Our personal property (clothing) is damage when we use washer and dryer provided in the room. I won't accept any response if there is no compensation. We tried to contact on site manager many times. Once, she said she would come by at 9 am but she didn't. We waited in the room until noon and she didn't come before we headed to theme park. I took photos for all damages just in case you need them.There are other things make us not comfortable staying in the hotel but we are not asking you to compensate for now.- we are instructed by reception to place garbage outside the door but garbage doesn't get clean up on time and left overnight. The other morning when we got out, we saw garbage all over around in front of the door. The cleaner came by and said it was done by raccoon. I have a photo on this just in case you need it. if there are wild animals around, garbage shouldn't be left overnight. It attracted animals to come on site. - the hot tub only gives hot water even the facet turns to cold water. I asked my children not to use it in case of getting burn by hot water. It is a safety issue- the shower facet doesn't shut completely and keep dripping overnight. It is annoying at nightThere are many things not functioning in the hotel and I guess there is something wrong in keeping up features working. When we buy the hotel, it is under condition everything is working but clearly it is not the case.

We are not satisfied with this resolution because on our first attempt to utilize Welk properties, we were denied a reservation and we were not told that there was anyone to assist us as you are stating in your letter.   Let me repeat, no one offered further assistance other than to state the word No!   So we then had to call the Welk hotel and they in-turn provided us with a room at a higher rate then the membership rate even after I told them that we were Welk Platinum members.    During the sales presentation we were also told that Welk properties had RV camping opportunities which we have not found in the book nor anywhere on the web site.   That was the only reason we took the 90,000 every even year plan.   We camp a lot during the summer in our RV and thought this would be a good vacation option.  Additionally, we were not told during our sales presentation that we would have to call Interval in order to reserve a property.  We attempted to call the property directly for a reservation and were told we could not make reservations ourselves.   It is our belief that if the first year of a members ownership is confusing, not only to the member, but also Welk employees, then owners should have the opportunity to withdraw their membership during the first year if not satisfied with the service.  As stated previously, we have not used any of our points nor have we been able to use any of the Welk properties, just the hotel which anyone can use without an ownership (which we found out after the fact).  It is our belief that Welk misrepresented numerous things to us during the sales briefing.  There are many things that were promised but have not come to fruition.    Because of this, we will continue to explore our options regarding Welk ownership.

Welk Resort Group Platinum Point Owner Number [redacted]Dear Mr. & Mrs. [redacted],I am in receipt of your Revdex.com rebuttal to my response dated November 6, 2015.  I understand your first experience using your ownership was less than ideal.  I apologize.  That is not typical when you are dealing with our organization.  The information you received from Welk Resort Group specifically asks you to reach out to our Owner Services team in regards to the usage of your ownership.  The toll free number for our Owner Services team is clearly listed in the documents explaining how to use your ownership. You have never spoken to our Owner Services team.  They are here solely to assist our owners with the usage of their ownership for vacation travel. We understand how there may be misunderstandings in terms and conditions given verbally; therefore we cover everything thoroughly in our documents and disclosures.  We know that you are given a large amount of information.  That is why we legally allow you five days to read your contract after the date you signed.  If you wanted to cancel within that time you had the right to do so.  Included in your documents were specific procedures on how to utilize your vacation ownership, as well as directions to cancel that same ownership.  The instructions are specific that it must be done in writing within the defined timeframe.  Unfortunately, since you have passed your legal rescission period, we cannot simply cancel your contract. The disclaimers that you reviewed when you purchased specifically cover that all the information has been personally reviewed by you, that you have received copies of all documents and that there are no other representations that are not covered in writing.  We review this information with you with the sole purpose of eliminating possible misunderstandings or confusion.As for your request to terminate your contract, it is not Welk’s policy to cancel contracts that have passed beyond the rescission period required under Missouri law.  I do not have a contract rescission option for your ownership commitment.  However, I know that happy owners are our most valuable asset, and welcome your ideas on how we might overcome your concerns regarding your Welk Platinum Program vacation ownership.  Please allow us to help you use your time.  As stated above, if you need any assistance in booking a reservation or help with using your Interval International exchange benefits please reach out to our Owner Services team @ 1-800-240-9342.  They are here to help you with any ownership need.I am more than happy to help you with any questions or concerns you may have.  If you would like me to assign a senior Owner Services agent to personally assist you with your ownership usage I am happy to  do that as well.  Please feel free to reach out to me for any further assistance in this matter.  Sincerely,Hutch FarrellDirector of Consumer AffairsWelk Resorts[redacted]

Welk continues to ignore the facts on what they have done to me and my family. Welk gives us a response and practically states that there is nothing they can do. The most frustrating part is the fact they use the term "we expect that you honor" which should be something Welk should follow themselves. How is it that they have sales people give wrongful information to sell these timeshares, but yet the company does not want to do anything about it. [redacted], who was our sales person, stated to us and I quote," I understand this terminology in the contract is confusing, but we will have one of our personnel in the finance department give you a call in 4 days and go over in detail the important things on the contract." That never happened. [redacted] should have explained to us what the contract meant. Instead when we asked he tells us that we would be getting help. Not one person at Welk told us that we had 7 days to rescind the contract. How convenient of the company to leave that out. According to the vacation ownership and timeshare act of 2004, Section 11216B, states that If a developer offers a purchaser the opportunity to subscribe to or to become a member of an exchange program, the developer shall provide to the purchaser in writing all of the information set forth in paragraphs (1) to (17), inclusive. If the exchange company is offering directly to the purchaser the opportunity to subscribe to or become a member of an exchange company, the exchange company shall provide to the purchaser in writing all of the information set forth in paragraphs (1) to (17), inclusive. In either case, the written information shall be provided prior to or concurrently with the execution of any contract or subscription for membership in the exchange program; Paragraph (7) and (8) - A fair and accurate description of the terms and conditions of the purchaser's contractual relationship with the exchange program and the procedure by which changes thereto maybe made."From the section mentioned above, Welk has not lived up to their end and has breach there contract by being unethical by not giving an accurate and fair description of what we were getting. I want this contract rescinded because I will not do business with a company that only cares about money.

As I stated in my previous response, Welk does not have a cancellation option for your ownership. I was not present at your sales presentation so I cannot assume what was said and what was taken away from your sales presentation. We use the signed documentation as the documents of record because it effectively eliminates the issue of any verbal promises that may lead to a misunderstanding regarding your ownership. Contracts are created, signed and explained to protect both parties in a transaction.  This information was reviewed with both of you during your purchase transaction. As additionally stated in my previous letter, it is not Welk’s policy to cancel contracts that have passed beyond the rescission period required underCalifornia law. Welk does not have a “take-back” program that would allow you to simply return your ownership to Welk. Welk Resort Group will not be refunding you any monies that have been paid toward your ownership obligation. I do not have a contract cancellation option for your ownership commitment.We can continue to go back and forth on the issue but our stance will not change. From where we stand: We will continue to assist you to the best of our abilities with use of your Welk ownership for vacation, exchange and rental as applicable, but we will not nullify your Welk ownership contract. You have a contractual ownership commitment to Welk Resort Group that we expect you to honor. Your mortgage commitment and owner obligated maintenance fee commitments both need to be kept current. Unfortunately, if you are not able to keep your ownership obligations current, collection activity and default proceedings may begin. You have a number of fantastic usage options available to you with your Platinum point ownership in regards to usage for exchange with Interval International or to travel to any of our Welk Resort locations within the Platinum point program. Please allow us the opportunity to help you use your Welk vacation ownership. The intent when you made this purchase was to use this ownership for vacation travel. I am happy to assist you in any way with the usage of your ownership. I am willing to have one of my senior Owner Services agents personally assist you with the usage of your ownership. [redacted],First and foremost, I disagree with what [redacted] wrote entirely.  We just found out we are pregnant this past week and I do not want to stress myself even further out over this matter.  I've spoken to attorneys who have told me that I have a case, that your sales representative broke multiple laws but that I would need to go through arbitration. I am requesting information on how this must be handled if this cannot be resolved.  I believe it's through JAMS but I need to know exactly how that process works.  I've also been told that this case could also fall under B&P 17200 and 17500. Additionally I am preparing the following: the response to the Revdex.com, an FTC complaint, a CA Department of Real Estate Complaint and a complaint the CA Department of Behavioral Sciences Board as it is against the law for anyone claiming to be an MFT to claim they are one and also offer counseling services as your associate did.  What I find most concerning is that [redacted] claimed he never looked into this when we spoke on the phone in the later part of April and that he wasn't responsible for what your employees say to your customers.  This is also illegal.  You are directly responsible for how they are trained and the promises your staff can make including statements that are entirely false or misleading.  This isn't a case of buyer's remorse.  Your associate had not only the ethical obligation not to sell the timeshare but a legal one as one.  And your company should have investigated my claims of fraud further.  I've attached files proving these claims.  But here's the longer, more detailed version of what happened, since you won't speak with me on the phone.  I am also requesting to directly speak to [redacted] as I have ZERO confidence in your company's ability to handle this complaint legally or lawfully.  Further my husband is a law enforcement officer and has been in the field for 32+ years.  He witnessed much of [redacted] making her false and misleading claims.  My husband [redacted] and I were invited as a MARRIED COUPLE to attend a timeshare presentation on 12-28-2014.  I reserved this on my credit card for I believe a fee of $99.00.  At the time, as a couple, we qualified to attend the presentation because I believe we earned more than 70,000 a year, had a major credit card and our age groups plus we were married which we also had to prove to the sales people with our marriage license (we have different last names)?  I do not remember the full qualifications at the time. I believe the presentation was at 10:00 or 11:00 in the morning, it could have been even earlier.  I did not leave the timeshare until 4:00 to 5:00pm.  I was there for 6+ hours, stranded without a car, with a dead cell phone and piss poor reception/no internet service prior to it dying at the WELK RESORT located in Escondido.  Please note I was on state disability for mental health and issues with my Hashimotos that stemmed from my husband’s infidelity and other work-related stress (SEE ATTACHMENT).  I worked for a church as their operations manager/advancement director and because the state of marriage was not in a good position, I was told that I would most likely not have a job back upon my return.  I was earning I believe $617.00 a week from the state with my disability.  I was required to attend 2-3 appointments/groups per week at Kaiser because of my mental health issues at the time which included MAJOR DEPRESSION, extreme anxiety and PTSD.  I have these records and can get them  I also communicated this to [redacted], the Welk sales representative because she claimed to be a MFT and would help me.The presentation was well over 90+ minutes.  We were told the following which we also learned recently is illegal: 1) this new timeshare was an investment; 2) it was tax deductible; 3) it could be sold for a profit later; 4) it could be rented to earn more income; 5) they could refinance at a lower rate with any financial institution; and 6) the sales agents would be willing to act as their personal representatives and help rent the timeshare.During the time my husband and I had an argument and I disclosed that he had been unfaithful and my job situation to the sales representative [redacted] who then revealed that she was a MFT and that this timeshare and vacationing would heal our marriage.  She also offered to provide free counseling services (I believe 4 but up to as many as 6 sessions if I agreed to purchase the timeshare).  She even wrote on the paper “mental health” as one of the reasons I should buy the timeshare (THIS IS IN DROP BOX). On the back of the paper for some reason she wrote “911” which to this day I have no idea what this means.  I just discovered this on 5/4/2017 in trying to gather paperwork. Also note, I could not find all these documents and discovered them recently during our move back East.  I had requested these documents previously and was denied that request. I don’t remember exactly what happened next but my husband [redacted] refused to have his credit report run and needed to run to do an errand in Carlsbad.  He actually left me at the timeshare.  Before they left they had run my credit and said that I actually qualified on my own.  I reviewed the credit application and there were multiple mistakes.  By this time, my phone was dead.  Internet reception at the Welk in 2014 is non-existent.  For starters our loan amount was wrong.  It says our mortgage was $1100.  Our mortgage at the time was over $3100.  Our HOA fees were not included which would have added $135.00.  I did not add the car which is over $600 a month or my student loans.  I did not do this fraudulently.  I was upset and mistaken and had no access to credit Karma to review accounts which I had done previously when we bought our home (closed in August 2014).  It also lists a CD account of $8000 —> this is my son’s account.  I’m the guardian of the account, but this is not my money.  I know for certain I was directed by [redacted] not to disclose my disability income.  I had not been fired from my employer and she told me just to put my wages.  I sent you a screenshot (also in DB) of my disability claim that started in 8/20/14 and continued through the August/September 2015.  So I listed my employer.  It also states on the bottom that they would run a full credit report and employment history which I believe was not done.  Had they done this they would have seen my other debts.  Again, I wasn’t trying to be deceptive, I had no access to get any account information and I was upset.  I had cried multiple times and was exhausted.  At closing they later had me initial a document that I don’t remember that says I was truthful on my credit information.  This was after things were run.  I was never provided a copy of the credit report.  I told [redacted] that I could not go back to that employer and that they had even forbidden me from attending church services there during the time I was on disability because of the situation.  She emphasized and stated that her MFT services would help as would this timeshare and the art of vacationing.  I was told that we would get 4 free airlines tickets that would never expire.  I was also told that if we didn’t take these that they would lower the principal on the loan by a few dollars a month, which is why I took them.  THIS NEVER HAPPENEDI was told that this would help my credit history and that I could earn rental income off the timeshare.  THIS IS A LIE.  [redacted] offered me a ride to go get my check book because I had no form of payment on me.  I felt trapped, alone, abandoned because this resort was 15+ miles from my house in Fallbrook.  I had no way to get home.  [redacted] vaped in the car, continued with her lies of promising free counseling services to me.  I don’t know why I actually believed her…I just thought she and this would help our marriage.  It’s done nothing but hurt it.  I got my checkbook and then she drove me back to the resort.  I actually don’t remember who drove me home.  I think my husband eventually came and got me.   asked about a recision period during closing with [redacted] R. and [redacted] who told me that if I was going to cancel not to do this. They did not explain that there was a recision period or any documents about that in the huge binder of material they gave me.  They also did not disclose about the 2012 mold case against the resort which I don’t know was ever resolved or not.  I got none of my free gifts which included a Catalina voucher, food thing, Hawaiian trip, boat rides, etc.  I got nothing.  I have never gotten anything.  I tried figuring out how to use my membership and kept getting the run around.  I also had never received a bill for anything and they sent me to collections.  I wrote [redacted] R. in 11/2015 that I felt that I coerced and fraudulently misled into the contract, explained why, asked for a refund and she said that she forwarded my email to management.  I later had some man call me on my phone (I can probably get phone records).  I remember him calling me in December while my husband and I were at PF Changs and he said he was going to do everything that he could do to resolve matter.  He eventually stopped answering my calls and then someone by the name of [redacted] called (he’s the director of consumer affairs)…he told me that there was no recision period and that he was going to comp my maintenance fees, he got the account out of collections, reinstated points, was going to get my airline tickets and send my vouchers.  He added an expiration date to the tickets four months later to which I told him via email that wasn’t good enough on 2/16/16 and [redacted] never responded.  [redacted] never answered future emails.  He never apologized or acknowledged what his representative had done and further there was no agreement made for the wrongs and illegal actions that were done against me.  With the other guy, I told him I was on disability.  That information wasn’t passed on to [redacted] to the best of my recollection/knowledge.  Again, I didn’t think that there was anything that I could do.  I was later invited to another timeshare meeting, they took a fee promised [redacted] tickets and other things and then during the beginning part of the presentation they said that I didn’t qualify to attend the presentation because my husband was not present. I can try to go through my records because I know that this was I believe in Spring 2016 (shortly before we moved). I remember calling [redacted] to complain and that the people apologized. Again, no vouchers were ever sent and it took days to get my refund back on the presentation.  I received no phone calls back, received none of the gifts promised even though they abruptly stopped the meeting saying I did not qualify because my husband wasn't present and this was a community property state.  WHY WASN'T THIS THE CASE THE FIRST TIME?I did not reach out as much back to [redacted] because I didn't feel he could help or that these were illegal.  After the move and settling and recent frustration with your billing department because how inept they are at updating address changes, I looked into this matter further and found out that these are very illegal actions your staff took which invalidates the sale.  Again, with the move, I reported my address change to the firm on multiple occasions.  I also live in very new construction with only 10-12 houses built in a 130 house development.  I was told that I was going to get a $130 late charge because my card did not go through.  We were at the hearing with you in CA and my card was stolen.  I reported it to the bank on 4/2 thinking the payment went through on 4/1.  They sent collection notes to the Bensalem, PA address for the maintenance fees and then collections notices of $0.00 for the timeshare mortgage payment with my current address in Delaware.  I now believe that [redacted] was never an MFT, that this was a bold-face lie and that I was coerced into buying this timeshare that I did not qualify for.  Also [redacted] offering her services, misrepresenting herself (writing MENTAL HEALTH AND 911 on the buyer sheet) opens your company up to other legal law suits entirely.  I also think a lender has a duty to do research of their credit applicants and had they run a credit report with our accounts they would have seen that I had 5 student loans accounts totaling more than $40,000, a avalon with $38,000 debt, a house with $534,000 debt and $3100 mortgage payment and that I could not of qualified even had I been employed. I did not try to misled the Welk but believe I was lied to and entirely misled.  They misled me as I was there for hours without phone, internet service or even a ride.  I did not have a meal and was in a very bad mental state to which [redacted] even wrote “911” back on the sheet.  I have not used the timeshare.  This has been a huge source of contention in my marriage and with my pregnancy, I do not want any further stress.  I am again demanding a full refund of all payments made and a full cancellation of this contract as well as an apology and surety from [redacted] at the WELK that this will never happen again to another individual.  I can be reached via email or cell.

It is kind of you for taking your
valuable time to explain all the different instrumental ways I can use the
programs.
 
You see the information you point
out about your program and its various functions are newly founded pieces of
knowledge for me. It is clear the reason sales people revise the way they
explain it is because restrictions like such will affect their chance to make
commission. If we don’t buy then they don’t get paid, correct?
 
That boldly explains why these
types of tactics give the timeshare industry a bad name. Do you want your
company to develop a reputation like the rest of these illicit low end
timeshare companies?  Have you looked at
the Revdex.com complaints, and state agency complaints? They are identical to mine.
 
Yes, I believe you and your
company do pride itself in your services, however sadly you have individuals
representing things not congruent with your actual policies. These sales employees
count on the fact that owners won’t possibly find these things out until way
past their time to cancel, and therefore there is no chance for them to be
punished by getting charged back their commission.  While your company as a whole holds a
significant level of commendation, you are employing some unscrupulous
individuals who apparently do not care about your company’s reputation amongst
your industry.
 
I am requesting to revoke this
Owner Purchase Agreement, and rescind any contractual obligations. The
presentation was full of fabricated incentives, deceit and decisive exclusions
of key facts. The Consumer Protections have been violated via unethical
timeshare presentation techniques, and contract deceptions.
 
No one should be made to suffer
from the egotistic acts of your sales agent’s just trying to make fast money,
and willing to say anything to accomplish that profit gain.
 
Based on what has happened to me, I would like to ask for a fair
monetary reimbursement even though I am outside my time to cancel, and I am not
paying more of my money after your agent scammed me into this. That is absurd.
I can see if that didn’t happen and then I just out of the blue decided I want
to cancel, then yes the fee is agreeable, but I was sold this under false
pretenses.  I would not have spent the
money if the sales agent would have been honestly forthcoming with all this
information like you have, and I thank you for that.
 
Please
do the honorable thing. One can achieve so much more with the power their job
gives them to help people, as oppose to abusing that power for purposes of
greed. You never know what a difference you possibly could make in someone’s

From the very beginning making this purchase was a huge mistake and we would prefer to sever ties now. We have expressed our grievances on many occasions and this was initiated shortly after making this purchase, but your company ignored us and ultimately has failed to resolve this matter. If you and your associates took the time to assist us upon receipt of our previous inquiries, this matter could have been resolved months ago. We were lied to and endured unethical business practices from your representatives for hours. Had we known the TRUTH, we would have never entered into this contract with your resort in the first place. With all the lies and being falsely promised solutions, we just want to end this nightmare with Welk Resorts. There is nothing Welk could do to rectify this situation and we demand that you help us achieve what we have been requested for quite some time now.

Your response did not address my comments in the least.  I am well aware that Welk Resorts is now partnered with RCI rather than Interval International and that they both offer “get aways”.  The comment that I am still waiting to get addressed is that your sales people tell lies to convince people to purchase your timeshares.  As I have repeatedly said, and you have not responded to yet, our sales people told us that get aways were only $149/week.  That supposed fact was the sole reason that we purchased your time share.  After looking at both RCI and interval International all of the Get aways are significantly more expensive than we can and have been purchasing on VRBO.  I would also like to address the useless of our points and “free airline” tickets.  We received  4 “free airline tickets” to Hawaii as part of our sale.  We have been in contact with the person who was supposed to show us how wonderful our purchase was and help us book a vacation.  She indicated that there was no availability for rentals in Hawaii this whole summer.  Hence, we decided to use our 4 “free” airline tickets to Hawaii and book lodging using VRBO since our points are useless.  I emailed your ticket agent on 2-25-18 with two proposed options for using our supposedly free tickets and I still have not heard back from her.  At this point, I am assuming that I will never hear back and that our 4 free airline tickets do not exist either.We were told during our sales presentation that because these time shares were so valuable, Welk wanted the first opportunity to buy back any time share that a member was planning on selling.  We would like to offer you the opportunity to buy back our time share.  It is unused and since you feel that it is so valuable, maybe you can extract some value out of it.
