She indicates that she has spoken with AES,the loan servicing company and they do not know anything about Simm. She also asserts that her accounts are up todate. She further states that Simm has somehowgotten her mother’s number and called her seeking payment. Finally, she says the letters from Simmcontain an incorrect phone number. Simm was referred delinquent accounts in the namesof *** and *** *** by Lexington Student Loan, LLC, the holder ofthe loan. The accounts were referred onMay 14th and 15th Simm placed calls to the numbers provided byLexington on May 14th and *** returned one of those calls. In the complaint he states that SIMM Associates has never called him but has called his aunt and that SIMM Associates is to not call his grandmother. We did mail out the initial dunning notice on August 12th. Per his complaint, this letter has been received. In regards to phone contact, we have made several attempts to contact Mr. [redacted] through his work phone and cell phone with no success. As of this complaint, he has yet to return any messages that our associates have left. For this reason, others were called. In regards to his aunt, we called her merely for location information which is legal under the FDCPA. Ruth Cubert, his grandmother, was called because she is the co-signer on the account. Due to being the co-signer on the account, she is just as responsible for this debt as Mr. [redacted]. As a result of not being able to establish contact with Mr. [redacted], we had no alternative but to call the co-signer on the account. Due to the complaint, we have closed this account in our office and forwarded it back to our client. Mr. [redacted] will receive no further communications from our office. Mwaura [redacted]’s complaint is in regards to a student loan account that she cosigned for her daughter. The account was placed in our office on July 1, 2016. In her complaint she states that the balance of this loan is not due until her daughter graduates and that her daughter alone is responsible for this debt. As mentioned previously, Ms. [redacted] cosigned for her daughter so she is indeed just as responsible for this debt as her daughter. In regards to payments not being due until her daughter’s graduation, this is simply not true. There are various reasons that would cause a loan to go into repayment before the student graduates. We would suggest Ms. [redacted] call AES, the servicer for the loan, to ascertain as to why this account is now in repayment status. Due to this complaint, the account was closed in our office and forwarded back to AES. There will be no more attempts from our office to contact Ms. [redacted]. If she has any questions, she may contact [redacted] at  [redacted]  Thank you.

It seems [redacted] may be her father in law and due to him being the co-signer on the account would be the reason for our representative’s request to have a conference call with him involved. All personal information provided on her account was passed to us by AES when the account was assigned. Due to the complaint we have closed this account in our office and forwarded it back to the AES. Ms. [redacted] will receive no further communications from SIMM Associates. I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  I  recently  spoke  to  Dave  Becker  about  this  matter  and  he  stated  that  he  needed  a  copy  of the  cashed  money  order  that  was  sent  to  Simms  Associates  because  he  stated  that  the  company  never  received  anything  but  received  payments  I  made  in  the  past.  I'm  going  to  attempt  to  get  a  copy  of  the  cashed  money  order  from  Western  Union  to  send  to  Simms  Associates  as  requested.  Hopefully,  once  received  my  money  of  $277.00  will  be  reimbursed  to me  paid  in  full. Once  this  occurs,  then  this  situation  will  be  resolved.  I  would  like  to  keep  this  complaint  open  until  this  matter  is  solved  to  my satisfaction.

AES advised that they did not refer my account to Sims and they would be filing an harassment grievance against them on my behalf.  AES has put my account in forbearance which further proves that the file was not sent to collections.  My claims to filing a lawsuit was against Sims not AES. As long as I and my co-signer receive no further contact via phone or mail find that this resolution is satisfactory to me.

First,
thank you both for the response. I appreciate that while most of the
information provided back to me is incorrect ... there has at least been
some sort of correspondence. Contact with SIMM Associates has been so
accusing and adversarial and very far from professional or appropriate
... it is difficult to conduct any business with anyone I have spoken to
so far.
The information I was asking for over the phone
was NEVER sent to my home or email - I
then complained and I was passed on to a supervisor named Mike James. It was
then and only then that the first postal contact was made after I asked
for "to who and what I owed" - except it was nothing I had asked for. I
was sent a photocopied listing of the property in question, an old
photocopied vericrest bill statement from 2012, and a photocopied notice
of foreclosure on my home. Nothing else. No explanation, no directions, no account number.
All of this
information I was given is available via Realcomp online and is nothing that I
requested at all. All I wanted to know was, that if I owed money directly to
SIMM Associates - please forward me the account number and proof of
account so that I could try to figure things out or set up a payment option. Mr. James did
notify me that he "did not have to give me anything he didn't want to
give" to which I replied, "it will be very hard for me to pay something
that I do not owe and know nothing about" - I am sorry [redacted], but
the information provided to you is very skewed and unfair.
To
this day ( Tuesday, April 8th ) ... SIMM Associates has still not
provided me with the information I asked for from the very first
inappropriate phone call I received at work. To this day ... I still
have no email to the email address I provided several times to make sure
it was correct.  I can provide proof, I can have records pulled by the
email company if needed ... I was sent nothing. With you being the
compliance manager, I do appreciate you letting Revdex.com know about the CFPB
complaint as well and you should know ... that the way the situation is
being handled by some of your employees is in direct violation of the
Fair Debt Collection Practices Act and should also be reported to the
FTC as next steps. Contacting relatives, neighbors, etc. acting as ME or
an "old friend" to gain information is not appreciated or legal.
Neither is constantly pinging my online credit reports, which I can see
happening online or even still contacting me at my place of work.
Finally,
I had to call my former lender of said property -Vericrest now Caliber
Loans about the property in question because dealing with SIMM was
getting me no where fast - Vericrest/Caliber said my account is
charged-off. I am doing more research as well to see how SIMM Associates
attached to this account and is allowed to do what they are doing to me
and how they are associated with this charge-off.
I am a
hard-working person who has rights too and any debt I learn about and
owe will be dealt with legally and appropriately as best I can as soon
as I possibly can. When I have proof, or learn of anything I may owe ...
I will do my very best to take the necessary steps to resolve matters.
