Mr. [redacted] has dates set for his unit for the 2016 use year and will be in Branson in July. At that point he will see the water park is open and has been for 3 years now. We have the boat dock open and slips are always subject to availability.
I have no knowledge of any problems he has had at the resort with his boat or truck.
I will be more than happy to sit down with Mr. [redacted] and see what we can work out when he is in Branson in July.

We are visiting this timeshare next week. I like [redacted], the property manager, BUT he is a business man. My complaints involve so many things throughout the years, that I am now so fed up with them, The latest that happened YESTERDAY was that I was told that I couldn't leave my boat on property anymore. I had to store them about 10 miles away, which in Branson, could now take up to and over an hour or better to get to the water. The water is only yards away from Stormy Point Resort. This is outrageous!!!!!! PLEASE RE-OPEN THIS COMPLAINT.

We are building at the location where the boats where kept. We have a full parking lot across the street

We have looked into this matter and the only complaint I see is they do not understand how the referral program works, once they send us names we call them and sell them a package. If they tour owner get a check if they purchase...

The other matter of the contract being a Triennial, it was covered in the contract closing.
As Mr. [redacted] stated in his complaint, he has stopped payment to the lender and is in default of the contract. We will allow this contract to be closed and he will forfeit all payments made to date.
It will take about 30 to 45 days to close the contract out, he will receive a letter from the contracts department once it is done. Nothing will be needed from Mr. [redacted] to close the account.

Again the resale of other units is not guaranteed per the contract and resale...

The sale was made in 2014 and I am sure the sales agent will not recall a conversation from over 2 years ago. This is why we have a contract and all the items are covered in the contract so they can be recalled and everyone is aware of what the purchase was and the terms of the contract.
Owners can rent weeks back to Stormy Point for the price of the current maintenance fee and they can do this as often as they wish subject to availability.
So again we will not cancel or refund this contract based on this complaint. The unit is paid in full and if they wish it can be sold by an agent of their choice.

Our Attorney has made some modifications to the release and an agreement has been reached. A new lease was signed by us, but was not signed by [redacted] LLC, Joseph [redacted], Managing Member. It is taking a long time to get their signature on the lease. I hope the lease agreement will be signed soon and we can bring this to closure so further action will not be needed. I have reviewed your concerns and find, per the contract you agreed to you can purchase extra weeks from $399.00 to $999.00 as stated in the VIP Charter and the contract. Extra weeks back to Stormy Point are based on the current maintenance fee, so yes you can get weeks back to Stormy Point for $589.00 plus tax.

If you do not want to use you week in your use year you can get a reimbursement of $499.00 of the maintenance fees you paid for the use year. I see that your first year use is set for 2017, so if you want to place it into the maintenance fee reimbursement program, you will need to call customer service in November of this year and tell them to do so.

You have unlimited weeks that you may purchase and travel as often as you wish. the Summerwinds travel and Interval international both offer extra weeks for purchase and not all of them are Hot weeks. II has weeks listed up to a year in advance.
Again we will not cancel or refund this contract based on this complaint.

We do not accept the response from Mr. [redacted] at Stormy Point/Summer Winds Resorts for the following reason. Mr. [redacted] refuses to acknowledge that his sales representative misrepresented and lied to us when he gave his sales presentation. What Mr. [redacted] was saying was in the contract, was NOT what the sales rep, [redacted] presented to us and to the [redacted] We purchased the timeshare based on what he told us, as did the [redacted] The four of us were also together when the contracts were signed. The [redacted] situation was the same as ours, not completely different as Mr. [redacted] implied in his previous letter. At no time during the presentation did either couple leave for any reason. Both couples heard and saw 100% of the same presentation. The fact that Summer Winds refunded the [redacted] their money, was clearly an admission that their sales rep lied and deceived us in his sales presentation of Stormy Point Village/ Summer Winds Resorts. We have consulted with a lawyer,and his advice is to continue our quest for Summer Winds Resorts refunding our money and releasing us from our contract. Mr. and Mrs. [redacted] have assured us they will testify on our behalf, if we are compelled to go to litigation.

Again everything in the complaint can be done, the weeks can be purchased for as little as $399.00
per week and new weeks are posted every Monday, all weeks no matter how they are purchased are subject to availability per the contract. Owner can also purchase weeks via Interval International and they can be purchased up to one year in advance. Again per the contract weeks are priced from $399.00 to $999.00
Again I cannot discuss someone else's contract, I will say that both party's filed a credit card dispute and we supplied the information and one of them was closed and the other was not. We didn't cancel the contract based on a complaint from anyone.
Mr. has paid his contract in full and he may have the unit listed and sold if he wants to get out of the ownership.
So again we will not cancel or refund this contract based on this complaint.

We disagree with Mr. Elliott's response on May 5, 2016. He said again, everything in our complaint can be done. That is absolutely not true. We purchased the timeshare based on what was told us by their sales rep, Scott Dygent,in his sales presentation. What we wrote in our first complaint is honest, true and factually the way it is. Mr. Elliott continues to avoid addressing the fact that his sales rep, Scott Dygent lied. The Papps credit card company froze payment to Summer Winds Resorts because they believed their complaint was honest and truthful. The Papps and [redacted] complaints are the same because we listened to the same presentation.

We have looked into this matter and find the resale listing was done in May of 2016 and is good for one year and will expired in May of this year. As per the contract and the resale disclosure, resale is not guaranteed. I Will...

As for time back to [redacted] and other resorts. In the VIP Charter it states that extra week are priced from $399.00 to $999.00 and the weeks back to [redacted] are based on the current maintenance fees amount. At this time a week back to [redacted] will be $579.00 for a 2 bedroom or $589.00 for a 3 bedroom well within the amount of the price range agreed to. I have attached a copy of the charter for review.
Maintenance fees are due every three years on this purchase, the HOA will send a bill every year for 1/3 of the next use years fee, owner can pay it by the yea or wait until the use year and pay the full amount at that time. Mo late fees will apply until the use year.
We will not cancel this contract based on this complaint. We do not wish to cause any hardship to our owners, so we may consider a release from the contract with no refund. We are NOT accepting the response from the business as we want out of the contracts we signed and a refund issued. Why should we walk away owing more than $5,000.00 on contracts that were signed under false pretenses? We were told information one way from the salesman and then of course the contracts read another way. They NEVER asked if we wanted to read any of the contracts before signing them. They did, however, tell us the contracts reiterated what we were told by the salesman and we signed them. Well, we found out what the salesman told us was not true. This is not a good value for us and again we are now stuck paying for two timeshares which is unfair. If we would have been told the truth during the initial presentation with the salesman, we never would have signed the contracts. We do not feel this is a good deal and we strongly believe that the contracts should be canceled and all monies paid to date should be refunded to us. We wrote a letter to the company back in December 2016, sent it certified with return receipt requested. We were hoping to deal with them directly to try and resolve the matter amicably between the parties but we did not get that chance because we NEVER heard from them. Signing contracts under false pretenses should be a good enough reason to make the contracts invalid and therefore the contracts should be canceled and all monies paid to date by us should be refunded. This company should not benefit from people signing contracts that DO NOT represent what they were told during a sales pitch and led to believe what they were signing was true and correct.

While there is a claim the check went out yesterday, there is no mention of the return of the original deed for our [redacted] property, nor an indication of the amount of the check. As I understand we have 10 days to reply, I am responding now with a "no" in terms of acceptance. If the check arrives in the stated amount along with the original deed, we will accept the response. However, we do find it frustrating that we can receive all kinds of calls and emails to send them money, but they seem always "behind" when providing responses to emails and the refund.

12/07/2017  They have been with us since 2009. We do not offer buy backs. I think some customers confuse our "right of refusal" with a promise to buy back. The right of refusal means the Resort has an option to buy the unit back in the future should for some reason it choose to do so. I have been through the [redacted]'s issues with the Attorney General and believe one of those Time Share Help companies also might have contacted us (those companies do not really have any clout so I just file their correspondence away). This is the first time I have had a call from a Revdex.com mediator (also, I mailed some information just yesterday to someone else at the Revdex.com). We would not be able to give them  a reference on who to use as a broker to sell this as we do not want to have any responsibility for who they use. Maintenance fees are past due.Are we willing to pay anything to settle this? Let me look at something. $8,000.00. Let me know what they say.[vm from business} I got your voice mail they would settle for $25,000.00. We have reviewed your concerns and I will address each of them as you have them listed.
1. All reservations are subject to availability, As an Admiral Club owner you can set a date up to 13 months in advance, I do understand that it is not always possible to know that far in advance, but the earlier you can set the better chance you will have of getting the time you want.
2. Bankruptcy, is not the only way out of a timeshare, You can sell them via a Broker of your choice
and have the unit listed and sold.
3. The ownership will end upon your passing, unless you place it into a trust or a will. We do not go after family members to take over the ownership unless it was given to them.
You made this purchase back in 2010 and I don't see any problems until recently and it looks like you may be having money problems. We do not wish to cause you any hardship, so if you need a release from the contract, we may consider a release with no refund. If you would like us to look into this, please let me know and I will be happy to.

Item # 14 of the Purchasers Acknowledgment states the owner will receive a deed within 4 to 6
months after the contract is paid in full.
Once Mr. [redacted] pays the outstanding 2016 maintenance fees, he can set a date for travel this year back to Stormy Point Village or exchange the week for some other location.

We had an issue with the maintenance fees being billed to us before we were ever able to use it. We should not have to pay any fees until we are able to utilize the contract, correct? We don't understand how your company can expect owners to pay any type of maintenance fee bills before they are ever able to utilize any aspect of their ownership. This is completely unacceptable.
We are also not happy with the fact that when we did try to utilize our contract, we called your company directly and the representative we spoke to reiterated to us that we could not stay at the actual resort, which is what we were promised, but they could put us up in a nearby hotel, but it would cost us more money! WHY??? Why would we have to pay any additional fees in order to utilize our contract? This makes no sense. How is this ownership beneficial for us? It seems the only ones benefiting is your company!
We have yet to be provided any services in return for the monies we have paid and we do expect for your company to cancel our contract and refund the monies we have paid thus far. We do not want to be associated with a company that tends to defraud consumers and would rather cut our losses now.

The reason Mr. [redacted] received his maintenance fee is this is his use year. Once the fees are paid he can use the week for 2016 to come back to Stormy Point or exchange the week to some other location.

The only reason an agent would tell them to stay in a hotel, is if we did not have any open units at Stormy Point. Owner can stay at Stormy point for $100.00 per night for a 2 or 3 bedroom unit within 30 days for the date of arrival.
If Mr. [redacted] looks over his VIP Charter he will find the information on the purchase of extra time.

I explained to her what was wrong she kept denying this wasn't said,(she did not attend the meeting with us so how can she know what was and not said)she called me back after getting Mr. [redacted] on the phone, he asked what was wrong I asked being he asked what was wrong was he just now learning of this problem being I have tried to reach him on several occasions, he said yes and started making excuse that he don't get involved when there is a problem. he denied what I said he told us. Ms. [redacted] started talking they were on conference call she asked me what kind of power do I think they have to buy our time share I told her the power to buy our time share since this was what we were told, I stated again Mr. [redacted] made us believe summer winds were buying our time share and we had no more claims to it. we're still standing on what we were told, she offers to put us in a cheaper unit with less cost, as I told her I'm standing on what we were told, she made a statement that we are just trying to get out of paying for this, no problem in paying for it if it was as we were told. she kept trying to get me to see it her way and again in our going back a forward I told her we are standing our grounds being the four of us were told the same things, I asked for our money back and contract to be cancelled she assured me it wouldn't be and it would be turned over to collections. I told her I'm not giving up on this we were lied to in getting us to purchase this time share. she got upset in turn so did I and I told her this stress I'm not going to continue and I hung up. I don't believe I would have ever received a call back from Ms. [redacted] or Mr. [redacted] had I not have filed a complaint being Mr. [redacted] knew nothing of this until 8/5/15. My Mother [redacted] would like her money back and we all want this cancelled. We have had this short dealing with this company and things are as they are it would be a train wreck to continue doing business with them..

We have looked into this matter and the sales department has tried to talk with Ms. [redacted] and she would not listen to them and from what I understand was quite abusive.
The sales person has been on the sales floor for about 8 years and has never told anyone anything like Ms. [redacted] is claiming.
Ms. [redacted] has refused the note with the lender and so we will allow her to cancel this contract and have a refund of her down payment to her within the next 90 days.
