She claims that representatives from our office have calledmultiple times, the representatives have a nasty attitude and SIMM refuses toprovide any documentation on the debt. We indeed sent her a validation letteron July 8th right after her defaulted accounts were placed with ourcompany. We have made multiple attempts to reach her but have actually onlyspoken with Ms. [redacted] one time. This contact did occur by calling her place ofemployment. However, at no time during the call did she say she could notreceive calls at her job and also at no time during the call did she ask forany supporting documents pertaining to her accounts with our office. We record100% of calls made from our office and management listened to this call afterreceiving the complaint. Ms. [redacted]’s account has been closed with our officeand she will receive no further calls or correspondence from SIMM Associates.Should Ms. [redacted] have any questions, she may contact [redacted]

[redacted]’s complaint stems from a PayPal Credit account that was placed in our office on April 4th. In her complaint she states that a representative from our company did not identify themselves and would not provide an address when requested. After reviewing her account we acknowledge that our representative could have indeed handled the call better. He should have identified himself and that he was calling from SIMM Associates. Management has addressed this with the representative and educated him on how to better handle calls in the future. Ms. [redacted] states in her complaint that she has yet to receive any correspondence from our company. The reason for this is because as mentioned above we received the account in our office on April 4th and she filed her complaint the next day. The only call we made is the call in question above and the reason why a letter was not sent was due to only having the account in our office for 1 day before her complaint was filed. Due to PayPal Credit’s complaint policy we have closed this account in our office and forwarded it back to PayPal Credit. Ms. [redacted] will receive no further communications from SIMM Associates. and appropriate manner.Mr. [redacted]’s complaint stems from a PayPal Credit
account with our company. He states that he is not aware of any purchase and he
has been in contact with EBAY and PayPal and they both informed him he has no
outstanding balance with them. The account we were collecting on was for PayPal
Credit. PayPal Credit is a different entity from EBAY and PayPal and sometimes
can be confusing for customers. We did send Mr. [redacted] media to show proof of
debt. As he mentioned in the complaint, the purchases were for safeglo and pro
flowers. He states that he has a letter showing these were paid in full. We
have notified PayPal Credit that the customer feels these have been paid in
full. In the meantime, due to the complaint, we have closed this account down
in our office and Mr. [redacted] will receive no further communications from our
office. Should Mr. [redacted] have any questions, he may contact [redacted] at [redacted]

Please extend my apology to [redacted] for the delay in responding to him.  I apologize.  Simm has removed all numbers in its records from its calling system.  A restriction has been placed upon the account that no calls be placed to [redacted].

She states she requested some form of validation of the debt and ourcompany. While our representative did nothing illegal, she definitely couldhave been more cooperative during the phone conversation. She could haveoffered to send a validation letter and also could have had Ms. [redacted] contactAmerican Education Services, the account servicer, to validate SIMM as anapproved vendor for this delinquent account. Management will meet with therepresentative to provide guidance and training on conflict resolution. Ms.[redacted]’s account has since been closed and returned to the servicer. [redacted]’s complaint stems from a student loan account that was placed in our office. In his complaint he states that his payment doubled without warning, our representatives are disrespectful and that we refuse to acknowledge they we are calling on behalf of AES. Per our records with AES, Mr. [redacted] was placed on a MGRS program 3 years ago. This program expired in March of this year which was the reason for the increase in his monthly payments. This would have been explained to Mr. [redacted] at the time the program started. As for our collector’s demeanor on the phone, we have pulled recordings and at no time were they aggressive or disrespectful. We do feel that our representative could have been more helpful in explaining the MGRS program. A call to conference in AES would have greatly alleviated any confusion. In regards to Mr. [redacted]’s assertion that we would not acknowledge that we were calling on behalf of AES is correct because we simply do not work for or call on behalf of AES. AES services the accounts for National Collegiate Trust but has no authority over SIMM Associates and we do not call on their behalf. Due to the complaint, we have closed this account in our office and forwarded it back to our client. Mr. [redacted] will receive no further communications from SIMM Associates. It was founded and incorporated in 1991 in Newark, Delaware. From its inception, SIMM has been dedicated to providing highly effective collection services to its clients, assuring always that the consumer is dealt with in a professional and appropriate manner. On March 6, 2014 Simm was referred an account in the name of [redacted] for collection. The initial notice letter was sent on March 7th.. Simm left a message for [redacted] on March 12, which he returned and spoke with a Simm representative. She reviewed the matter with him, discussed a possible settlement, pursuant to which [redacted] requested proof of the debt. The Simm representative agreed to email validation information to him, which she did through her manager. On March 17th, the representative called to confirm the settlement and set up the payment for the 23rd. [redacted] stated he had not received the email of March 12, which had included the validation letter and the settlement confirmation. His complaint was received on March 20th. [redacted] requests that Simm provide him documentation showing "who and how" he owes money as well as an account number. Simm has submitted a request to its client for the information and should reply to [redacted] with additional information by April 5th. Simm appreciates this opportunity to resolve this matter to both [redacted]'s and Simm's benefit. Should [redacted] have any questions, he may contact [redacted]

Hello, My name is [redacted] - I keep getting harassing phone calls at my work place from SIMM Associates ([redacted] regarding a past Foreclosure telling me I have to pay a certain amount of money in a few days or they will be forced to sue for the whole amount. The problem is ... they will not give me an account number or any information regarding the debt. I am not refusing to pay, I am asking for validation. I need to see in writing what and who I owe. It is my right. They keep telling me they sent it in an email (that I never see or receive) and when I ask for it to be mailed as a document to my home - they get furious and start yelling and threatening me over the phone. IF it is a real debt - I am not sure why they just cannot send me the information so I can get to next steps to pay it. They keep demanding payment over the phone and immediately without providing me any real information on the debt. I will comply when I see the proper paperwork. IS there anything you can do to help? -[redacted]

Desired resolution
I think a fair resolution would be for SIMM Associates to send paperwork showing who and how I owe money and how they are involved. I would need an account number things to even proceed. Things they have not provided in the two weeks here they have been harassing me over the phone while I am at work. Possibly quit threatening me while I am at work ... that would be nice too.
 
 
On March 26th, our collection manager spoke with [redacted], advising that he had forwarded the loan documents [redacted] had requested.  [redacted] indicated that he wished to review the materials with his attorney and would get back in touch thereafter.

Ms. [redacted]’s complaint originates from an Applied Bank past due credit card balance that was placed in our office on February 15th. In her complaint she states that she made a payment on February 27th that was not properly credited to her balance and as a result her credit report is still showing a past due balance. After further research we found that Ms. [redacted]’s payment was made via our automated phone system instead of Applied Card’s payment portal and as a result was not credited to her overdue balance. We have since reversed the payment in our system and applied the funds back to her credit card. We also have contacted our client, Applied Bank, to make them aware of the mistake. We will have a manager call Ms. [redacted] to make her aware of situation. SIMM Associates will also get payment information again so we can pass it through the payment portal so it can be applied properly to her account. [redacted] states in her complaint that she has been contacted by SIMM Associates on several occasions in regards to her defaulted private student loans owned by National Collegiate Trust, and formerly serviced by American Education Services. She states that she and her co-signor have received calls twice per day every day and has asked for paperwork in regards to these loans. She also claims that we have threatened to garnish wages and “take” tax returns. Ms. [redacted] also states that she received a call in December 2015 demanding that payments of $900.00 per month be made or she would need to pay $2500.00 up front to reduce the loan amount. In the event that these arrangements were not secured, the party that contacted her stated that they would take legal action. Ms. [redacted]’s two defaulted private student loans were placed with SIMM Associates on August 4, 2016. Between the placement date of August 4th and August 8th when the complaint was received, two attempts were made to phone number 603 204 4431, one attempt was made to 603 686 6585 and one contact was made with the co-signer at 603 974 1075. A review of the call discredits the claims made in the dispute as no reference to legal action, requests for paperwork, wage garnishment or the “taking” of tax returns was found. Additionally, since the files were placed on August 4th, it is not possible for SIMM Associates to have placed the call in December 2015 that she references. It seems Ms. [redacted] may have our company confused with another that may have been calling her. Due to the complaint, this account was closed in our office. [redacted]’s complaint stems from a Resurgent Capital Services bill that was placed in our office on June 12, 2013.   In her complaint she states that she has written numerous letters with no response, that she called the Newark office looking for information on the “main office” and that she has requested monthly payment notices and has not received any. We feel that Ms. [redacted] may have us or the bill in our office confused with another. SIMM Associates only has one location in Newark, DE. We are not familiar with a company located in Oaks, Pa. Furthermore we have been sending her monthly payment reminders to the address we have on file. We also have received and posted towards her balance $10 payments that Ms. [redacted] has been mailing for the last few years. In regards to letters mailed to us we have received them, documented her account and made attempts to call her to explain the status on her account but these attempts were unsuccessful due to bad phone numbers. We have closed this account in our office and forwarded it back to our client. Ms. [redacted] will receive no further communications from SIMM Associates. Simm educates its representatives to pursue collectionin a forceful but sympathetic manner. The summary by [redacted] would not be consistent with that goal.  Simm apologizes for the inconveniencecaused.  The representatives involvedhave been counseled regarding the handling of this account.  Please have [redacted] contact [redacted]

In his original complaint, Mr. [redacted] requested that Simm contact him solely by mail or email.  He indicated his email address is [redacted]  Simm responded stating direct mail had proven ineffective and providing the email at Simm to which he might correspond.  His rejection of the response states he wants no calls to any number and contact solely by email.  Simm will not contact Mr. [redacted] at any number.  Simm will utilize email for any correspondence with him.

[redacted]’s complaint stems from a student loan account that was placed in our office. In her complaint she states that she was contacted regarding a “supposed” student loan debt that SIMM Associates was servicing that was previously serviced by American Education Services and that our representatives have been calling and harassing another family member. Ms. [redacted] states that she is unemployed and never received communications from AES that the loan was “passed on” to SIMM Associates. She also states that SIMM Associates is not willing to validate the debt nor work with her towards a reasonable resolution and that payment demands are completely ridiculous and unattainable. She is also concerned that AES advised her that they knew nothing about said debt being owned by SIMM Associates. SIMM Associates received the defaulted private student loan in our monthly placements from TSI on April 8, 2016. SIMM Associates is contracted with TSI to service defaulted private student loans that were previously serviced by AES. On April 16th, the initial validation letter was sent to Ms. [redacted] and the co-signer at the addresses provided in the placement file. Our first contact was made with Ms. [redacted] on April 13th, at which time we advised her that the balance of $11,316.25 was due in accordance with the promissory note that she executed when securing the loan. As a courtesy, payment arrangements were discussed and she stated that she would have to speak with her co-signer and would call back that Friday. Records indicate that no request for validation was made at this time. Efforts to communicate with her were unsuccessful up to May 20th when a relative was called for the purpose of obtaining location information for both the her and the co-signer. Additional efforts were made to reach them with no success, so on June 8th another relative was called to obtain location information. During the course of this call with the relative, he stated he knew the debtor but wanted his number removed. In accordance with his request, the number was marked bad immediately. On June 8th, Ms. [redacted] called back in and was provided options for settlement and/or hardship payment arrangements. She again stated that she needed to speak with the co-signer. This particular file was handled in accordance with policy and I find no evidence of harassment or unreasonable demands.

When our representative began to ask questions to better understand the situation and history on the account, he hung up. This was our only contact with the husband and we never spoke with Mrs. [redacted]. Due to this complaint, we have closed this account in our office and no more communications will be attempted from SIMM Associates.
