The hours our business is open does not in any way reflect the cancellation procedure. The business hours on the door are the same as the answering machine. Again, this does not affect any cancellation procedure. The date on the contract and the entire cancellation notice, the only relevant information needed to cancel, is clear, and not crossed out. The only impression that that gives, is that the last day to cancel the contract was the 13th. There is nothing on the contract that is crossed out. The credit application that was signed by the buyer(s) as well as the recorded call to United consumer financial services, was all verified by the buyer(s) at the time of sale. Again, we will not be cancelling this contract.

A check will be sent out today.

We will be sending a cashiers check for the full amount by Monday October 10th at the latest. The vacuum, however, we are allowed to give something comparable. If she would like a different comparable vacuum she may contact our office.

The contract has instructions on the bottom portion of how to cancel as well as the date the cancellation notice must be in writing and delivered to the office by 2/13/16. It is clearly not crossed out. A certified letter was sent out on 2/17/16, however it was returned on march 24th because it was...

"unclaimed". We will not be honoring a late cancellation.

The Watson ads appear on job sites on regular basis.  The advertising does not tell you about the quota system.  It does not tell you about the "suggested" hours.  Or how you are an independent contractor.   It does not tell you that you have to have a "dirt off" in the customers home.   Does not say door to door to sell a multi thousand dollar vacuum and then try to sell financing.  Sincerely,[redacted]

Revdex.com:My spouse spoke to a [redacted] from the office. she now denies this statement about the mail. I have since then filed a police report in regards to the companies missing mail, as I saw the mail man take away my mail on 11/19. I have also sent this police report along with another copy of my cancellation notice certified mail today. I do not want this Kirby vacuum what so ever. I felt very pressured in the sale and the sales guy would not take no as an answer. They also PROMISED me a no hassle return. We have Ms. [redacted] original trade in. We will withhold from donating it for 14 business days. If she would like to schedule the return of the merchandise, she may do so by contacting the office at 360-489-1712 before May 2, 2016.

Mr. [redacted], signed and verified with the finance company, United Consumer Financial Services, a contract for the purchase of a Kirby Avalir System. This contract does not state anywhere on it that a new machine was to be delivered. They had a copy of a separate receipt stating that we would switch...

them out for a new machine within 7-10 business days. We are not in possession of a copy of this document, however, I offered to replace the machine and honor the copy of the agreement that was made between them and the independent contractor that sold them the machine. As stated on the contract, I informed them of the three day cancellation policy and that they couldn't cancel the machine. Ms. [redacted] stated she had called the office a few times the same day, yet did not leave a voicemail. We will not be cancelling out the contract, however, if they would like their machine replaced with a new one, they can still contact our office to do so.

Our apologies. It appears we sent a check out of the wrong account. We will have someone deliver a cashiers check for the full amount owed via cashiers check. They will be calling you to schedule a time. I will also ship out some extra supplies with our sincerest apologies!

Ms. [redacted] sent in her cancellation and it was received on 10/18/16. She was sent conformation via email this morning, 10/19/16 at 9:15 am confirming her cancellation and advising her that someone will contact her to schedule a pick up of the merchandise within 20 days per her contract....

The Kirby product is multifaceted and comes with an extensive warranty from the manufacturer, a rebuilding plan that is in  effect for the life of the product sold to the original consumer and a fire replacement plan whereby the product is replaced...

free of charge in the event the product is destroyed as a result of a house fire.
Additionally, a consumer that is aged 67 or older can cancel the sale within one year from the date of purchase and recover all monies paid and if the sale is financed and to have the finance company likewise cancel the contract with monies having been paid refunded to the consumer. 
Upon any cancellation, the distributor must return any trade-in of a vacuum by the consumer with the same trade-in or one equal to or of better value.
All prospective dealers with a distributor are background checked to be certain that they do not pose a danger to the consumer and are to wear identifying badges as to their names and contact information as to the distributor.
During orientation and thereafter, dealers are told about consumer protection laws, what constitutes deceptive trade practices and as to the Fair Debt Collection Act and The Consumer Practices Act - both as to Federal and State Laws.
I also travel to meet with distributors to proactively advise as to compliance issues as to consumerism. Any resulting compliant involving a sale is promptly addresses or the distributor is subjected to disciplinary action by the manufacturer. 
Once a sale is made a dealer is not paid his/her commission until the buyer's remorse period has expired since otherwise a cancellation will result in the distributor having paid the dealer commission and suffering a loss. 
Ms. [redacted] claims that she canceled the sale and sent in the signed cancellation notice. It would b helpful if you could provide me with an additional details as to who she spoke with at Watson Productions as to claims that someone at Watson Production was having problems with their mail. I am looking into that and will respond to you in the immediate future.

I did NOT agree to buy or purchase and used vacuum for 1, 300.00 dollars.The male who came to my home and did a demonstration told me the vacuum was new. Why would I purchase a used vacuum for that amount of money. Secondly I have a warrenty and you have failed to provide my with my paperwork for my warrenty as asked many times. You fail to even call me when I have left voice mail after voice mail after voice mail. The next step will be a lawsuit and a police report. I've tried working with your company many, many times. My account is under [redacted] Lee. If you are about your customer at all and answered the phone you would have gotten the name change decades ago. Either replace my used vacuum that I was told was new or I will file a lawsuit for failing to provide proper documentation and ignoring the problem.

It says via the contract you have to be told by the sales rep the vacuum was used for demostration purposes or sales. I WAS NOT TOLD THAT. I was told by the male rep he was trying to win a contest and needed to sell a few more vacuums and that this vacuum was not available to the public and only can be bought through door to door sales and it was a new model made for Kirbys such and such birthday to celebrate the years it has made vacuums. I know that sounds familiar because that's the pitch. I didn't take my phone and record the conversation so I'm not sure what your expectations are as far as proof. Besides what you already have. I'm not even asking much. I'm not even asking to cancel.Sincerely,[redacted]

Complaint: [redacted]I am rejecting this response because: This complaint is only addressing a very minuscule part of the issue. There are still questions about the legality the team took when selling us the vacuum and how they gave us the portion of the contract that was crossed out (file provided in .JPEG). The team exaggerated information about our income and length of residence to sell us the vacuum (which is illegal). If you speak with our apartment manager and employers, we have not been living in our residence for the length of time our seller provided to the financial company, nor have we been employed for as long as stated. By all means we should not have been eligible to purchase the vacuum. By word of Watson Productions, the secretary is not allowed to answer phone calls they receive, leaving our complaints prior to the cancellation deadline unheard. Through another reliable source, we heard Watson Productions was told to not solicit apartment residences (which is where I was located when this transaction took place). We still have a recording of the Watson Productions voicemail that speaks of your business hours and how it contradicts with the signs you display in your offices, and we can provide the voicemail recording as a counterargument for our "late cancellation". Though we cannot validate the statement regarding solicitation, though given the business practices shown to us so far, we can assume that it is true due to the practices and the suspicion displayed. All we are asking for is the vacuum to be gone--please, just take it back from us. Sincerely,[redacted]
