and as stated in our initial response, the client went through a voice recorded compliance call that clearly states that a reduction or any specific outcome is not guaranteed. If the client did not acknowledge her understanding to this specific disclosure, or any disclosure for that matter, services would cease until all questions are addressed. Since the client did not express any concerns Optima Tax moved forward accordingly.     Per the Client Services Addendum it clearly outlines the resolution services Optima Tax would provide. Those services include, but are not limited to:  Collection Representation, IRS Compliance, and ultimately setting the client up on an affordable payment plan that falls in line with their monthly income and expenses.   Although the client feels we did not help her situation, we would like to point out that we brought the client out of collections and set her up on an affordable payment which means the client is now compliant with the IRS. This resolution we negotiated on behalf of the client also protects their assets from being seized to satisfy their outstanding tax liability. The resolution will also prevent any liens being filed against the client. To say that we misled the client is an inaccurate statement as we fully represented the client as outlined in the agreement and provided services in full as we were hired to do.   Lastly, to ensure that the services provided by Optima Tax were presented appropriately, we conducted a review of client's enrollment call for accuracy and to see if there happened to be any issues as the client has claimed. After reviewing the call, it was evident that the client was clearly made aware of the fact that after receiving her financials they came back higher then what was presented initially and thus the best option for the client would be an affordable Installment Agreement. It’s truly unfortunate that the client feels that Optima Tax was not forthcoming regarding the services provided, but after an extensive review of the client's file it is confirmed that there was full transparency from the onset of client's enrollment in regards to our approach and the services to be offered to the client. Nonetheless, we will continue to stay in contact with the client until a resolve is met.

Contrary to the client’s statement, the client had been given an opportunity to review all necessary paperwork in order to present any issues or questions they had before Optima Tax received their payment. The Client Services Addendum clearly outlines the services Optima Tax will perform during the Resolution Phase. As stated in our initial response, those services include but are not limited to, IRS Representation, IRS Compliance and negotiating a favorable monthly payment. At no point did Optima Tax change our method, our strategy, or the services the client would receive after the client paid for services he contractually agreed to.   The initial conversation between the client and our management revolved around potentially looking into resolution. No promises were ever made regarding any type of reimbursement. To ensure the client had a full understanding of that conversation, the manager involved followed up with the client in writing which clearly stated that the matter will be looked into.   Since receiving the complaint an Optima Tax associate has reached out to the client both verbally and via email with no response from the client. To our knowledge, three messages were left along with an introductory email. Optima Tax will continue their efforts to establish communication with the client and will continue to address their concerns in an attempt to come to a mutual resolve.

Optima tax was a God sent for me. Everything was explained upfront, there was no surprises. Optima stayed in touch with me, just letting me know they were working on my claim or if I ever have a question just let them know. They made sure I understood anything that was going on and made eack step easy. Have already recommended them to several people who have struggled with the IRS and told them not to be agraid.

We appreciate the client’s concerns with her case, but at no point do Optima Tax representatives provide any misleading or false information. The client’s case is extremely complex and requires a great attention to detail. Given certain factors in the client’s case, the IRS has the right to implement certain enforcement action to secure its interest in the outstanding liability.   Although the action the IRS took was not financially detrimental, we understand that this is a burden and Optima Tax is working towards options to relinquish the actions the IRS took. Prior to receiving the complaint, the client was presented with various options. Optima Tax’s management went over those options again in detail and the client now has a better understanding of our strategy. More so, the client wishes to continue the business relationship with Optima Tax.   At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy. are disappointed to learn that the client feels as if Optima
Tax did not fulfill its contractual obligations.  Our services are broken down into two phases,
an Investigation Phase and our Resolution Phase. During our Investigation Phase
we were able to make contact with the IRS and obtain all the necessary
information to help resolve the client’s IRS liability. As part of the
Investigation services, our job was to address the levy that was in place prior
to the client contacting Optima Tax.
Although we are highly successful in releasing wage levies, the IRS would not
release the levy due to a variety of reasons that we cannot disclose at this
time. Even though the IRS would not release the levy, we successfully obtained
an extension for the client in order to provide further documentation to the
IRS. This extension ultimately would have prevented the IRS from taking further
actions against the client. After informing the client of the services that
Optima Tax provided, we came to a mutual agreement that satisfied both parties.
