I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my dispute.The advertisement in the website clearly states "Certified Pre-Owned", which would mean I would purchase the vehicle as CPO with no additional cost ( no addl. costs were mentioned in the advertisement or disclaimers).  And, as per the response, the vehicle went through the certification process, however, the case that the CPO charge $399 is over and above the purchase price seems against the FTC "Truth in Advertising" guidelines.  If 399 is the price that the purchaser needs to pay over and above, that should have been indicated in the advertisement or the adv. should have read "Eligible for CPO" or something similar.  @Revdex.com, can I proceed to log a query with FTC on this practice ?

I am rejecting this response because:This not what they told me and we decided for mmp, they told me bumper to bumper and for 2 years, not...

basic warranty and for only 6 months.The sign on the mpp paper not mine, but on the second paper its mine, they never provided these papers for me, its first time I see it, do you suggest me to have attorney and complain against it through curt? Its not right and I never signed the mmp paper.

We have settled this complaint with Mr. [redacted].

I have spoken to this customer via the telephone to try and explain the TrueCar (Sam's Club) shopping program.  I have included the certificate that the buyer "Saw" prior to arrival and viewed in the system.  If you look,  it clearly shows the "Total Savings" of $9,926 off MSRP...

<--  to get the total number of $9,926 off MSRP it clearly shows the "Certified Dealer MSRP discount of $3,926 less the 2 rebates/bonus cash totaling $6,000.   The $9,926 off MSRP (Not a "Dealer Discount of $9,926 PLUS the rebates) which,  the consumer is trying to deduct the rebates twice ...once on the certificate - and then again once they arrived at the dealership.  The Sam's Club TrueCar certificate again clearly shows the rebates have already been deducted to achieve the $9,926 off MSRP...it cannot be deducted again to achieve "$10,000 off MSRP plus the rebates just as their certificate reflects.  I have included in attachment form what the customer was offered and what was shown to them prior to their arrival to finalize the deal.

The entire time I was working with Mr [redacted], the sales manager approved the deal until I asked for a receipt, this business does not know or understand customer service. Then manager [redacted] stated he would investigate and call me back that was over a month ago with no follow through or call. Nothing may not happen with this business and the level of customer service they provide this should go against them as bad business and poor customer service.

The check was Rejected (Sent Back by the lienholder) we have cut a check directly to Ms. [redacted] today and will place it in the mail ...please let us know if she does not receive it by Thursday 11/16

We will definitely look into the altering the way the CPO is displayed on the website....are you wanting Texas Nissan to "Activate" the CPO coverage?  Please let me know...thank you    JC

Mr. [redacted] has purchased 3 New Vehicles from Texas Nissan and has been a very good customer of ours.  After reviewing the documentation I beleive there could be some possible confusion - Mr. [redacted] only Fianced $44,729, I do not see a figure of $59,000 on any of his purchases from Texas...

Nissan.  We would be happy to sit down and review the paper work with Mr. [redacted] at any time...he has been a repeat cusomer of ours and we would like to retain our relationship with Mr. [redacted].

Ms. [redacted] has been a repeat customer of ours.  I apologize for the inconvenience ....I would reimburse her the $200 she has requested.

Ms. [redacted] ...we do apologize for the frustrating experience.  Online prices are changed from time to tome (daily in some cases) for all kinds of different reasons.  When I pulled your file the actual "Selling Price" was $25,080.  To help prevent any confusion or any deals made...

verbally ....we always refer back to the "Official"  offers made in writing that is signed by both parties after each were able to review.  Even though the contracts are signed with all figures in plain sight I don't want you to feel upset about your purchase.  I don't mind send the price difference of $1,080 (plus 6.25% in sales tax of that amount) back to your lien holder for the difference in pricing.  I am not able to cut a"check" back to the customer, that is considered "rebating" the customer and it's against the terms of the contract.    **

I am rejecting this response because:The lies continue by this dealership, we did NOT receive the Sam's Pricing. If the General Manager will meet with us, we  can clearly show him what [redacted] did to us. He lied. The numbers discussed were not the Sams Pricing, we NEVER met with the Sams point of contact. As stated before, this is beyond the Sam's Club Pricing. The FACT is - the numbers that landed on the contract 7.5 hours later -in the business office with [redacted], were NEVER the numbers agreed upon. [redacted] kept changing the numbers. I have 2 documents that show how he kept changing the price. It is pure INJUSTICE. What explanation is there to keep us there for 8 LONG HOURS with 3 children other than to exhaust us, so that we could just sign and get us out of there.We have been requesting this meeting ongoing now for a month and the General Manager has not confirmed a Friday evening,  when we are available to meet. What does this dealership say about the 2nd key. Hello? Where is our 2nd key, where is the Monroney window sticker, that [redacted] said had been ordered? Hello? The key alone is worth $350.00 not including tax, the fine for the removal of the Monroney sticker is $1,000.00. I have purchased new vehicles before and have always received the Monroney Window sticker.Meeting with the General manager is requested as soon as possible. Prepared to write a refund check, because there is a REFUND due to us.

After researching I discovered we sent he check to the incorrect lienholder...we stopped payment on that check and issued it to the correct Timmons account.  I have uploaded the check and where it was endorsed on the back.  Hopefully this helps!

I have reviewed all of the paper work that was read- looked over -explained and signed off on by the consumer.  The "Sams Club Pricing" (also what was given to the customer prior to their arrival-they had several days to review this certificate before coming in and finalizing their deal)  is 100% what she received at the dealership.  The consumer keeps referring to wanting the "Sam's Club Pricing" and that's what was offered - signed off on in the contracts by the consumer.  We will have to refer back to the numbers on the contract that were approved and signed off on by the consumer and the dealer.  We do not have $7,000 in additional rebates or price....

We apologize for any issues Ms. [redacted] is having.  We did have some issues right after she purchased the vehicle...I did however pay for several thousands of dollars in repairs at no cost to Ms. [redacted].  We did not have the tools to repair her vehicle under her warranty (which did in fact...

cover the issue on the Mazda) and for that issue I paid her deductible that was to be paid for by Ms. [redacted].   All Used Cars are sold AS-IS and that is relayed to the customer.  I have included the "AS-IS No warranty" signed by Ms. [redacted] and the Carfax disclosure.  I would be willing to try and trade Ms. [redacted] out of her current vehicle into a replacement vehicle.  We have in good faith covered repairs that were not to be covered at zero expense to her...and we were glad to do so.  At some point we have to adhere to what was agreed upon and we cannot offer more help financially other than a trade in assistance at Texas Nissan.  We do apologize for the issues she is having.  **
