She states that Simm called multiple times over the past few months, todiscuss a matter related to her motherSimm was referred the account about which it calledon April 2nd, 2015. The firstcall was April 16th, when Simm spoke to Ms***’sex-husband. He advised that Ms***was managing the affairs of Ms***. Four phone calls were placed to Ms*** over the next weeks. On May 1st, she called Simm and discussedthe account, purchases made on the account, and she acknowledged awareness ofthe purchases. She stated she wouldreview the matter and call Simm back. Simm requested account documentation from its client and forwarded theinformation received to the account address care of Ms***. My experience with Simm Associates, Incfrom the very start was not good at allI was attempting to make a payment online because I know coming from a customer service background speaking with representatives and having a good conversation is far and few in betweenWhen attempting to make a payment I kept on getting issues with not getting a specific confirmation number This lead me to believe that I was on a fraudulent websiteI spoke to a representative over the phone and confirmed that I was indeed on the correct website and she saw my payment being processedGreat! It was satisfactory until the following Monday on my statement I noticed that Simm Associates took out an additional $from my checking accountThere was nothing on the website stating there was any processing fee which I thought was strange, so I did take it upon myself to ask the representative when I confirmed that the payment went through successfully over the phone if there was any processing feeWhich she responded "no, there are no additional fees." A few minutes later I spoke to a manager and he told me that "yes there is a dollar processing fee which is in the terms and services on the website"Which I might add the so-called manager spoke to me in a degrading snarky wayOkay so I agreed to look into the matter just in case I might've missed the fine printOnly problem is that on the website there was no radio dial to check to agree to the terms and services for that matter nothing on the page regarding terms and services of making paymentsTo prove that there was none, myself and the manager walked through the steps of how I made the payment, and he did agree that there was nothing on the website speaking of terms and services, or feesIn addition he spoke with the company's tech team and they informed the manager that they upgraded their software and there was bugs on the updated payment pageSo, he apologized and agreed to give me a full refund of the $and it will take no more than hourshours passed by and still no refundI called a week later after the manager gave me his word just to give it more time to process the refundStill nothingI called from my phone and long and behold I was not able to get into contact with Simm Associates customer service line any longer Anytime I called the phone would ring 10-times and then either disconnect or it would sound like someone picked up the phone and hung upOne can only conclude that my calls were being screenedJust to make sure that nothing was going on my with my phone I immediately called family members and friends to ensure they could receive my calls, which every single person was able to receive my callsWith these results I called back Simm from a different number and they indeed picked up the line without hesitationWhen I spoke to customer service I spoke with the same young lady that told me there was no processing feeI asked her if a refund would ever be processed because I don't want to expect something that is never going to happenShe informed me that " the request has been submitted but it has not been reviewed and it will 7-business days after being reviewed"In so many words as an example I can 'speak to the universe requesting that world peace please be in full affect ASAP' but will it ever go into fruition? After that conversation I realized that I was being lied to and I will never receive the refund
This whole scenario happened at the middle of June and here we are in the middle of JulyI don't expect to ever see the $I just want anyone and everyone else that has to deal with Simm Associates to document everything, and get it in writingI recommend do not pay anything on their website and if you have the resources go to them in person I'm not sure how many people they deal with on a day to day basis but if they interact with persons a day that have the same experience that I've had that equals $a day, approximately $4,a month, and $54,a year! That is too much money any company should be making off of lies and empty promises to good people who just want to pay their billI hope this helps anyone who has to deal with this untrustworthy company

*** ***- I am responding to *** ***’s thoughtful reply to my initial response on behalf of Simm Associates.
I included *** *** in my response since he referred to the fact he had given Simm his email address previously.
Initially, I must apologize for the quality of communication received from Simm when this matter was with us for collection. *** *** is not asking for unreasonable information from Simm and I am disappointed we were not able to provide him more of what he sought. This has been addressed with the collection team involved and I appreciate *** *** bringing this to our attention.
A couple of points for clarification. Simm is a third party collection agency. We collect solely on loans that other companies own and that they refer to us for collection. In this instance, Caliber Home Loans referred their account to Simm. We receive an electronic download of pertinent information, but we do not receive an extensive background file with copies of original loan documents, statements, or related materials. When a customer requests these, we must request them from our client. This may have contributed to the frustration with our responses *** *** experienced, but it is not an excuse. It is Simm’s responsibility to work through our clients to get the information for the customer or to cease collection.
That is what has been done in this matter. The account has been closed and returned to Caliber. Simm will have no further role in its collection. As *** *** has already contacted Caliber on a prior occasion, I would encourage that he seek to resolve this matter directly with them.

The agent we spoke with committed criminal fraudHe attempted to extort money from us to pay a student loan of our daughterOur daughter entered a masters programThe Online University got her to sign a loan through *** *** *** saying it was for the first semester and not providing the full paperworkThey infact had her sign for the entire two year program a loan of $22,which within two years they jacked up to $32,By the time she completed her first semester she had become seriously ill with a degenerative nerve and spinal diseaseShe was unable to drive or use her hands and had to drop out*** eventually deferred the loan till she was officially declared disabled, but passed the information on to SIMM AssociatesAlmost a year later SIMM's agent called us one Tuesday night saying the loan was days in arrears (a lie) and that we had to pay $by bank draft or credit card because they were having a court proceeding Friday morning in which all of our assets would be attachedWe could not send a checkNone of us had received any notice of a court actionHe repeatedly refused to answer if he had spoken with our daughterFinally he said she had not answered the calls, letters, or emailsShe had not received any communicationsFurther she has the deferment notice in writing which is still in effectSIMM was simply trying to extort money from her elderly mother by fraudulent claims and threats

*** *** *** *** is seeking approval of a settlement to which Simm Associates, Incdid not agree. On February 14th, *** *** called in to discuss his National Collegiate Trust student loan. An agreement was reached calling for one payment of $1,to be
made on February 18th, and monthly payments of $411.33. The total settlement was $5,against a then due balance of $7,749.19.
Simm’s collection notes reflect these specific terms. *** *** made the initial $1,on February 18th. On March 17th, the date the first installment of $was due, Simm called *** ***He suggested that Simm had offered to settle the account for a payment of $3,500. Our representative advised that we did not and could not agree to such a settlement. Two days later, we received this complaint.
Simm can offer *** *** two options to resolve this matter. He may resume the payment schedule stated above by making the March and April payments by April 17th, thereupon resuming the scheduled payments. Alternatively, he may make one payment of $4,649, payable by April 30, 2014.
Upon receiving his election, I will have a new settlement agreement sent to him via email at *** Should he have any questions, he should contact our collection manager, *** *** ** *** *** ***

initiated to the phone numbers supplied by NCT The account was reported as a collection account to the credit reporting agencies Per Simm's notes, we were not successful in engaging *** *** in conversation
Per her request, Simm is closing these accounts and returning them to NCT Simm is also deleting its report to the reporting agencies The collection account will be removed
