The issue here is not about maintenance fees or the costs related to the selling of our timeshare property, although we were lied to about these also. The issue is that the salesman for the Summerwinds Resorts/[redacted] Village told us that he could sell our old Bluegreen timeshare for $18,000.00 which we could use to buy the [redacted] property. He said this would happen within one year. It has NOT. We subsequently found out after looking into the situation that timeshares are not selling anywhere close to their value, if at all. The salesman knew this and he lied to us to sell his timeshare. Obviously it is our word against his and we did sign a contract. But we had no reason to believe that salesman like him would be dishonest and lie to sell something. It was not something we could investigate before signing. It was now or never. It is time the Revdex.com and the Attorney General stop this deceit in these business dealings and help innocent trusting people from being harmed. We are retired people and for us this has become a financial headache. One would expect this behavior in 3rd world countries, but it is very sad that this is happening in America. This company is certainly a BLACKMARK on our country and should not be allowed to operate.
The above situation has NOT been resolved nor will it ever be resolved until our Bluegreen timeshare is sold for near $18,000.00 OR our money returned and contract terminated from the deceitful sole of [redacted] property as promised.

Tell us why here... Dear Sir, The item that was sent was the DEED to the unit that Mr. [redacted] purchased. The letter was the only thing that was a mistake and we have since sent out a correction letter to them on October 17,2017. II have attached a copy of the letter and the deed for the unit that is paid in full and the Mr. and Mr. [redacted] are the owners of.We have not taken anything from them as they are owners. If they wish to, they may list the unit for sale to recover the cost of the purchase. My wife and I both assumed this company would sell out current timeshare. [redacted], the sales person, seemed so nice and we just completely fell for her charm. We were told that our timeshare is worth between $9,000 - $11,000. [redacted] kept saying that it would probably all be a wash. So when we were offered to do an upgrade, as she called it, we were thrilled that we would not be out much money. I even told her that we would never have done this if we were not sure we could sell our current timeshare. When we went to the Resale Disclosure, Mr. [redacted] said to just initial, that we were agreeing to everything that was presented to us by [redacted]. So, unfortunately, we just initialed without reading. When we got home and really looked at the papers it states that any oral representations to the contrary are not binding. We both thought that they would sell our timeshare, but the info is actually given to [redacted] in [redacted], Ohio. We realize now that we also initialed that we agreed to pay this company $199 to "try" to sell our timeshare. (I called [redacted] and found out that our timeshare is not worth very much. Also, on the closing papers we were charged $589 for for maintenance fees to Summer Winds Resort. We were told that if we did not stay at this resort we would not have to pay a maintenance fee. We were told by [redacted] that our current timeshare was a 3-star but if we bought into this program we would be a 5-star customer and could purchase as many vacations a year as we wanted for $499. It is actually $499 to $999 per week, depending on where you choose to stay. We gave them $1,973 ($589 maintenance, $484 for enrollment, and 15% of loan amount which was $1,489) They went ahead and set up payments for $166.58 (at 15.9%). I had originally told them that when I got home I would get the $8,411 out of savings and go ahead and pay the loan off and when the timeshare was sold I would put the money back in savings.
So, as I stated, when I got home and found all of this I called American Express to file a complaint and also told them not to pay the $166.58 which was to be automatically taken out each month.
I have read other complaints against this company. I don't see how they can still be in business. I certainly don't understand how [redacted] and [redacted] and Mr. [redacted] can look you right in the face and lie to you. This is truly a scam.

We have looked into this matter and this is the first year of use on the contract and Ms. [redacted] can set a date for Stormy Point or exchange the week via [redacted]. If she want to exchange we do pay the exchange fees, but it is up to the owner to maintain the membership.
We pay for the first year of the II membership. Owners can place the week into the maintenance fee reimbursement program and receive $499.00 back on the fees, the program is open starting in November and we take as many weeks as we can into the program.
I am not sure what is meant about the 2014 no spots. Ms. [redacted] can call customer service at X-XXX-XXX-XXXX and set her dates for her 2016 use week.

Not satisfied at all or willing to do a refund. I've called sell my time share now to see how much our property is worth and it's no where near what we paid. We paid 10,900 and he said the most we'd get out of it was no more than 3-4,000, not including the 1,300 selling fee we'd have to pay. He told us we shouldn't have paid more than 7,000 for it. I was shocked, surprised and disappointed because during the time of purchase we were told it's worth 17,400. I've talked to a couple lawyers to see what our options were and one of them told us "Good luck selling it because no one even wants them when their giving them away." Lies after lies with this disgusting company. They accused us of lying saying Don, their employee, would never tell us what were saying was suppose to be included. They act like we make this [redacted] up. Stay away from these people!!!!

weeks as many times per year as they wish. Weeks are unlimited for our owners and can be purchased up to one year in advance in some cases. Nothing is free, so weeks back to Stormy Point Village are based on the current maintenance fees. Owners can also purchase extra nights back to Stormy Point Village for only $100.00 per night.
This was the second purchase with Summer Winds, so the owner should know about the contract and the five days allowed to cancel with a full refund. At this time we will not cancel or refund this contract based on this complaint. We are always willing to help owners to better understand the program and how to get the most out of the ownership by calling customer service at [redacted] any time you need help with travel.

[redacted], This response is exactly what I am talking about. You are pointing out what your company has to offer while dancing around the lies that you told us to get us to buy. We already know we can buy extra weeks to use as a vacation. We can go anywhere in Branson and do that. Even those weeks you speak of are only allowed to be booked last minute and when we call to book one the place is always "full". There is never availability of those hundred dollar nights. That really has nothing to do with the issue of our contract. We were told about the hundred dollar days but those were presented as something totally separate. I see where this is going. You have legal loopholes to protect yourself on everything to allow your company to win. I'm rejecting your response as satisfactory. I'm not willing to continue to pay for a contract I feel like I got lied to about for the purpose of entrapment. My husband and I feel imprisoned by a contract full of misrepresentation. Worst case scenario let's assume my husband and I who own a home and both have successful careers are just is when it comes to the legal stuff. We still do not feel like the contract is what we signed. Even if we just don't understand anything we will never enjoy coming up to vacation with your company. Put yourself in our shoes for a minute and consider that had you felt like you got lied to for a purchase. You wouldn't want anything to do with the company so please if we can't settle on a refund at least release us from our contract with no further payment required.

Mr. [redacted] stated he had received a few letters to which he had sent replies to each. We sent seven letters of complaint beginning September 1, 2015 to which he responded to only three. He also stated we had five days from signing contract to identify concerns. 1) Concerns did not occur within the first five days. They occurred when phoning for reservations and were told "no reservations available for owners at this time"; "no reservations can be made outside of 30 days of arrival date". 2) When we were assured an upgrade was much more appealing and another timeshare we owned [redacted] would be transferred to that upgraded contract, with no further maintenance fee from [redacted] That transfer never occurred and we continued to be accessed maintenance fees. In addition, original contract had annual usage, up-grade only even year usage. 3) We were told we could sell the timeshare at any time. But how and to whom? Will Stormy Point purchase our contract?
We sincerely feel there was willful misrepresentation at the time of our up-grade in April, 2014.

Again we have looked into this matter and from the rely it seem as if there is some confusion on the ownership and how to use it. All reservations are subject to availability, Mr. [redacted] had a week to use in 2016 and that date can be set up to one year in advance, as for bonus time, yes it can only be set 30 days out from the date of arrival.
The old contract was for a 2 bedroom unit with annual use, the new contract is for a 4 bedroom unit with even year use, the price of the 4 bedroom units are much higher than a 2 bedroom.
The transfer of the [redacted] unit was closed on April 18,2016 and the e mail below was sent to Mr. & Mrs. [redacted].

Thank you for taking the time to respond. Again we must continue this dispute and continue seeking cancellation of this forced and grossly misrepresented contract. We are not confused in regards to this ownership at all. Our issues stem from the lack of availability in your resort. We were presented the opportunity to travel in the most affordable of ways. We've had to learn that not only is this membership not at all affordable, but the ability to actually use it is scarce. Anytime we've tried to call and schedule a reservation we're never able to. Why would we want to be involved with a company if the relationship is one sided? Do you think we enjoy aimlessly throwing away our hard earned money only to receive absolutely no benefits?
Finally, the transfer of our [redacted] property was completed, yes. However, that was done with absolutely no help from your company at all.
The bottom line here is that you sell a product that does not work and we want our contract terminated immediately.

Tell us why here... 1. We have never had an internal resale program. All resale listing are done by a third party agent, as    you agreed to in your contract. You filled out a worksheet for [redacted] to perform the resale of your [redacted] property. You also agreed to the resale disclosure...

Once again all resale listing are done by a third party agent and we make no guarantee of that sale, you were also given a five day right to look over the contract and cancel with a full refund.  3. Timeshare is an investment in your future vacations and not a money making investment as stated in your contract. We do have a first right of refusal in our contract and at some point we may buy units back from owners. We are not at that point yet. 4. We do offer a rental program or a maintenance fees reimbursement program , that you used for your2016 use year and received a refund of $499.00. You can also use the rental program, by calling customer service at [redacted]. 5. Missouri law requires that all tours are gifted the day of tour and the tour you agreed to stated a minimum of 90 minutes.  Again you had a full five day right to look over the contract, ask any questions you may have had and even cancel the contract with a full refund. At this time you have stopped payment to the lender and are close to being in default of the contract, if this happens you will forfeit all moneys paid to date on the contract. We started off with a younger guy who was a Salesperson and lived around there and believe he was sincere. We were told they would buy this back (now deny) and it's also an investment that could be sold for a profit. We have never gotten to use the 4 BR unit; never gotten to reserve it. Just got to look at it once when we were there. Doesn't look like the Attorney General is going to be doing anything. We have also been talking with a company called Time Share Release ([redacted]) but nothing has developed yet with that. Would we take less to settle?  $25,000.00.12/07/2017  So he offered $8.000.00. Well, I'm not destitute nor an it. We'd take $20,000.00. O.k, go with your plan that since the $25,000.00 I mentioned yesterday was not brought up, try that and see what he says. If he'll go up to $20,000.00 we will take it.12/08/2017 [emailed consumer about businesses $8,000.00 offer plus restore to old biannual plan (paid in full), etc.]Well, that $8,000.00 is not enough. Don't know what he means by showing a biannual 4 BR as "paid in full" as we have already paid in full with the $38,000.00 we've paid there. The fees are that are due every three years are Maintenance fees that also include taxes and other items, with Mr. [redacted] being a timeshare owner he had to understand that he would have a maintenance fee with his purchase.
Our owners can exchange the week and travel all over the world, and yes we do pay the exchange fees for our owners. We paid the first year of the membership and after that the owners must keep the account current if they wish to do so.
With this purchase not even being 30 days, it is hard to understand how anything can be wrong, as they have not even been put into the system and have not been able to explore the remaining portions of the program. We will not cancel this contract based on this complaint. Customer service is always willing to help our owners with any questions just by calling [redacted] anytime.

First off, the sales agent told us a broker would contact us to sell our other time share. And yes this was offered at point of sale which was the beginning of May, so yes your sales agent has offered this recently!
Second we were told there would be absolutely NO maintenance fees, we should not be expected to "understand" something if your sales agent is telling us something completely different. We were told the fee of $579 was a set fee every three years and only for taxes on the property.
Third, the exchange is only for the year you have a week, we were told we had a week every year but come to find out we only have a week every three years. So NO we can not exchange anywhere around the world every year because again your sales agent lied to us! And we were told that summer winds would pay Forever the Platinum package through Interval International we would never have to pay for that again. Again another LIE!
And yes this purchase is not 30 days old yet, but we realized early on all the lies we were told. Which is why we have posted this complaint and have asked to cancel this contract. So yes there are many things "wrong" with this contract. And as I explained to you in an email ans formally signed letter Mr. [redacted] we would like this cancelled and be reimbursed for the deposit we paid, because this contract was deceptive and we are not receiving what we were told in our presentation we were purchasing.
This company is taking part in unlawful practises according to Missouri law and we do not want any part of this and are forewarning those who are considering purchasing with you not to do so. This company is manipulative and promise so many things that are all lies.

Again we have looked at this matter and we have no contract for any resale listing, the owner was given a name of an agent that may be able to sell the unit. We have nothing to do with this.
As for maintenance fees, Mrs. [redacted] is a timeshare owner and I am sure she understands what maintenance fees are for and that they must be paid. The nice thing with our program is the owners can recover $499.00 of the maintenance fees if they do not use the unit and place it into the reimbursement program.
We do pay the exchange fees for our owners, in the use year. we do0 not charge an exchange fee for extra weeks or get a way weeks. All membership info for Interval International is for a standard membership, if owners wish to they may upgrade with II themselves.
Once again we will not cancel or refund this contract based on this complaint.

I do want out of this contract because of the false and inaccurate information that the sales person gave me. I want a full refund of all money that I have paid. I will not give them over $9,000 when they lied to me over and over again. That is bad business on their part, not mine. The whole process was very misleading.

I have tried to contact [redacted]. I have not been able to get through to him. The exact amount that this company has taken from me is $6,654.96. My original estimate included a downpayment of $3000 but realize now that it was $2574. I paid a down payment of $2574 on June 19, 2015. Automatic withdrawal started in August of 2015 for an amount of $313.92. This brings the total to $6,654.96.
I am willing to make an agreement but not to give this company over $6,000 for their lack of following through and lies to get customers. I am just saddened that a growing company like this one would need to do this in order to get sales.
I am not at a financial place in my life to take a $6,654 loss. I have already mentioned that I am a single mom trying to put two children through college by myself. I am a high school teacher that is trying to stay afloat financially. The salesperson, [redacted], knew all of this but still sold me this property with lies and misinformation.
I have not used any of the timeshare services and have not paid any maintenance fees. Therefore, I do not see what the issue is. You are a large corporation. Returning my money and canceling the contract will not hurt you at all. It will devastate me.

We received your letter and I want to what happened with Stormy Point. Early march I received a telephone call from the guy who sold us down the river.[redacted] in which he has been in Florida for the winter and he left us a message on our caller ID, and informed me that he was on vacation and not work so he would not or call me. He got back around early March? A very chew as my person as if I should know where he is all the time? At the end of the message he neglected to hang up the receiver and he and the other manager were talking about us being the dumb [redacted] about who assigned us to the time share and what ive asked if for shure that ive missed the return dead line to cancel?? [redacted] did not learn until Nov. sometime in Dec.? [redacted] was here but he would not respond to my calls. They were even glad that we did not get to cancel. I have recorded their conversations about us like we were a good catch I did not appreciate the way and what they called us not them knowing we heard them and their conversations. I have it on a recorder of our voice mail on the telephone. I called them and told them the next time to hang up before they tear and talk about us in such a foul way!! I do believe it schocked them and they([redacted]) got very upset and informed him I was going to pass it on if needed so. He got into a very upset mood. I believe I will send this letter to the Attorney General ([redacted] I am so upset with those folks at storm point or south wind Or whatever!!! We want nothing to do with those folks. I have sent these books back to them and have not called there office other than we do not apperecate the foul deception of us they called us and left us their foul message on our caller id telephone message!!
Their sales manager ([redacted] when he called us and informed us that they have enough lawyers and better that their people will beat us down and they will prevail!! Their people are not what you would call nice. I was even at one time offered to give them our money to have the company refund our full payment back to us. It did not happen. I will be 81 years old and my wife will be 79 years old in 2 months and we do not travel much anymore. All our family lived in Mo. our son in St Louis and daughter and family in Joplin & Spfld Mo. The tornado took their home but we all were spared. We do not travel much at all. We are ending our [redacted] at [redacted] their coming end of the year 2015. We were not smart with their ordeal of Stormy Point. The cancel time times are not fair and we did not need another time share and we thought we had a different purchase. We were singled out and swindled out of [redacted] We are in our last decade so to speak and traveling can be a chore to do at our age. I agree that the original complaint was more about threats than about substance. I apologize that I allowed my anger to overshadow my better judgment. My wife and I have just been so frustrated trying to get a vacation booked as we were told we could during the sales presentation. Yes, you can book trips 52 weeks out of the year but the availability in the areas we expressed interest in is the problem. We were asked in our presentation where we liked to travel and the 2 main places we told them was Destin, Fl and Colorado for skiing. The salesman opened the book to show us that they had properties in both locations. That is true. However, what he failed to tell us was that availability for these 2 locations was almost non-existent. We began trying to book a Destin vacation right after we bought the package. There was no availability for the entire summer. We tried to find locations in the FL panhandle but were unable to do so. Traveling to the other places in Florida with our family is cost prohibitive because of the long distance. There were more places in Colorado than Florida but we have still been unable to book a trip due to the low availability. It is also very frustrating to even attempt to book a trip because their website only allows you to search for a particular resort within a particular date range. There is no way to search to see what is available except by date. So you would have to be able to "guess: the exact date ranges that are available in order for it to show up on the site. If you call to inquire, you also have to provide specific dates and the calls are frustrating because they are pushing you to give up (trade) your week at your resort instead of wanting to help you get a vacation booked. The website is not user friendly. We strongly feel that we were pressured to buy this property that day and were told whatever we wanted to hear in order for a sale to be closed. I would love to see someone from the Revdex.com go sit through one of their high pressure sales pitches in order to understand that it is all about making the sale and not about providing the customer with a quality product. We love Branson and travel there quite often. However, it is again disappointing to find a business with such lack of concern for customer satisfaction and ethical business practices to be operating there.
We could be satisfied with our package if we could determine how to book vacations in the geographic areas where we expressed interest in traveling - booking 2 years out is not an option for us(as suggested by one of the travel agents we spoke with).
We continue to believe we may qualify for a hardship case as well. In March of this year, we found out we would be helping to raise our 7 year old grandson. He is staying with us most of the time which has made it harder to travel.

We have looked into this matter and find it hard to believe they thought they were just listing a unit for sale. They came in to the resort via an OPC contact that had nothing to do with Diamond Resorts and nothing in the paperwork...

they were given by the OPC had anything to do with Diamond Resorts.
This purchase was made in November of 2013 and they have never paid a maintenance fee to allow them to use the unit. In December of 2015 Mr. [redacted] said he sent a cancel letter to us, we did not receive any letter, I informed him it was too late to cancel the contract and that he had five days to do so.
I am not sure how Mr. [redacted] was able to book a stay at a resort in Branson, our records show that he has never paid the fees and he would not be able to travel with us until the fees are paid.
At this pint Mr. [redacted] can sell the unit via a broker of his choice, keep in mind the maintenance fees must be up to date before the unit can be transferred to the new owner.
We will not cancel or refund this contract based on this complaint.

When we were contacted by phone, we thought this was a service to sell our contract, which is the only reason why we attended.

Your sales staff deceived us on purpose! The know that had we known our contract would not be sold, we would have never agreed to attend the presentation.
The only bill we have received for maintenance fees was in July 2015. If you would like to see a copy of this bill, we would be more than happy to send this to you.
We will not sell this contract to anyone! We are owed a cancellation and we do expect for you to make this happen.

Mr. [redacted], states that we called him for this tour, when in fact he walked into our office on Hwy 248
here in Branson and asked about show tickets. This was not a telemarketing call. Again nothing on the paperwork given to them for the tour had any information on Diamond Resorts, it all stated Summerwinds Resorts. All of the contract he took with them from the purchase stated Summerwinds Resorts, and he had five days to look over them and cancel the contract.
So again if Mr. [redacted] would like to get rid of the unit he can have it listed and sold by the broker of his choice. The only thing I can offer is a deed back of the unit with NO REFUND.
I will have the accounting department send out a statement of the outstanding maintenance fees as they will need to be current before we can allow a transfer to the new owner when it is sold.

The asking price was set for the $16,00.00 you are asking. As per the contract you agreed to the Resale Disclosure ( copy enclosed) that states we did help list a unit for resale and we do not guarantee that sale.
So at this point you are in default of the contract due to stopping the payments to the lender.
If the account is not brought up to date and is allowed to go 90 days without payment the account will closed as a default and you may lose everything you have paid to date.

However, Summer Winds Resorts omitted the guaranteed $16,000 trade in value of our Parkway Resort in writing in contract number XXXXX if our Parkway Resort was not sold within 1 year. This is what was stated to the four of us by *** Austin on March 7, 2016 and this was the only reason we even considered buying into the Summer Winds Resorts.
Once again it seems apparent to us that Summer Winds Resorts has no intention of honoring the words of *** Austin or *** *** (see letter dated May 11, 2016).

*** *** response is not acceptable to us because Summer Winds will not put the $16,000 guaranteed trade in value of our Parkway Resort in writing. Of course, the sales staff feels like this will not be a problem one year later. I believe what *** *** and the sales staff are really saying is: we will put in writing the trade in value of $16,000 for your resort but if your unit is not sold within one year, then the trade in value of $16,000 becomes contingent upon the value after one year. Suppose one year later at their discretion $8,000 becomes the new value, then will that be the new trade in value of our unit? The statement by *** *** does not guarantee the $16,000 trade in value of our Parkway Resort and has absolutely no meaning to us. Once again, the only reason we even considered buying into the Summer Winds Resorts was the $16,000 guaranteed trade in value of our resort. The true value of a time share unit is not the listing price of the property but the actual amount the unit sells for. Your response is not a guaranteed trade in value but instead a play on words.
I checked with Vacation Services International, the agent listing our Parkway Resort about a month ago and they had many Parkway Resort properties for sale from $2,000 - $30,000+ and some of these properties have been on the market for over two years. On May 27, 2016 I again checked the VSI website at http://vacationservicesinternational.com/ and they have a total of 71 time share resorts available from $2,000 - $43,000. I'm sure that many of these are Parkway Resorts that are not selling. Do you think that maybe Summer Winds Resorts is overstating the value of our property so we would buy their property? On August 31, 2014 - September 7, 2014 we visited the *** *** Resort in Genoa, Nevada. We also went to a time share meeting at their resort and we did not buy their property because they overstated the value of their resort and they would only give us a trade in value of $8,000 for our resort.
We believe for this deal to go through there is one and only one scenario that can now be accepted by us. At the March 7, 2016 sales meeting, Summer Winds Resorts and *** *** placed a $16,000 value on their Summer Winds Resort and a $16,000 value on our Parkway Resort. Since the $16,000 value of both resorts was the same amount, then Summer Winds Resorts should be willing to trade their resort for our Parkway Resort. All future money we spend at a Summer Winds Resort will be money in their pockets. We will sign this contract and Summer Winds can take their time selling our Parkway Resort. If they sell it for $16,000+ they can keep the difference. This is more than a fair deal for both parties and no money has to be exchanged.
No other scenario other than the one we presented in paragraph 3 will be acceptable to us. We are tired of repeating ourselves over and over again. If Summer Winds will not accept this agreement, then send us the cancellation papers immediately. *** & *** ***

I don't know how else to explain this program, it is simple to understand the purchase was agreed to for a triennia use week, that can be used every year by paying a maintenance fee. this is one of our most popular ownerships, due to the fact that if you want an extra week you just purchase it and go. If you are not wanting an extra week then you're not out any money until the use year. In this case the use year is set for 2018 and the reservation can be set now for next year. She is right as the difference between the annual and a triennial are just the maintenance fees would be do every year on an annual contract.We have offered to help her to better understand how to use the purchase that they agreed to.They had five days to look over the contract ask any questions or even cancel the purchase. No calls were made to us until August 16th 10 days after the purchase. Once again we will not cancel or refund this contract based on this complaint due to the fact it can be used every year as she was told. Weeks can be purchased for as little as $399.00 per weeks less than a price of the maintenance fees.
