I apologize if you felt pressured, or felt that the sale process took an excessive amount of time. The sales presentation is minutes. The purchase agreement negotiation, based upon the owner needs, pricing, discounts and incentives, takes additional time. Every contract is negotiated personally and pricing, discounts and incentives can change daily. You are only obligated to stay for the minute sales presentation to receive your initial free gifts. You always have the right to leave at any time. The choice to purchase your vacation ownership was both of yours. I was not present at your sales presentation so I cannot assume what was said and what was taken away from the conversation. We use the signed documentation as the documents of record because it effectively eliminates the issue of any verbal promises that may lead to a misunderstanding regarding your ownership. Contracts are created, signed and explained to protect both parties in a transaction. This information was reviewed with you during your purchase transaction. We review this information with you for the sole purpose of eliminating possible misunderstandings or confusion. As for your request to terminate your contract and a refund of the funds paid for your deposit, it is not Welk’s policy to cancel contracts that have passed beyond the rescission period required under California law. I do not have a contract rescission option for your ownership commitment. Welk does not have a “take-back” program that would allow you to simply return your ownership to Welk. I show most of your owner notes are in reference to the setting up of payment plans for your owner obligated usage year maintenance fee payments. I show no notes in reference to wanting to sell your ownership until you spoke to a Vacation Owners Associate on February 24, 2014. We received a letter earlier this year demanding that we cancel your ownership. I responded to your letter personally. There is no usage history for your ownership. You are the sole owner of your Welk Platinum point vacation ownership. At this point in time both your ownership mortgage and owner obligated maintenance fee commitment are delinquent. Regrettably, if you are unwilling to bring your ownership obligations current, collection activity and default proceedings may begin. We are an ethical company and cover everything thoroughly in our documents. Every contract is negotiated personally and pricing, discounts and incentives can change daily. We take our service levels and company ethics very seriously. Contracts are created, signed and explained to protect both parties in a transaction. Not only did you meet and talk to the Sales Person and Sales Manager, the Escrow Analyst also went through the documents with you independently during each of your purchase transactions. The disclaimers that you reviewed with each purchase specifically cover that all the information has been personally reviewed by you, that you have received copies of all documents and that there are no other representations that are not covered in writing. We review this information with you with the sole purpose of eliminating possible misunderstandings or confusionYour documents are given to you prior to leaving on the date of your purchase. Included in those documents is a copy of your ownership contract which included the specific steps to be taken if you wanted to rescind your ownership agreement As for your request that we rescind your contract, contract rescission is not an option. Our position on the cancellation of your Welk ownership remains unchanged. I am clear on what you are asking. Ownership rescission is not an option that is available to you. Welk Resort Group will not be refunding you any monies that have been paid toward your ownership obligation. There are no notes in your ownership history that you have ever spoken to a member of our Owner Services team in reference to booking a reservation at a Welk Resort location. You have never placed a deposit with Interval International for exchange usage. You have never tried to use your ownership. Non-usage is not a basis for ownership rescission. I am happy to have a senior member of our Owner Services team personally help you with usage of our Owner Rental program or with booking a stay at any of our Welk Resort locations. They can also assist with usage of our exchange program. I can only offer you solutions that are within the scope of your ownership contract I do not have any further options available to you other that trying to place your time with our Owner Rental program or choosing to use your time. As outlined above, usage can be done through using Interval International as an exchange travel option if you do not feel you want to stay at any of our Welk Resort locations We can continue to go back and forth on the issue but our stance in reference to contractual rescission will not change.
