SUMMARY - Optima Tax's management had already addressed the client’s concerns listed in his rebuttal in our initial response, however we are happy to further clarify here. RESPONSE - Optima Tax management's initial response to the complaint was clear, accurate and precise. Contrary to the client's claim,  at no point did we fail to file his 2014 tax return. In fact, due to filing the 2014 return that included an outstanding balance, this is the only reason why his Installment Agreement amount increased. We have made it very clear to the client that Optima Tax had no influence on the increase of his payment plan and the decision to increase his payment amount is strictly up to the IRS. The IRS has certain protocols in place that we cannot override nor ignore. The client was thoroughly educated as to why his payment increased but he refuses to accept the facts of his case. Furthermore, and as the client stated, he was previously set up on an Installment Agreement for with the IRS that he negotiated prior to contacting Optima Tax Relief. When the IRS accepts any agreement there are certain stipulations that the tax payer must follow to ensure the agreement stays in tack. Part of that agreement is the tax payer must file their tax returns on time and pay any outstanding balances or the agreement will become null and void. Since the client had a balance for 2014 his original agreement was cancelled and Optima Tax established and negotiated the current agreement that is in place on his behalf. To provide further reassurance and proof to the client we provided the client with the name and employee ID number of the IRS agent we were woking with on behalf of the client. To claim that we did not provide this information is another inaccurate statement. Additionally, the client breached the agreement in June of 2015 that unfortunately caused a long term delay on his case. Once we resolved the matter in October of 2015, Optima Tax began working his case as outlined in the agreement. Once the client reached back out to Optima Tax after his unfortunate health issues, he requested that we continue servicing his case. We presented him an option regarding his resolution that the client accepted. We are also pleased to say that we were able to reduce the client’s liability as well. Optima Tax is happy to address any further questions or concerns that may arise regarding this matter.

however, we needed to adhere to applicable policies and regulations set by the Internal Revenue Service (“IRS”). There seems to have been an unfortunate misunderstanding in communicating the guidelines set by the IRS, however, such misunderstanding has been rectified through our ongoing communication with the client. As a result, while the client understands that there are no specific guarantees of any outcome, he is excited to continue moving forward with Optima Tax. Our representative assured the client that there will be more effort in utilizing a channel of clear communication between the parties. Consequently, the client has indicated that he is satisfied with the outcome of his dealings with our representative and that he looks forward to resolving his IRS debt with Optima Tax. At Optima Tax, we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy. Optima Tax’s management has been in communication with the
client to address their concerns as outlined in the complaint. Optima Tax makes
it a point to educate our clients of the process of dealing with their tax
liability and we take every step to ensure that our clients fully understand
that ultimately the IRS makes the final decision regarding their outstanding
tax liability owed.  For this reason, we
do not make any specific guarantees to any specific outcome. In regards to
possibly obtaining a reduction for the client, at this point the client has yet
to allow us to explore all potential options available for them, which includes
a potential reduction.
Considering
the fact that the client’s case was at the highest level of collections with
the IRS prior to the client contacting Optima Tax, there was a very high
likelihood the client would endure penalties from the IRS.. This does not mean the
impending penalties cannot be removed or reduced once a resolution is in place.
Although the client could not provide certain necessary financial documents in
the two years they have been with Optima Tax we were still able to work with
the assigned IRS agent and present the client with three options to resolve
their case. Additionally, the communication issue had been addressed and
resolved as of last year.

Although the client feels that the initial investigation of his tax matter was not necessary, it’s imperative that we perform this service to ensure we have a clear understanding of the client's liability and in order to formulate the best possible resolution strategy for the client. Furthermore, if the client happened to be facing IRS collection efforts the investigation would reveal this information and give us the ability to work with the IRS in an effort to cease collection activity. Once the Investigation Phase was complete, the client was presented with our findings and our formulated strategy to resolve their tax liability.   Per his complaint, the client feels that Optima Tax took unnecessary steps to resolve his tax matter however, he agreed to the terms of our approach after all details were thoroughly explained to him and thus, we moved forward accordingly and ultimately resolved his case. I give Optima a 5 star rating. From the first phone call I placed to them, to the resolution of our case, I had full confidence in the work they did for us, We were 10yrs. delinquent filing our taxes and very worried about the outcome of our case. The first person we spoke to at Optima was able to reassure us within a week, that we were in a compliance issue and not criminal action. We had difficulty getting all of our data together for our case workers, due to having a house fire and losing most of our documents. Even with this Optima went to work and were able to 6 years of taxes forgiven and left us with 4 years of taxes and penalties to pay. Long story short, we have now paid our taxes and just received a notice from the IRS, that we will be getting a refund of $240.00. It doesn't sound like much to get back, but to come out compliant and get a refund seems unbelievable to us. We will always be grateful to Optima and strongly recommend them to anyone with tax problems. It was definitely a very positive experience and outcome. I give 2 thumbs up, plus our unending gratitude for their concern, patience and definitely professional expertise in resolving our problem. THANK YOU, OPTIMA!!!!!!!!

complaint, he hired Optima Tax to represent him before the IRS regarding an outstanding liability. After Optima finalized the initial Investigation, we presented the client with our findings, our formulated strategy to help resolve the debt, and the client ultimately decided to enroll into our Resolution services. The services the client contracted Optima Tax to perform included, among other things, Collection Representation and ultimately setting up an affordable payment plan.  Given the complexity of the individual client’s case ultimately dictates the amount of time needed to resolve the case. In fact, Optima Tax clearly disclosed to the client the potential time line for a resolution. Although we appreciate the client’s frustration with having the IRS file a tax lien on his property, this action is a result of the IRS securing its interest in recovering the full amount of the client’s tax liability and not a result of Optima Tax failing to fulfill its obligations to the client. Furthermore, the client went through a voice recorded Verification Call that covers all legal disclosures with each disclosure requiring a “yes” answer before moving forward. During this call the client was informed of the services he contracted Optima Tax to perform and also the fact that the IRS can initiate enforcement action at any time, penalties and interest will continue to accrue until the balance is paid in full, and that the IRS has the right to issue a lien.  Ultimately, although the client may not be happy with the actions the IRS took to secure their interest in the liability, it does not negate the fact that Optima Tax provided its services as outlined in the Client Services Agreement. Furthermore, Optima Tax finalized a resolution on behalf of the client that will prevent any enforcement action such as wage levies or bank and property seizures.    At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy. receiving the complaint and we are working towards a mutual resolve.   RESPONSE - Optima Tax’s management has been in communication with the client to address their concerns as outlined in the complaint. As the client stated, he hired Optima Tax for representation as they had outstanding IRS tax liability balances for various years. Our approach to each case we assist with has remained the same. The first phase, Phase one, we investigate the client’s liability, gathering information from both the client and the IRS, and analyze and formulate a strategy to help resolve the case and present it to the client accordingly.   Once we completed our Investigation the client received a thorough breakdown of our strategy and decided to hire Optima Tax as their representatives to help resolve their case. Thereafter, the client's assigned team went to work immediately and finalized his case as outlined in the Client Services Agreement provided to the client.   While reviewing the complaint, the client stated that he can submit a hardship letter that could reduce the fee. We are assuming the fee he references is our Resolution Retainer to take on his case. Although we have an option that we can offer our client’s that find themselves in a position where affordability ultimately is the deciding factor to move forward this is in no way unethical. This is an option the client can take advantage of if it brings financial relief.   Additionally, based off our Investigation the client was never on a payment plan with the IRS prior to contacting Optima Tax as they have claimed. Furthermore, the client was deep into collections activity with the IRS which required Optima to negotiate a hold on the collection activity. Although the client did not have a lien in place the IRS at any time can file a lien against a tax payer to protect their common interest in the outstanding balance. Considering the client’s balance exceeded a certain threshold it is likely for the IRS to issue a lien in these situations.   Lastly, the client was thoroughly informed of the services Optima Tax will be providing. The Resolution Addendum Agreement was provided to the client before any payment was drafted from their account. This Agreement thoroughly explains the services to be provided and outlines all details of the client's enrollment. To ensure that the client had a full understanding of the services Optima Tax was to provide they went through a voice recorded Verification Call that covers all legal disclosures. After each disclosure is given the client must respond with a yes answer acknowledging they fully understand the disclosure before they are able to move forward. When we disclosed the services Optima Tax will provide, the client promptly answered with a yes. Those disclosures also state that a reduction is possible but not guaranteed. Again, the client answered with a yes and continued moving forward. For the record, Optima Tax submitted the necessary paperwork to the IRS in an effort to reduce any penalties associated with the balance and achieve the best possible outcome for the client.     At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy. It’s unfortunate that the client is dissatisfied with our services but we worked their case as agreed upon. I would like to say I was very satisfied with the results. There is a lot of paperwork that was needed thru out the process but the end result was well worth it.

I had several years of back Federal and State Taxes due because of the economic set backs and when it finally come time to actually deal with the issue I started checking out "assistance" sites because the IRS forms and requirements and website was overwhelming. I chose "Optima Tax" and my end results of 3 years of back taxes, came down to owning only $100.00 plus my returns for the last two years - great job

Dealing with the IRS can be very stressful but team at Optima Tax Relief really allow me to have a peace of mind. I am recovering from a heart attack and under doctor's care right now. [As stated by me. When we first contacted Optima about being garnished we were told pay $995 and no worries once we seen we had been garnished we called now this is in a less 2 week period , was then told would cost an additional $4580. Phase two. We were hurt by the practice used by Optima with a promise of paying 13,000 by Aug 19 to the IRS we should of been informed. Not only that is they did there investigation we would of got a call from Optima with great news and that being need to file your 2014 tax and garnishment would be listed. And stead need to pay $4580 . When all said and done we will not even owe the IRS as much as Optima is wanting us to pay them. In less than 2 weeks I canceled Optima. To resolve this Optima needs to refund us our $995. Yes each email I have gotten from Optima has been sent to Revdex.com and I have posted no negatives except those emails when you are not happy with a company and felt you are done wrong of course you want to let others know. Since Optima does not want to resolve this we feel last thing left is small claims court in which Optima sent me this email: Enclosed. When I called I was pressured into paying the Optima and just had me sign real fast in order to stop the garnishment. So when [redacted] informed we cannot sue, I saidwhat  person in their right mind would hire a company like this? And thought they do your taxes hurt you and have a clause which says not their fault just glad I fired them very early before they took us into debt we could not recover from, would never hired them nor would I ever recommend them. There has been no miscommunication on what has happened they did not do the work promised. I actually handled this 2014 tax has been sent in and garnishment has been lifted. We do not like giving our money away for nothing and we want a full refund only communication now can only be done through Revdex.com . Since they do not want to resolve this our next step is small claims. We tried to work this out to no end.

I can finally breath thanks to Optima tax relief,from owing 34k+ And only having to pay 6,000 to the IRS is a big relief. So if your looking for someone to help you out with your tax issues I highly recommend OTR. Great experience also great communication. Before I used OTR I used a different company which took my money,but didn't resolve anything. So save your money and go with OTR.

unfortunate that the client did not express his concerns to Optima Tax prior to filing the complaint because we feel as though this situation could have been easily resolved. However, once communication is established we’re confident that we’ll come to an amicable resolve.   As the client stated in the complaint, he hired Optima Tax to conduct a thorough Investigation into his outstanding liability. Once we completed the initial Investigation, on or about April 12, 2016 the client was presented with our formulated strategy to resolve his case. Thereafter, the client became nonresponsive to any of our communications and his case was cancelled in accordance with the Client Services Agreement.   Unfortunately, given the amount of time that has passed between our initial Investigation and when the client reached back out to Optima Tax, the information we initially gathered has essentially expired. In addition, there is another tax year that needs investigation (2015). Therefore, Optima Tax has no other choice but to start the process over again in order to ensure that we present the client with the most up to date information so that we can present a strategy to resolve his case.   At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy.
