I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.First, the response does not address the fact that my card was charged before the matter was resolvedMy card was charged even after I have contacted ebth twice about the issue above and before I heard any concrete response from ebthI view this a evidence that the outcome was long determined before the matter was really investigateI suggested potentially bug due to client sessions crossI do notice ebth made some improvement for their siteTheir site is far from bug freeAdditionally regarding shipping, I stand my viewFirst, because it is user sessionusers' address is storedso the the shipping can be calculated by the stored addressInstead you have to navigate and wait for the shipping quote request to come backWhether the design is driven the customer to tried to pay less attention to the shipping cost by putting a obstacle to get the shipping info instead shipping when viewing the items at the list pageEbth has charged regularly double or more shipping charge than through regular shipperIf they do want generate additional revenue through this methodIt should state very clearly to their customers.

Thank you for the opportunity to respond to these concerns. Ms*** bought items, all
Swarovski figurines, from a Southwest Florida sale for a total of $According to our terms and conditions, “All sales are subject to appropriate state sales and use tax laws,” so Ms*** is legally required to pay sales tax in her state of New YorkThe sales tax for this invoice was $ When Ms*** reached out to our customer service department, she requested a shipping quote for a single item, which she was givenNo quotes were generated for her shipping zip code of for any other items Ms*** purchased. These items originated in Southwest Florida and were processed from our distribution center in Cincinnati, OHAs each item was photographed and assessed, it was packaged in a box, ready for shipmentAs such, we are unable to combine shipping on these itemsWhen Ms*** called to ask for shipping to be combined, the customer service specialist with whom she spoke agreed to check to be sureEach item ships from Cincinnati to Tonawanda, NY for an average of $The combined shipping cost of all items purchased is $498.51. The total amount of Ms***’s invoice is $She has paid $and we applied a $gift card as a courtesy to help offset the shipping costHer re***ing owed balance is $ We are unable to discount shipping any further, as all of our shipping information is available on an item page during the duration of the item saleNo shipping quotes were generated for these items to Ms***’s zip codeAdditionally, we are unable to waive the sales tax, without the appropriate tax exemption documentation required by law, per state law. If Ms*** does not wish to pay shipping, she is able to forfeit her itemsIn a forfeiture, she is responsible only for the item price and sales tax as well as a disposal feeIn this instance, the disposal fee would be $50, making her final total $3943.40. The items will be shipped to Ms*** upon her final settlement of the invoice Thank you for your consideration, EBTH

Thank you for the opportunity to further respond to these concerns. We have refunded the Terra Cotta ceramicIt will not be charged againMs*** can no longer see it on her account We reviewed the *** clown jar and the restoration estimateBased on that, we agreed with Ms***’s assessment of misrepresentation was accurateShe has been refunded the remaining $320.64. Ms*** worked with our shipping team for a full refund on the broken dragon jar. Ms***’s experience has been atypical of the EBTH experienceWe would like to extend our most sincere apologies to herWe are working hard to ensure things like this do not happen. Thank you for your consideration. EBTH

Thank you for the opportunity to respond to these concerns.Per our standard policy, “Shipping estimates are subject to daily carrier updates regarding the price of postageThe price may also change based on insurance, typically 3% of the item value or the current high bidAs the item climbs in value, the shipping prices may also begin to increase.” Based on this calculation, insurance would have been $on an item value of $He was instead charged $for the same coverage, a discount we were able to offer as a result of our business relationship with ***. Mr***’s final total with the next day air shipping was $267.42, with $in transit, $in packing, and $in insuranceThis is a difference of $Instead of charging Mr*** the additional cost, we absorbed it as a courtesy. While we value Mr***’s business and recognize that he is a frequent customer, we will not be reinstating his account based on his continued refusal to work with EBTH within the parameters set forth by our terms and conditions. We consider this matter resolved. Thank you for your consideration,EBTH

Thank you for the opportunity to respond to these concerns. Ms*** purchased a 14K Yellow Gold and Platinum Blue Star Sapphire and Diamond Ring on 3/for $451, invoice ***With shipping and tax, her final total is $The star sapphire at the center of the ring was a synthetic
sapphire, as we noted in the description. Ms*** called after placing the winning bid to retract that bid, which is not something we typically doShe said that she bid on the item after reading the title but she did not read the descriptionThe description notated that the stone was a synthetic stone, which she acknowledged in her initial phone call. When she won the bid, she called to inform us that she was not interested in the piece as she felt it had been misrepresentedAgain, she noted that it was a synthetic stone, but that the title did not read “Synthetic.” Repeatedly while talking about the ring, she called it a “fake piece of jewelry.”We consulted with our gemology department, who confirmed that this piece was represented accuratelyAdditionally, they clarified that the sapphire in this piece is a genuine sapphire which shares the same properties as a natural sapphireWhen a sapphire is “synthetic,” that means it has been grown in a lab environment over a short period of timeA “natural” sapphire is grown in rocks over a significantly longer period of timeBoth types of sapphires are genuine sapphires. The word “synthetic” was not listed in the title because there were several other descriptive items we included insteadWe included it in the listing and Ms*** acknowledged having read that. We cannot issue Ms*** a refund for this pieceShipping has been booked and it will be sent to her soon. Thank you for your consideration,EBTH

***,We are sorry that the firearm did not work, but in cases such as this where we state "untested" on an item, the item is sold "as is" per our terms and conditions Firearms present unique challenges in that we are not able to fire the weapon any more than you are at the property
In listing an item as "untested", it devalues the item from a bid perspective and is only done in cases where we know the item cannot be tested at the home properly or get affirmation from the previous owner This stated condition is not a preferred state from our position or the seller's, but is necessary in cases such as these We encourage you to watch stated conditions and in cases where we do not disclose properly, EBTH will stand behind our cataloging Thanks for bidding with EBTH and we hope this does not discourage you from future purchases. The EBTH Team

Thank you for the opportunity to respond to these concerns. Mr *** purchased a *** *** from EBTH for $on 6/30, invoice ***It was available to be picked up on 7/5.Mr*** arrived an hour before the scheduled pickup time to pick the car upAt the pickup, he was
offered the vehicle title and the power of attorney formAccording to the seller and staff on site, Mr*** stated that he did not need the POA formHe was told that, if he does need it, we would email it to him as soon as possible. In the afternoon of 7/6, Mr *** placed several calls to our customer service department stating the he did need the POA formThe management in the market was notified and he was sent the POA form by approximately 5:pm, local timeOn the morning of 7/7, he confirmed with the team in *** that the paperwork they sent to him was appropriate and that he would be register the vehicle in Florida. We apologize for the confusion regarding this paperwork. Thank you for your consideration, EBTH

Thank you for the opportunity to respond to these concerns. Mr*** purchased items for $on 6/13, invoice B-***With $in sales tax and $in shipping, his final total was $167.60.The pieces purchased by Mr*** were housed at our Blue Ash distribution centerThey
were only available to be shipped and would have only shown a fulfillment option of shipping during their time on EBTHEach item was checked in preparation for this response, and none were found to have an available pickup option. Mr*** authorized EBTH to charge his card on file automatically in agreeing to our terms and conditions prior to creating his account Per the terms and conditions, “In the event that you fail to pick up or designate shipping for your terms in accordance with the EBTH terms and conditions, you hereby authorize EBTH to charge your credit card for the purchase amount of the item plus any taxes, shipping costs, and handling fees.” Because Mr*** did not select shipping on his own, he was automatically charged to the default card on fileWe cannot refund the shipping costs, as these were clearly marked as the only option for fulfillment for these piecesWe are unable to ship the pieces for free. Mr***’s pieces have begun to ship and he should receive them in the next week or so. Thank you for your consideration,EBTH

Thank you for the opportunity to respond to these concerns.Mr*** purchased a lot of toy trains for $from a Baltimore market sale on 2/In some markets, items are removed from the market and taken to our distribution center in Cincinnati, OH, which is what happened in this particular sale
In these sales, the physical item location is listed on each individual item page as well as the fulfillment optionsThe toy trains were available for pickup from our Cincinnati location. Mr*** called on 2/to inform us we had made a mistake in the item pickup locationWe let him know that the pickup would have shown as the Cincinnati distribution center for the entire duration of time that the sale was live. On 2/27, we attempted to charge Mr*** $134.28, the full balance of the invoice including taxes and shipping, twiceThe charge failed both timesOn 2/28, a $gift card was applied to Mr***’s invoiceWe attempted to charge him $on 3/1, 3/2, and 3/On 3/3, we left a message for Mr*** that we needed payment for the item and shippingWe tried charging again on 3/4, 3/5, 3/and 3/We attempted to collect payment for the item and shipping nine total times, with all nine attempts being declined. On 3/23, we considered the item forfeit for nonpaymentWe attempted a final charge for $93.79, the item price and tax and it went throughThe item was forfeit at this point because it had exceeded the day payment window set forth by our terms and conditionsPer our terms, “Any items not paid for in accordance with the EBTH Terms and Conditions within seven (7) days of the sale closing (or upon a later applicable payment due date as may be provided herein) will be forfeited by you and EBTH may, in its sole and absolute discretion, resell or dispose of the items as well as donate the items to a charity of EBTH’s choosingEBTH reserves the right to charge any payment option you have on file and/or to report your account to collections for the combined total of the original invoice amount and any moving or disposal charges and you will be responsible for any charges incurred by EBTH in collecting your payment.” The trains were designated for resale. That same day, prior to filing this complaint with the Revdex.com, Mr*** emailed us inquiring about when his items would be shippedWhen this complaint was received, our customer service team had already started working with the distribution center team to reacquire the items and send them to him. As of today, 3/28, Mr*** was charged $for shipping and the items were sent to him via UPS, tracking number ***He requested that we remove him from our marketing emails and that we remove his credit card informationWe have removed him from our marketing emails, but he will have to remove his payment information. We have resolved this issue with Mr***. Thank you for your consideration,EBTH

Hello:We are working with this situation The customer is correct She paid in cash and we have cut a check of $to be shipped to her today Thank you for the opportunity to correct this EBTH

An amount of $was refunded on October 5th as requested Please let us know if we can be of further assistance. The EBTH Team

Thank you for the opportunity to respond to these concerns. When placing bids on EBTH, we
allow customers to place a maximum but along with their minimum bidThe maximum bid stands as the amount the customer is willing to pay for the item and can be edited at any time provided it has not been outbid. Per the terms and conditions, “You may elect to raise the bid by more than the required minimum by entering a higher bid in the “Your Minimum Bid” boxIf you enter a higher minimum bid and your bid is the winning bid, you agree to be bound to your bid amount, regardless of any other previous bidsYou may also elect to enter a proxy bid in the “Your Maximum Bid” boxIf you enter a maximum bid, the system will automatically raise your bid by the specified increments if you are subsequently outbid, up to your designated maximum bid amount (“Maximum Bid”)Maximum Bids are not disclosedMaximum and/or Minimum Bids do not include any taxes, shipping or handling fees.” In reviewing Ms*** bidding history, it appears that she placed a minimum bid of $alongside a maximum bid of $at 3:pm on 12/on item ***, a sterling silver animal charm braceletEach bid following this was placed automatically, until no further bidders were willing to bid higherThe bidding ended with a high bid of $During the duration of the sale, Ms*** would have been able to see that her max bid was $on her “Following” page We have attached the PDF file sent to Ms***, showcasing this to herThe blue boxes next to a bidder name indicate an automatic bidFrom this bidding history, we can see that no bids were placed after the $bid until 6:pm on 12/14. According to the terms and conditions, “Your winning bid placed on the Site represents an irrevocable contract and you are responsible for paying all amounts due to EBTHIf you cannot pay for the items or agree to the shipping terms and costs, please do not bid on the items.” Because Ms*** $max bid was placed in conjunction with her $minimum bid, we are unable to allow her to return the bracelet for a refund. Ms*** received an email saying she was outbid at $on item ***, an silver charm braceletShe placed a $bid on 12/at 2:pm and was outbid at 5:pm the same day Thank you for your consideration, EBTH

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.I have agreed to have their gemologist inspect the table but never heard back from them. Originally, when they made the offer that I accepted of the credit back they asked me to provide proof which I did by a certified gemologist and I provided photos. I welcome EBTH to send their gemologist as I had already agreed to.I assume that once their gemologist confirms what mine had already that they will then send me a cashiers check for the $we previously agreed upon?

ETBH's assertions on this matter is an utter nonsenseThey contend that they listed item without specifying whether it was men's or women's; however this assertion is completely false In fact, not only have they explicitly posted a close up of a box that was labeled as " *** *** *** * *** " (***), EBTH specifically emphasizes the item in its title as "***) referring to the white box with a label that state the item as Man's watchBy posting this particular item in question as such, EBTH has committed a representation to its consumers because the size of the head and the wrist is specially sized for women wearer, and are most importantly, I contend that the box that was presented by EBTH is not the original box for item that was sold by EBTHIf you refer to the attached exhibit of the watch case in the white box in question, the picture clearly shows that the white outer box is far too big to be the original case of the watch EBTH have sold. It has been said that a"picture says a thousand words" by promoting the watch by falsely advertising it as a watch as in its original box, EBTH has deceived the buyer and other bidders by stating as suchTherefore I reject EBTH''s conclusion and I demand that a prepaid shipping label for the item to be returned and refund a full amount of the sale in the original form of payment as soon as possible. ** ***
