I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The message sent was careless from the first line and indicative of the treatment I've received. It said "Mr. [redacted] has been servicing his vehicle since 2010 and I am saddened he feels this way" but I didn't purchased the vehicle from Sheehy Nissan of Mechanicsville until 2012.For further background, I first went to Sheehy on 5/18/17 and told them of my brake issue. I rode with one of their technicians was able to point out the problem to him. The car was then taken into their shop and I would later be told I needed rotors and brakes. I informed them then I had just gotten brakes in recently. I was then told that the rotors were causing the issue and that if I was getting new rotors I should also get new brakes as well as a brake fluid flush. I then walked across the street to an auto parts store and purchased rotors and brought them back to Sheehy to have installed based on their direction to fix the issue. The same day after leaving I called and told them I still had the same brake issue. Upon returning 5/30/17 I told the service associate I was still having the same problem. I asked to be credited for the money spent 5/18/17. They said it would depend on what the diagnostic said that would need to be run that day 5/30/17 for which I was responsible to pay. I asked why another diagnostic needed to be ran and what diagnostic was ran 5/18/17. No diagnostic was run at least not one that was documented and could be shown to me. I then said I didn't feel it was right I should have to pay for this diagnostic because had it properly been ran before it would have been waived with my service payment. I was was told it could be waived. It cost $[redacted] (including a hazardous waste removal and shop supplies fee). It returned information saying I only needed oxygen sensors. (This is the same information I received previously at an [redacted] with their FREE check engine light service.) The service associate upon relaying this information said that the technician recommended a "TSB" which cost over $[redacted] I asked what a TSB was and was told "it's another type of diagnostic" but when I asked for more information I wasn't given anymore detail. I also questioned why this was not mentioned as an option from the beginning. I said that I didn't feel comfortable paying for another diagnostic when I had already spent over $[redacted] dollars without being any closer to resolving my issue and not being given any assurances about a TSB except that it was a different diagnostic. I asked for more information. I did not "decline repair" as stated by Mr. [redacted]. I was told by the service associate I'd have to speak to the Service Manager who was gone for the day. I was also told I would need to pay for the first diagnostic $[redacted] before getting my car which I had previously been told would be waived. I was now being told that the only the service manager could waive the fee and that since he was gone I would need to contact him tomorrow. Upon contacting Doug I was told my diagnostic fee would not be waived and that I would receive no credit or refund on anything to be used toward the TSB and that the most he could do for me would be to check the brand new brakes and rotors free of charge if I cared to bring the car back into their store. It's misleading that their response stated "all services such as brakes, rotors and fluid exchange were requested." I agreed to pay for those services after being told they would fix my brake issue. In reference to "bulletins are the responsibility of Nissan to make owners aware of the concerns" I'm not sure if this was stated to absolve Sheehy specifically or to concur with what I previously said but I stand by what I stated originally. I wish the TSB and all other possible diagnostics had been discussed the first visit.

I just spoke with Miguel the general manager and unfortunately there is nothing we can do since the customer went to a 3rd party & had the vehicle fixed without reaching out to us pryor to the repairs.

made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. It was made very clear to me that any issues with the performance of the vehicle needed to be addressed within three days after purchase. Those days, while the vehicle were in the care of the seller, were specifically directed to address mechanical issues with the vehicle which were performed unsatisfactorily, as expressed in the e-mail communication dated 4/30 to Brian Hepburn and Richard Higgins. As a simple transmission flush and fill were beyond the capabilities of your service staff, we had no option but to enlist the services of a shop that specializes in the vehicle make and model that we purchased. It was from this shop that we learned about the diagnostic work that was performed on the same vehicle at the seller's request one month prior to our purchasing the vehicle. As the seller, you were aware of the significant mechanical shortcomings of the vehicle. That fact was not disclosed to us when we purchased the vehicle and at any time was any effort made to make us aware of that verifiable fact. It is with this that I ask reimbursement for the repair cost of the vehicle's transmission. Cost that I would not have otherwise incurred had I been aware of that fact when we first looked at the vehicle.

[redacted], Thank you for taking the time to speak with me in regards to your daughters purchase.  Again I do apologize for not explaining things better when your daughter was here in regards to why we used a different bank than [redacted].  I sometimes take for granted...

that when I speak about bank guide lines that everyone knows what I am talking about and I need to go into more detail to insure everyone is on the same page.  Like we talked about if you or your daughter have any questions or if I can be of any assistance to you please feel free to contact me.  Again thank you for your time. Steven H[redacted] Customer is Happy with the outcome I believe...

We are aware of Ms. [redacted] concerns and they have been addressed by our service manager Doug. The vehicle was purchased from an individual owner and outside of Sheehy if the vehicle was purchased from Sheehy it would have come with an additional warranty along with the remaining factory warranty....

The factory warranty is * years or [redacted] miles whichever occurs first and in this case the warranty expired on 02/27/2017 or 5 years from the in-service date, thus it was sold to her with no warranty. The vehicle was purchased September 21, 2013 with [redacted] miles  and returned to the dealership 04/17/14 for the first free oil change with [redacted] miles and again on 04/03/15 for an oil change with [redacted] miles. The next and last visit to our service department was on 01/16/2017 to check air bag light blinking. As you can see we have no obligation to repair the vehicle.Sincerely,Dan C[redacted]General ManagerSheehy Nissan Mechanicsville
