Ms*** referred to this as the “fine print,” but this information is clear and present during the bidding processWe have attached two picturesThe picture titled “***_Teacups” is the closed item page for the teacups purchased by Ms***We have used a red box to highlight the dimensions, which note that the measurement is for the largest teacup and includes the measurement for the smallest teacup. Because this is a closed item, the location of the dimensions has shifted to the rightThe second photo is an example of a currently running sale, with the location of the dimensions highlightedAs is shown, this information is available to bidders at the time of bidding. We rely on all bidders to read all information regarding their itemsAs such, we cannot refund Ms***’s invoice. are left at a storage facility in the marketOn each individual item page, the physical location of the item as well as the available fulfillment options are listedWe do our best to keep the process as transparent as we can and we always advise that customers check shipping and pickup options prior to bidding. Mr*** bid on items before realizing that the items were physically in CincinnatiHe called our customer service number and a CS representative informed him that we could not retract the bids as the item location and shipping options were clearly visible to Mr*** for the duration of the sale being live. On 3/31, the same day we received his filing with the Revdex.com, Mr*** set and email to our customer service email that read “Misleading information on your website has forced my bids to exceed desired maximum bid amountA sale listed as local in Roswell, GA (***) has lots that are based in Ohio and requires an exorbitant shipping fee well in excess of the value of the itemAs it is not yet within hours of the close of the sale I would like to retract my winning bids from the following items : *** *** *** *** *** *** *** ***If you are unable/unwilling to remove my current bids, I hereby agree to pay for the winning bid and allow the item to be resold as unclaimed rather than pay the exorbitant shipping fee for what has been falsely listed as a local auctionAnd in the future I will endeavor to do my business with a company that is not so morally and ethically bankrupt as to mislead the consumer in such a way.”Based on this email, we took no immediate actionHe was outbid on all but one item, which he won for $On Monday 4/3, the item was forfeit and sent back for resaleMr*** was charged $1.07, the item price plus tax, for the invoice, per his instructions. Thank you for the opportunity to respond to these concerns.When *** did not pick up her item, it was transferred to our Cincinnati showroom on 9/13/When an item arrives at this particular location, it is our policy that it may be held there for days before it is forfeitedThe item was forfeited on 10/6/16, days after it arrive at the showroom in CincinnatiThe day policy at the showroom is commonly utilized so there is no reason to believe that the customer service representative *** spoke to would have told *** EBTH could hold the item for days, especially since there is no record of this. *** said that the customer service representative did not allow her to speak to anyone elseHowever, the customer service representative who spoke with *** offered to have a manager call her back, and *** refused this.Regarding ***’s concern of the lack of a reminder from EBTH about the pickup, our terms and conditions do not require a reminder: "The failure to receive a notification of a winning bid does not relieve you from your contractual obligations as the winning bidder."EBTH is only able to offer a refund to the credit card or credit line that was used to make the purchaseBecause of this, we issued a refund via ***, our credit card vendorWhen the refund gets to ***'s bank, they will apply it to the line of credit, for which *** has a new number.
