The Watson ads appear on job sites on regular basis The advertising does not tell you about the quota system It does not tell you about the "suggested" hours Or how you are an independent contractor It does not tell you that you have to have a "dirt off" in the customers home Does not say door to door to sell a multi thousand dollar vacuum and then try to sell financing Sincerely,*** ***

I did NOT agree to buy or purchase and used vacuum for 1, dollars.The male who came to my home and did a demonstration told me the vacuum was newWhy would I purchase a used vacuum for that amount of moneySecondly I have a warrenty and you have failed to provide my with my paperwork for my warrenty as asked many timesYou fail to even call me when I have left voice mail after voice mail after voice mailThe next step will be a lawsuit and a police reportI've tried working with your company many, many timesMy account is under *** LeeIf you are about your customer at all and answered the phone you would have gotten the name change decades agoEither replace my used vacuum that I was told was new or I will file a lawsuit for failing to provide proper documentation and ignoring the problem

We will be sending a cashiers check for the full amount by Monday October 10th at the latestThe vacuum, however, we are allowed to give something comparableIf she would like a different comparable vacuum she may contact our office

Complaint: ***I am rejecting this response because: This complaint is only addressing a very minuscule part of the issueThere are still questions about the legality the team took when selling us the vacuum and how they gave us the portion of the contract that was crossed out (file provided in .JPEG)The team exaggerated information about our income and length of residence to sell us the vacuum (which is illegal)If you speak with our apartment manager and employers, we have not been living in our residence for the length of time our seller provided to the financial company, nor have we been employed for as long as statedBy all means we should not have been eligible to purchase the vacuumBy word of Watson Productions, the secretary is not allowed to answer phone calls they receive, leaving our complaints prior to the cancellation deadline unheardThrough another reliable source, we heard Watson Productions was told to not solicit apartment residences (which is where I was located when this transaction took place)We still have a recording of the Watson Productions voicemail that speaks of your business hours and how it contradicts with the signs you display in your offices, and we can provide the voicemail recording as a counterargument for our "late cancellation"Though we cannot validate the statement regarding solicitation, though given the business practices shown to us so far, we can assume that it is true due to the practices and the suspicion displayedAll we are asking for is the vacuum to be gone--please, just take it back from usSincerely,*** ***

Complaint: ***I am rejecting this response because: Your message contradicts the words you just saidYour business hours very clearly include Saturday, yet in the voicemail recording, it only states Monday - FridayHow were we to know that Saturday was a business day in that regard? At the time we only had the voicemail to go off of, since no other website listed the business hours as wellWe attempted to contact you multiple times before the deadline date and we heard nothingWhy was the part of the contract we listed still crossed out? I would still like an answer to this as wellWe were not given a description on how to cancel when we received the vacuum, and the section of the contract I uploaded was still crossed outThe salesperson also crossed it out after we signed it, leaving us with no choice but to take itI am under the belief that if someone is going to edit parts of a contract to meet a sales quota, then why not revise said contract altogether? The Kirby product is multifaceted and comes with an extensive warranty from the manufacturer, a rebuilding plan that is in effect for the life of the product sold to the original consumer and a fire replacement plan whereby the product is replaced free of charge in the event the product is destroyed as a result of a house fire.Additionally, a consumer that is aged or older can cancel the sale within one year from the date of purchase and recover all monies paid and if the sale is financed and to have the finance company likewise cancel the contract with monies having been paid refunded to the consumer. Upon any cancellation, the distributor must return any traof a vacuum by the consumer with the same traor one equal to or of better value.All prospective dealers with a distributor are background checked to be certain that they do not pose a danger to the consumer and are to wear identifying badges as to their names and contact information as to the distributor.During orientation and thereafter, dealers are told about consumer protection laws, what constitutes deceptive trade practices and as to the Fair Debt Collection Act and The Consumer Practices Act - both as to Federal and State Laws.I also travel to meet with distributors to proactively advise as to compliance issues as to consumerismAny resulting compliant involving a sale is promptly addresses or the distributor is subjected to disciplinary action by the manufacturer. Once a sale is made a dealer is not paid his/her commission until the buyer's remorse period has expired since otherwise a cancellation will result in the distributor having paid the dealer commission and suffering a loss. It is my understanding that Watson Production is "picking up" the product sold to Ms*** and attached is a copy of my letter to her which I believe is self-explanatory.***Please See Attached***

It appears that the owners brother, that owns a different franchise, had used a contract that had our information preprinted on itI have clarified with the customer and given her the correct information

I never got any namesI might have the first few calls when I cancelled my contractThe first gentleman that answered the phone was wonderful and did give me his name but that was almost a month ago and I don't rememberPast that I got two or three drivers that I corresponded with that never gave me a name, including the driver that picked up the kirbysThe rest of my calls I had to leave messages and was called back while I was busy and not focusedI believe the rest of the calls to the office were with the main office ladyI had to make all of these calls while at work with my boss breathing down my neck to get off the phone

The contract does not state thatI do not know what was said at the time of saleI also do not show that that machine was previously sold to anyoneYou were the first to purchase that machineYou purchased it three days after we purchased it from the factory.? Again, without documentation, we will not be providing a new machine

These products are and always have been sold to consumer end-users by in-home demonstrations done by an independent contractors associated with the distributors of same (e.g., Watson Productions) known as "dealer".?
Distributors seek to associate with persons for those purposes and often advertise for that position in the news media, Craigslist, etc.?
I have reviewed the ads for his position placed by my client and and can find nothing deceptive or misleading with themTherefore, I am at a loss to offer any type of resolution to this amorphous complaint.?
