First,
thank you both for the response. I appreciate that while most of the
information provided back to me is incorrect ... there has at least been
some sort of correspondence. Contact with SIMM Associates has been so
accusing and adversarial and very far from professional or appropriate
... it is difficult to conduct any business with anyone I have spoken to
so far.
The information I was asking for over the phone
was NEVER sent to my home or email - I
then complained and I was passed on to a supervisor named Mike James. It was
then and only then that the first postal contact was made after I asked
for "to who and what I owed" - except it was nothing I had asked for. I
was sent a photocopied listing of the property in question, an old
photocopied vericrest bill statement from 2012, and a photocopied notice
of foreclosure on my home. Nothing else. No explanation, no directions, no account number.
All of this
information I was given is available via Realcomp online and is nothing that I
requested at all. All I wanted to know was, that if I owed money directly to
SIMM Associates - please forward me the account number and proof of
account so that I could try to figure things out or set up a payment option. Mr. James did
notify me that he "did not have to give me anything he didn't want to
give" to which I replied, "it will be very hard for me to pay something
that I do not owe and know nothing about" - I am sorry [redacted], but
the information provided to you is very skewed and unfair.
To
this day ( Tuesday, April 8th ) ... SIMM Associates has still not
provided me with the information I asked for from the very first
inappropriate phone call I received at work. To this day ... I still
have no email to the email address I provided several times to make sure
it was correct.  I can provide proof, I can have records pulled by the
email company if needed ... I was sent nothing. With you being the
compliance manager, I do appreciate you letting Revdex.com know about the CFPB
complaint as well and you should know ... that the way the situation is
being handled by some of your employees is in direct violation of the
Fair Debt Collection Practices Act and should also be reported to the
FTC as next steps. Contacting relatives, neighbors, etc. acting as ME or
an "old friend" to gain information is not appreciated or legal.
Neither is constantly pinging my online credit reports, which I can see
happening online or even still contacting me at my place of work.
Finally,
I had to call my former lender of said property -Vericrest now Caliber
Loans about the property in question because dealing with SIMM was
getting me no where fast - Vericrest/Caliber said my account is
charged-off. I am doing more research as well to see how SIMM Associates
attached to this account and is allowed to do what they are doing to me
and how they are associated with this charge-off.
I am a
hard-working person who has rights too and any debt I learn about and
owe will be dealt with legally and appropriately as best I can as soon
as I possibly can. When I have proof, or learn of anything I may owe ...
I will do my very best to take the necessary steps to resolve matters.

This was to be mailed out after the 1st reimbursement check was sent and before SIMM Associates sent the 2nd reimbursement check.

The statement the business made indicating they have never spoken with me is false.   I have spoken with them on several occasions.   The last of which was 1-2 months ago when I confirmed for them my name, phone number, and told them they do not have my permission to contact anyone else regarding my loan.   I was told at that time that my record was being updated with that information.   Following that, I received no further calls, but my relatives started receiving calls again.  If this is being closed with them and they will no longer contact my family or me, that is an acceptable resolution. [redacted] complaint originates from a student loan account that was placed in our office on March 15, 2016 by our client Access Group. In her complaint she states that we continue to contact her grandmother, that her grandmother is not the co-signer on her account and that her attempts to make payment arrangements have been unsuccessful. Per a conversation with Ms. [redacted] on April 7th, she did not state her grandmother was not the co-signer but in fact asked our representative to have her grandmother removed from the account. Our representative told Ms. [redacted] that was not possible and SIMM Associates does not have the authority to do that. The following day there was another phone conversation with [redacted]. In this conversation a possible settlement arrangement was proposed. Due to the low settlement percentage, we notified her that we would first need financial paperwork completed. We would then forward to our client for final approval of the proposed settlement. We have made multiple attempts to contact Ms. [redacted] since this April conversation with no success. Due to the complaint, we have closed this account in our office and forwarded it back to our client. Ms. [redacted] will receive no further communications from SIMM Associates. Should she have any questions, she may contact [redacted]  Thank you.

Mr. [redacted]’s complaint stems from a Resurgent Capital Services account that was placed in our office on December 7, 2015. He states in the complaint we had purchased the account and he also had concerns with the age of the account, as it was over eight years old. First, as mentioned above, SIMM Associates did not purchase this debt and does not own this debt. It is owned by our client LVNV Funding LLC and was forwarded to us for collection purchases. We sent a total of two letters to Mr. [redacted]. The first was the initial dunning notice that we are required to send upon placement. The second letter was indeed a settlement option letter. We made several attempts to contact him by phone but had no success. Due to the complaint, we have closed the account down in our office and sent it back to our client. Simmsent an initial notice to [redacted] and received this complaint, immediatelyceasing collection efforts thereupon.Simm has closed the account and returned it toPayPal.  Should [redacted] havequestions, she may contact C[redacted]

[redacted]’s complaint originates from a student loan account that was placed in our office by Access Group on February 5th of this year. The complaint states that payments were agreed upon and SIMM Associates is now trying to raise them and that the consumer’s account was over-drawn by us and the money was not retuned in a timely fashion. In response to the complaint about SIMM Associates attempting to increase payments and settle the account, we contacted the consumer in March and took three payments with the understanding that we would follow up when they were done.  Any payments taken on post-default accounts are temporary and by no means permanent terms of repayment.  We followed up in June and took four more because the situation was unchanged. We again followed up in September and October and tried to settle the account to resolve the debt.  It appears that the consumer is under the false assumption that payments can be made until the debt is paid in full, when actually we were making a temporary accommodation until the consumer could find means to either pay the debt off in full or agree to a settlement amount.  In regards to the time it takes to reimburse the over-payment, while it may be an inconvenience, it is our company policy to first verify with banking statements and then cut a manual check back to the consumer.   According to our records, there are monthly payments scheduled to post through March of 2017. Should there be any questions, the consumer may contact [redacted] at [redacted]  Thank you.

[redacted]’s complaint originates from student loan accounts placed in our office. She states that we are calling phone numbers for people that are not associated with her or her accounts. She also states that we are using a “computer scanning system” to find phone numbers. We have had multiple accounts for Ms. [redacted] over the last year or so and most times we have used phone numbers provided to us from our client in order to contact her. We have even removed numbers at her request because she did not want to be contacted at work. The only time we used public information to find an alternate number for her was when she was not returning our calls and that was solely for the purpose of location information. The result of that attempted call was a disconnected number. Over the last year or so we have had multiple conversations with Ms. [redacted] with the most recent conversation on February 9th and at no time did she express any dissatisfaction over any type of attempts to reach her. Due to her complaint, we closed this account in our office. Ms. [redacted] will receive no further communications from our office. If she has any questions, she may contact [redacted] or call at [redacted]  Thank you.

Was phoned up a couple of times about putting an advert in for me initially agreed, then changed mind, charged £240 for to what seemed to me nothing.

providing highlyeffective collection services to its clients, assuring always that the consumeris dealt with in a professional and appropriate manner.Ms. [redacted]’s complaint relates to a conversationwith a Simm representative regarding her Pay Pal loan.  Ms. [redacted] states she requested accountverification and did not receive it.  Shealso felt that the representative implied certain matters to induce Ms. [redacted]to make a payment.  As she correctly states, Ms. [redacted] is entitled to verificationof the debt from Simm, and that collection efforts be stayed during the time ittakes to provide verification.  Simm willrequest the verifying information and forward it to MS. [redacted] beforecontacting her again.  As to theinferences made by the representative, her manager has reviewed the call withher and advised her how to avoid creating an unintended or improper impression forthe debtor.  Simm apologizes for anyinconvenience the call caused her.  Simmis unable to modify the credit reporting for Ms. [redacted]’s account as SimmAssociates does not report to the credit agencies for her account.    If Ms. [redacted]has any questions, she may contact [redacted]  Thank you.

I have reviewed the complaint filed by [redacted], have reviewed our account records, and have spoken with our collection manager.  [redacted] related her unsatisfactory experience when calling Simm Associates in response to a message left for her by her...

sister.   Simm Associates regrets that our representative was unsuccessful in locating the matter with regard to which she had been called.  For this we apologize. 
 
As to her assertions that we sent false collection notices and made phone calls she characterizes as “illegal activity” we disagree.  On December 6th 2013, Simm Associates was referred a National Collegiate Trust in [redacted]’s name for collection.  Our attempts to reach her were unsuccessful so our representative sought to confirm location information through her sister.  That led to the message and [redacted]’s calls to Simm.  When she called Simm, our representative attempted to confirm [redacted]’s identity and locate her account within our computer.  [redacted] elected  not to assist in that process and our representative could not locate the account in question. 
 
If our representative hung up upon [redacted], it was unjustified, unprofessional, and inconsistent with the principles Simm has established for its representatives.  Simm wishes to apologize for that experience.

Given her request for solely letter contact, Simmwill close her account to further collection, code it as a Cease and Desistrequest, and return the account to our client. If Ms. [redacted] has any questions, she may contact [redacted] Thank you.
