Review: We were searching for a truck this past summer. We found a truck we were interested at Thrift Auto Sales (Morristown, NJ location, apparently closed now). I believe that their Mountain Lakes, NJ is the same company.

When I called about the truck they told me that they needed a $500 deposit to 'hold' the truck until we could drive to NJ (from Binghamton, NY) to see it. The $500 was charged on 8/14/13 and we drove down to see the truck on 8/16. We did not like the condition of the vehicle and did not buy it. We were told we would be credited back the $500.

We have made numerous calls to them, initially a receptionist took the information during our first few attempts. During my most recent call, last month, I specifically asked for someone in management. I spoke to a 'Tito'. He took the information and asked for our credit card number. We received our December credit card bill and there was still no $500 credit.

My husband called his credit card company and they are pursuing this as well.Desired Settlement: We need the $500 credited back. It has been over 4 months!

I am rejecting this response because:The credit did not occur by an action taking by this company, but rather, our credit card company was able to resolve this. Numerous calls to this company were never returned. The few times that they answered the phone we were promised a credit. It's important to note that this company did not fulfill their obligation, but rather, they were forced by our credit card company.

Review: I purchased a 2010 BMW 528 xdrive and I purchased an extended warranty. When the warranty was needed I called the phone # on the brochure that they provided to me and the warranty confirmed that Thrift Auto Sales did not purchase an extended warranty on my behalf.Desired Settlement: I want the charges for the services rendered on my vehicle to be paid for as well as a refund for the amount that was charged on my contract for a bogus contract.

Business

Response:

I am not sure why this customer is making a false claim. The warranty is active and has been active with Allstate since he purchased it. Please feel free to email me at [email protected] with any other concerns. Thank you

Review: I just purchased a 2004 [redacted] from this company on Friday 9/26/2014 and on Monday 9/29/2014 the car completely shut's off in the middle of the street I put gas in the vehicle amounting to $50 and the gas hand is supposedly working they handed me the car fax saying that everything on the car worked perfectly fine. I called the guy who I dealt with at the dealership his name is [redacted] and he tells me to call a tow truck and have my mechanic look at it because it has to be a stupid reason why the car shut off.Desired Settlement: I either want the car serviced completely or I want my money back because I refuse to deal with shady people.

Business

Response:

We are and would be willing to help the customer if she has any issues with the car despite the fact that the sale of this car and all cars by state law are deemed as is. Please feel free to email me [redacted] and we will attempt to help you in a fair manner. Thank you.

Review: On April 2nd, 2014 I pur[redacted]d a 2012 Mercedes E350 4Matic from [redacted] at Thrift Auto Sales. After a long day of waiting for repair of key marks on the car not previously noted, the Mercedes was received back from your body shop and paperwork was completed. Due to schedule conflicts, I had to quickly depart. As [redacted] and I did an expedited final walk around and quick test drive of the car in your parking lot, we noted a clicking sound coming from the driver’s side rear tire. [redacted] assured me that nothing was wrong with the car and that it had received a thorough inspection prior to my arrival. He said that if anything required attention, the car was covered by a 90-day warranty that was provided by Thrift in addition to the Mercedes warranty. I scheduled the “A Service” for the E350 4Matic. During that service, I asked them to investigate the clicking sound in the rear tire. When investigated, the service technician [redacted]ed that the tire pressure sensor had become dislodged and was moving freely within the wheel. This part had to be replaced for $281.50.

Also, the front license plate bracket was removed from the car prior to my arrival. [redacted] told me that he would send the license plate bracket on Monday, April 28th. I have yet to receive it.

Finally, as part of the Thrift Auto financing process I was required to pay the Missouri sales tax on the pur[redacted]. Believing that this was required and would be handled by Thrift and [redacted] Bank, I paid my Missouri sales tax as part of the transaction. About 2 weeks later, I received a check from Thrift apparently reimbursing me for the sales tax collected and including 2 other charges which I question. It looks as though I was refunded both a $399.00 registration charge and $2,776.33 charge for the sales tax, but a $500 debit was deducted as outstanding balance. I assume that this is the deposit that I also paid via [redacted], so it looks as though I have been charged twice for the deposit.Desired Settlement: I would like the Thrift Warranty to cover the $281.50 for the tire sensor, supply the front license plate bracket, and provide explanation of the charges for the refund check (and likely refund of my twice-paid $500 deposit).

Business

Response:

We have not heard from this customer since the transaction was complete and yes his registration fee and taxes were refunded to him. [redacted] no longer works at Thrift Auto, but if you have anything in writing promising a license plate bracket to be provided and/or a reimbursement for a noise in the tire please email it to [email protected] and we will provide you with what was promised. Thank you.

Response:

I am rejecting this response because:

The business has stated multiple times that they have sent me a reimbursement check, but they have not. I am more than willing to resolve the complaint if the business actually sends a reimbursement check covering my unresolved issues with them to my address that is on file.

The reimburse amount of money has cleared our bank account. Can we please resolve this issue. Thank you.

Review: I purchased a 2008 Hyundai Accent from Thrift Auto on December 23, 2013. I was informed that the vehicle would be delivered by the end of the week following documentation. I called on Friday, Dec 27 and was told the new delivery time would be the morning of Saturday, Dec 28. I called on Saturday morning and was told the vehicle would be delivered in the evening. The vehicle was not delivered, and the new time I was given was Monday morning, upon lack of delivery I called again and was told it would be delivered Monday, Dec 30 by end of the day. There was no delivery. Upon calling again, I was given a delivery time of Tuesday, Dec 31 by noon which was pushed to 1pm. There was no delivery. I called them at 2:30pm, and asked to speak to the manager since my sales representative was not picking up or returning any of the calls made to his office phone or cellphone. I was informed that the manager was not present but that he would return my call. I did not receive a call. I called at 5pm that same day and no one picked up. My voice mails and emails to the sales representative remain unanswered.Desired Settlement: I would like to be refunded for the total amount of $5140 that I paid for the vehicle that I never received.

Response:

This customer has been refunded the money. If there are any other issues please email [redacted]

Thrift Auto Sales Inc. fraudulently induced my wife and I to purchase a used Porsche 911 after Thrift Auto's Import Car Specialist at the Mountain Lakes location, Christopher Phillips:
(1) Lied about the source of an engine light we'd noticed during the course of the test drive - Sales Representative Phillips claimed the light was for an oil change and claimed Thrift Auto had no copy of the Owner's Manual for the Porsche, which we have still not received, and
(2) Lied about the scope of Thrift Auto's warranty, which Sales Representative Phillips and the company's sales manager both claimed would cover any internal issue with the car, preexisting or not.
On the strength of Thrift Auto's lies, we purchased the vehicle, secure in our belief that the law of contract and of conscience would protect us. We bought the car on Friday, July 17, 2015, and brought it to our mechanic the same night.
The mechanic contacted me on Monday to tell me that the Porsche's engine light we'd discovered during the test drive was indeed not a light for an oil change, which any Import Car Specialist must have known, but my wife and I, who were purchasing our first car, did not.
The cost of the oil change I'd asked for because of Sales Representative Phillips's misrepresentation was about $50; the cost of the internal engine repairs that Sales Representative Phillips had purposely lied to me and my wife about in order to get us to buy the car was thousands.
The mechanic also informed me that the Porsche's engine problem was so severe that it could not be driven in the State of New Jersey as it could not pass inspection. However, my mechanic, who also sells motor vehicles, informed me that Thrift Auto could not legally sell me a car that wouldn't pass inspection and he suggested that I contact them about repairing it. He said that he wouldn't repair the car before I spoke to Thrift Auto because he suspected the used car dealership might have an onsite repair service and might not be willing to pay for repairs by an outside mechanic.
Unable to drive the car and unsure who was going to make the repairs or pay for them, I called Thrift Auto's Import Car Specialist shortly 5 p.m. on Monday, July 20, the first workday after we'd purchased the car. He picked up the phone and we spoke for some time that evening about the representations Sales Representative Phillips and his sales manager had made regarding the car's mechanical condition and the company's warranty. Mr. Phillips did not deny he had made these representations and appeared to agree to seek approval of onsite repairs of the Porsche. He told me he would call me back the next day to let me know what Thrift Auto could do by way of correcting his earlier misrepresentation about the car. That was, in fact, the last time I ever spoke to Sales Representative Phillips who neither called nor answered his phone on Tuesday, July 21, or Wednesday, July 22, 2015. It was fitting that the last words he spoke to me were lies.
Over the two days following our conversation, I became increasingly concerned about whether Sales Representative Phillips was proceeding in good faith. But I suspected him more of neglect than outright fraud. Had he and his manager not both promised to fix the car if we purchased their warranty at any time within thirty days of purchasing the vehicle? Sales Representative Phillips had promised to call me back no later than Tuesday, July 21, 2015, and when he did not, I decided to call his manager.
Where Sales Representative Phillips had been evasive, his manager was cruel and abrasive. He told me that if I brought the car back to return it he would have it towed back to my house in South Orange. When I informed him of his employee's fraud he laughed a hard and sneering laugh and told me we had bought the car "as is," which indeed we had on the strength of the managers assertion that the document only confirmed our decision not to purchase the warranty at the time of purchase but that we could do so anytime thereafter.
I am a tax and business lawyer who does not make accusations of fraud lightly. I am fully aware of the harmful stain such allegations may have on a person's business but I am much more concerned about the cavalier attitude toward fraud expressed not only by the employees of Thrift Auto but also the company's managers and its President, Nikita Ouritski, with whom my wife and I are currently engaged in litigation. This website is devoted to the protection of consumers not those engaged in fraudulent business practices and Thrift Auto's "so sue me" attitude is particularly troubling to me.
As a lawyer with a commercial litigation practice and law degrees from the University of Chicago Law School (J.D.) and New York University School of Law (LL.M. Taxation), I have resources that many consumers may not. Most car dealerships forced by New Jersey's Attorney General to acknowledge acts of consumer fraud and pay a settlement of close to $90,000 would not begin defrauding consumers two months later. This one does. In an extraordinary act of brazenness apparently unique to the contracts of Thrift Auto, the BUYERS GUIDE, which each customer must sign, comes with the following warning in bold, capital letters: "IMPORTANT: Spoken promises are difficult to enforce."
Nothing truer was ever written about the practices of Thrift Auto. The same form on which those dark words are written was originally presented to my wife as a temporary waiver of the company's bumper-to-bumper coverage of preexisting conditions, which as we learned later never existed, but which the company now claims waived every right we have under the law.
Thrift Auto's statement that "[s]poken promises are difficult to enforce," appearing as it does atop a company's misslabled waiver of warranties, which are presented to consumers as something other, is not only a misstatement of contract law, it is an abomination. There has never been a rule of law that spoken lies are less disastrous to a contract than written ones. Both render the entire contract unenforceable.
On July 17, 2015, my wife and I exchanged our promises for lies: lies by Christopher Phillips and his sales manager about the mechanical condition of the car; lies about the sales tax owed by us for purchasing the car; lies about the proper state of registration for the car; lies about Thrift Auto's bumper-to-bumper warranty, its coverage of preexisting conditions of the vehicle, and its availability for 30 days after purchase; and lies about whether our waivers concerned repairs that could be had under the company's special bumper-to-bumper warrant, as the sales manager said at the time, rather than waivers of legal rights in general, as Thrift Auto now claims. That's not a contract; it's a farce.
For more than a century judges and jurist have drawn on a classic statement of the damage done by fraud to human intercourse. It reads as follows:
"Fraud vitiates and avoids all human transactions, from the solemn judgment of a court to a private contract. It is as odious and as fatal in a court of law as in a court of equity. It is a thing indefinable by any fixed and arbitrary definition. In its multiform phases and subtle shapes, it baffles definition. It is said, indeed, that it is part of the equity doctrine of fraud not to define it, lest the craft of men should find ways of committing fraud which might evade such a definition. In its most general sense, it embraces all 'acts, omissions, or concealments which involve a breach of legal and equitable duty, trust or confidence justly reposed, and are injurious to another, or by which an undue and unconscientious advantage is taken of another.' A judicial proceeding in rem, while generally binding upon all persons, is no more free from the fatal taint of fraud than a proceeding in personam, or an individual contract. When once shown to exist, it poisons alike the contract of the citizen, the treaty of the diplomat, and the solemn judgment of the court." 26 Williston on Contracts § 69:1 (4th ed.), quoting Smith v. Harrison, 49 Tenn. 230, 2 Heisk. 230, 1871 WL 3494 (1871).
The fatal taint of fraud does indeed pervade this company and the people who work there. On Thursday, July 23, 2015, three days after the company had threatened to tow our car if we tried to return it, my wife and I returned to Thrift Auto's Mountain Lakes location to pick up our title. By that time, we no longer believed Sales Representative Phillips or Thrift Auto planned to honor any of the promises it had made less than a week before. We wanted to pick up our title in person since we suspected after reading the Attorney General's consent order against Thrift Auto where the company had sometimes withheld titles from customers. But I was also scared of the sales manager who had yelled at me on the phone and threatened to tow the car back to South Orange if I exercised my contractual right to reject nonconforming goods, so I decided to openly record the visit. Despite the presence of a tape recorder, I was able to confirm that no such warranty on preexisting vehicle conditions had ever been offered by the company making Thrift Auto's "spoken promises" during our sales contract, in their words, "difficult to enforce."

I have signed 4 different contracts already and still they claim my deal is not done. They have not payed off my previous vehicle but they sold it to someone else. The temporary sticker they gave me on june 22 has been expired since july 12th 2015 and I have no plated or anything for this vehicle something needs to be done asap my credit score has dropped because they have my account with my previous car unpaid since they havent paid it off and when I call I can never speak to someone either they are busy or out of the office I have left several messages and nothing has been done yet.Desired Settlement: I want my previous vehicled paid and off and I want my plates and registration as well as a real deal for my new vehicle

Review: I sent a request by way of UPS to terminate my service contract that I purchased through them for my 2011 [redacted] SV. Per the terms of the contract I was required to send a written request to the dealer to terminate the contract. Also per the contract I had 60 days from effective date of the service contract to cancel the contract and receive a full refund as long as I did not have any claims, which I did not.

Upon multiple attempts to contact the finance manager [redacted] (who is always in a meeting) he refused to honor my request even though the terms of the contract state that if I cancelled the service contract within 60 days of the effective date I am due a full refund.

Thrift Auto has failed to honor the contract they signed and therefore have breached the terms of the contract.

I am attempting to recover the funds that are fraudulently being held by Thrift Auto Sales.

In the event Thrift Auto refuses to issue the refund I will commence legal proceedings against them for 3 times the amount ($5100) as allowable by New Jersey State Law, in addition to legal fees.Desired Settlement: I am requesting to be given my full refund of $1700 as is required of them by the the contract.

Review: Saw car on [redacted]. Needed a 2nd driver to get me there due to no public transportation. 2 hour drive each way, each car. Paid in full. Thrift Auto delivered the car to me with: 1) No gas! 2) Plastic starting dragging from undercarriage of car onto pavement. 3) Check Engine Light came on 3 days later. Usually 3 strikes mean you're out! Wait... there's more. My salesperson is suddenly not available so I ask to speak to a manager. Eventually I spoke to Julio. He tells me to send an email to the General Mgr, David. Immediately I sent David an email. I waited until the next day to call back. After 5 calls and hours of waiting in between on a Friday, David finally gets on the phone at 230 in the afternoon to tell me his mechanics are available between 10am and 2pm Monday - Friday. I explain to him this info was untimely, his evasiveness rude and there was no apology. David refused to apologize and now I'm more than upset. Bad karma is upon this place and this particular business will soon get what it deserves.Desired Settlement: First I would like an apology. Next I would like compensation plus punitive damages for the work I have to incur to rectify this breach of contract. My check engine light is a clear indication my vehicle will not pass my [redacted] inspection. I do not trust this dealership to service my vehicle. Also, an apology first and foremost should be standard practice for this affiliation to all customers who have to call in a complaint.

Review: On May 18, 2015, I purchased a vehicle from Thrift Auto Sales, I financed this vehicle through a private bank, the terms included my tax, title and licensing of the subject vehicle. Thrift Auto Sales failed to complete my titling process within the time of the expiration of the temporary tags and asked I go ahead and double pay for my new tags and I will be reimbursed since the amount was already factored into my loan payments. On July 15, 2015, I finally was given an email address to forward my reimbursement receipts to, for a total of $234.00. I have attempted to contact this business through telephone, email, and their website. To date, I have not received the money owed or any response from their office.Desired Settlement: I would like payment for the double paid amount and for someone to contact me to resolve this matter immediately.

Review: On July 15, 2015 I purchased a 2012 Honda Civic from Thrift Auto. I paid an additional $249 to have the windows etched. It was not done. I have tried repeatedly to call them but no one answers any of the extensions nor do they return my call when I leave a message. They also promised me a bottle of touch-up paint for scratches to the body.Desired Settlement: I want my $249 (plus tax) refunded and the bottle to paint I was promised. Thank you.

Review: I purchased a used 2009 Audi A5 from Thrift Auto Sales in late June this year 2015. It was written in the contract that they would order and repair a part for the headlight. I have called literally several dozen times only to have excuse after excuse. I''ve been told it's on it way, it's on back order, I need to speak with the service manager to get a work order, he was sick this week, and so on. It's almost been 3 months. All the while I still have never received my title and registration for the car which should have been done within a few weeks after the purchase. I get the same run around with the title such as it's on it's way the main title employee is on maternity leave, the new girl is unorganized and behind, I've even been told more than once that it will arrive in the mail with nothing ever arriving. I am very conserned that the vehicle may have been stolen at this point since they have put off getting me the title for 3 months. I know I bought the vehicle as is but there have been several other issues with the car that I will not go into. For the past week they will not even answer their main dealership phone number and no one returns voicemail calls. I believe they may have closed down in which I have no clue what to do about getting the title and I've all but given up on getting the headlight repaired.Desired Settlement: All I really want is for them to follow through with what was agreed upon during the sale of the vehicle or have another location repair the headlight and have Thrift Auto Sales pay for it. It also goes without saying I need the title of the vehicle so I can register the car and comply with state regulations and laws.

Review: I am sure this mail will find you well. I am writing this letter to you with the hope if you can kindly help me with a purchase nightmare I am having by buying a car from Thrift auto sales, mountain lakes. Here is my experience.1. I bought an Audi A4 2006 convertible from this used car dealer on Dec 30th 2014.2. I paid the total cost in cash ($15499 including car cost, repairing cost , 4 years unlimited miles cars protection plus warranty and NJ sales tax) on that day. They promised me to give the car within a week after fixing the issues ( The written and signed "WE OWE YOU" document from them is attached herewith for your reference.3. After that they started playing with me and did not give me the car for 3 months. I have asked for a refund (sent them an email which I have the copy) in January but they never responded. I have a lot of email going back and fourth with the sales man and he was continuously promising me that the car will be ready in 2 days. Finally on 27th of marchevening they suddenly sent the car to my home. 4. Next day morning I saw the car and noticed they did not fix anything in the body of the car as they promised in the we owe you document.5. I contacted them again and they told me to bring the car again to them.6. In this time I have also realized that they took money from me for the warranty but they did not make any warranty with car protection plus. So when I went they told me that they forgot about it and asked me to sign another warranty for back dated March 16th. 7. This time they took the car again to fix all the issues which they promised and told me that the warranty will be activated within 15 days.8. They sent me the car back again after 15 days and nothing has been fixed ( the body has dents, marks, the engine light is on, the front hood has a crack, the passenger seat tilting switch is missing and the right side of the bumper is still damaged).9. They said to me that they will order for the switch (which again is documented through email) and I have to give the car again to fix that along with the others.10. Now last week I have again realized that in spite of asking me to sign on the warranty papers second time on April 9th( back dated March 16th) they still not have activated the warranty.11. I again went to them today asking for keeping their commitments. But every time I go there I get to meet a different person introducing him as either the GM or finance manager and promise me to take care of me. They also tell me the same story that the previous management got fired and they will take care. But nothing happens.12. I moved to the United states 8 months before and I had high expectation about the professionalism of the people here. But this experience has ruined everything. I feel cheated like anything.13. I bought this car for my pregnant wife and I have lost all my self respect in front of her as she could barely drive the car for total of 20 to 30 days out of 6 months. I activated the insurance on Jan 5th and paid the insurance for no reason. I am going through a family issue ( anxiety, frustration, misunderstanding) with my wife because of thrift auto sales.14. Today I went to them again and meet with a gentleman Mr[redacted] who introduced me as the new finance manager. ( by the way just before I met him his colleague [redacted] told me that he is the new General Manager) and I requested him to give me written commitment on when is the warranty get activated and when is he going to fix these remaining issues. He refused to give anything in writing so I left the car and the key with him and picked up a taxi and came back. The car is with them now and I am not going to take it back unless all these issues are fixed and the warranty is activated or I have the refund from them. I have full faith on the law and justice of this great country so I am writing to you. I would rather loose my $15000 but will not be cheated like this.Just to ,etc you know that I have all the text messages and email documented from the beginning with the sales person about asking for refund, fixing issues and letting them know about my family problem. My friends have advised me to contact Revdex.com hoping that you could guide me on what should I do.Thanks a lot in advance for your kind helpDesired Settlement: see Attached document

Review: I was in the market to purchase a used vehicle to replace my main vehicle and was searching through cars.com. I had been monitoring this particular vehicle for a few weeks before committing to the 40 minute drive up to Mountain Lakes to see it in person. A few negative internet reviews of the dealership and its employees had me slightly worried, but the vehicle itself had a clean carfax and was a 1 owner vehicle so I figured at the price it was listed it was still worth looking at. Throughout this period, the vehicle had been listed at $4,995. The morning I decided to drive to the dealership I check again and see the price suddenly jumped by $1,000. I still made the trip to see the vehicle, but was certainly very interested as to the sudden change in price. Upon arriving, finding, and greeting the salesperson ([redacted] in this case as my e-mail correspondence was addressed by him, which I later found to simply be a form letter) my first question was why the overnight change in price. [redacted] immediately informed me the change was due to the fact they just received the vehicle back from repair work, and that it had received a brand new transmission professionally installed by Rose City Transmission that carried a 1 year/unlimited mileage warranty. The window sticker confirmed this as the warranty box was checked with notes to see dealer for details. I figured this indeed justified the cost increase, test drove the vehicle, and eventually wound up purchasing it. I've since come to find there is no new transmission (the transmission fluid in fact needs to be flushed and replaced), Rose city denied doing any work on the vehicle, and informed me they simply sold Thrift Auto parts at cost, but didn't perform any work or carry any warranty on the vehicle. Whatever work may have been done appears to have created additional issues with the vehicle, and I'm presently looking at about $1,500 in repairs to the drive-train that may or may not be covered under a warranty?Desired Settlement: I've been repeatedly calling for over a month trying to get this resolved or find out ANY kind of reliable information regarding what was actually done to the vehicle and whether or not it actually carries a warranty. I've spoken numerous times with the salesperson [redacted], who always seems to need to look into something else and will call me back (never has); and most recently spoke with [redacted] (sp) the general manager, who also informed me he would find out all the details and call me back. Since our one and only conversation, not only has he not called back but I've called numerous times (often multiple per day), left messages on both voice mail and verbally with other staff members, and been /disconnected/hung up on, left on hold, or asked if I'd like to leave additional messages without any return response. I've offered to completely forget about the warranty/lies/everything in return for the $1000 difference to perform the needed repairs. I want at least 1K for repairs.

Thrift Auto Sales has repeatedly attempted to Contact Mr. [redacted], and each time we received no response. We have taken action by calling numerous times, as well as leaving voice mails. Currently we have no other option but to assume the customer does not want to reached.

I am rejecting this response because:That sounds like utter bull, to coin a phrase. I have received no contact from the business ever, and they have had multiple numbers to reach myself and my attorney. In fact any contact with the business prior had to be initiated by me, because whenever I left messages or numbers, I have never been contacted by anyone on behalf of thrift auto. Business is currently in default of lawsuit, I am awaiting judgment against them.

Response:

Our company just spoke to the Customer Mr. [redacted] yesterday, August 19, 2013. We have worked hard to do the best we can to resolve the issue. We have conveyed this to Mr. [redacted]. We are exhausting all options, and if there is anything we can do to help, we will definitely do so.

Response:

Review: [redacted]

I am rejecting this response because:

This is simply a duplicate of the response from the business sent 8/22, as yesterday was obviously not 8/19. I still have not been presented with any options for resolution, nor have been contacted by the business regarding any type of proposed settlement. In fact the last contact of any kind I received from Thrift Auto was by [redacted] on 9/5, simply stating:

"Mr. [redacted],

I do apologize for the delay in response. I have been working earnestly to resolve this case. I currently have management reviewing the case. As soon as our company has made a decision , I will be sure to inform you.

Best Regards,

[redacted]"

At this point in time I have received no further contact from Thrift Auto or any of its representatives, nor have been informed of any type of decision in regards to this case. My attorney is still seeking legal settlement against them.

Review: I seen a vehicle for sale on eBay, however the selling dealership declined offer I put in through eBay. Shortly after end of auction the selling dealer contacted me asking me to purchase the car outside of eBay ( I now know it was to get me out of the eBay vehicle buyback protection program). The car is a 2008 Pontiac Solsctice GXP with only 5700 miles. I was told the car was like new and in show room condition (as you would expect with only 5700 miles). I specifically asked if the car was a flood car or damaged in any way because the car was in New York during hurricane SANDY. I was told there was no damage at all, not a flood car and again that it is in showroom new condition. I purchased the car on the salesman word (his name is Joe), but once the car arrives, the 1st thing I could see from 20feet away was GIGANTIC scratches all over the car. And to make it worse, looks like someone tried sanding out the scratches with sandpaper leaving the exterior of the car with these softball sized scratches surrounded by scratches from sanding around the scratch to try and remove or hide it. The vehicle transporter listed on his manifest the every body panel on the car was heavily scratched and the dealer sighed acknowledging the fact of the scratches before leaving with the car. Car also appears to be a flood car as the car has lots of mud and sand underneath, in engine bay, and inside car. Everything is heavily corroded and very rusted. I have contact the dealer several times. I am always given the runaround, no one will return my phone calls. Every time I ask for a manager they tell me they are gone, or out or on vacation, or some other excuse why they can't come to the phone. This has been going on for weeks now with no one returning my phone calls. I sent emails, and links album of all the damage on the car. And I have not even received a title for the car!!! This is pure fraud!!! I am only 50 miles from Chicago and can't travel to New York to dealer.Desired Settlement: I request that the dealer send their shipper back to come pick up car and give me a 100% refund.

Response:

Our Company has once again reviewed the case Regarding [redacted], and it is our position to inform you that this a case of buyer's remorse. Unfortunately we do not deliver cars from the customer's residence to our company's car lot based on a sudden dislike of a purchase. We have gone above and beyond our contractual agreement in offering a complete detail on the vehicle, to please Mr. [redacted]. We are not in the position to offer any further compensation. We find his request are unreasonable, as he has in fact asked that we transport the vehicle from his residence back to our company's lot. We sell a large number of vehicles and try our best to see to it that each customer leaves our dealership with great satisfaction. Unfortunately it appears that buyer's remorse supersedes all reasonable and equitable offers of compensation.Sincerely,Thrift Auto Sales

Review: Thrift advertised a price of $13,995 for a 2010 [redacted], AT Car ID:[redacted], stock number [redacted] on [redacted]

The Advertisement has a Disclaimer, which states: "Price includes all costs to be paid by a consumer, except for licensing costs, registration fees, and taxes."

When I arrived on September 18th at the dealer to inspect the car, the salesman, [redacted], refused to sell me the car under those terms at the advertised price. He said they would only sell the car if I paid an additional $2,995 for "conditioning", representing a more than 21% increase! [redacted] and/or his boss, [redacted] agreed to lower the so-called conditioning to $1500. Since the deal involved a possible trade-in, I wanted to wait and see if the extra charge could be made up on the trade in allowance, so I took a test drive. [redacted] came along. [redacted] instructed me to make the first two available U-Turns to make the test drive as short as possible. It was only about 1 mile in total. During the test, I noticed a sudden acceleration whenever moving from a stop, and brought it to his attention. He denied there was any problem. After I said this was like nothing I had ever seen in 40 years of driving, he said he would look into it, and I left. He called me a day or two later that the car had been tested and a defect found in the motor mounts. I told him I had automotive engineering skills and had never associated this kind of problem with motor mounts. [redacted] said he had approval the spend the $600 to replace the motor mounts. He called me on Saturday the 27th to tell me the car was fixed and ready for pickup. I came there, did another test drive and found nothing had changed. They wanted to try again, but I asked to see the warrantee which they hadn't shown me before. It would not have covered the likely real causes of the problem, so I would be stuck if I bought it. I asked for my $500 deposit back. They refused. I made another visit to try to resolve. Refused again.Desired Settlement: For settlement purposes only:

A refund of $500, plus $39.28 in mileage for the second wasted trip, and $39.28 in mileage for the third, for a total of $578.56 to be received no later than October 10, 2014.

Response:

We are not looking to hold your deposit, how did you pay it? with a credit card, if so we will refund the credit card. I am sorry you did not come to an agreement on the purchase, but the car is still available and parked on the lot if you are interested in buying it. Thanks,[redacted]

[A default letter is provided here which indicates your acceptance of the business's response. If you wish, you may update it before sending it.]

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me, provided they issue a refund to the credit card I made the deposit on by no later than Friday, October 10, 2014.They should call me at ###-###-#### (cell), the number I gave them previously, so I can remind them of the Credit Card number, etc. I do not wish to purchase the car.

Regards,

Review: I purchased a vehicle with Thrift Auto Sales on 8/24/15. My bank gave me a loan to purchase the car. At the time of the purchase Thrift Auto Sales gave me a temporary registration and plate for 30 days. They said they would call me when my actual real plates arrive. As of today I have not received my plates and I called the DMV and they told me that the dealer had a suspended license when they sold me the car. I go to the dealer and it says that they will be indefinitely closed. I have purchased the vehicle properly and I need my title so I can register it with the DMV.Desired Settlement: Please send me the Title of the vehicle I have purchased so that I can register the car properly.
