Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Please see attached link. This goes to show how this ordeal is a misunderstanding on the part of EBTH. In the $90,000 of items purchased through EBTH I have not had any major issues until recent. Below is a link to the shipping policy and charge formulas for [redacted].https://www.[redacted].com/assets/resources/media/value-added_pricing... charges .90 per 100 for packages valued over 100. Since EBTH uses [redacted] exclusively... Ideally they should 1) know the terms of service with [redacted]. 2) Have a discounted rate greater than the amount quoted on the sheet. This whole matter could be resolved with EBTH better understanding there own shipping. I am not saying this to be rude, I am saying this to help them improve their business model when the shipping is currenlty the weakest portion IMO.Second refund the overage in shipping charges. Third reinstate my account so I can continue to work with EBTH and drive up bids and win interesting items.Thank you,[redacted]

Thank you for the opportunity to respond to these concerns. The shipping refund that was agreed upon was a credit for $31.15, bringing her $51.15 shipping charge to $20. This is the amount that Ms. [redacted] originally requested. We attempted to make this refund on 11/21. After Ms. [redacted] refiled with the Revdex.com, we checked her account and found that the refund had been rejected due to an outstanding dispute on the total charge. We cannot issue the agreed upon refund to Ms. [redacted]’s card until the dispute has been removed. When it has, we are happy to refund the $31.15.Thank you for your consideration,EBTH

Thank you for the opportunity to further respond to these concerns. The inventory list included by Mr. [redacted] was created by the [redacted] project manager. She created this list for him so that he knew what he would be getting back from EBTH. The item listed as broken by an EBTH employee was not broken by EBTH. The piece was packed in its original box with custom cut foam padding, so it could not have broken in transit or packing. The hazardous materials disclaimer was applied to lot [redacted], a motorcycle gas tank, and lot [redacted], a collection of 100th anniversary [redacted] memorabilia that included a [redacted] lighter. The direct links to both items are as follows:[redacted]
Mr. [redacted] met the project manager and the sales specialist with whom he worked at the [redacted], CO warehouse on 7/30 to pick up the items on the list sent to him by the project manager. Included in file “[redacted] Email 2” is the direct account from the project manager of her interaction with Mr. [redacted]. No mention was made in that meeting of any further issues. Per the seller contract, “Consignor acknowledges that the Items’ final value will be determined by the public based on the respective online bids.” Mr. [redacted] offered his items up for auction on EBTH with the agreement that their final selling price would be their [redacted]et value. We can only honor the [redacted]et value of items on EBTH as determined by our buyers and we cannot offer any further compensation for these items. Mr. [redacted] has had his remaining items returned to him. We consider this matter resolved. Thank you for your consideration,EBTH

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]EBTH refunded my shipping costs, which I appreciate. I am still waiting on my items to arrive at my home. I have been waiting on a response from EBTH for 3 days concerning this shipment.  Unfortunately I have had to do part of their job, as evidently nobody knows how to call the shipper. They shipped my items via Pilot Freight Services. My items arrived in Lavergne TN on 08/24/2016. I talked to Pilot this morning, my items were handed off to Southeastern Freight, who in turn handed it off to GSC? Not sure if that is correct, but I talked to an it named [redacted] and she said they have tried to contact me several times. I advised that I have not had anybody try to contact me, especially from the number that I called nor did anybody leave a message, but yet she could not provide another number. I want my items delivered ASAP. This is beyond freakin' ridiculous. If they cannot provide a better service than what they are doing, then they need to stop shipping stuff.

Thank you for the opportunity to respond to these concerns.  Mr. [redacted] purchased a collection of assorted gold scrap metal containing approximately 25 pieces for $935 on 1/30, invoice [redacted]. The shipping cost is $20.22 and the sales tax was $56.10, for a final total of $1,011.32. Mr....

[redacted] resold the some of pieces he purchased on eBay quickly after winning his bid and sent them on to his buyer upon his receipt of the pieces. The items were tested by our gemology team, which has the ability to test precious metals. On 2/21, Mr. [redacted] called to let us know that his buyer claimed the items were fake gold. We informed him that we are not a supplier for resellers, but that he could send the items back for verification. He received the sold pieces back from his buyer on 3/3, at which point we sent him the return label. When we received the items on 3/9, we discovered that Mr. [redacted] had only sent 2 of the 25 pieces. On 3/14, our customer service team explained to Mr. [redacted] that all pieces purchased have to be returned. He was given a $20 gift card and, at that point, we resolved his issue to his satisfaction. Per our terms and conditions, “Any claims submitted for review under our return policy must be received within thirty (30) days of the earliest of delivery or your taking possession of the item.” At this point, we can’t do anything further for Mr. [redacted]. Thank you for your consideration. EBTH

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]The response from EBTH is not a full explanation of my conversation with their Team Lead person, not with a manager.  I did say that I had no reason to access the Shipping Quote area because the sale was listed as a Louisville Sale and there would be no reason for me to request a Shipping Quote due to the reason that I live within a few minutes drive of the published Pickup location.I agreed with sharing the shipping cost of the first invoice for the Louisville Sale item that was shipped from Cincinnati, even though nothing on the site referenced that the item was actually in Cincinnati. My reason for agreeing to share the cost was merely because the second customer service rep seemed to understand my complaint and she was very polite in making that offer to me.  I even advised each customer service rep that I was successful bidding on another item in this same sale.  None of them advised me that there would be an additional $30 fee to pick this item up.When I received the second invoice with another $30 fee for warehouse pick up I called EBTH customer service again to inquire about this additional fee.  I was told again that the information is in the Shipping Quote area.  Again, I would not have a reason to request a shipping quote for a Louisville sale with pick up a few minutes from my home. The example attached in my previous response clearly shows that the information is in an area that would not normally be visited by a buyer for an item to be picked up in the same city or a few minutes from their home.
Respectfully, I do not accept the response form EBTH because the information regarding the sale location is not fully factual, the pick up location is misleading, and the additional fee requirements are not clearly disclosed in the sale description.

[redacted]

Regards,
[redacted]---Hello Ms. [redacted],I wanted to follow up with EBTH's last response. Image 1 shows the quote I requested for shipping to [redacted], CA (zip code [redacted]). The shipping corrected to [redacted] for a different part of town but the quote is for $27.96. I could not correct the shipping with [redacted] My Choice because the package had not been picked up from ETBH and [redacted] said they had to just cancel the order (no fee since it had not left EBTH) and create a new ticket. I hope this helps. I have purchased other items from EBTH and have checked out after 48 hours and have never been charged like this. I also did not approved either charge. I received an invoice asking me to input my shipping for final checkout and was never allowed to do that.Thank you for your time and consideration.Kind regards,[redacted]

Thank you for the opportunity to respond to these concerns. Mr. [redacted] purchased a [redacted] wristwatch for $1255 on 7/16, invoice B-[redacted]. With the additional item on the invoice, shipping and sales tax, his final total was $1736.38. Mr. [redacted] reached out to our...

customer service team on 7/27 to let us know that he believed the watch he received was a women’s watch. The customer service representative asked him what, in his opinion, made the watch a women’s watch. Mr. [redacted] sent our customer service representative a picture of the watch on his wrist - it did not fit - and cited a label pictured that read “[redacted].”A direct link to the description of the piece can be found here: [redacted]In accordance with EBTH policy, the watch was not listed as being a men’s watch or a women’s watch. We do not gender watches because, sometimes, the pieces given to EBTH as part of the watch are not original pieces. Instead, it was listed as a [redacted] wristwatch. This piece is a [redacted] watch, which is a signature [redacted] design and is marketed to both men and women. The watch was sold with three additional straps which could be interchanged with the black crocodile embossed leather strap. As can be seen in the dimensions of the watch, the bracelet including the face was listed as 8.5”. Prior to purchasing the watch, the information regarding the size of the watch was available to Mr. [redacted]. His assessment that the watch was misrepresented based on its size when he tried it on is inaccurate as he had access to the bracelet size information prior to placing his initial bid. We are unable to refund Mr. [redacted]’s purchase. Thank you for your consideration,EBTH

Thank you for the opportunity to respond to these concerns. Mr. [redacted] purchased a [redacted] grandfather clock for $350 on 10/30, invoice B-[redacted]. With shipping and sales tax, his final invoice total was $465.73. The clock was booked to ship to Mr. [redacted] via our home delivery...

service, which typically takes 3-8 weeks. The piece was delivered to Mr. [redacted] on 12/21, 7 weeks following his purchase. Upon delivery, Mr. [redacted] discovered that the weights, cables and pendulums were missing from his piece and contacted our customer service team. Due to the Christmas holiday, there was a slight delay in contacting the local team in [redacted] who sold this piece, but our customer service representative reached out to that team on 12/27. On 1/2, the team in [redacted] sent preliminary confirmation that the weights, cables and pendulum had been sent with our carrier, which was passed to Mr. [redacted]. On 1/11, the team in [redacted] determined that the missing pieces had not been sent with the carrier and were at their facility. We let Mr. [redacted] know that we would be shipping these to him directly. On 1/11, our logistics coordinator requested a special carrier service to take the missing pieces from our facility in [redacted], MI directly to Mr. [redacted] in [redacted], NY. Unfortunately, due to the relatively remote location of Mr. [redacted]’s property, our special carrier was unable to book a shipment to him. On 2/19, we received approval from [redacted] to ship to him via that service. [redacted] was not initially contacted due to the weight of the shipment. On 2/23, the weights, cables and pendulum shipped to Mr. [redacted] via [redacted], tracking [redacted], with a delivery scheduled for 2/27.We understand that this has been a frustrating experience for Mr. [redacted]. We would like to offer our sincere apologies for not shipping the weights, cables and pendulum with his initial delivery. We appreciate his patience during the delay in shipping these to him. Thank you for your consideration,EBTH

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]The contract never mentioned a "price per lot" and in talks with the EBTH representatives that "price per lot" was never mentioned whatsoever. There was never any "negotiations" whatsoever. I still feel that EBTH has botched this sale and caused me great financial loss and stress in my life. As I stated before I never agreed to a second consignment auction. While I tried to talk both on the phone and via email about my concerns and complaints with their project managers Bruno C[redacted] and Lucy B[redacted] as well as my designated contact Heather D[redacted], immediately after the sale was started, I was totally ignored after the third day of the 5 day auction (one email sent on June 27th still has not been answered}. The contract states that they would advertise the sale prior to it going live which they did not. The mass email was sent on the 4th day of the 5 day auction. I tried to promote the auction myself using the EBTH advertising tools provided. EBTH totally ignored my "lotting" instructions prior to the sale going live. I talked, in person, with Bruno C[redacted] and Heather D[redacted] about the "sets" of articles and the value of specific items as well. They told me that they understood my concerns and goals for this sale and would make sure that the "maximum" amount would be achieved for my items. EBTH's statements in the response are totally untrue. I would still like this issue resolved. Additionally, I have been waiting more than a week to find out what items were not included in the auction so that I can make plans to pick up my property in [redacted]. As of today, I still have not had a response. I also submitted two [redacted] paintings in this auction at the urging of Heather D[redacted]. She stated that "artwork" always brings higher prices when auctioned by EBTH. The financial losses on the paintings alone were severe. I am still severely upset by all of this which includes sleepless nights and stress. I am now not able to reach my financial goal which was explained to Bruno C[redacted] and Heather D[redacted] in person at my home. Some of the items in the auction stated "local pick-up only" or "may contain hazardous materials". I also inquired about these statements stating that "doesn't this limit the bidding to local areas only" and "what hazardous materials" are you talking about? I was totally ignored on those issues as well. Regards,[redacted]

EBTH is a licensed auction company, operating within all state and local guidelines where we have offices. We are committed to keeping our processes transparent.   To research this claim, we have compiled information from every person who encountered all of Mr. [redacted] items.    In transit from [redacted] to our [redacted] distribution center, thirteen of Mr. [redacted] items were broken. He was issued a check for those items, based on past auction value of similar items. To determine this value, we average the final sold values of similar items which have sold on EBTH. This is the approximate value we could have expected to fetch for the items, had they gone to auction. The only data we are able to use is our previously sold item records. We have included a document with the broken item numbers, reimbursed price, and comparable items. We have also compiled a list of items Mr. [redacted] still contends are missing.   -Hunting bag - Not taken by the crew due to low value -10 Sterling silver bread plates - Not taken by the crew  -[redacted] Soundbar with Subwoofer - Lost, credit for $88 based on previously sold items  -[redacted] speakers - Pulled due to insufficient information, will be sold later for Mr. [redacted] -[redacted] Watch - This piece has been lost. We will issue him a credit for $40, based on comparable watches sold on EBTH.  -[redacted] Drinking Glasses - Not taken by the crew due to low value -Cut emeralds - Never received or inventoried. The only loose stone taken by EBTH was a loose blue topaz, sold in a second sale (item [redacted]).   In regards to the [redacted] watch, at the property, Mr. [redacted] stated that [redacted] makes  “two different qualities of watches,” including the regular high-quality ones and a lower quality line which has more affordable watches. Based on our research, this is not an accurate statement. There are various price points for [redacted] watches, but there is not a “budget” line.    The watch was determined to be an inauthentic piece, it was sent back to [redacted]. In [redacted], the original crew member who packaged the watch to be sent to our distribution center verified that this was the exact same watch that she sent to [redacted]. We sent Mr. [redacted] his original watch back after we determined it was not a genuine [redacted] watch.    While we do appreciate any information a seller can give us, we are ultimately responsible for creating accurate descriptions and information about items being sold. As we are liable for returns, we must rely on our staff who write descriptions and have a focus on items they are experts in.  To utilize the seller for descriptions is a conflict of interest.   We handle millions of dollars in inventory.  We are only as successful as Mr. [redacted] is when it comes to the sale of his items.     Thank you.    EBTH

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and they did indeed ship out weights and a pendulum which arrived today. However, upon inspection the cables for the weights are still missing and the weights themselves seem to have sustained damage during shipment due to improper packaging, one of them having come apart and the other two having sustained dents. The items were delivered in a large 22 x 26 x16 [redacted] box, assumingly picked to accommodate the length of the 33 inch pendulum on a diagonal, but then the three weights each measuring 10 x appr. 2, were simply wrapped in packing paper with the void of the box loosely packed with additional lightly wadded packing paper. This provided no stable cushioning and allowed the weights, which are quite heavy, to freely roll around the box during transport which would explain the damage to them. Though the damage on the two intact weights seems more or less cosmetic, I am not certain that the third one, the one that came apart, can be sufficiently repaired. I have taken photos of the damaged weights as I found them when unpacking them after delivery. In addition, as I mentioned, the cables to hang the weights with are missing, yet the photo in the ad clearly showed the clock fully and properly assembled. As you can see my complaint has not been properly resolved. For it to be resolved the cables would still need to be shipped to me and at a minimum the broken weight replaced or properly fixed, and I don't think that to be an unreasonable request. We bid on and bought this clock in good faith that it would be delivered as shown and promised, and have been more than patient in the matter especially considering the clock was purchased in October 2017 and we still have no way to set it up as intended let alone try to see if it is in working condition.

[redacted]

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. At no time did I agree with them NOT shipping my item. It was explained to me that they would refund the shipping as a service to me for the trouble and delay they have caused in shipping my item. In my call, they did say that if I denied deliver on the item or returned it, that I would then forfeit it. I did not deny or return my item, so therefore, they should ship it to me. This company is not honest and as you can see on many other reviews and websites, they have serious issues with their shipping of products. I am another on that has bene taken advantage of by this company. What company would take your money for an item, return the shipping fee as an apology and then keep the item as a penalty? Their argument does NOT makes sense.I reject their explanation and the dishonest way that they have portrayed the events that have occurred. They have admitted receiving payment within hours of the end of the auction and over a month they have not shipped it and now are saying that they are keeping something that I paid for so therefore have admitted stealing it.

Thank you for the opportunity to respond to these concerns. Mr. [redacted] purchased a Hand-Knotted Persian [redacted] Area Rug on 11/26 for $460.00, invoice B-[redacted]. Mr. [redacted] reached out to Customer Service on 11/29 stating that there were undisclosed stains on this item and asked for...

EBTH to reimburse him $200 to get the rug cleaned. He sent in pictures for Customer Service to review on Wednesday 11/29. The pictures the customer sent did not show any severe discoloring or any flaws that would warrant a return or compensation for cleaning. Per the terms and conditions, “All items are sold "as is" and you are aware that, unless otherwise stated, the items sold on the Site are not new nor in perfect condition, may require touch-up or repairs prior to use and the available information about these items may be limited.”This item was described as “Good” with “minor marks from use”. We offered Mr. [redacted] $50, roughly 10%, off the entire invoice as a gesture of good faith, but EBTH regretfully cannot reimburse the customer $200 for a rug cleaning. We are willing to offer $75, about 15% off, the entire invoice to help offset the cost of cleaning for this item. We would like to extend our apologies to Mr. [redacted]. We understand that his experience was not satisfactory and that EBTH was not able to fulfill his compensation request. Thank you for your consideration, EBTH
