[redacted] ,In response to your situation, we have made several attempts to contact you so that we could've helped you out with your situationAs mentioned before, the agreement that you have signed up under is a basic 12-payment-agreement, meaning that upon signing up, you are obligated to make payments plus a once per year price guarantee fee before you are able to cancel your membership with a day notice as stated in the contractThis can be found under the terms and agreements section at the siscreen, one which must also be checked before proceeding to signing upWithout agreeing to the terms and conditions, one is unable to sign up for a membership.You were very diligent in terms of making your payments, and have made payments plus the annual fee, but unfortunately you have disputed the charges for three monthly dues as well as the annual feeThat would default you on your payments and would prevent any further payments from being made as your credit card company will no longer allow the card on file to be draftedAs stated in the contract, should you default on any of your payment obligations as called for in this agreement, Retro Fitness will have the right to declare the entire remaining balance due and payable and you agree to pay all costs of collection, including but not limited to collection agency fees, court costs, disbursements and attorneys fees which may be paid or incurred by the facility.As mentioned in your statement, you signed up online and only used the service onceHowever, the key word in that sentence is "service"As with your phone service, your TV provider, Netfilx, and gym memberships, you aren't charged based on how frequently you utilize the service, you pay for having it available to you at any given time (in our case, within our business hours)Unfortunately, at this time we are unable to credit you for any and all of the months for which you have been billedWe will be sure to follwith you in the upcoming days via the phone number that we have on file for you

When I arrived to work, 06/01/at 8:00am there was a note to call [redacted] first thing in the morningI contacted [redacted] at approximately 8:17am and he told me that his card is on file for [redacted] 's membership and he does not authorize the paymentI looked into her account and advised that it appears [redacted] or [redacted] updated the card on file from home and that none of my staff made any adjustments to her accountStated that if he is not authorizing a payment, he must call our billing company, [redacted] and they will be able to stop payments [redacted] responded "So you're no help to me and I will just call [redacted] and report the card charge as fraud"stated you can do that or just speak to [redacted] and they will handle it [redacted] , now sounding irritated said "no that's alright' and then hung up.At 8:am [redacted] called back and Deana who was working in childcare answered the phoneHe asked "what is your manager's name and your corporate number'She said hold on will get him and transferred the call to me at the front deskWhen I picked up [redacted] asked me for my first name, which stated, then asked for my last name which statedHe asked me to spell it and I asked "what is this in reference to" as he then proceeded to try and spell it outsaid the number to Corporate is ###-###-####, have a nice day and hung up.At 9: [redacted] called back for the third time and said that he needed the number to the billing companyI advised that I tried giving it to him the first time he called but he became irate and kept saying "I am no help to him" [redacted] said "well I went ahead and filed a report with the Revdex.com, the Retro Fitness corporate office and the credit card Company'I told [redacted] that's fine, initially tried referring him to [redacted] when he said he didn't put his card on file and didn't authorize the payment but he wanted no part of itWhen he got bent out of shape l wasn't calling them on his behalf and I wouldn't spell out my last name he said what are you hiding? Member was informed according to agreement must provide a doctors note stating member could no longer use gym because of medical condition/injuryMember has not provided any medical documentation Member also informed cancellations are day process that start when medical documents are provided and member must pay all invoices due within the daysThe stated member would also have to have membership paid up to current statusMember received email of agreement on at 3:pm too [redacted]

Due to member changing membership type, expiration date of the agreement was extendedAlthough her signed legally binding agreement does not expire until September 2014, as a courtesy, we have cancelled her agreement

I am writing after speaking with several managers at Retro Fitness - [redacted] (Segei and Justin) In December 2015, a staff member, Derrick called me and asked about my experience and I openly shared my feelings about the gym The gym charges an annual maintenance fee but the gym's status of cleanliness is subpar There is always trash and debris scattered throughout the gym and locker room The bench in the locker room where you are supposed to be able to sit is ALWAYS dirty I would never sit on bench The equipment is never in place and most of the times I visit there are no sanitizing wipes In the locker room, there are several panels in the ceiling that are missing where the heating ducts are visible In addition to this, there is a mildew smell in the downstairs area - especially in the locker room There is no ventilation system and no matter what time I visit, it smells like a stinky locker room The locker room is generally covered with hair, receipts, bags and everything else imaginable There are areas throughout the gym where the paint is missing and white plaster is visible where it hasn't been re-painted In the 6+ months that I've been a member, I have only seen staff cleaning maybe five times Also, I observed the front desk staff cleaning the blenders with ONLY water NO soap I would never have a smoothie there and find it hard to believe that they have certification to sell smoothies there I feel that the lack of cleanliness in this gym is a hazard and the fact that I pay a maintenance fee is frustrating I have attempted on multiple occasions to resolve this directly with management but they have not been responsive I would like to have the gym cleaned regularly or have my maintenance fee waived

Hello,My Name is Justin D [redacted] I am the acting manager of Retro Fitness of KenilworthI spoke to [redacted] yesterday and let him know that I was the one who signed him up originally on October 31st of When he signed up the promotion we were running was "NO MONTHLY PAYMENTS UNTIL JANUARY"I explained to him that you will still be charged your annual fee on December 1st of and even showed it to him where it is highlighted in red on the contract on the computerOur annual fee date is the same for all members depending on the sign up dateIf you sign up between June 1st and October 31st the annual fee is billed on December 1stIf you sign up between November 1st and May 31st the annual fee is billed on August 1stI tried to explain this to him again on the phone when he called and also offered to provide him with a copy of the contractI also attached a copy of [redacted] contract to this emailI am sorry [redacted] feels that he was misinformed.Best,Justin D [redacted]

This member has had NUMEROUS incidents in the facility with other membersThis was not the first time we had a confrontation with this memberWe also have the right to cancel anyone's membership, which we did after he told Samantha to cancel itWe have witnesses that were that day in which this member is referring toMember is disgruntled because he was removed from facility, and not the other member who handled the situation properly by alerting managementThe member who was cancelled was not banned from every Retro, simply Fair LawnWe also have in writing/email that he requested his membership be cancelled, AFTER he TOLD the manager to cancelThis is all on camera as wellThis is simple matter of he said she said, by the angry ex-memberCancellation policies ARE outlined in the contractMember was also not charged 45.00, he was charged for the regular monthly dues, which is NON refundable by owners choice if member breaks agreementThis member has a criminal record, and has been fired from other jobs due to anger/racism issuesThis member is 100% out of line, and nothing was done improperly by RetroThis member is angry that he started a fight and many other problems over the years, and we removed him from our facility

Gym member was refuting charges stemming back from as she no longer was using gym and wanted a credit We are the new owners of the gym and took over 6/24/I spoke with [redacted] on 10/10/and mutually agreed that she will be credited back monies from July and August of as we were then the ownershipShe was happy with the results and is looking to join our gym soonRalph B*** [redacted]

[redacted] *** came in this [redacted] 12/ [redacted] at [redacted] after some back and forth to start settling some of her six months of delinquent paymentsShe applied one month of $at the club and I updated her billing info.She told me that she set up a payment plan with *** [redacted] of $every two weeks (something close to this) and also asked if she could make payments at the club as well to be totally paid in full by MarchI said not a problem since taking the money is better than leaving it outstandingThe next day at [redacted] , *** proceeded to process the remaining five payments as her billing was updated the night beforeThis is new for [redacted] since before I needed to send a Credit Card Authorization form to process payments behind even when billing is unchangedSo obviously I look like the bad guy since I told [redacted] I cannot process payments without her being present

I did not complete my enrollment at a kiosk inside this businessThe first time I entered the location was to request that my membership be canceledMy enrollment was completed by a female representative by the name of [redacted] (who is no longer with the company) on March 6, (dated invoice attached) inside the pre-opening location of [redacted] 2) "Upon [redacted] ***'s first visit she met and was informed by our representative of the features and benefits Retro Fitness offers as well as the facility grand-opening promotional offer of $enrollment and $processing totaling to $inclusive of taxes and the total that has been paid at point of sale as a down payment by [redacted] ***As Retro Fitness standard operating procedures dictate, we pride ourselves with maintaining the highest level of integrity and fully stand by our statement in regards to [redacted] being informed by our representative prior to her purchase that our Retro Fitness Agreement consists of a month installment contract at the price of $per month and carries a $annual fee as stated in her contractRetro Fitness maintains that at no point did our representative state or even allude to there being a $cancellation fee in order for the contract to be cancelled as alleged by [redacted] ***." I was never offered, nor did I pay (invoice attached) a $enrollment fee, nor did I pay a $processing feeAs my invoice shows, my enrollment fee is $+ $tax = $20.89, the same figure also applies to my processing fee for a total of $to startSince my form was filled by a representative of the business I responded either positively or negatively to questions posedI never read any agreement, it was emailed to me for later reviewAt this time I asked the representative, [redacted] who signed me up, about the cancellation policy and was told of the $pay in advance option As for the rest of the response from the business, I understand the need to manufacture points to make yourself seem reasonable and uprightThe showboating carried on by the [redacted] , pacing back and forth, barely keeping eye contact, and insisting on not cancelling my membership did inspire ireeach time I asked to cancel my membership I received a stupid grin and a different answer, one of which was "$right now"I think it is absolutely absurd for a business to contact the police for someone who only wants to cancel a membershipAnd in the situation in which my membership is not canceled, I have every right to be on the property, especially if I do not want to be a member and am being forced to remain a member [redacted] In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted] ***

This member is misinformed They have attended the gym a total of times and now that they have not paid us and are in collections they have a problem with their membership and account We show zero notes on heraccount that they ever called in to request a cancel and we do not under any circumstances allow anyone to call in and cancel a membership Specifically, our contract states in Section that "If you choose to cancel this contract you must either 1) send a signed and dated written notice of cancellation by registered or certified mail, return receipt requested, or 2) personally deliver a signed and dated it written notice of cancellation to Retro Fitness"

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: There are several incorrect statements posed by the business [redacted] states I was due a $restaurant.com gift card free, but unfortuantley I never received suchAlso, in my original request to cancel my membership, and the complaint submitted to Revdex.com the question was raised concerning the verbiage in the contract which specifically states "In some cases you may also cancel this agreement if you signed it before the health club facility was completed," under the Terms and Conditions sections The response from the business still does not answer this question, which was posed several times The main point of my complaint is based soley on this statement in the agreement [redacted] avoids answering thisI called the business, not long after sending several emails to get an answer about the clarification of the statement about canceling listed in Retro Fitness's agreement, the representative said the manager was not in but he would call him and have him return my call The employee called me back a few minutes later stating that Bryan didn't have time to talk to me but would call me tomorrow I never recieved a call back and there was no mention of him being out for any extended period or anyone taking his place in his absence that could help me [redacted] states that the code violation are unfounded I never said there was an actual violation yet There is a room in the front of the facility used for cycling which hold approxbikes for the class The maximum occupancy clearly says max When I questioned this I was specifically told by Bryan H***, the manager, that they remove the bikes when they know the Township Inspector is coming in to take a look at the facility because they still did not have their occupany permit due to unbalancing of the heater/AC system After the inspector leaves, they put the bikes back in the room for class Clearly this is a violation, but they have been avoiding being caught I was not the only person present when Bryan advised me of what they do As the fiance of a fire-fighter in the township this was NOT something I was comfortable with The terms and conditions of the membership do not state that a reason the cancel is required; only needed is the request which I provided Unfortunately due to the ignorance of responding to my question listed above resulted in going over the manager in hopes of clarifying the adamant terms of month memberhship Bryan was quick to respond concerning the month agreement, but when I posed any additional questions I was ignoredA simple clarification would have avoided any further involvement of Revdex.com My cancellation request is not an arbitrary request, holds merit with safety concerns and customer dissatifaction.Regards, [redacted] ***
