We have received and reviewed the consumer complaint.  A previous complaint was filed by the same consumer 6/27/2017 when the account had been paid.  The payment was made on 6/27/2017, but then was returned due to insufficient funds, therefore the account is still outstanding....

 Verification with documentation was mailed to the consumer on 8/16/2017 to support the charges on the account.  A copy of the documentation mailed to the consumer is attached to this complaint response.  The information reported to the consumer reporting agencies is accurate and therefore will not be removed at this time.  We are no longer attempting to contact the consumer in order to collect the referenced debt.  If he has any questions, he can contact the compliance department at [redacted] or [redacted]@sourcerm.com.

We have received and reviewed the consumer complaint claiming that the consumer does not have a contract with our office and is not liable for account with [redacted].  The consumer is requesting removal of the account from the consumer reporting agencies. According to our investigation as well as...

the creditor’s, we have reached the correct consumer and the charges are valid.  The remaining balance on the account is for unpaid service and equipment cancellation fees on the account.  Although we have already previously provided the consumer with verification of the debt, we mailed additional verification with documentation to the consumer today to provide more detailed information and creditor documentation to help the consumer understand the balance.  We are not required to have a contract with the consumer to collect or report the debt on behalf of [redacted]. The information that was reported to the consumer reporting agencies is confirmed to be accurate and complete; therefore we cannot remove the information.  We have already notified the consumer reporting agencies that the account is disputed. If the consumer has any questions, the compliance department can be reached directly at [redacted]@sourcerm.com or [redacted].  We hope we have helped the consumer resolve this complaint.  As we have previously received notification that the consumer refuses to pay, we have ceased efforts to reach out to the consumer to collect the debt.  Therefore, we are a professional debt collector; however this communication and the verification provided are for the sole purpose or responding to the consumer complaint and are NOT an attempt to collect a debt.

Source Receivables Management (SourceRM) has reviewed the information received in Revdex.com Case #[redacted] regarding SourceRM Account [redacted].
The referenced account was referred to our office by [redacted] regarding a remaining balance of $465.01...

for [redacted] account number [redacted]. Service for this account began on 9/30/2104. The last payment received on the account was 9/29/2014 in the amount of $102.48. The account was cancelled on 10/9/2014 and went delinquent on 12/3/2014. SourceRM received the account on 12/6/2015 with a balance of $465.01.
In response to Mr. [redacted]'s complaint, we reviewed the notes in [redacted]'s system and found that the account was cancelled during the PO Guarantee Period. Return Kit # [redacted] was sent to the consumer 10/10/2014. Credit was given for only one early termination fee in the amount of $419.12. There were two lines on the account. Return Kit [redacted] was also sent to customer on 10/10/2014. SourceRM has contacted [redacted] to verify whether the 2nd phone (iPhone 5S/Gold 16GB - #[redacted]) was returned to the warehouse.
As we have not yet heard back from [redacted], we have ceased collection efforts on the referenced account. We have also requested that the three major consumer reporting agencies (TransUnion, Experian, and Equifax) remove the referenced account from the consumer's credit file. Consumer reporting agencies may take up to 30 days or longer to update consumer reports and this is beyond our control.
I spoke with Mr. [redacted] directly on 6/15/2016. He has requested that I contact him when I hear from [redacted] regarding the return of his equipment. Should he have any additional questions beforehand, he can call the compliance department directly at [redacted].
Please also be advised that Source Receivables Management (SourceRM) is a professional debt collector; however this communication is for the sole purpose of responding the consumer complaint and providing the results of our investigation. This is NOT an attempt to collect a debt.

We are sorry that the consumer has been unhappy with his experience.  All of our calls are recorded and I have personally monitored every call that our office had with the consumer.  The account has never been reported to the consumer reporting agencies and the consumer's credit was not discussed with him.  Mr. [redacted] was transferred to supervisor Ron M[redacted] and spoke with him on 1/30/2017.  If the consumer sent something via mail, we have yet to receive it.  Documentation from the creditor was provided to the consumer with our first response to this complaint submitted yesterday 2/9/2017.  As stated in the previous responses, we have ceased collection efforts on this account, which included removing the consumer's phone numbers from our calling list.  He will not receive any further calls or attempts to collect the debt.  Again, we are sorry that the consumer is upset.  The matter has been escalated to [redacted] and they have placed the account on hold for their Executive Services department to review the account in detail.  If the consumer wants to discuss the details further or if he has questions he can contact our compliance department directly or contact [redacted].  We are not attempting to collect the debt and the account is not going to be reported to the consumer reporting agencies by our office.

We have received and reviewed the rebuttal by Mr. [redacted].  Please advise the consumer that neither Source Receivables Management or [redacted] own the debt referenced.  The account belongs to the creditor, [redacted].  Most likely the account was placed with [redacted] prior to being placed in our office.  If you contact [redacted], they are required to remove the information from the consumer reporting agencies as the account is no longer placed with their office.  Since the account is currently placed in our office and we have confirmed the accuracy and integrity of the information reported to the consumer reporting agencies on behalf of [redacted], removing the account would be in violation of our contract with the credit reporting agencies and with the creditor.  The debt is valid and verification with documentation has been provided.  We have honored the consumer's request not continue efforts to contact him in attempt to collect the debt.  However, the debt is still valid and is owed to [redacted]; therefore it will not be removed from the consumer reporting agencies while the account is placed with our office.  If the consumer has further questions or would like to discuss the information provided to him, he can contact the compliance department directly at [redacted] or [redacted]@sourcerm.com.  We are a debt collector.  This communication is for the sole purpose of responding to the consumer's complaint and is NOT an attempt to collect a debt.

was transferred to another agency.
While the referenced account was placed with our office, the consumer made the following payments on the account: $149.50 posted on 2/23/2016 and $144.81 posted on 7/22/2016. His beginning balance when the account was placed in our office was $1794.31. When the account was recalled by our client, [redacted] and [redacted], the remaining balance was $1500.00. We checked our payment files, and both of the payments were sent to the client.
We have reached out to our client again advising them of the consumer complaint to ensure that the other agency is aware of the consumer's most recent payment. Please see the attached letter reflecting the consumer's payment history with our office and advising him that the account was recalled and returned to the client.

[redacted] account number XXXXXXXXX. Service for this account began on 05/22/2001. An e-mail address provided for the account was [redacted]@yahoo.com. The account became delinquent on 3/20/2014 when the account was cancelled because the consumer transferred to another carrier. The last payment received on the account was 7/2/2014 in the amount of $50.00. SourceRM received the account on 4/21/2015 with a balance of $500.47.
A validation notice letter was mailed to the consumer on 4/27/2015 advising her that the account was placed with our office and of her right to dispute the debt. SourceRM first reported this account to the major credit reporting agencies (TransUnion, Equifax, and Experian) on 6/10/2015.
Our office received the first dispute from the consumer on 2/4/2016 via one of the credit reporting agencies. In response, our office mailed verification to the consumer. The account information reported to the credit reporting agencies has since been updated to reflect that the account has been disputed. We did receive a dispute letter on 2/12/2016, but the dispute did not contain any new information about the consumer's dispute, and verification had already been mailed on 2/4/2016.
In response to Ms. [redacted]'s complaint, our office has mailed out further verification with documentation to validate the charges on the referenced account. This verification includes a summary of the account, a [redacted] Bill Summary Report, and [redacted] Billing Statement copies from April and July 2014. Our client, [redacted], has also been notified of the consumer's complaint.

Please advise Ms. [redacted] that the letter mailed to her on 4/27/2015 included a notice that the account may be credit reported, even though we are not required to provide the consumer with such notification. We mailed another letter on 6/18/2015 offering a settlement, and then mailed verification on 2/4/2016 in response to the consumer's dispute. If the consumer did not receive our correspondence, we apologize. However verification with documentation has now been mailed to the address provided on this complaint. A copy of that verification is also attached for the consumer's review.

7/5/2016. Our response to this complaint is the same as the response to the CFPB.
The referenced account was referred to our office by [redacted] (AEP) regarding a remaining balance of $93.72 for [redacted] account number [redacted]. The service dates for the account were 5/27/2008 through 1/24/2011 at service address [redacted] Johnstown, OH XX[redacted].
Upon further investigation, our office has confirmed that the consumer filed bankruptcy on 2/11/2011 and that bankruptcy was discharged on 5/24/2011. We therefore closed the account and forwarded the bankruptcy information to our client, [redacted] SourceRM has not reported this account to any of the consumer reporting agencies and does not intend to do so.
Our compliance department has also reviewed all conversations that took place between Ms. [redacted] and our representatives. To ensure that we do not give private information to the incorrect party, our representatives are required to verify certain information (such as the consumer's full name and address and/or last four digits of social security number) to determine right party contact prior to disclosing the reason for their call. We apologize if Ms. [redacted] was upset by this verification process. Our office contacted Ms. [redacted] on two occasions (6/21/2016 and 6/28/2016). On both occasions, the representative was unable to determine they were speaking with the correct party. All other conversations were inbound calls from the consumer. The consumer did not advise our office of the bankruptcy mentioned in this complaint in any of the phone calls. Upon Ms. [redacted]'s request that we cease calls, her phone number was flagged so that our office would not call her phone number any more. Following that conversation, no further calls were made to the consumer.

account was settled, but it may take some time for the creditor to get confirmation that payment has cleared the bank before the account can be permanently assigned to a settled status on their end.  Regarding the consumer reporting agencies, accounts are updated within 30 days of payment.  To expedite the process, we have submitted a manual update to the consumer reporting agencies notifying them that the account is settled in full.  Consumer reporting agencies may take 30 days or longer to update their files and that is beyond our control.  A settled in full letter has been mailed to the consumer address provided on this complaint.  Please advise her to keep an eye out for that letter in the next 7-10 business days.  We hope that we have helped resolve the consumer's complaint.

We have received and reviewed the consumer complaint claiming that we have continued collection calls without providing proof of debt.  Our compliance department has reviewed the history of the account in our office, including call recordings, and has found that our agents responded...

appropriately in their conversations with Mr. [redacted].  The calls that were disconnected were disconnected in a professional manner in line with company policy due to profanity from the consumer.  The representatives never discussed the consumer’s credit or made any indications that the account would impact the consumer’s credit.  Although we were verbally notified of the consumer dispute, this complaint is our first notification that he is requesting verification of the debt.   As explained to the consumer over the phone on 1/30/2017, the balance with the creditor is for the charges the month before cancellation.  The only charges incurred after cancellation were late fees and taxes, but those were adjusted off after a conversation the consumer had with the creditor in August of last year where he said he was not receiving the bills.  Attached please find verification with documentation from the creditor.  We hope that the information provided helps the consumer understand the charges making up the balance that we were attempting to collect.  Following our investigation, we forwarded a copy of the complaint to the creditor.  They have placed the account on a 14 day hold for Executive Services to investigate the dispute further.  Per the consumer’s request, our office has ceased collection efforts on the referenced account.  We have not reported the account to the consumer reporting agencies and do not intend to do so in the future.  If Mr. [redacted] has further questions he can contact the compliance department directly at [redacted]@sourcerm.com or [redacted].  We are a professional debt collector; however this communication is for the sole purpose of responding to the consumer complaint and providing the results of our investigation.  This is NOT an attempt to collect a debt.

I am rejecting this response because:
I specifically requested and asked for them to remove this off all credit bureaus. Once we made the agreement on the settled amount I paid and in addition a letter showing how much I paid to dispute.I did receive the letter and they were supposed to remove it all bureaus.The agent who I spoke with and who I paid agreed it would be removed off all bureaus and the letter will be mailed .They are not telling the truth .I am requesting for it to be  removed off all bureaus.,it is paid and settled in full .It is not fair for me to still have this negatively on all bureaus when I have held up my end and bargain to settle and pay in full .I never signed a contract with this credit agency in the first place ,and I do not have an account with them but I went and paid anyways so it could be removed all the credit bureaus .I am demanding this to be removed from all credit bureaus immediately as I was promised and advised it will be removed .

collection on 9/12/2017.  Our office mailed a notice to the consumer on 9/15/2017 advising her that the account was placed in our office and of her right to dispute the debt.  That notice was mailed to the same address as listed on this complaint.  The first dispute our office received regarding this account was on 02/17/2018 via Revdex.com.  In response, validation of debt has been mailed to the consumer at the same address listed on this complaint and has been attached to this complaint for review. According to our investigation as well as the creditors’; we have reached the correct consumer and the charges are valid. We cannot remove the account from the consumer reporting agencies as the reporting is believed to be accurate and that would violate our agreement with the creditor and the consumer reporting agencies, however we have reported this account as disputed which could take 30 days or greater to update which is beyond our control. our office on 09/10/2015 for a balance of $192.25. The balance is for tax preparation services provided for the consumer in 2014 when she was at address [redacted] XXXXX. A notice letter was mailed to Ms. [redacted] at her updated address on [redacted] on 10/10/2015.
We are a professional organization that trains and tests our collectors on FDCPA requirements. To ensure there are no issues of third party disclosure, we require that our agents verify that they are speaking to the correct party using information such as the consumer's full name, address, year of birth, and/or last four digits of the social security number. For the consumer's privacy, the collectors cannot see the entire social security number, only the last four digits. It is our intention to provide services in a professional manner. All conversations that our office had with Ms. [redacted] have been monitored by our compliance team. In each of the calls, our representatives identified themselves and the company name when asked. They attempted to verify that they were speaking to the correct party; however the consumer did not want to verify any personal information. The representatives were not being unprofessional towards Ms. [redacted] by not telling her the purpose of the call; they were simply following protocol to avoid third party disclosure and make sure they were giving information to the correct party. In both conversations, Ms. [redacted] terminated the call.
Per the consumer's request, we have ceased all collection efforts on the referenced account. Please advise Ms. [redacted] to contact our office if she has any further questions or concerns.
