reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she has sold the property where her alarm system is, and that she has requested cancellation of her account, but Vivint has made it difficult for her to cancel service. Ms. [redacted] desires a refund of the monies she has paid to Vivint since attempting to cancel, and for her account to be cancelled. Vivint’s records show that Ms. [redacted] signed an agreement with Vivint on May 4, 2007, in which she agreed that service would continue year to year after the initial term of sixty (60) months, unless cancelled in writing no less than 30 days before the next renewal term (APX/Vivint Purchase and Services Agreement, Section 2.4).  A written notice of cancellation was provided by Ms. [redacted] on October 3, 2015, and her account was invoiced for the last month of service on October 1, 2015.  Vivint would like to apologize for any undue delay in the cancellation process.  At this time, Ms. [redacted]’s account has been cancelled, and she has no further obligation to Vivint.  In an effort to assist Ms. [redacted], $[redacted] is being sent back to the credit card on file, to refund the last month’s payment. If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal. Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint Mr. [redacted] states that his sales representative promised to pay off his previous security contract but Vivint has yet to do so. Mr. [redacted] desires Vivint to pay off his previous security contract in the amount of $408.85. Vivint agrees to send a check to Mr. [redacted] in the amount of $250 to cover half the buyout of his previous security contract and has credited his account for two months of service as a gesture of goodwill.  Vivint’s records indicate that Mr. [redacted] entered into his System Purchase and Services Agreement (“Agreement”) on July 23, 2016. Prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-installation survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation survey, and if a customer does not pass the survey, Vivint will not enter into an Agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. During the recorded Pre-Installation survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty-two (42) months and that he would pay a monthly monitoring fee of $44.99 each month during that term. Further, Mr. [redacted] represented that he would be responsible for any cancellation fees from his previous security provider and that Vivint’s representative did not make any promises or commitments that were not written on the Agreement. Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement.             Vivint Account #: [redacted]            Date of Agreement: May 20, 2009            Date of Addendum: September 24, 2013                                                   To Whom It May Concern:   I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond.   In her complaint, Ms. [redacted] explains that after moving into a new home, she had confirmed an appointment with a Vivint representative to have a technician sent out to install Ms. [redacted]’s system. The technician had a four hour window of which he had to arrive at Ms. [redacted]’s home, Ms. [redacted] arrived an hour into that time frame. After waiting almost the full length of the time period for the technician to arrive, Ms. [redacted] called a Vivint representative which informed Ms. [redacted] that the appointment had been cancelled. Ms. [redacted] had attempted to cancel her account with Vivint multiple times, and was eventually sent to collections. Ms. [redacted] desires cancellation of her Agreement and removal of her account from collections.   Vivint has agreed to cancel Ms. [redacted]’s account with Vivint, as well as remove her from collections.   Vivint’s records show that a technician attempted to install Ms. [redacted]’s system on June 10, 2015, but Ms. [redacted] was reported to not be home. Vivint did not hear from Ms. [redacted] in regards to rescheduling an appointment to have a technician install the system. Vivint received a call from Ms. [redacted] on October 20, 2015 requesting to cancel her account. Vivint’s cancellation policy requires customers to send a Notice of Cancellation letter to Vivint 30 days prior to the requested cancellation date, after they have completed the term of their contract. Unfortunately, Ms. [redacted] was still within the term of her contract, therefore Vivint was not obligated to cancel her account. Vivint’s records further show that Ms. [redacted] stopped making her monthly payments after May 11, 2015.  As such, the account was cancelled for non-payment, and was sold to an outside collections agency.   Despite this information, Vivint agrees to the above resolution. September 24, 2012        Date of Addendum: June 23, 2014 To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he  attempted to cancel his account about a year ago, but instead he was offered an extended term in exchange for some free months of service. Mr. [redacted] also states that he has had multiple equipment issues, and that he has not been given any acceptable cancellation options.  He desires cancellation of his agreement without penalty.A representative from Vivint has recently attempted to contact Mr. [redacted] in an effort to resolve these concerns.  At this time, Vivint is willing to waive the extension of Mr. [redacted]’s Agreement and cancel his account at the end of his initial term.  The final payment for the initial term has been processed, and the account will be cancelled as of March 24, 2016.  Vivint’s records show that on September 24, 2012, Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months.  Vivint spoke with Mr. [redacted] regarding his alarm service on June 23, 2014.  Mr. [redacted] represented that he was  interested in extending the term of his agreement in exchange for six (6) free months of service.  Based upon this representation, Vivint offered a forty-two (42) month extension to which Mr. [redacted] agreed.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. Despite the above information, in resolution to this matter, Mr. [redacted] has no further obligation to Vivint.  He may contact Vivint’s representative if he has any further questions or concerns.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal. I am rejecting this response because:  I have a copy of the contract and and it was signed by [redacted] for a total of 42 Months. It does not have anything to do with a MS. [redacted].  if you don't even know my name.  Well, If she signed the contract then she can pay for it??I have tried several times to get help from customer service and they have told me they could help me a little, but then the next correspondence I get is for More money than I agreed to.  I am feeling verymuch like I have been taken. I have been paying for more than a year and things seemed to be okay until I got a notice that my payment didn't go through the bank  Since then I have had nothing but trouble with this company and their customer service.  I tried to explain to customer service  that my financial situation has changed.  I can barely make the Payment that they changed my account to now.  Let alone two months payment if they take it out of the account before the 4th of the month and the bank denies payment because there is no money in it yet.I am on disability and only get so much a month.  I do watch my finances pretty close, but I don't always see everything.  I even called four different times trying to get it settled.  Sincerely,

I did finally receive a response from a Vivint support staff member named Karrie J[redacted].  We agreed that I would finish out my current contract with Vivint which is due to expire on  11-11-15 but I would no longer be held to the verbal contract with Vivint for an additional 60 months due to the fact that Vivint cannot provide support for my security system in a  timely manner.  Ii will advise the Revdex.com if there are any further problems with Vivint since final resolution is a couple of months away.

(“Vivint”) expired and that she was forced to renew the term of her Agreement over the phone. Ms. [redacted] desires cancellation of her Agreement without penalty.At this time, in an effort to resolve this matter, Vivint agrees to cancel Ms. [redacted]’s Agreement, effective immediately.Vivint’s records show that on August 3, 2010, Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months. information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she was misled by a Vivint representative regarding contract terms, and now is unable to cancel her agreement.  Ms. [redacted] desires cancellation of the Agreement without penalty, and for her Vivint system to be removed from her home.A representative from Vivint has recently contacted Ms. [redacted], in an effort to resolve these concerns.  Should Ms. [redacted] wish to cancel her agreement prematurely, her payoff amount would be $2249.50; however, in an effort to assist Ms. [redacted], Vivint is willing to lower her payoff amount by 25%, bringing the total payoff amount to $1687.12.  Alternately, Ms. [redacted] has been offered a credit to her Vivint billing account in the amount of $179.96 (four months of monitoring fee).  Vivint’s records indicate that prior to the installation of any equipment; Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement.      To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he has experienced technical issues with the Vivint application on his mobile device.  Mr. [redacted] further explains that Vivint has been unable to resolve these issues. Mr. [redacted] requests immediate cancellation of his Agreement with no penalty and a refund of all payments made to Vivint. Vivint’s records show that Mr. [redacted] has experienced minor issues with the Vivint application. A technician was sent to Mr. [redacted]’s home on December 13, 2017 to resolve any physical issues with Mr. [redacted]’s equipment. Additionally Vivint provided a work around solution for Mr. [redacted]’s software issue. Records do not indicate that Mr. [redacted] has contacted Vivint support with any issues following that date and he does not specify specific issues he is experience in his complaint. Vivint representatives have attempted to contact Mr. [redacted] in an effort to ascertain the exact nature of the software issues he is experiencing. As the equipment installed in Mr. [redacted]’s home is functioning correctly cancellation without penalty is not warranted at this time.Due to the mobile application issues Mr. [redacted] has experienced Vivint has reduced Mr. [redacted]’s monthly rate by $5.00. the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] alleges that his mother unfortunately passed away and has sent in the necessary documentation to cancel her account but Vivint has continued to withdraw money from his mother’s bank account for the monthly service fee. Unfortunately, I am unable to find the Vivint account in question with the information given by Mr. [redacted].  I would advise Mr. [redacted] to respond with the address of the premise where the alarm system is, or the name of the account holder, so that I may further review the situation.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal.
