Bill Me Later referred an account in the name of

[redacted] to Simm for collection on October 22, 2013. A Simm representative spoke with [redacted] on

October 25th and [redacted] agreed to make a series of 4 payments on

the account. Shortly thereafter, [redacted] called back with questions regarding a second account. That account had not been referred to Simm

for collection and our representative advised him that we could not resolve

that account.

As a result, [redacted] filed this complaint on

October 28th. He requests

that he get “a replacement account like newegg preferred account”. This is not something within the purview of

Simm’s role as a collection agency.

Issuance of a new account is an issue for the loan originator.

close its collection efforts and return the account to Bill Me Later.

Review: Simm Associate has called several times asking for a [redacted] named person. I continue to tell them no one here by that name, but yet they continue to call. On the last call, I asked what the rep's name, [redacted] and then asked for an address. The line was either cut or he hung up. So I called back, requested to talk to [redacted] again. The second time, he would not give me the address and hung up on me. I called back and requested a manager. I was put on hold for 5 minutes, then when the person came on, they identified themselves as a manager, but would not provide a name. I simply asked for an address and a name of contact. No one was willing to give the companies address. Nor would they say they would stop calling my number.Desired Settlement: I would like this company to remove my number from their calling queue. There is no one here by the name they continue to call for.

Review: A collector from Simm and Associates has made calls to my parents regarding a billing matter related to myself. I was threatened with a lien on my property and wage garnishments. I was told a judgement was currently being entered against me. I requested written documentation from this company but my request was denied. [redacted] told me a mailing was sent to me but returned to her marked returned to sender which is a flat out lie. The matter goes back to early 2007 which is already past the statute of limitations. I have received a total of 3 calls within a matter of 10 minutes on 7/16/2013. I was told she will contact my neighbors and employers in order to get a hold of me. I requested she not contact any family members or neighbors in regards to this but she said "she will do what she has to do". Again, I requested documentation but she again refused to send me anything. I have the right to know who is seeking to collect from me and the reason so I may have the chance to validate this. This is my right.Desired Settlement: This is past the statute of limitations for the state of Connecticut. Remove from thier files or send me documentation in writing.

inquiry. The collection manager was on vacation for the first week, and I

was in the midst of a move [redacted] during the second week.

I

finally reviewed the account notes with the manager. They reflect the

account was referred to us on June 28th, 2013 for collection by

[redacted]. The account reflected a [redacted] address and phone number [redacted] Calls to that number were not

responded to. Having no other numbers available, our representative

referred to account records that indicated references provided by [redacted]

at the time of loan origination. Our representative contacted these

references to acquire location information as permitted under the FDCPA.

Through

a number provided, our representative was able to speak with [redacted]. The conversation described by [redacted] is not acceptable to

Simm Associates. If our representative refused to supply verification she

was wrong. The discussion of judicial remedies is permitted if properly

conditioned, but they should not have been discussed in the call of July

16. If they were, our representative erred.

Regardless

of the conversation, our representative succeeded only in irritating [redacted] That is ineffective and contrary to Simm policies and

education. Our manager has reviewed this complaint with our

representative and on her behalf and that of Simm Associates, I apologize.

I have had the account closed to further collection by our office. It

will be returned to [redacted]

Review: I have dealt with Simms Associates on several occasions and I strongly feel that their collection practices are both unethical and unconstitutional. I have clearly provided the agents from Simms Associates with my desired contact information, yet, they still seem to enjoy harassing relatives of mine and also contacting my work office. I understand that I am unable to demand that they refrain from calling my debt-cosigner, but they have called and left messages with my in-laws, with whom I do not reside with nor do any of them have any direct/indirect relationship with the nature of the debt in discussion. They have left my private information as the disposal of whoever as well as disclosed the personal nature of the call on an unverified number that at any moment can belong to another customer. I feel that this is a gross and inhumane business practice.

Also, whenever you try to state your claim with an agent, they are very combative and they tend to antagonize you as well as make snide and inappropriate remarks about your personal business. I clearly asked the agent during my most recent conversation, “Why would you contact my in-laws regarding a personal matter of mine when clearly I have provided you all with my address and my direct cell phone number?” They agent responded, “Well sir, it worked didn’t it, we got you to call back, right?” I was fueled at her tackiness and lack of decency and respect for human rights in general. I advised her that this was very unethical and that it shouldn’t have to be this kind of business relationship just because she is attempting to collect a debt. Regardless of the nature of your business, you can’t just talk to people any which way you please.

Now, maybe this young lady received the aftermath of my disgust in place of the actual agent who called my in-laws and my work office in the first place, but it was almost as if she was prepared or anticipating a confrontation with me. It wasn’t until she began to rudely speak over me in attempt to provoke an argument that I became angry and infuriated. I think it is a bully tactic that they are using and for any company to allow Simms Associates to collect debt on their behalf, it says a lot about the classlessness of that established.

I am highly disgusted and I think that they are creating civil offenses with their practices. I am compelled to go to social media and spread my complaints amongst a vast social base, marketing this complaint to other wronged individuals who have had similar experiences. It is gross, disgusting and unnecessary business practices. You do not have to intimidate all people to collect money. A simple ear of understanding and ingenuity with a focus on humility and reality would do all the better. More people would pay if they weren’t being put into a corner in which they feel disrespected, exposed and belittled by the pursuer.

Review: I and my co-signer have been contacted by the company on several occasions. I know they are a predatory collector who tries to collect on others debts for a fee. At the time I was not even 30 days past due and I didn't even owe a full payment. I advised them on numerous occasions that the servicer and the lender and I were working together to get a modification done on my payments. The even sent me a demand collection letter. I called my lender and they advised that they had not turned my file over to collections and Simm Associates should not be contacting me. The lender advised me this week they would be filing a greivence on my behalf for the continued harassment that I have been receiving from them. The lender and I have come to a modification agreement on my file. Simm Associates should not have any involvement with my account. I have been advised that they can be fined $1500 for each unwarranted contact that they make with me. I have 5 documented phone calls and a letter.Desired Settlement: do not contact me again. If I receive further contact I will be pursuing monetary damages for harassment.

loan account with our office. We received the account on October 9, 2015. The

complaint states that the account was not delinquent and should never have been

sent to our office. As mentioned previously, the account was sent to us last

month by the servicer, AES, which means that in fact the account was not

current. On October 15, we had a phone call with [redacted] at which time it was

stated that AES had refused to lower the monthly payments and a lawsuit was going

to be brought against them. We notified [redacted] that AES did indeed send the

account to our office for payment and to please keep us updated with any

communications with AES. After this conversation there were three more attempts

by our office to contact [redacted] with no success. Due to this complaint, the

account was closed in our office on November 16. There will be no more attempts

Sims is a predatory collector you scavenges for accounts to make make money from the lender. AES advised that they did not refer my account to Sims and they would be filing an harassment grievance against them on my behalf. AES has put my account in forbearance which further proves that the file was not sent to collections. My claims to filing a lawsuit was against Sims not AES. As long as I and my co-signer receive no further contact via phone or mail find that this resolution is satisfactory to me.

Review: Simm Associates contacted my grandmother (addressed as Estate of [redacted]) in a letter attempting to collect debt for a student loan my grandfather ([redacted]) co-signed with me and Sallie Mae. The letter says to send payment directly and immediately to them (via Money Gram, Western Union, a bank draft or credit card to a PO Box in Delaware, or through their website www.simmassociates.com/payment.htm), and "all inquires regarding this account should be addressed to our office and not to creditor as noted above [Sallie Mae]." My gut said this is not right, and I called them asking for explanation. They said that the promissory note we signed allows Sallie Mae to demand my whole loan to be due since the co-signer has died, and that Sallie Mae does not have a probate department so is using their service to collect my loan. I confirmed that my note does in fact say that, and then called Sallie Mae to confirm that they sent my loan into collections with Simm Associates. The customer service representative said that was not the case on my account. She said my loan has in fact not changed in status, even though they have the option to do so, that there was no mention of Simm Associates anywhere in my account file and that my payments are still due to Sallie Mae on the same payment schedule they have been on for the two years since my grandfather passed. Simm Associates is a money scamming business targeting widows and student loan holders.Desired Settlement: Please shut down this 'business'!

Simm Associates on September 25th, 2013.for collection of the

balance due on the loan through the estate of deceased borrower [redacted] acknowledged that her loan

documents indeed authorize acceleration of the loan payment when one of the

debtors dies. Simm has been advised that

Review: SIMM Associates took a 3rd payment out of my bank account to settle a debt. This 3rd charge was NOT authorized. I have ended up paying well over what the original debt amount was. I have been told repeatedly that I would get a reimbursement check in the mail. It has been about 2 weeks and I still have not received the check that was supposedly mailed out. I am now being told that they will need to void the original check and reissue a new one. I am fine with that. However, I am now getting the run around saying they don't know how long it will take to cancel the check much less when they will get the new one sent out. I am starting to think this company is a scam. They are trying to keep my money with no guarantee that I will ever get reimbursed now. Such poor management and business practices. If this company contacts you trying to collect a debt, I would wait for the next company that takes over because this one is the most shady business I've dealt with.Desired Settlement: I would like SIMM Associates to refund me the extra payment that they took out of my bank account that was not authorized and expedite the process.

She advised that she had been unsuccessful. It was agreed that Simm would process 2 payments, on February 4th and 13th respectively, to settle the account. Unbeknownst to Ms. [redacted] or Simm, a payment had been made online, which, when received on February 9th, represented an overpayment. Ms. [redacted] contacted Simm on February 18th regarding the overpayment. She forwarded a copy of her depository statement showing the 3rd payment on February 23rd. The manager requested issuance of a reimbursement payment. It appears that Simm attempted to issue a credit back to her account, rather than issue the reimbursement check. Ultimately, the check was mailed on March 11th, 2015. Simm regrets the problems Ms. [redacted] experienced with our payment processing. It is not typical of our process and we regret the inconvenience she was caused to endure. She may contact [redacted] Thank you.

Review: This agency has repeatedly contacted me at my place of employment looking for an individual named [redacted], which is not me nor is me. They were told that on the phone and again in a letter sent ( 5/7/15) to their agency that I am not the person they are attempting to reach and to stop calling me and my place of employment. But they called again on 5/14/15 @ 11:57 am looking for [redacted] and again I told them that I was not that person.Desired Settlement: They need to acknowledge that they are harassing the wrong person and look and contact the correct person who may owe the debt that they are collecting.

If myself or [redacted] was listed by either my brother-in-law or father-in-law as some type of reference, we had no knowledge of that. She further states that Simm has somehowgotten her mother’s number and called her seeking payment. Finally, she says the letters from Simmcontain an incorrect phone number. Simm was referred 2 delinquent accounts in the namesof [redacted] and [redacted] by Lexington Student Loan, LLC, the holder ofthe loan. The accounts were referred onMay 14th and 15th. Simm placed calls to the numbers provided byLexington on May 14th and [redacted] returned one of those calls. She advised our representative that [redacted]managed the loans and that she would have [redacted] contact Simm. The loans were recalled by Lexington on May20th and 21st as a result of payments received. Simm is unable to address the informationprovided to Ms. [redacted] by AES. Simmhas made our client aware of the issue. Simm called [redacted] because she is a co-obligor on these loans,coequally responsible for their payment. I have reviewed the 2 letters sent to Ms. [redacted]. Each reflects a proper 800 number forreaching Simm. The numbers were[redacted]

Review: I've been paying the debt in question to the original creditor; HSBC for 4yrs.

SIMM Associates contacted me in May 2014 saying I owed 2x the original amount. When I questioned the monies I had been paying I was told the debtor was unable to do that so I asked was the amounts I had been paying applied to this new debt. I also asked if they had record of my payment status. I was told to stop paying and start paying them. I started paying them from May 2014- Sept 2014. When the rep contacted me to set up more payments she wanted to increase and I couldn't accommodate her and requested to return to the amounts I had originally been paying the previous debtor. I was told someone would call me back for approval. Now I see SIMM along with two other debtors for the same debt on my credit report affecting my security clearance. None of these companies has given me credit for any monies/payments made over the last 4yrs, nor has SIMM for the time i've done business with them. Again when I asked about the previous payments I had been making noone could answer me but say the company can't do that.Desired Settlement: I want this matter cleared up and/or removed on my credit report and only one company contacting me over this debt that I have been paying.

Review: For the past two years I have been dealing with SIMMS Associates making payments of 55.00 a month. My payment contract with them was to be taken out the 3rd Wednesday of each month due to the fact that I am a senior citizen and my social security comes on the 3rd Wednesday of each month. The first year everything was pretty smooth except one time they took out two payments. In January 2015 a representative called me asking if I wanted to settle this account. I told the representative that I was unable to do this at this time. She indicated to me that my next payment would come out January 15th which was the 3rd Thursday of that month. The next month my payment was taken out on February 15th causing me to be overdrawn in my account. I called and they apologized indicating that if I send my bank statement they would refund the overdraft. I decided that we all make mistakes and I let it go. I also instructed them that my payment must be taken out on the 3rd Wednesday of each month. In May again two payments were taken out of my account. I called indicating that this will be the last payment that I will be sending electronically and that until they can send me a bill each month where I will send a check that I will not send another payment. The representative was very unprofessional and indicated that I still owed 459.72. I asked what about my over payment? She said she would reverse it on Monday. Nothing happened for three days and I called [redacted] bank and the bank reversed the payment. In July I received a phone call from SIMMS indicating that I still owed 459.72 at which time I asked for a supervisor. [redacted] came on the phone and indicated to me that he would set up the account and he apologized for everything that happened. He indicated that he set it up for the 10th of each month however not to worry about it that I could pay for it on the 3rd Wednesday of each month. On the 15th of August a representative contacted me indicating that I again still owed 459.72 and how would I like to make payment. I told the representative that [redacted] instructed me that making a payment on the 3rd Wednesday of each month would suffice. I also indicated that I already sent a check of 159.72 and she should be receiving it shortly. On August 25th I received a bill from SIMMS showing that [redacted] 00 payment was applied to my account and I owe 409.72. I called SIMMS and was very arrogant on the phone that I made a payment 159.72 that my balance should be 300.00 and not 409.72. The representative was very arrogant to me and refused to allow me to talk to a supervisor. I asked if [redacted] was in and she told me that [redacted] was not the supervisor of the account. I asked her who was and she said the supervisor was not in. I asked her to have him contact me in the morning and she said I don't I can do that. I got very irate and she said" I am hanging up now have a good day " and the phone was disconnected. I feel my account should reflect 300.00 and that until I receive a letter of apology and a new balance of 300.00I will not make another payment. Your attention in this matter is deeply appreciated.Desired Settlement: Billing adjustment and letter of apology

Review: This company continues to try to collect on a debt that was already paid & is no longer an existing or valid debt. They have been contacted & told that the debt was paid through Commonwealth Financial on 3/24/15 for the bill from West [redacted] Physicians but still continue to try to collect & refuse to remove it from my credit report. They also are reporting this debt which no longer exists to the credit bureau. The debt was never our responsibility in the first place as it was my daughter's bill & her father was responsible for her medical debts as stated in court papers, which is why it landed in collections in the first place. We got tired of it ruining our credit so we paid the bill we weren't responsible for through Commonwealth. We still have Simms trying to collect this non existing debt & unfairly reporting said debt to the credit bureaus which is why we didn't get a loan & this is violating the Fair Credit Reporting Act & also the company is violating the Fair Debt Collection Practices Act. You cannot collect on a debt that no longer exists!Desired Settlement: Simply remove this from the credit report!

Review: SIMM Associates keeps calling my phone about an alleged debt owed by someone who has never lived here and of whom I have no information on demographics. I am an 88-year old widow. They call at all hours of the day and on weekends. They have left several messages. Earlier this week, I answered their "unavailable" call and they hung up on me. Yesterday, they called before 9 a.m. and just let the phone ring once then hung up. It is very unnerving and upsetting for them to be calling me. I will take action through the FTC and NY Attorney General's offices if this does not stop immediately.Desired Settlement: Leave me alone and never contact me again.

Review: Simm's associates, ext. 2288 called my sisters phone number asking to speak to me, she asked my sister, for my contact information. Clearly my sister did not give a stranger this information, the woman from Simm's gave my sister her contact info and asked her to pass it on to me. I called the company, identified myself told her the above and that I was not familiar with her company, what was the phone call about. She claimed to not be able to find my name in her system, asked for my personal phone number and address. I told her that I can not give that to a company/individual that I do not know. That they should have my name somewhere because they just called my sister asking for me. She said fine then and hung up the phone. I then called the company again and pushed 0 for operator. it seems that the same woman answered the phone again. I identified myself, before my whole last name came out of my mouth, she hung up the phone again. I believe they are trying to collect funds for a Barclay account that I have received phone calls saying it is behind in payments. However, my Barclay account is current and up to date. I have spoken with the Barclay company via the number on the back of my credit card, and they have assured me that my account is in good standing.Desired Settlement: I want whoever is filing these false collection notices and phone calls to be shut down, obvious illegal activity. I have reviewed the complaint filed by [redacted], have reviewed our account records, and have spoken with our collection manager. [redacted] related her unsatisfactory experience when calling Simm Associates in response to a message left for her by her sister. Simm Associates regrets that our representative was unsuccessful in locating the matter with regard to which she had been called. For this we apologize.

As to her assertions that we sent false collection notices and made phone calls she characterizes as “illegal activity” we disagree. On December 6th 2013, Simm Associates was referred a National Collegiate Trust in [redacted]’s name for collection. Our attempts to reach her were unsuccessful so our representative sought to confirm location information through her sister. That led to the message and [redacted]’s calls to Simm. When she called Simm, our representative attempted to confirm [redacted]’s identity and locate her account within our computer. [redacted] elected not to assist in that process and our representative could not locate the account in question.

If our representative hung up upon [redacted], it was unjustified, unprofessional, and inconsistent with the principles Simm has established for its representatives. Simm wishes to apologize for that experience.

Review: I owed money to Paypal Credit and was offered a settlement, on their behalf, by Simm Associates. It was to make a one-time payment of $392.85 and save 65% of my balance owed. I made the payment right away and it has already come out of my bank account. But every time I log into Paypal Credit, it states that I'm 6 months behind in payments and doesn't show any payment credit of the settlement amount. I have tried contacting Simm Associates on 3 separate occasions to ask when they would notify Paypal Credit that the settlement had been accepted and fulfilled. They do not respond. I've emailed twice and called once and no one responds and/or gives me information.Desired Settlement: I would like an email confirmation that the settlement has been fulfilled and a timeline for when they will notify Paypal Credit that the settlement amount was paid in full.

I told this person that I would not "take a message" and not to call me any more. I then called the company directly (three times) and told them to remove my number from the account and not call anymore or I would file harassment charges with my attorney. Your company is on very shaky legal ground repeatedly contacting people who are not in collections in order to locate those that are.
