Refusal to give me options and pay full amount in vehicle accident.
I got in an accident and Windhaven insurance totalled my car, even when the damages were only about 40% of the value of the vehicle and took over 2 months to prosess my insurance claim, they also refused to give me options within my claim. I have full coverage insurance with Windhaven Insurance and they refused to pay the full value of my car (Texas State Law). They paid $21,000 on a $26,000 car. (New 2019 Mazda 3) they are also extremely rude and difficult to contact, and their answering machines are broken loops, designed to avoid real phone calls.

Desired Outcome

I want this criminal organization to go under investigation, I want this false financial institution to pay the full value of my vehicle as per Texas state law. And I want a refund because this has been an extremely painful and stressful experience with little to no action or response on their behalf.

They didn't even address the fact that they are quite literally near impossible to contact. Their answering machines are broken loops that hang up on you and just repeat themselves, and when you do get transferred, you just get put on an infinite hold. They didn't pay the full value of the vehicle (Texas state Law) and when they did decide to pay, it was done late to the agreement with the bank. It took them a total of 52 days to do so. They are also extremely rude and condescending to their policy holders. When I requested to dispute the total loss of the vehicle, they completely dismissed my request even when I had an accurate appraisal done on the vehicle that said it was clearly not a total loss. Obviously they did that for their own financial interests/gain. If you ***'t believe me just Google the company and see the endless angry reviews. It is also the Law that an insurance company should operate in good faith of the policyholders, and these criminals definitely haven't done that. This criminal organization should not still be around today. side note I recently received contact from the other party involved in the total they they weew never contacted by my insurance even though I gave tbem the information to do so and the other can't get a hold of them either, big surprise.

The settlement offer was consistant with the fair market value on a 2019 Mazda 3. Our responsibilities are to pay the fair market retail value and we have fulfilled our obligations with the consumer. The lienholder on the vehicle agreed and accepted our offer. It appears the consumer is asking for the purchase price of the vehicle and unfortunately the fair retail market value on a used Mazda 3 is nowhere near what the consumer paid or asking for the vehicle.At this time we consider this matter closed.

They are completely avoiding the other numerous Injustices and focusing only on the amount paid when they still haven't contacted the other party involved in the accident and have not addressed their rude condescending staff, or their broken answering machines, or not allowing options to their policy holders in the event of an accident, and not explaining the logic behind totaling a car with 35 to 40% cost to value ratio on the car. This is quite literally a criminal organization and they should be closed down for their negligence and unprofessionalism and their disregard for their policy holders.

I was run into by a windhaven client on January 10th 2020. They will not call me back and no response to my claim.
I was run into by a windhaven client on January 10th this year. I filed a claim on the 11th and was told I would hear back from them asap. On the 13th a claim appraiser came to look at my vehicle and write an estimate and told me my adjuster would contact me within one hour. That was over a week ago and I have made 6 phone calls to their company office with no return calls. Claims adjuster is never there and no one else apparently cares to actually move the claim forward. There can be no question as to fault as I had a dash cam running and even sent them a copy of the recording clearly showing their client coming into my lane and running into me.

I want my claim processed and money for the damages their client caused to be paid.

What I received was an estimate using non OEM parts on a 2017 Truck with an MSRP of &67k new. There is zero doubt this accident is 100% the fault of your client. I expect to be made whole, the value of my truck will take a hit of as much as $2,500 when the accident populates on the carfax and the use of non OEM parts (low quality) is not acceptable. I expect my truck fixed correctly and to be compensated for the depretian value caused by your client.

We followed up with the consumer who indicated at first, that they repaired their vehicle out of pocket and out of scope of our estimate using OEM (New) parts on their 2017 vehicle and were seeking reimbursement for the difference. The insurance terminology of betterment was explained to the consumer and that we would not owe for those 'wear and tear' parts prior to the accident.

The consumer indicated they had traded in the vehicle in question for a new vehicle after they had the damages repaired. They then announced that their 2017 repaired vehicle was worth less when they traded, for their new replacement vehicle, due to this accident, and requested to be compensated for the diminished difference.

We congratulated the consumer on their new purchase and requested they send us the purchase agreement showing the trade of their 2017 vehicle for their newly purchased vehicle.

Instructions and process on submitting a claim for diminished value have been communicated to the consumer both verbally and in writing via email.

To date, the consumer has not provided any of the requested supporting documentation.

The insurance company I found is currently under receivership because of it's common bad practices. As of February 5th this year all it's policies were canceled and the company was moved into liquidation. The amount I received was for sub standard parts, the value of my Truck is diminished and they tell me it's my job to prove the value is diminished. It is beyond belief that any company that is in the automotive business in any respect doesn't admit that anytime a carfax shows an accident the value of the vehicle is greatly diminished. In the end this accident cost me almost $18k as after I fixed the truck I traded it in. To say I'm disappointed in the treatment, response and results from this company is beyond belief. It is clear why they are no longer solvent.

Still haven't received a check due to damages done by a windhaven customer and the representative are very nasty saying I must contact someone else because of a freeze which has nothing to do with me I need my check for the damages to my car which is a total loss since September 2019 over 5 months plus I need interest

I have been corresponding with *** failing to pay for services rendered.
I had additional parts and calibrations needed on a repair, the supervisor had approved said items and advised me to provide him with an invoice for these parts and calibrations and he would pay. I have a copy of the communication between us to prove that this money is owed. I released the car to owner in good faith and have yet to receive the money owed despite numerous conversations and messages over a year ago with Israel Aguilar and have yet to receive a dime.

I wish to receive payment for services rendered.

This insurance company isn't helpful! I was hit by one of their drivers. They accepted 100% liability on my claim and told me my car was completely totaled. The adjuster called me on Dec. 19th, I have called them almost everyday since, and they have yet to call me back or take my calls! I have even called the supervisor and she has yet to call me back! Their business sense is horrible. I would not recommend this insurance company to anyone or doing business with them!

I did not pay for February because the company is out of business. The fact they wrote a policy knowing they could not fullfil the contract should be considered a criminal act.

As we mentioned in our response of 1/20/20, Mr. has insurance coverage until 2/5/20, the cancellation of his policy because the company no longer writes in the State of Florida will take effect on 2/5/20, we have no refund to send to Mr. because his policy is still active until 2/5/20 and the only premium that we have received was the down payment made on 12/18/19.

Windhaven was fully aware when they took my down payment and finance charges they they would not be able to honor the contract.
They have not just stopped writing in Florida they were shut down for failing to pay claims.
Forcing me to refinance with another company.
Had I not been informed before my next payment they had been shut down they fully intended to take more money from me.

Immoral and criminal.

If I could give this insurance company zero stars, I would. My husband and I had been using this insurance company for only a few months before they canceled our policy, without notice, due to a $32 "endorsement payment" that was not made, that was put on our account without notice, and was supposed to be due on Christmas day. When I asked them what they payment was for, I was told 3 different things that it could have been for, so they don't even know. Mind you, we had paid our insurance for the month of December and they canceled our policy 3 days after the endorsement payment was not made AND the endorsement payment was nowhere on our original payment schedule. Even though our payment for the month of December was supposed to cover us until January, they canceled at the end of December. They didn't even send us a notification that our policy had been canceled, I found out when I attempted to get my license in the state that we moved to that I had been driving without insurance for 5 days. When I called to get it resolved, they said there was no way to reactivate the account and that I would have to start a new policy and pay a new $500 down payment. I even tried to log into our account to see our documents and they are denying us access to see any documents. To continue, they attempted to change our payment amounts on our pay schedule without notice but luckily, we were able to download the documents prior to this situation to see the changes they made with no consent or notification. DO NOT, I REPEAT DO NOT GET INSURED WITH THEM. After seeing all of these other reviews, I am surprised they are still in business. But clearly they are getting away with stealing money from their customers!

We would like to respond to the complaint but unfortunately a policy number was not provided and I do not find a policy for *** as the named insured. Generally, for any change made to a policy, a Declaration page outlining the change and a revised payment schedule is sent to the insured via email or physical mail, whichever method the insured selected. Also, when a policy is set up for cancellation a Notice of Cancellation is mailed out.

Please provide the policy number or named insured on the policy so that we may review and accurately respond.

I'm still yet to receive my claims check simple you accept the claim send me the check to get fixed but instead they accepted it. I get my car fixed pay for it out my pocket and still yet to receive my CHECK from them.

Withholding my settlement
On oct XX XXXX my car was stolen right outside my residence a 2019 dodge durango I called the police and ins right away after waiting several days I finally received a call from my appointed adjuster glendora Matthews extension 8154 which tells me she will be out of the office til the following week to set up the recorded statement on the day she said she will call she didnt she called the following day no biggie I was just eager to get the process started I sent everything she asked for and answered all her questions I asked if I had rental car coverage but she said she will get back to me which she never did and it turns out I do not so I have been paying out of pocket for rentals but no problem again I just want the process to keep going and get the matter resolved after a while from not hearing from her I called to at least confirm she received the documents she was very rude and quick with me said yes they're attached but she is working on other cases I have to wait I said sure no problem I just wanted to confirm your not missing any paper work and she dismissed me quickly saying she'll get back to me which she never did again. Fast forward to dec 16 I finally hear from her but she tells me she
Is ready to settle my claim but I can't and I can't tell you why but you are free to figure it out but doesnt give me any info as to who or where can I call she just leaves me in limbo. I contact my insurance agent which gives me some sort of guidance so I called mrs Matthews at her ext 8154 and she got really defensive and nasty with me saying I was given the wrong info but she still swears she doesnt have any info she kept back and fourth being aggressive I had to tell her can you please get past that I needed to speak with her she finally let me speak I just need my case resolved I am still a paying customer from many years I have never defaulted or been late on any payment I am still trying to do everything properly and paying my loan as well but I have a newborn I had to replace her carseat and stroller I cannot keep affording renting a car and still paying for a loan when I am paying a policy that's in place with coverage she yells out "what do you want from me" I just need my case resolved and she then tells me she cannot give me that! My issue is why if I am paying for that service she she refuses to tell me anything my partner also called to try to get any info from her but again she got really aggresive with him and as soon as he asks for a supervisor she hangs up. We have been more than patient and cooperative done every thing the proper way I just need my case settled so I can move on from this nightmare

Yes they advised me that they simply cannot pay my claim however the petition didnt get granted by the dept of financial services until dec 18 so why would my adjuster hold it on dec 16 when they were still obligated to pay yes the grant was retroactive as of dec 9 but they paid out a claim on dec 12 and the 16 was 2 days before they were granted their petition! I'm sure there is records of that call.I still believe my adjuster unfairly and without reason didnt pay out my claim on dec 16 when I have been paying monthly for over 5 years a policy that now I basically cannot use!!

I followed up 4 times and no answer. She calls me this morning to tell me she hasn't received the documentation in the mail. How ironic! She hung up on me after I proceeded to tell her she was intentionally holding back my claim without any legal rights. I have never in the years of working with corporate companies dealt with such a rude individual lacking sense of urgency and empathy for another individual! She has disregarded me as a paying customer ( I'm still paying for the stolen car's insurance), as a person and my sense of urgency in this matter. I will seek legal representation.

All my required and requested documentation have been sent over a month ago, including the Power of Attorney requested two weeks ago to release the claim payment. Please release the claim payment to me as required by state law.

This issue is with our car that got damage by one of their insurer, it's been two months awaiting on them to take care of this claim.
oct 4th 2019 one of their insurer crash into our car causing bodily injury and damage,after my first call with *** she told me over the phone that they only had 11,000.00 total to cover both cars ours and the car infront being a vw beetle that got hit from the impact. the vw had bumper damage and our car had damage to the front and rear. after a month they send me to a place for a photo inspection that was over a hours drive from me and I did, after calling them and leaving messages they called 1 1/2 week later. now *** said our car would be repaired first because our car had the most damage then the vw. another person by the name of shake Williams called me and told me that she was handling the claim now and that they were sending me a check for 3,671.78 and to take my car to a body shop for repair of my choice. I told her that it wasn't enough to cover the cost because judging by what I see it's gonna be a lot more then that check they send me. she said not to worry that the body shop could let them know of any other cost and that they would send someone to the body shop to take a look and take photos of the others damages they found. once again the manager reached out to me because they haven't responded,and it's been 1 1/2 weeks, when I stepped in and called after three of four attemps spoke with Shakeya Williams she then informed me that she was no longer handling my claim and that it was now Rachel Ponce I asked is her new of anything and she said she was gonna take a look at her computer and that is when she informed me that my car was totaled. I asked her why didn't anyone informed me or the repair shop she had no answer but that she would connect me to ***'s extension. once again not response left a voice mail after another week go's by she calls and the first thing she said is that I have to contact my insurance to cover the cost of the repair. let me tell you I got so heated and told her that my insurance was not going to cover the cost and that they had to pay for the total lost of the car. one thing they didn't know that iv'e been in contact with the other party involved and they informed me that their car was repaired at a cost of 2,500.00 and I asked her why was I told that our car would be repaired first by *** and she had no answer. before that she told me that she reached out to the body shop and basically told them that same thing she told me about my insurance comp. anyway she told me that she was going to run some numbers and get back with me, this was Monday dec 2nd 2019. it's Tuesday evening I called around 2pm left her a voice message and send her a email and once again no response.now I turn to Revdex.com for help this has dragged to long and it's costing me a rental fee that is above 900.00 now and afraid that they are not gonna cover that as well. i'm at a total lost I don't earn a lot and we only have one car to get around no money to purchase another car. these people are so hard to deal with don't ever answer the calls to them, always a answering machine with a few return calls and never a positive answer. to me and other it looks like they are just trying not to pay anything or the bare amount.

My car was totaled by their insured and they won't pay me my cars worth and won't call me or email me back. It has been 9 weeks since the wreck.
On October 2 one of their insured hit my car in the rear and totaled it. I have called and emailed them numerous times and they will not respond. Finally I spoke to a supervisor and he was extremely rude and only offered me 4300 for my car. That is below what they are going for in my area. He won't listen to me and wants to argue about the price and will not give me a number to his boss or let me speak to someone else. He told me I can only speak to him. I sent him via email several comps to similar cars. I have called them And sent emails every day for 8 weeks. Meanwhile I do not have a car.

I want them to give me what my car is worth and what they are going for in my area so I can replace my car and in a timely manner since it has been two months

Involved in 3 car accident there client deemed at Fault.
On 4/19 was involved in 3 car accident with there client who was deemed at fault.Ive sent the requirements needed twice and still no justification they owe me for my car and rental car reimbursement they have been ignoring my calls, emails.I spoke to *** once and she promised that I would receive money owed to me still nothing, I'm very disappointed in this company it's been 7months of the runaround I just want what due to me.

On easter sunday my life was changes forever. A single mother of three my vehicle was stolen from me at a gas station by a violent criminal on the run. Windhaven insurance was horrible from the very beginning I was given a very rude lady as my claim manager she would ask me a question but when I go to answer she cut me off saying just yes or no. She told me.from the start she wasn't answering any questions for me! I carry full coverage insurance so I am covering for a stolen vehicle and yet this crooked company still refuses to pay my claim after they guaranteed me payment for a rental car yet I paid for that out of pocket. Now here I am without a car a way to work amd raising 3 kids on my own we lost the only means of transportation we had all because this company. The car thief was caught arrested and charged for the crime! They have all the evidence they need and more to see that I should have gotten paid for my claim! Stay away from this company go elsewhere! *** is the worst customer service representative I have ever encountered in my entire life with no desire to even listen to the customer. Please dont give this company your money! I am owed $10,000 and I want my money so I can provide for my.children. I was simply trying to support my kids on my.own after leaving an abusive relationship I was in college, my car gets stolen and this horrible insurance company saw me as a single defenseless woman and took me for everything I had!

I am owed payment from rental car and payment in the entire claim settlement for my vehicle lost. I am owed minimum $10,000 I will take and go my way! I paid for full coverage insurance for emergencies like this I am owed the amount I lost for my vehicle paying out of pocket for a rental I should be paid back for having to quit school and loose my job because of transportation this company should be glad to only pay me 10,000$ because I think all the emotional damage and life change they caused on me and my children is way more than enough for a lawsuit! One letter received 2 weeks after the accident with their policy holder. No returned phone calls to me or my insurance provider
I was hit from behind while at a ref light by a policyholder of Windhaven on 9/21/19. As of 10/30/19, Windhaven has not acknowledged liability. I have had to pay out of pocket for rentals and medical bills. They ***'t return calls or emails.

Desired Outcome

Contact for reimbursement of car rentals. Has caused a significant amount of frustration, worry, and financial depletion

Thank you for the opportunity to address this matter. The claimant is represented by an attorney. All correspondence is being attempted to her attorney on her behalf. We have received contact from her insurance carrier and will be in touch to handle that portion of the claim directly with them. They are more than one claimant involved in this accident and damages will have to be apportioned once all demands have been received.

CFLXXXXXXXX Windhaven is refusing to total an unsafe vehicle because they have exceeded the ACV in repairs.
My car has been in the shop since August of this year because of extensive damage from a car accident. I filed and insurance claim on August 16th due to an accident. I have been told twice that the car would be totaled. I even received and email last week from my adjuster stating that there had been some miscommunication with the appraiser and the person at Windhaven with repair estimates and that the appraiser supervisor agreed the car should be totaled. My main issue is I have a body shop who has been in business over 20 years to tell me even with the repairs Windhaven requested be made the vehicle is not safe to drive. Because Windhaven has went over the ACV they have now come back and said they will not total the car even after being told it still will not be safe to drive. I feel no company should be willing to put a person's life at risk in an unsafe vehicle after been told by the body shop that is working on the vehicle that it is not safe. Not to mention the vehicle has motor issues from the accident that no one from Windhaven has even addressed.

Desired Outcome

I would like Windhaven to total this vehicle like they should have from the beginning. The body shop cannot guarantee by safety in this vehicle which means Windhaven can't either.

*** says hes the most knowledgeable adjuster which is completely false I file a claim he put me under investigation like im a criminal when im a tax paying citizen pay my bills on time every month I have went thru his interrogation passed *** all off a sudden he going on vacation when my car is sitting at the repair shop which been there since the 20 of last month at a storage rate of 25 dollars a day in which *** low balling me on the repair estimates benifits inside the policy he;s not informing me about

What a terrible company. I was struck by one of their clients who made an illegal left turn from the right lane. I filed my claim the next morning (their office was closed the night of). Extremely poor communication with their victims. I have had to basically go broke paying for a rental car while they take their time working my account. They claim they offer reimbursement at the end, but it is costing me so much money to keep this rental. Absolutely awful. They had an initial appraisal on my car of roughly $4,300 (give or take) and when the shop sent their supplement there was a difference of $1,700. They claimed this as a total loss. Their loss department has given me no answers yet. I am beyond frustrated they act like they don't care about anyone or the inconveniences their company puts upon the people their clients have victimized is insane. There is no sense of care. They just don't want to pay anything and take as little responsibility as they can. This company should have red flags ALL OVER IT.

On September 30,2019 I requested to terminate my policy. They still pulled money out of my account on the 4th of October 2019. In the amount of 147.
My policy number is for windhaven is WIN01574222-06. On September 30,2019 I requested to terminate my policy. They still pulled money out of my account on the 4th of October 2019. In the amount of 147.87. I called today 3 weeks later and my policy had not been canceled still and they still have not started the refund. I sent out the declaration page from my new insurance which was on October 30, 2019. I would really like my money back in a week it will be one month since I tried to cancel the policy. Attached is declaration page for my new insurance. Also attached is the cancellation request dated.

Desired Outcome

My refund for 147.87 as soon as Possible
