Hello, The Merchant in the complaint has refunded the moneyI do not see any additional charges from the Merchant at this time. I still believe that the Merchant needs great improvement in billing and in customer service. thank you for your assistance

I am rejecting this response because:The *** *** contract was cancelled because they could not locate itI told the manager that I had health issues and was afraid of signing a contract due to future unpredicted set backs in my healthHe assured me that there is a medical exemption clauseWhen I tried to utilize it, I was deniedI submitted the orders of a PICC line being placed for daily IV antibiotics to the *** *** corporate office*** *** continued to call and harass me about paymentOnce they could not locate the contract, it was cancelledThey did not do me a favor and we'd still be arguing had they actually located the contractTheir courteous remark is a blatant lie. In order to work with *** ***, one must sign a contract with Retro fitnessThis is the dilemmaConsidering the circumstances with *** ***, it is not fair that I am held to the Retro contractThey choose to let this company into the gym and their record (previous complaints t/o many states) is evidentTheir practice is unethicalThe fact that I may participate at other facilities is irrelevantI would not have signed had I known how this would all work out.

Once again this company is fabricating the truthPlease advise I have phone records of each time I contacted this company back in June The manager is careless and returns calls as she feels like I was never offered to come in and sign paperwork by the manager nor was I offered to sign paperwork as I came into the gym Correct the manager was not there she is never in The employees do not fully know the rules which are in place and continuously misinform customers .Each time I've reached out I was looking for resolution only to be mid informed or spoken with disrespect I can see why this company has this issue with consumers , handfuls and hundreds of complaints regarding the same matter Please advise who regulates this company polices , proceeds and practice as I would like to know . I just called Revdex.com to make a correction and she said corrections must be done in writingIn regards to case #***I was wrong about the fitness connection not being registered, they have more than one listing on the health spa registration page and I only saw the one that was expired,

Dear Sir:While a gym membership is required to utilize Personal Training services, our gym membership, like the Personal Training Agreement, has a provision where the membership can be cancelled before the agreement term is met due to medical reasons at no charge(which is stated in the agreement)It is not our intention or desire to obligate a member to the gym agreement when there is a medical reason that prevents the member from utilizing the facility.The member has several options:The member may "Freeze" the gym membership for any reason (including medical) for up to months without a physician's note for $per month (vs regular dues billing) and reinstate the agreement when the member wishes by filling out a "Freeze Form" at the gym.The member may "Freeze" the gym membership WITH a physician's note stating the reason the member is medically unable to use the facility for a period of up to months at NO monthly charge by bringing the note to the gym and filling out a 'Freeze Form".** In this case, if the member elects the "Freeze" option, the Personal Training Sessions purchased but not used would be preserved and available for use in the future at the member's discretion.The member may request medical cancellation and provide a physician's note to the gym stating the member cannot continue to utilize the facility permanently due to a medical condition and fill out a cancellation request form and the membership will be cancelled.We would be obliged to work toward a satisfactory solutionThe member may contact the gym and speak with our GM who will provide assistance based on how the member wishes to proceed.Thanks for your time and attention to this matter.Pete BManaging Partner

training programs and how her client folder is kept

personal goals and joined for a 12mo 1xWeek program for one on one trainingI
have included a copy of her signed agreement for your reference clearly showing
in bold her program type is a 12mo 1xWeek program paying monthly of $To
enroll, she agreed to paying the 1st month and 12th month down for $initial
down payment, leaving the next installments of $beginning on Jan**,
clearly stated by her initialsThe remaining balance also clearly shows
in bold she is responsible for $left over the last remaining payments
and total program price of $She also initialed the Note of Auto-Renewal
which states after the 12th month, her agreement will convert to a month to
month program for as long as she wishes to continue, or she could give days
notice before the 12th month to cancel the program once her 12th month has been
satisfied
There are two sections *** initialed, one authorizing a monthly draft of
$for the next months, and the other initial that she understands the
Note of Auto-RenewalIn addition, she was also required to give her signature

Trying to resolve retro gym membershipI spoke to the manager in Stroudsburg a few times about moving to NYThe manager asked to send a bill or receipt with my name & new address and she would stop calling in regards to the accountShe gave me her email & I emailed the document

The allegations are that the gym is misinforming customers in order to trap them into a contract, which no none of the staff knows the terms and conditions forYou keep referring to the contract but you guys aren't even adhering to it as your staff didn't act accordingly and cancel the contract before it auto-renewed for a second timeYet your staff says there is no auto-renewal, so why was I charged again in the first place? Please get your story straight.The contract isnt supposed to auto-renew if I explicitly request it to be cancelledI called to cancel after the first time you guys auto renewed because I didnt realize you "changed" the contract because the trainer who signed me up (and was subsequently fired) told me it was the same contract when I asked him explicitlySimilarly, when my fiance called yesterday and your personal training manager told him there was no auto-renew policy in the contract or an expiration date attached to the sessions(THIS IS YOUR MANAGER THAT IS STATING THIS!!!!) So while you have a point, in that I should have read the contract when I re-signed, your organization is 100% in the wrong because they auto-renewed my contract for a second time after I explicitly asked them to stop because I couldn't afford to be charged anymoreThey told me it was taken care of, but yet next month I was charged againYour staff giving the wrong information out to your clientele and perhaps they didn't know how to cancel the auto-renew because they aren't aware of itIf your PT Manager has no clue about it, why would anyone else working the desk know? This makes me think you want this discrepancy because they would better sell training contracts believing the misinformation they were given so you could trap countless people by misleading them into a contract that refuses to be cancelled.These are issues that you are avoiding in each correspondence. So please when you next send me a response let me know:A) Why your staff doesn't cancel personal training sessions when the contract is up, upon client request, only that you can auto-renew the contract and continue to bill them fraudulently? (apparently this is okay with you guys)B) Why you do not educate your staff on changes the management is making to the contract? (We both know its in order to trap more clients into personal training sessions by conveying misinformation about the conditions of the sessions, which expire whenever you feel like it.)---They first auto-renewed in August, so you had months to acclimate your staff to changes in the contract, yet they are still misinformed. You are trying to tell me I am at fault and responsible because I didn't read your contract, yet your staff that are selling these packages are lying to the members of the gym because they have no idea what in the contract; this is YOUR faultThe fact that they were inept and didn't cancel the contract when I requested it after the first auto-renewal is YOUR faultI expect to be compensated for my troubles and I don't want reparations that are tied to your gym because you cannot be trusted. You cant even form a cogent argument when you aren't addressing any of the wrongdoings on your end, which I have clearly outlined.Not only that, but not a single time in our correspondence back and forth did you once offer me an apology for the way I have been treated by your organizationRegardless of who's right and who's wrong, your first response as a business owner should have been conciliatoryThe fact that you continue to patronize me, only speaks to your character as person and also illustrates your bullying business tactics.

I signed up for this club in July of during a promotion of a Grand Opening which was scheduled for July This Grand opening never happened and I made several attempts to contact the club to see about the status of the club and my membershipI was never able to get in contact with anyone via phone or in person at the unopened gym I gave up and just assumed the club would never open since I was never charged and received no communication otherwiseOn Sept I was charged $by Retro fitness and was extremely surprised and frustratedI went to the club on 9/5/to uncover what was going onI found out from an associate that the club had been open since July under new ownership and that members like myself that signed up a year prior were given a free month free trial membership as a courtesy for the inconvenienceI was never notified of this opening or promotionThe associate told me that I could try the club out for the month since I'd already been ch

Terrible business! They charged my debit card various charges that were not mine and refused to remove my debit card information from the system at my request I had to cancel my card and my bank account due to unauthorized activity Jerry the owner was unhelpful as well as staff
