At no time has EBTH reached out to me to reschedule the pickup in the last several weeks since charging my credit card. This contradicts the claim that the items are waiting for me to collect them at the warehouse.They also acknowledge that they have charged my card for shipping charges without actually having prepared the shipment or shipped the items.This is a FULL ADMISSION that they have charged my card for services that they have not provided, and that they have both lied to me and have misled me. How many other consumers have suffered the same poor, unethical treatment from EBTH?!But for the Revdex.com complaint they would not even have made these admissions, and I truly appreciate Revdex.com support and efforts to reverse the charges!I have neither received the goods nor have they even been prepared for shipment. Now a full month has passed and I again ask that EBTH undertake the following actions:1. Apologize in writing for the above actions.2. Refund in full the charges made on my credit card.3. Thank you for the opportunity to further respond to these concerns. Ms. [redacted] did bring to our attention that we had included photographs that were not part of the chair photos. This can sometimes happen and we appreciated her alerting us to this. We checked with the project manager in Boston with whom Ms. [redacted] interacted when she picked up her chair. He told us that, where appropriate, the market in Boston does put pet disclaimers. The disclaimer was not necessary in this case because the pet hair is clearly visible in the item photographs available to Ms. [redacted] prior to bidding. He also clarified that the Boston market does not typically include the disclaimer regarding cleaning because they do not sell items so dirty they need to be cleaned. They did not feel the chair Ms. [redacted] purchased was unusually dirty for an as-is item and opted to sell it. At no point did he claim that adding such disclaimers was against company policy. While we do occasionally include disclaimers about pet hair or cleaning on item descriptions, these are included as a courtesy and are left to the discretion of the team who catalogs the piece. Typically, these are included in cases where photographs are not able to clearly depict the extent of wear, stain, or damage. Such disclaimers are subjective and, therefore, not standard protocol for inclusion. Ms. [redacted] included several photographs, including the photos from our website, in her claim. We have attached, for the sake of clarity, four of the photographs used in the original item listing. In the photos, you can see the wear and holes to the side, the staining on the front lower left corner of the piece, and staining along the left side. We carefully examined the photographs in comparison to hers and we saw these stains. Ms. [redacted] accuses EBTH of manipulating photographs to hide damage. This is not the case. EBTH photographers are instructed to capture all damage to an item and it is our position that this was done in this case. The chair was professionally lit during the photography process, which does brighten the whole piece, but it does not have any effect on the flaws in the piece. Per our terms and conditions, “All items are sold ‘as is’ and you are aware that, unless otherwise stated, the items sold on the Site are not new nor in perfect condition, may require touch-up or repairs prior to use and the available information about these items may be limited. EBTH will not list every flaw associated with each item as these are to be expected. In the case of obvious faults (chips, cracks, significant damage, etc.) EBTH does its best to list the fault within the description. EBTH will provide descriptions based on its assessment of an item. However, you should not assume that our assessment of condition will be the same as your assessment. It is your responsibility to read and review all descriptions and images of an item before bidding.”We did not libel Ms. [redacted] in any way, we simply cannot speak to when the larger stains she photographed occurred. They were not present on the piece at the time of the pickup. If Ms. [redacted] feels an item is misrepresented it is her right to raise her concerns. We have concluded that the chair was not misrepresented. We are unable to refund the chair. We came to the decision that the chair was represented accurately after careful consideration and evaluation, as well as thorough investigation. In her interactions with our customer service team, Ms. [redacted] refused to engage in a civil discourse and allow our customer service team members to answer her questions. Instead, she repeatedly yelled over them when they started speaking, resulting in our team disconnecting her calls. Ms. [redacted] made it clear over the course of her interactions with us that she is unwilling to use EBTH within the parameters set forth by the terms and conditions which she agreed to prior to placing her first bid. As a result of this unwillingness and behavior towards our staff over the phone and in person, we have decided to discontinue our business relationship with her and we have permanently suspended her account. The website, as you mentioned, listed it in Southwest Florida and Cincinnati, but on the main page and the shipping page, both stated that all items from this sale would be available to ship only. sets of coins from a sale in Charlotte, NC on 2/5 for $472. The sales tax he has been charged is $30.51. We cannot waive this tax. When EBTH establishes a market in a state, we do so in such a way that conforms to all laws and regulations pertaining to estate sales and auctions. Additionally, when we have a physical presence in a state, customers purchasing in that state must conform to the laws and regulations pertaining to estate sales and auctions. Per our terms and conditions, “All sales are subject to appropriate state sales and use tax laws.” In this instance, Mr. [redacted] is located in North Carolina. We have a physical presence in Charlotte, North Carolina, which means that Mr. [redacted] has to pay the sales tax on his items. Waiving the sales tax for Mr. [redacted] would mean breaking the law. Tell us why here...Mr. [redacted] has now made himself available after many attempts to discuss the problem with him. All the customer service tickets referenced that my concerns were assigned to him although he was never available to accept phone calls. There is a history on Revdex.com about poor customer service. I never said the shipping charge was unacceptable, I asked why 1 painting that I won had shipping charges that were only $37, far less than $169. There is still no shipping or tracking information for the painting in question for $169 shipping cost. No mention was made about "home delivery". Unfortunately a real explanation cannot be given as to how it is possible to bid a minimum and maximum bid at the same time. There is a significant commission involved here that Mr. [redacted] is concerned about. Once again, why would I change a MAXIMUM bid after viewing it for 5 days when the whole purpose of bidding a MAXIMUM bid is so I would not have to monitor the bidding during that time. Marc, the customer service manage, did email back a reply to my email after Ms [redacted], the cofounder who received a copy, told him to call her asap! I have that email which can be provided if necessary. Please review the [redacted] website for reviews by EBTH employees to substantiate my complaint. I feel my request for restitution is very fair.

Thank you for the opportunity to respond to these concerns. Ms. [redacted] purchased a pair of glass serving dishes and an offset lithograph shadowbox illustration for $4 on 10/13, invoice B-[redacted]. This invoice was available to be picked up at our [redacted] Distribution Center on 10/19....
When Ms. [redacted] did not pick the items up, they were held for three weeks until 11/9, when she was automatically charged $43.07 for shipping and the shipping was booked. Ms. [redacted] called and spoke to our customer service team on 11/9 to express her frustration at this charge. She said that she lived close to the distribution center, that she was not happy with the $43.07 shipping charge, and that she had forgotten about the items she won. The customer service representative explained that when items are not picked up, they are automatically charged out. Ms. [redacted] asked to speak to a supervisor, who explained the same thing. When customers are scheduled to pick items up but fail to do so, those items are held for a short period of time and, if the customer does not get in touch with the EBTH staff, they are automatically shipped as long as the shipping is under $175. In this instance, Ms. [redacted]’s items were held for three weeks before she was charged for shipping. We ask that all EBTH customers remain aware of their winnings using the EBTH website. At this point, we are unable to refund the shipping cost. That said, when we investigated the items on Ms. [redacted]’s invoices, we determined that the glass serving dishes had been delivered to Ms. [redacted] but the offset lithograph is unable to be located. Since we do not keep funds for items we are unable to deliver, we have refunded Ms. [redacted] $22.83, which is the total cost of the item and shipping for that piece. It must be nice to pocket an extra 3% now that this has been brought to your attention. You could at least research this on your own. Check with [redacted] on wether they would collect city tax at that address? Or [redacted]? Or [redacted]? We NEVER pay city tax on any delivery, because We are not in the city! Yet you collected City tax from everyone who picked up at the auction address. This means people over paid, sometimes by hundreds of dollars. Does this not bother you at all. To me it is theft pure and simple, and now add fraud on because you have been informed that this address is not in the city limits and have not corrected the error. Or maybe it was purposful?

Tell us why here...Mr. [redacted] has now made himself available after many attempts to discuss the problem with him. All the customer service tickets referenced that my concerns were assigned to him although he was never available to accept phone calls. There is a history on Revdex.com about poor customer service. I never said the shipping charge was unacceptable, I asked why 1 painting that I won had shipping charges that were only $37, far less than $169. There is still no shipping or tracking information for the painting in question for $169 shipping cost. No mention was made about "home delivery". Unfortunately a real explanation cannot be given as to how it is possible to bid a minimum and maximum bid at the same time. There is a significant commission involved here that Mr. [redacted] is concerned about. Once again, why would I change a MAXIMUM bid after viewing it for 5 days when the whole purpose of bidding a MAXIMUM bid is so I would not have to monitor the bidding during that time. Marc, the customer service manage, did email back a reply to my email after Ms [redacted], the cofounder who received a copy, told him to call her asap! I have that email which can be provided if necessary. Please review the [redacted] website for reviews by EBTH employees to substantiate my complaint. I feel my request for restitution is very fair.

Thank you for the opportunity to respond to these concerns. Ms. [redacted] purchased a pair of glass serving dishes and an offset lithograph shadowbox illustration for $4 on 10/13, invoice B-[redacted]. This invoice was available to be picked up at our [redacted] Distribution Center on 10/19....
When Ms. [redacted] did not pick the items up, they were held for three weeks until 11/9, when she was automatically charged $43.07 for shipping and the shipping was booked. Ms. [redacted] called and spoke to our customer service team on 11/9 to express her frustration at this charge. She said that she lived close to the distribution center, that she was not happy with the $43.07 shipping charge, and that she had forgotten about the items she won. The customer service representative explained that when items are not picked up, they are automatically charged out. Ms. [redacted] asked to speak to a supervisor, who explained the same thing. When customers are scheduled to pick items up but fail to do so, those items are held for a short period of time and, if the customer does not get in touch with the EBTH staff, they are automatically shipped as long as the shipping is under $175. In this instance, Ms. [redacted]’s items were held for three weeks before she was charged for shipping. We ask that all EBTH customers remain aware of their winnings using the EBTH website. At this point, we are unable to refund the shipping cost. That said, when we investigated the items on Ms. [redacted]’s invoices, we determined that the glass serving dishes had been delivered to Ms. [redacted] but the offset lithograph is unable to be located. Since we do not keep funds for items we are unable to deliver, we have refunded Ms. [redacted] $22.83, which is the total cost of the item and shipping for that piece. [To assist us in bringing this matter to a close, we would like to know your view on the matter.]You are not abiding by the law you are commiting fraud in collecting tax that is not due. It must be nice to pocket an extra 3% now that this has been brought to your attention. You could at least research this on your own. Check with [redacted] on wether they would collect city tax at that address? Or [redacted]? Or [redacted]? We NEVER pay city tax on any delivery, because We are not in the city! Yet you collected City tax from everyone who picked up at the auction address. This means people over paid, sometimes by hundreds of dollars. Does this not bother you at all. To me it is theft pure and simple, and now add fraud on because you have been informed that this address is not in the city limits and have not corrected the error. Or maybe it was purposful?

Per our terms and conditions, “Your winning bid placed on the Site represents an irrevocable contract and you are responsible for paying all amounts due to EBTH. If you cannot pay for the items or agree to the shipping terms and costs, please do not bid on the items.” Additionally, they state that “EBTH will use reasonable efforts to ship the Consigned Items within ten (10) business days after the scheduled sale removal and payment date.”Ms. [redacted]’s items shipped on 8/10, which was 13 business days from the scheduled payment date. This is within our reasonable efforts clause. Ms. [redacted] received a refund of $11.73, which was just more than half of her shipping cost, as a courtesy for the slight delay. They were delivered to Ms. [redacted] on 8/11. We consider this matter resolved. EBTH
