This piece was also in mint condition when I submitted it to EBTH. It is totally destroyed and also no worthless. As you can see it appears it was removed from the shipping box and someone from EBTH destroyed the sculpture. I am a serious collector and took excellent care of my collection. Additionally, EBTH was to have informed me of any and all items that were not going to be sold prior to the auction being started. I will not accept the box and will deny deliveryI want a refund right away, or I will take further actionsWhy don't you respond to my emails or call me back?” While we do have some representatives who work on the weekends, the hour deadline pertains to business daysBefore we could respond to Mr [redacted] ’s email on Monday 3/6, he called and spoke to a third customer service representativeThat person told Mr [redacted] that we were still within the terms and conditions for shipping timelines since it was the tenth business day and that the item was scheduled to ship that dayMr [redacted] insisted we cancel his order and refund him, but our CS representative said she was not sure she could do thatHe told her that if it was shipped, he would reject delivery.At that point, the customer service representative explained to Mr [redacted] that rejection of delivery or canceling shipping would cause him to forfeit the itemShe explained that in the event of a forfeit item, the customer is still responsible for paying the full invoice valueShe told him that, if she could cancel shipping, she would refund his shipping cost as a courtesy, but he would still have to pay $for the item cost and taxMr [redacted] ’s response was “We’ll have to go through court on that” and instructed her to cancel the item anywayWe were able to cancel shipping, so Mr [redacted] was refunded $for the canceled shipment and his email ticket was closed.Per our terms and conditions, “if you fail to piany items at the specified time or designate a shipping or fulfillment option within seven (7) days of the close of bidding you will be considered to have abandoned and forfeited the items.” Canceling the shipment indicates a cancellation in the fulfillment option which, ultimately, lead to the item being abandoned and, thusly, forfeitThe terms and conditions also state that “You expressly agree that failure to receive any item in the event of abandonment does not relieve you of your obligation to pay for the item or any other feesAt a minimum, you will be charged the amount of your bid to satisfy payment obligations to the seller.”We cannot refund Mr [redacted] any furtherThank you for your consideration,EBTH

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below [To assist us in bringing this matter to a close, we would like to know your view on the matter.] Regards, [redacted] -in mid July I contacted EBTH to consider them to sell the contents of my apartment-I asked for EBTH to provide conservative auction estimates for the key items they felt comfortable they would be able to fetch-I was told my items could be collected by august 1st and wouldE held at the EBTH warehouse in CT for a NY sale in mid to late september when their operations thee would be running-I agreed to use EBTH based off this information and that my story would be featured and anonymous-while traveling in Europe after the story interview I found out the auction was to be listed out of Ohio, and at the worst retail time ever, the week around Labor Day.-I was very vocal about this not being what I was told and how bad sales are at this time-I was assured the pieces would fetch good prices and if I didn't go ahead with the listing my feature would not take place-auction went live with listing errors which I conveyed to EBTH-had to follow up everyday on errors including site crash the final day of auction-some items never corrected-auction performed 30,USD below EBTH estimates-was not informed of any damaged items until mid September Was told table base of [redacted] did not get shipped and would sell in later NY sale-come to find out table base damaged and only received photos and more info after numerous requets-received photos of damage oct 2016-attached are emails showing EBTH wanted to sell lamp in NY sale, because of poor results I asked it to be returned because they could not assure there would be interest -at no time was any damage mentioned or missing purces-EBTH was aware insurance coverage needed late September as I was unaware all items were not to be sold IOriginal auction.-second attachment shows I found they had sold the base at an auction without my rep or myself knowing in september-all this while telling me it was to be sold in NY and then assuring me it would be sent back-rep couldn't believe what happened, -once again had EBTH returned the item after inspection in early August stating they could not sell, had the reported the damage before my insurance ended by late September, had they handled this professionally I would not be in the position-they did not, they repeatedly were in communication staton he they wished to sell the lmap-I asked for its return based on their poor auction results-finally they did repair two pieces they damaged and they did sell, the table sold for at least below their low estimate and secretary they locked the key in for half of its value Auction is a risk which I know pieces do not always perform A company acting like them repairing items they broke and being able to sell them is wonderful should realize that is the most basic steps they have to take to correct their errors

Thank you for the opportunity to respond to these concernsMr [redacted] has created an accurate timeline of events and meetingsWe will fill in any gaps in the timeline and bring some clarity to his experienceOut of both our Lexington and Cincinnati markets, we offer consignment services and estate auction servicesThe estate auction experience outlined to Mr [redacted] is accurate, but we do need to meet a certain value/distance criteria to hold an estate auctionAdditionally, the in-home estate commission can be between 35% and 45% and this determination is based on the value of the items and the distance from our headquarters in marketOur inside sales team can make recommendations as to whether a sale is a consignment or an estate auction, but the final decision is ultimately up to the sales specialist in marketIn Mr [redacted] ’s instance, the Lexington sales specialist determined that his items would be well suited for a consignment sale, rather than the estate auction initially recommended, based on the value of the items and the distance from the warehouseA consignment sale would have been conducted at a 35% commission rate with the items being moved from [redacted] to our warehouse in Lexington at the seller’s expenseThe price quoted to Mr [redacted] was $1000, based on an estimate of a full moving truck and a drive time of hour and minutesMr [redacted] ’s estate has an estimated value of $5000, so this would likely cost about half of his final proceedsMr [redacted] was dissatisfied with this and reached back out to our inside sales teamHe was forwarded to our Cincinnati market in the hopes that it would be easier for that team to accommodate himWhen the sales specialist in Cincinnati spoke with Mr [redacted] , she told him that the commission would be 45% for an in-home auction, based on value and a drive time of hour and minutesAgain, this is about half of the final proceeds of the estimated valueUltimately, we determined that this is not a viable option for us to offer himMr [redacted] spoke with our General Manager in Cincinnati at the end of DecemberIn their conversations, the GM ag [redacted] to try to find a cheaper moving companyMr [redacted] did not propose splitting the moving cost with us to the GM, but we would not have been able to agree to thatUltimately, in their final correspondence, our GM told Mr [redacted] that he was unable to find a shipping quote that was of a favorable priceMoving quotes were again based on a full moving truck and the drive time from the property to the warehouseIn this instance, it takes the same amount of time to get from [redacted] to Cincinnati as it does to get from [redacted] to Lexington and, as such, all of the shipping quotes were about $At this point, the only option we have to offer Mr [redacted] is to sell his items at consignment, to be moved at Mr [redacted] ’s expenseWe do, however, work with another local auction company for situations like thisUnlike us, they conduct live auctions offsite and can often accommodate in situations where we cannotWe understand that liquidating a parent’s estate can be a difficult thing to do and we would be happy to put Mr [redacted] in touch with themThank you for your consideration, EBTH
