Highland Capital Corporation (HCC) is responding to a complaint to the Revdex.com initiated by [redacted] on 3/9/ The ID# is [redacted] There was a follcomplaint by [redacted] on March 20, As clearly stated in our initial response on 3/16/18, [redacted] entered into a noncancelable Master Lease Agreement (HCC will supply the document upon written authorization from [redacted] ***, as privacy laws will not permit HCC to release the information at this time.) The payments are fixed for the term of the lease and are not broken out between principle and interest This agreement is not a loan Please note the following terms: Contract # [redacted] Amount Financed = $18,($16,plus $1,Sales Taxes) Term = Months Monthly Payments = @ $463.55, @ $0.00, @ $(inclapplicable taxes) Residual = $plus applicable taxes Contract # [redacted] Amount Financed = $29,($26,plus $2,Sales Taxes) Term = Months Monthly Payments = @ $0.00, @ $(inclapplicable taxes) Residual = $plus applicable taxes Contract # [redacted] Amount Financed = $43,($39,plus $4,Sales Taxes) Term = Months Monthly Payments = @ $0.00, @ $(inclapplicable taxes) Residual = $plus applicable taxes The total amount financed for the three contracts was $90,(includes Sales Taxes paid) If [redacted] wishes to terminate the contracts, he may send a check to HCC for $102,902.01, which covers the remaining contractual obligation The breakout is as follows: Contract # [redacted] Remaining Payments @ $ $20, Residual Buyout good thru 4/18/ $20, Contract # [redacted] Remaining Payments @ $33, UCC Termination Fee Residual Buyout good thru 4/18/ $33, Contract # [redacted] Remaining Payments @ $48, UCC Termination Fee Residual Buyout good thru 4/18/ $49, As previously indicated with regards to the Insurance charges, please see the Master Lease Agreement, Section Insurance (HCC will supply the document upon written authorization from [redacted] ***, as privacy laws will not permit HCC to release the information at this time.) “If Lessee fails to maintain such insurance, or fails to provide Lessor with evidence of such insurance within days of our request, Lessor may, but is not obligated to, obtain insurance in such forms and amounts as Lessor deems reasonable to protect Lessor’s interests and which does not name Lessee as an insured“ The agreement was signed by [redacted] on 7/18/There are no fine print sections of the finance agreement Monthly statements were sent to [redacted] clearly indicating the monthly charges Various letters were sent by American Lease Insurance (ALI) beginning on 7/21/to obtain sufficient proof of insurance (naming HCC as additional insured and as loss payee) from [redacted] *** The equipment was insured thru ALI from 9/thru 1/ Sufficient proof of insurance was received on 1/29/ Therefore, HCC is unable to refund [redacted] ***’s insurance charges Highland Capital Corporation is a reputable finance company for medical practices and refutes the claims alleged by [redacted] *** We do not charge our customers “Sneaky Double Insurance Charges” and our terms and conditions are clearly stated in our finance agreements A “Huge amount of money” has not been added to his principal amount borrowed In addition, HCC, as well as our insurance agent, ALI, has addressed [redacted] ***’s requests HCC proudly serves over 12,customers on a monthly basis with the highest level of service in the industry If you would like further clarification for any of the items above, please let us know Sincerely, Highland Capital Corporation

Ms [redacted] , You have made some allegations which are extremely upsetting to hear Under no circumstances would we ever condone an employee of Spinnaker Resorts to resort to name calling for any reason We expect professionalism and rest assured I will be conducting a full investigation of this matter If you could provide me with a little more specific information it will allow me to finish quickerPlease advise me of the following specific details: 1) what dates and times did you call our offices? 2) what dates and times did our personnel call you? 3) what telephone numbers did you call FROM? (your numbers) 4) what telephone numbers did you call to reach us? 5) do you know the name of the person who allegedly called you a "Deadbeat" ? Complaint [redacted] I am rejecting this response because:90,total borrowed; became 104,total current payoff does not equal %APRthat is triple and not as stated and promised from initial agreement%(rough)so why didn’t HCC just ask to see the busy [redacted] Evidence of Business insurance which He clearly had In full force and effect since Juky 2017.HCC didn’t care to because its not in HCC and [redacted] best interest to care or ask ; just add on charges and then force me to prove,why /how in the year of our lord must HCC still rely on primitive forms of communication XThey have computer no banking? Direct deposit can only be instituted but the lack of communicatio access fails by today’s banking standards: this puts the customer at a disadvantage whenthey need to plead their caseWhy HCC or [redacted] so reluctant to give back hard working [redacted] double insurance chargeswhen fine print was clearly not made apparent to the [redacted] nor the stated opportunity or waring to nor produce evidence would result in double insurance charges.Suppotive of sneaky claim.All communications from bank are on paper statementswithout any abilities to log on and update account in real time.its probably safe to say they their weakness in communication puts the customer at unfair disadvantage Regards, [redacted] **

I have read and researched your complaint. Let me explain the contract
that we have with Interval International and RCI. When we first developed
the timeshare properties on Hilton Head Island the Developer and the HOA
entered into an agreement with RCI which meant that each piece of inventory
sold by the Developer would be affiliated with RCI for trading/exchange
purposes. This inventory was sold with the explicit explanation that RCI
was the sole exchange company affiliated with the timeshare. In
during construction of our newest Resort Bluewater Resort and Marina located on
the intra-coastal waterway on Hilton Head, Island the Developer was
approached by Executives of Interval International (II) who wanted to become
affiliated with the Developer in conjunction with the New Bluewater Project
along with the New Project in Ormond Beach Florida (Royal Floridian South) and
our new Project in Branson Missouri (Palace View Heights).
A business decision was made by the Developer to affiliate with II when selling
the new properties. In 2011, after getting positive feedback from our
existing owners/members who had the memberships with II the Developer started
discussions with II regarding other resorts and their affiliation. Since
the previously sold timeshare inventory was previously affiliated with RCI by
contract, the only way the Developer could enter into a new affiliation
agreement, without the possibility of a breach of the existing contract with RCI,
was to sign an agreement with II which limited the inventory which has II
affiliation to NEW Inventory sold after a certain date. Therefore in December of we started
selling all Inventory which was owned by the Developer.
What you are asking us to do is modify the affiliation which
the inventory had when you purchased it in August of and which was pre -identified as
RCI affiliated inventory and simply make it II affiliated inventory. That could potentially open ourselves up to a
Breach of contract lawsuit and/or open II up to a lawsuit alleging Tortuous Interference with Contractual
Relations Please see the Legal

So you can see, there is no collusion, it is a simple case
of Business. We can only sell you
Developer Inventory , but in order to do that there is a minimum cost for the
sales department of $5,Therefore if there are any upgrade changes or
additions you’d like to make to your existing ownership, now may be the best
time to look at proceeding since there is already a cost associated with any inventory
change

Ms***I think there may be some misunderstanding with what transpired with confirming your vacation package. Our notes from 2/6/reflect the following:2/6/2015: *** ** *** ** *** *** "She thought she had purchased a condo package and wanted to know why it doesn't show. Informed her that what she bought was for the SR Hotel, but to make the gust happy we upgraded her to a condo stay. She will call back to set dates."As a result of the conflicting information in your complaint and our notes, I have asked a representative to contact you today to figure out what happened and how we can resolve this matter. I traveled to Hilton Head earlier this month for a time share presentationFirst, you must report to a visitors' center then travel to your hotelThe agent gave me directions to the Bluewater propertyThe staff at Bluewater informed me that was impossible, only property owners stay thereSo I drove back to the visitors' center and asked numerous questions (also getting names of staff members) before driving to the S.RHotel
The S.RHotel hasn't been updated since the 80sI've truly received better customer service at a Motel 6...how this company remains in business, I have no ideaI could tell right away this was a shady operationI decided to make the best of it, report for the time share presentation since I had already paid nearly $for the vacation package (which is NOT worth it)
I reported to the time share presentation the following morning, arrived minutes early and ended up waiting with everyone else for nearly minutes while the staff meeting that morning ran lateThe property was okay but with other vacation websites wasn't a good dealI informed the sales guy of the problems I had the day before - he wasn't surprised and asked me to be brutally honest during the surveyI completed the survey three weeks laterThis company is awfulIf you see the word - Spinnaker - RUN!!
The gifts promised ended up being a cruise certificate that you must pay $in advance to get additional information and travel dates are limitedThe hotel stay requires a $advance fee then an additional fee to book and stay at the hotelThe $food vouchers were $at a local restaurant in Hilton Head (Stacks - similar to Denny's) and the remaining $are restaurant.com vouchers which I've called three restaurants listed on the website and none of them will honor the vouchersThey did issue a check for $that I immediately cashed at their bank, it wasn't worth the time and effort taking the time off and driving to Hilton HeadNeedless to say, I drove home that night
Spinnaker Resorts is a sham! I didn't read the reviews prior to getting sucked into their ployHopefully, this review and other online statements will prevent others from making the same mistakeHilton Head was a wonderful area but Spinnaker Resorts' shenanigans ruined what might have been a pleasant experience!
Wish I could possibly get my money refundedHopefully, this review prevents others from being taken advantage of! As for the people that work there, shame on you

I am rejecting this response because: after I sent the documentation for the 3rd time, I received another voicemail from *** *** stating that my documentation would be reviewed and processed I do not know if a check was ever sent out or not and *** did not even acknowledge the second part of my complaint in which I asked someone to walk me through the deposit process in a way that I would get two weeks at a resort of our choice for our Bluewater one week deposit as we were promised

Contract *** * ***Our records reflect that you originally purchased a timeshare interval from the Royal Floridian Resort on or about September 27, (Contract #***). You upgraded from that timeshare to a bedroom at the Royal Floridian South Resort on or about December 12,
(Contract #112997). Then on November 25, you upgraded again to a bedroom at the Royal Floridian South Resort but decided to cancel your contract within the state mandated day rescission period. With that rescission you automatically were reverted back to your bedroom unit at the Royal Floridian South Resort. Therefore, this is why you still own the timeshare at Spinnaker Resort's Royal Floridian South Resort. I am not sure what your specific complaint is in regards to as your original statement that you cancelled your timeshare contract but we are still billing you doesn't explain how Spinnaker has done anything wrong at this pointThanks,*** ***
