The referenced account was referred to our office by [redacted] regarding a remaining balance of $722.12 for...

[redacted] account number [redacted]. Service for this account began on 3/24/2013. An e-mail address provided for the account was [redacted]@gmail.com. The last payment received on the account was 10/10/2014 in the amount of $204.65, but that payment was returned by the bank. The account went delinquent on 10/20/2014 and was cancelled due to non-payment on 10/28/2014. SourceRM received the account on 11/16/2015 with a balance of $722.12.
A validation notice letter was mailed to the consumer on 11/23/2015 advising him that the account was placed with our office and of his right to dispute the debt. SourceRM first reported this account to the major credit reporting agencies (TransUnion, Equifax, and Experian) on 1/14/2016.
Our office received the first dispute from the consumer on 2/22/2016 via one of the credit reporting agencies. In response, our office provided verification to the consumer. The account information reported to the credit reporting agencies has since been updated to reflect that the account has been disputed.
In response to Mr. [redacted]'s complaint, our office has mailed out further verification with documentation to validate the charges on the referenced account. This verification includes a summary of the account, a [redacted] Bill Summary Report, and [redacted] Billing Statement copies from October and November 2014. Our client, [redacted], has also been notified of the consumer's complaint.

We previously attached validation of the debt including Retail Installment Contracts, and bills from the original creditor. Based on system notes from [redacted] and their review the debt is believed to be accurate and there was no evidence of disputing the Apple watch. According to [redacted]’s notes there were many conversations regarding payment plans that were denied by [redacted] due to multiple factors including ; age of debt, previous denied payments and amount offered in relation to amount of debt owed. They did however try to collect payment in full or split the amount due into 2 payments. We unfortunately do not have access to [redacted]’s phone recordings so if you feel something was stated over the phone that does not reflect in the notes we can access you may request those recordings from [redacted]. We have requested that the consumer reporting agencies update the account as disputed.  Consumer reporting agencies may take 30 days or longer to update their files and that is beyond our control. If the consumer has questions about the information provided or would like to discuss payment options, he can call our toll-free number at [redacted] or contact the compliance department directly at 1[redacted].  We are a professional debt collector attempting to collect a debt.  Any information obtained will be used for that purpose.

We have reviewed Ms. [redacted]'s complaint.  Upon receipt, we forwarded the information to the creditor and requested documentation.  They provided the attached Invoice dated 8/22/2016 for the consumer's review.  Of the remaining balance on the account, $150.00 is for a special assessment...

charged to all owners at the [redacted] on 3/28/2016 for Window/Sliding door replacement. The remaining $60.00 is a collection fee added by our agency.  According to the creditor, they are currently working directly with the consumer to resolve her dispute.  We have therefore ceased collection efforts.  Please advise Ms. [redacted] that we are a professional debt collector; however this communication is for the sole purpose of responding to her complaint and is NOT an attempt to collect a debt.  We have not reported the account to the consumer reporting agencies and do not intend to do so.  The consumer can contact our compliance department directly at [redacted] or [redacted]@sourcerm.com with any questions about the information provided.

I am rejecting this response because:  [redacted] is not listed on my credit reports, but this company is. As I stated, I do not have a contract with this company and I should not be authorized to pay someone who doesn't have anything in writing or has a verbal. This company can not prove any validation. According to the Fair Credit Reporting Act (FCRA) An item on your report must be removed if it is any of the following: ?Inaccurate meaning wrong account number, item is not yours,etc?Incomplete meaning a field is blank, letters added or missing, etc. ?Unverifiable meaning no original contract, etc

In response to this complaint, we have double checked with Experian, Equifax, and TransUnion and confirmed that we are not reporting the referenced account to the consumer reporting agencies.  The results are attached showing that we successfully removed all trade lines like we said we would.  If something is being reported to the consumer reporting agencies, it is not being reported by Source Receivables Management.

I am rejecting this response because: they are lying their rep said they'd ruin my credit if I didn't pay they also hung up when I asked for supervisor and told me the couldn't mail me any verification or proof of debt. I will contact the FCC and the attorney general in my state as well as theirs. I admit to using profanity as I was frustrated my their condescending tone and lack of any proof.

We have received and reviewed the consumer complaint stating that account that the account we are reporting to the consumer reporting agencies was previously removed due to fraud and that she has not received any documentation from us. The account reported to the consumer reporting agencies is...

reported on behalf of the creditor, [redacted].  [redacted] placed the account in our office on 11/13/2016 with a balance of $160.48.  There are multiple reasons the previous agency may have removed the account from the consumer reporting agencies; for example, if the account was no longer placed in their office or if they chose not to validate the debt.  We do not see any evidence in our investigation that the account was ever closed because it was determined to be fraudulent.  Our investigation of the account, as well as the creditor’s, indicates that we have reached the correct consumer and that the charges are valid.  We notified the consumer that the account was placed in our office on 11/17/2016.  Her first dispute we received was on 1/30/2017 and we mailed verification of the debt in response to that dispute.  We also notified the consumer reporting agencies that the account was disputed. We mailed fraud packets to the consumer in response to subsequent disputes.  A completed packet has not been returned to date.  Attached please find additional verification of the debt including our investigation findings as well as documentation from the creditor to validate the charges on the account. We hope that this information helps Ms. [redacted] understand the balance.  If the consumer would like to continue to claim that this account is a result of identity theft, she will need to provide all of the required information as instructed in the fraud packet provided to her.  If the consumer remembers the account would like to discuss payment options or has questions about the information provided, she can contact the compliance department directly via the contact information provided in the attached letter.  We are a professional debt collector attempting to collect a debt and any information obtained will be used for the purpose.

consumer a validation notice on 9/12/2016 advising her of her right to dispute the debt and notifying her that the account was placed in our office.  The first dispute received by the consumer was via Experian on 3/23/2017.  The consumer was claiming the account was not hers.  Although our investigation did not indicate fraud, we mailed a fraud packet to the consumer to give her the opportunity to claim identity theft.  The completed fraud packet was never returned.  On 4/6/2017 we received a generic fax, which we suspect came from a credit counseling service, stating that the consumer disputed the debt and that she refused to pay.  The fax did not contain a request for validation of the debt.  We therefore ceased efforts to contact the consumer regarding the collection of the debt per written request.  According to our investigations, we have reached the correct consumer and the charges are valid.  The remaining balance on the account is for unpaid service and lease charges on the account.  We mailed verification with documentation to the consumer today to provide more detailed information and creditor documentation to help the consumer understand the balance.  That verification is also attached to this complaint response. The information that was reported to the consumer reporting agencies is confirmed to be accurate and complete; therefore we cannot remove the information.  We have already notified the consumer reporting agencies that the account is disputed. Source Receivables Management, LLC (SourceRM) has reviewed Ms. [redacted]'s complaint claiming that an account placed on her credit file was not updated correctly.
[redacted] account number [redacted] was referred to our office by [redacted] on 9/20/2015...

with a balance of $951.02. Ms. [redacted] paid a reduced balance of $520 on 9/8/2016 to close the account as paid in full for less than the full balance (settled in full). A letter stating that the account was closed and paid was mailed on 9/12/2016. On 10/10/2016 our office reported the account as closed with a zero balance (paid in full for less than the full balance) to the three consumer reporting agencies (Equifax, TransUnion, and Experian)
Our office received disputes from the consumer via TransUnion and Equifax on 10/13/2016. If a reporting error occurred, it is likely that it would have occurred during the manual dispute response process since our system reflects accurate information being sent to the consumer reporting agencies. On 11/4/2016 we received verbal notification that there may be an error on Ms. [redacted]'s report. In response, we submitted an Automated Universal Data (AUD) update to the three consumer reporting agencies to ensure that the account information was reported accurately.
Although it is not our policy to remove paid accounts from consumer reporting agencies and we do not have any call recordings where our representatives agreed to make an exception for Ms. [redacted], we have submitted a subsequent AUD request to remove the referenced account from the consumer reporting agencies as a courtesy to the consumer. Consumer reporting agencies may take up to 30 days or longer to update consumer reports and this is beyond our control.
Please advise Ms. [redacted] that we are a professional debt collector; however this communication is solely for the purpose of responding to her complaint and is NOT an attempt to collect a debt.

I have reviewed the response made by the business in reference to complaint ID [redacted], and I accept that they have realized their claim was fraudulent. We have received and reviewed the consumer complaint disputing the debt placed in our office and alleging our representative was loud, rude, disrespectful and threatened legal action, along with a request for us to cease and desist. We conducted an investigation and forwarded the dispute to the creditor for additional review. According to our investigation as well as the creditors, this account is believed to be fraudulent and the debt has been disassociated from Mr. [redacted]. Per the consumer’s request and dispute findings, we have ceased efforts to contact him in reference to collections on the above debt. The compliance department pulled and listened to the recording of the telephone conversation that took place on 03/19/2018. I am rejecting this response because:
I do NOT have a written or verbal contract with this company. They are in violation of the FCRA. They mentioned in the above statement that they are not trying to collect on the debt? This needs to be removed off ALL of my credit reports. As I stated, I do not have a contract with this company. The company has NO proof that any validation mail from them was mailed to me. I have never heard of this company before it appeared on my credit report. If I have no contract written or verbal, then I am not liable for any accounts.

A collector can't continue to collect on a debt after I've made a written request to verify the debt as long as the request was made within 30 days of the collector's written notice. [15 USC 1692g] § 809(b). Its been well over 30 days and I have not seen a contract that I had with the collection company or the client they represent. This is clearly a violation of the federal debt collection practice Act. This account is not valid, where is my signature where I joined a legal binding contract with either.

The open date on Mr. [redacted]'s credit report reflects the date [redacted] opened the account with SourceRM. The credit reporting agencies were also provided with a delinquency date of 01/29/2014 to indicate the accurate age of account. We are in no way attempting to alter information associated with the account.
Based on the information provided to us by [redacted] it does not appear the Early Termination Fees (ETF's) on this account were waived by our client. The balance referred to us includes $380.00 in ETF's. We have notified [redacted] that Mr. [redacted] is disputing the balance. We have also placed the account in a cease communication status. Our standard procedure once an account has been credit reported is to update the account as disputed, paid, settled, active etc. to maintain the integrity of the credit reporting agencies' data. However, since there is conflicting information in this case, we have requested removal of the credit entries reported by SourceRM. [redacted] records currently reflect the balance referenced above. We recommend Mr. [redacted] attempt to get this matter resolved with [redacted] so the account does not progress through the collection process and get referred to other agencies in the future.
