Thank you for the opportunity to respond to these concerns. Ms*** purchased two rings for $on 2/on invoice #B-The 10K tanzanite and diamond ring, ***, was purchased for $and the 10K white gold diamond engagement ring, 17CIN106-145, was purchased for $180. We
looked into her purchase and bidding on these items and determined the bids were placed by Ms*** and cannot be retractedIn bidding on EBTH, we do allow for maximum bids to be placed along with current bids which automatically raise bids until the maximum bid is reachedWe have included PDF files of the bidding on the two itemsPlease note that any bidders other than Ms*** have had their names blacked out. In the bidding for ***, Ms*** placed a pid for $with a maximum bid of $on 2/at 5:pmThe rest of the bidding on the item occurred on 2/She was outbid at 6:pm for $Between 7:03pm and 7:pm, Ms*** and another bidder bid back and forth, each time placing a new bid with no maximumAt 7:08:the bid was at $and at 7:08:Ms*** placed the winning bid of $300. In the bidding for 17CIN106-145, another bidder placed a bid for $with a maximum bid of $on 2/On 2/at 5:34:pm, Ms*** placed a bid of $with a maximum bid of $As can be seen on the attached sheet, Ms***’s bid was immediately outbid by the first bidder’s maximum bid, which was immediately outbid by Ms***’s maximum bid. In both instances, Ms*** placed intentional bids with the amounts she was willing to payWe cannot, therefore, allow her to refuse purchaseShipping has been paid for on the rings and they will ship to her shortly. Thank you for your consideration,EBTH

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear belowIn their initial response, EBTH insisted that this particular watch “* *** *** ** *** *** ***” was “a *** watch, which is a signature *** design and is marketed to both men and womenHowever this very assertion is proven false, by the very picture they have posted as part of their item description where they posted as part of twelve very thoughtfully laid out exhibit that shows a close up of a box with a label sticker that read “*** *** ** ***.” where if this particular watch model was indeed marketed as an unisex model, why would they label a box specifying it as a “Man’s” modelIn EBTH’s second response, they now insist that the “original box” they were referring to in the item title was in fact the red watch case, not the “white cardboard box.” This attempt at narrative further highlights their disingenuousness, where such distinction was never made in their item description of the watch, nor was it ever brought up in their initial responseTheir attempt to redefine or distinguish between a watch case and box is duplicitous and dishonestEBTH posted exactly pictures of this watch, and as the last, finale of the presentation, they posted a front centered close up picture of the white cardboard box with a label that read “*** ** *** *** *** *** *** *** *** *** *** ** ***.” EBTH claims that it “does not sell watches for a specific gender as watches are easily changed and altered.” However, for this particular item, they have made a deliberate decision to market this watch as “gender specific watch” by posting the clopicture that is explicitly gender specific where it shows a close up of the label that reads “Man’s Watch.” They did not arbitrarily pick out and posted twelve random pictures of them, but they took watch to their studio, and placed it in a certain light and to took professional photographs of the watch and all related item as a selling point of this watchAfter much thought and marketing process, they have chosen to include that particular picture of the labeled white cardboard box as part of twelve selling points of this particular watch. It doesn’t take much imagination or deductive reasoning to understand what EBTH was convey: that “This was a Genuine *** MAN’s watch, and we have an original box to prove it“ As EBTH has finally admitted in their latest reply: the red *** watch case “is much smaller than the white cardboard box it was placed in, indicating that it may not be the box the watch was placed in at the time of the original purchase,” EBTH falsely misrepresented a crucial information about this particular watch by presenting a picture of a white cardboard box with a label that read “*** ** *** *** *** *** *** *** *** ** ***” as part of its item description falsely stating that this was a Man’s watch, when it fact it was not. What is even more egregious is that, EBTH has had an ample time and opportunity to examine and discover that the box in question was not the original box for the watch during their initial examination, preparation and shipping process of this particular item, they had an opportunity to notice and acknowledge and carry out proper due diligence of the watch and related items they have posted in order to boost provenance and marketability of this particular watch, before they posted erroneous and information about this item but they have failed to do so at every single stage, even to this momentUnder federal law, all auctioneers are required to advertise their product honestly and accurately. In this case, EBTH has failed to do so, and have actually committed a false/fraudulent representation: where“any auctioneer who shall have knowledge of any or fraudulent representations or statements or who makes or causes any such statements to be made in respect to the character of any sale, or the party authorizing the same, or the quality, condition, ownership, situation, or value of any property, real or personal, exposed, put up, or offered by him or her for sale at public auction, shall be deemed guilty of a misdemeanor.” I demand full refund for this item as well as a prepaid shipping label, for the item to be sent back to EBTH. I have been more than patient and reasonable with EBTH up to this point, but unless this matter is resolved as requested by end of this week, I will be proceeding with filing my complaint with the FTC, New Jersey Division of Consumer Affairs, Ohio Consumer Protection Section at Office of the Attorney General, Ohio Office of Consumers' Counsel, as well as proceeding with a chargeback process against EBTH I will also be reaching out to local and nation news shows including online news sites about my experience in order to prevent other consumers from being victimized by this unscrupulous practice of EBTH tilted: Everything But The House or Everything But The Truth? Jekyll and Hyde story of an up and coming online auction site, one news producer’s nightmarish and surreal adventure dealing with EBTH Customer service department This story once published will perhaps give courage to countless other consumers who were duped and victimized by EBTH to come forward and bring light to this fraudulent and unscrupulous behavior of this company Regards,** ***

Thank you for the opportunity to further respond to these concerns. We have reviewed the screenshots provided by Ms*** and we have tested the addresses in Google Maps and MapQuestWe provided the correct address and every test took us to the same location in Texas. It is our opinion that the moving company hired by Ms*** did not do their due diligence on their initial trip and they are responsible for refunding her. Thanks for your consideration. EBTH

I do NOT see how the shipping fees are conveniently over $for a very short intra-*** *** trip for a few pieces that took less than minutes to load. And on both high-profile clients and I do represent a LOT of people in ** -- and I would never use this service againWith a business specializing in this type of service, there would be an expectation that shipping companies would offer better rates, and also, that some types of verbal quotations by representatives should at least be within a certain negligible range of plus or minus 20%From a quotation of around $to over $is absolutely insaneAnd comparable to picking up one piece at a very similar location -- with that shipping for Downtown *** *** being only $-- it doesn't make sense fiscallyI just am not happy at all with this service and it feels like a scamI've now given two high-profile clients' f*ly heirloom expensive items to EBTH for absolutely NO money back and a hassleIm not okay with this from an ethical perspective if not more so, just the level of customer service as wellIt's disheartening

For your reference, details of the offer I reviewed appear below. This response is the first time that EBTH has actually provided a statement acknowledging that they were unable to find my missing stirrerI'm extremely disappointed and upset that they haven't acknowledged this further despite my numerous attemptsWas EBTH planning on even notifying me and if so, when? I bid in good faith knowing that I was bidding on a complete set of If I would have known that it was only instead of the pictured 8, then I would not have bid on the itemsI don't want a refund on the missing stirrerI want to RETURN the stirrers I received and receive a complete refund including shipping

Thank you for the time to send the response The measurements listed were the size of the stools, consistent of how we have listed all items since he has joined Since he has purchased similar items and we have given him the option of previewing the items, we continue to have to maintain our stance We also received no contacts from the customer requesting additional information prior to bidding, which we offer all customers

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint
As I stated in all my correspondence with EBTH, and Revdex.com, I want to know what they mean by there statement in the disclaimer, " Autographs without COA's are compared to authenticated examples from online sources prior to sale upload" I want to know what they mean by this statement and what did they compare this autograph to? This is a misleading statement and if they don't have a reasonable answer to this question, this is misinforming the bidder on the validity of the autograph I would also like to respond to the absurd accusation by EBTH that this ball may not be the original ball sold If they look at the photograph on the JSA report and compare it to the offering photo that should resolve that ridiculous comment I would also like to address the fabrication given to my being banned by EBTH, I came to the facility to talk with the customer service manager, I did not speak to anyone prior to my coming in to see the manager with the hope he would be in and discuss this matter in person, apparently he was not in and I was given lip service by a customer service representative

Thank you for the opportunity to respond to these concerns. Ms*** purchased a pair of decorative tables and a lamp for $on 4/24, invoice ***With the $warehouse pickup fee, her final total was $193.16. The items in this sale were removed from the property prior to being
soldSmaller items were taken to our distribution center in Blue Ash, OH where they were only available to be shipped to buyersLarger items were taken to a storage facility in La Vergne, TN where they were available for local pickup with a $per item feeThe fee helps cover the expense associated with professionally removing the items from the sale and storing them at a storage facilitySince Ms*** purchased two items, she was charged a $warehouse pickup fee. Ms*** reached out to our customer service team on 4/to express her dissatisfaction with the warehouse pickup feeWe informed her that the fee cannot be waivedPer our terms and conditions, “By placing a bid, you expressly agree that if you are the winning bidder you will pay for your item and agree to any additional handling and shipping fees applicable for shipped itemsIt is your responsibility to understand the pickup and delivery options and costs for each item before you place your bid.” For the items on her invoice, the warehouse pickup with the $fee was clearly indicated on the individual item page. We have included two screen shots of items with available warehouse pickup for a $feeThis is how the items purchased by Ms*** would have looked. These items were available for pickup on Wednesday, April Ms*** picked them upWe cannot refund her pickup fee. Thank you for your consideration,EBTH

Thank you for the opportunity to respond to these concerns. Ms*** contacted EBTH to hold a sale for her in January of She held a sale with EBTH via our *** market which closed on 1/31/The sale contained items and made a gross profit of $3461, of which Ms*** was paid
$2,after EBTH kept a 35% commission. When preparing this sale, there were multiple items that EBTH misplaced in the transition, including rugs and a bed frameThe rugs were sent to our distribution center in *** for processingUnfortunately, the rugs were unable to be locatedMs*** was sent compensation for these rugs, based on combined amounts of comparable pieces a total of $in August 2017.Ms*** also sent us a wrought metal bed frameThis piece was lost in our warehouse in ***The general manager of the EBTH market requested a compensation of $for the best frame, based on what similar items have sold for on EBTH, on 11/10, so she should see that soon. We would like to extend our apologies to Ms***We understand that her experience was frustrating and it was not indicative of the typical EBTH experience. Thank you for your consideration, EBTH

Thank you for the opportunity to respond to your additional concerns. Any contact made by *** has been addressed by our customer service team with the exception of emails containing exclusively abusive languageShe has sent multiple emails simply insulting us with no additional issuesAny responses indicating that we will look into an issue means that the issue the customer has is something that requires consultation with another departmentTicket are automatically in the system, but can be reopened by the customer simply replying to them.We have reached out to our delivery service to determine when the second painting on invoice *** will be delivered and asking for urgencyWe are actively working to ensure delivery of the piece to ***. *** reached out to us on 10/regarding ***, which was delivered incomplete on 10/Our customer service team reached out to the shipping department, who located and shipped the missing piece outIt is scheduled to arrive 10/*** *** is scheduled for delivery 10/as well. When *** reached out to us about ***, she was seeking to charge her invoice of $to her credit cardHer email read “My total was less than $before shipping and taxCan I not just pay by credit card? I will do that tonight and have it out of the way.” Generally, our terms and conditions dictate that “purchases over five thousand dollars ($5,000) will require payment via cashier’s check, ACH or wire.” The customer service representative who answered her email on Sunday 10/informed her that the purchase could not be charged*** asked if the charges could be split up and mentioned that she was waiting on other invoicesThe customer service representative told her that they could not be combined and asked for the invoices so she could look into those on ***’s behalfAt this point, *** replied “I will not pay that kind of money without getting the points from my credit cardThe individual earrings do not total $Actually, the combined cost does not until you add tax and shippingYou can keep the earrings.” Unfortunately, we cannot issue refunds because a buyer has changed their mindPer our terms and conditions, which were agreed to prior to bidding, “EBTH will only accept returns in cases of material errors in the item description made by EBTH, as determined by EBTH in its sole discretion.” When the office re-opened Monday morning, the customer service representative was able to obtain approval for a one time exception to charge ***’s card for $and let We proceeded with shipment of the earrings as we typically wouldFedEx attempted to deliver them Saturday 10/22, but delivery was refusedPer their process, they will attempt again Tuesday 10/If the items are refused again, they will be sent back to EBTHHowever, per ***’s responsibility to pay for the items according to the terms and conditions, she will still be responsible for paying the $for the earrings and the will be considered forfeitedIt is our recommendation that *** accept delivery of the earrings on 10/25.We are a licensed auction company which operates within all state and local guidelines where we have marketsWe do not engage in any or subversive business practices and work hard to resolve all issues. Thanks for your consideration,EBTH

Thank you for the opportunity to further respond to these concerns. We have been unable to locate the initial gemologist report for this pieceThe market in Columbus no longer has these recordsWhen Mr*** sends the piece back to us, our gemology department will evaluate the ringAt EBTH, each gemologist on our team is a Graduate Gemologist from the Gemological Institute of America, where they were trained to use gemological equipment and procedures to identify and grade gemstonesWe will request a copy of the evaluation report for this stone. We can’t offer an unconditional guarantee of a full refund, but if our gemology team determines that the stone is in a condition that is not consistent with the ring’s listing, we will refund Mr*** in fullThis is our standard return policy for gemology and we are unable to make an exception. As soon as we receive the ring, we will have the gemology department evaluate it and pass our determination on to Mr***We would like to work with Mr*** to find the right resolution for both him and EBTH. Thank you for your consideration,EBTH
