200 weeks listed at this time for only $399.00.

I do not want to do any further business with this company or give them any more money for maintenance fees or exchanges as I believe we were not given the correct information about the selling of our other timeshare. We were not informed that the listing would only be for a year. I called the properties in Door County that they said would be available and there is no availability as we were told there would be. We would have to deposit our "exchange" on Jan. 1st and hope that something would be available at the property we wanted for spring or summer when our children could take advantage of it. Our Mexico property does not carry a deed with it and they did not point that out when they were making their sales pitch to us. They assured us their property was such a good place and we could easily exchange it. We do not want to do any further business with this company as we believe we were given false information verbally. When signing a mortgage, they carefully go over each step of the contract and this was not the case with Summer Winds. We were dealing with some medical issues last year and did not respond earlier and when we did contact [redacted] they did not have anything available! We do not wish to use Summer Winds or Exchange it for anything. I really feel that there are many young families and elderly people who are being taken advantage of in order to sustain this company. They are offered free tickets to get them to come and just "hear" about the property and see it and then they are pressured into buying.

The resale listing was only set for one year, so again we will have the unit relisted at no cost to Mr. [redacted] until the unit is sold.
In reading the reply I can see Mr. [redacted] is having a hard time understanding how the program works. Owners do not call the resort for reservations, they call the Summer Winds Travel to book the weeks for the $399.00 At this time the Summerwinds Travel has 6 units listed in Wisconsin for only $395.00 per week in a 2 bedroom unit, again that is only $56.00 per night.
Yes they can place the 2016 week into [redacted] for exchange in 2016 and they will not pay an exchange fee, as we pay all owners exchange fees.
If the [redacted]'s wish to they can list the unit for sale with a broker of their choice and have the unit sold.
Again we will be more than happy to help them to better understand how the program works and how to get the reservation they want. We will not cancel or refund this contract.

I am not surprised at the response, but my wife and I are very disappointed in the untruths that are being told to people to sell these units. We were told very clearly that we could upgrade our unit no problem, but everytime we called and asked none were available. I would like to know if any were ever available. I know our kids were thinking about investing in a time share. That will never happen now after this problem we have had. We are telling all our friends about how we were told whatever we wanted to hear. Very disgusted with the whole thing.

The fact that we do not offer unit upgrades any more is not an untruth, it is just supply and demand and the demand for unit upgrades was not enough to maintain the program.
The POA has the right to make changes to the resort matrix that will better the resort for all of our owners. At some point in time they may allow unit upgrades again depending on demand.

I have been very upset about the owner of this resort changing his policy after the fact we were told when we purchased the property it would be no problem to upgrade to a larger house if needed. We told them we had a large family and may need a larger unit from time to time. I feel we were used by the old bait and switch trick. I understand we are stuck in our situation, but all I can do is tell everyone that I come in contact with what happened to us. I can assure you none of my friends or family will ever deal with this company again. Thanks for ruining our vacation this year.

We feel that the tactics used to sell us on the Summer Winds timeshare were dishonest. We purchased a membership in Stormy Point Village in Branson, Missouri.
We would never even have considered buying a timeshare, if the salesperson hadn't told us that we would be able to reserve unlimited weeks for $[redacted] per week--upon availability--for us or our children, in the [redacted] inventory of timeshares. This was the thing that convinced us to sign up for the timeshare. As we stated in our earlier complaint, we didn't just hear her wrong or misunderstand...we asked over and over again if the $[redacted] per week price was accurate and true, and she continued to tell us it was. Had she explained honestly that there were only 150 weeks available for that price, out of the thousands and thousands of weeks in [redacted]'s rental pool, we never would have bought the timeshare. When we saw the "$[redacted] - $[redacted]" price on the charter membership form that we signed, we again questioned her, and she reassured us that that higher price was only charged on very rare occasions, for instance, in a city that was hosting the Super Bowl or some other major event that week. We believed her explanation--which ended up not being true at all.
We feel that a business should not be able to explicitly lie to its customers in order to sell a time share ownership, and then hide behind a document that wasn't honestly explained.
We feel that Summer Winds knowingly mislead us, and we deserve to have a refund of our $[redacted] payment, which we paid in cash.

Mr. [redacted] is missing the point of our complaint.
We were NOT told that we would have 150 weeks to choose from at $[redacted] per week. We were told that ALL weeks in the [redacted] inventory would be available to us, for $[redacted] with our VIP membership, with only a RARE exception. We repeatedly asked our salesperson if ALL weeks were $[redacted] per week and she said yes, except for very unusual circumstances! That is not the fact and she knew it was not the fact. She purposely misled us into believing her sales pitch.
If she had not lied to us, we would never have even had an interest in buying the timeshare.
Why is a company allowed to use deceptive tactics to ensnare their potential buyers and not have to own up to their deception? This company cost us almost $[redacted] because of a total and deliberate misrepresentation. They should not be allowed to train their salespeople to make untrue statements, and then use a document we signed under false explanations to blame us for the situation.
Had the salesperson been honest with us, we would have walked away, and not have found ourselves in such a frustrating position. How can they justify keeping our money when we bought the timeshare ONLY because of their dishonest sales practices?
We respectfully ask that they refund our payment!

the 150 weeks is just a guideline of the listings, some weeks they have over 200 weeks listed for the $[redacted] price and again that change every Monday evening, so new inventory and locations are placed on the list every week and again owner are not restricted to just these weeks.
I have attached 2 documents from the contract that was signed and initialed by both Mr. & Mrs. [redacted] that states the weeks run from $[redacted] to $[redacted]. I only see one request for travel and it was available
for less than $[redacted] for the week.
Again we will not cancel this contract based on this complaint, as they can have unlimited weeks for $[redacted]

once again this is in response to the fact that I was lied to to get me to purchase their product It is a violation of state statute to use deceit to sell a product. of the sale.

Mr. [redacted] continues nice words that have no meaning because of Summerwinds' action. If he could provide some proof that VSI has actually sold a timeshare from a Summerwinds referral, it would be meaningful. The VIP membership states Maintenance Fee Reimbursement up to $499 with no exceptions and is signed by Summerwinds' manager. Also, I have a text message from [redacted] which state no maintenance fee.

I disagree as to why the owner was not able to "tour" the resort as they had no intention to change their ownership they just had questions as to how to use their ownership and were not allowed to do so. One owner, not all owners, should be able to attend a presentation to ask questions at any time as promised at time of purchase. The initial intent to attend presentation, was not to change ownership but to ask direct questions in person regarding how to use their ownership. Promises were made by sales associate at time of purchase that were very misleading and it should be noted, the resorts in [redacted] are subject to availability and it was not mentioned that they are rarely, if ever, available. I tried to call [redacted] and was not able to talk to him in person - only allowed to email him. I was told [redacted] was in charge of compliance for Summerwinds. I asked for a copy of their sales associate compliance policy and to date, have not received a copy. Since two of the owners are 83 and 86, all of this was very confusing and frustrating to them and I wanted to explain this to [redacted] and was not able to do so.

We offer show tickets to owner to do updates of the resort and to maybe offer upgrades, therefore all the owners on the deed must me present so the deed can be changed if need be. The update is not for questions on how the program works, we have a full customer service department to help owners with questions.
As for the availability of the resorts in [redacted] all the resorts are subject to availability, this week the Summerwinds Travel web site has 2 units in MN for $399.00 for the week. New inventory is added to the site every week, so you just have to look for something that will meet your needs.
I do not have a sales associate compliance policy. All contract documents on the saqle are provided to the owner at the point of sale.

no because they said when we called back, they can't buy it back, because of phase three not being sold out . and now it is so they should be buying it back. [redacted] the sales rep. who sold us the time share told us it we ever need to sell they would buy it back. customer service said now that the economy was bad they wouldn't be doing it now. but that not what they said when we bought the time share. and for that reason I think they should buy it back because we need the money now.
The rep I talked too also, said they would take the time share back,
at no charge so we could get out of Maintenance fee I guess they would. I told them that any body would. That alone suggest a scam. I would appreciate your help in this matter, thank you [redacted].

[redacted] says we couldn't be lied to because we signed those documents. Well we were lied too and there was 4 of us sitting in that meeting and we all heard the same thing. The salesman that sold us that contract is no longer with the company either. I had texted him several times with stuff that we didn't understand. One was the fact that we could stay anywhere for $399 for a week. He talked to fast that if we were told about it only being hot weeks we didn't hear that. Also he said they would sell our other time share the same way we bought it in the first place and that was in a presentation and that isn't the way it is. It is put on a site to sell and nothing about a presentation to sell it. So if that isn't a lie I don't know what is. We are very unhappy with the way things went down. It was a high pressured sale too. We weren't able to get into the web site for about a month when we were giving our number and that is when we learn about all this. I think they do that so you don't back out right away until it is too late. We haven't used and so therefore would like our money back. We won't be happy with any other way. Thank you

for booking or banking, the note below is from the TPI agent that talked to her on January 22 that if the week was used she would be able to exchange it, if not she would lost the week.
The week was never picked up, so she was not able to exchange in 2013.

2016 is her next use year and she has not paid the maintenance fees for this year so her week has been lost again due to non payment of fees. If Mrs. [redacted] is willing to pay her 2016 fees we will do a onetime banking into her Interval International account so she can exchange her week for this year and travel.
Mrs. [redacted] must remember that her week in the first nine weeks of the year and she should be calling in November prior to her use year in 2019 to set a date or bank the week so it won't be lost.

1) When we were recruited at the meeting, we were told first that not only would we have a week every 3 years. We also would have what they called BONUS WEEKS which we could use any time and any place.
2) As we spoke of getting the time share [redacted], and [redacted] said that because the time share was at such a prestigious resort there would no problem to trade our week for any other place in the US or any other country. (They all neglected to share that the time share that was being sold to us was for the first 9 weeks of the year. And why would anyone want to go to Branson in Jan or Feb. Are the waterslides working then?) I tried numerous times to find a place in Wisconsin to trade our week for. (Because our "salesman" said there were several resorts that would be available for us to book in Wisconsin.) From the time we got our time share and the ability to log in was at least several months and then every attempt to log in failed (password [redacted] to us was incorrect?) at that time I attempted to contact Summer Winds via their website and received no response EVER.
3) I have not seen anywhere in our papers where it shows that our Tri-C "yellow" season 2Bd cottage is listed as only the first 9 weeks of the year. If we were actually told that we would NEVER had even considered the purchase of this time share. Why on earth would someone from Wisconsin even consider purchasing a time share that would be used or required to trade for someone else to use in January or February in Branson? That is insane!!!
4) When I did talk to someone to talk about a trade they said that someone would have to want our week before we could trade for the place and week that we wanted. Why would anyone want our week? It is certainly not in the middle of the summer when the weather is nice. So the possibility of trading our week for any other week is 0.
5) We were also told that we would NEVER have to pay the maintenance fee because we could always bank it and someone else WOULD always take our week if we didn't use it. They neglected to tell us that you need to pay the maintenance fees first and then maybe they can rent out our week, that there is no guarantee of getting any maintenance fees returned to us. I was told that when they sent out the billings for the maintenance fees.
6) The salesmen that we dealt with namely [redacted] and [redacted] gave a phone number to call to get assistance with our time share which I never was able to get an answer.

Dear Jeff,
Again this purchase was made in 2010 and Ms. [redacted] has use it and should by now understand how the program works. Once again I will reply to each of her concerns listed.
1. You can purchase bonus weeks anytime and travel as often as you wish. Prices run from $399.00 to $999.00.
2.Yes you can exchange your week and travel to other locations, it is not a problem for a yellow week owner to exchange. we do have owners travel to Branson in the early part of the year, and yes Branson has a water slide that is open year round.
3. I have enclosed 2 documents that show this to be a Triennial C yellow unit.
4. Someone wanting the week is not the owners problem, once it is banked the owner can exchange the week and no matter what the exchange co is able to use the unit or not the owner still is able to travel.
5. It is called a reimbursement program, so yes they have to be paid before we can reimburse them.
Again this is all part of learning how to use the purchase, our customer service department is always willing to help owner understand how to get the most out of the ownership. just call us at X-XXX-XXX-XXXX and we will be happy to help.
So once again we will not cancel the contract from 2010.

Mr. [redacted] is concerned about the sales price of the unit he listed for resale, after looking at the comparisons the price seems to be right in line with the top listing set for $26,000.00 down to $11,000.00. The resale process is...

just like selling a home, it is listed for a price and if an offer is made you can accept or counter offer. The purchase was made in January so it has only been listed for a short time.
Nothing about the sale was as Mr. [redacted] puts it deceptive, the listing is active and per the resale disclosure, resale is not guaranteed. Mr. McGee with VSI will be more than happy to talk with Mr. [redacted] anytime about his listing and how to maybe move it faster.

This purchase was made in 2009,at that time we were selling Yellow time and Red time, with Red being Prime time and Yellow being off season in the first 9 weeks of the year. The contract purchased was for yellow time. Mrs. [redacted]...

has banked her weeks in the past and use them in exchange. Once a week is banked you do not have any color applied to it.
If an owner wants to travel back to the home resort, the reservation must be within the first 9 weeks of the year, or they can pay an upgrade fee of $150.00 to set a date outside the yellow season within 30 days from the arrival.
The only way to avoid the fee is to bank the week with Interval International and do an exchange, we will pay the exchange fees for the owner.
The reservation for 2016 was set by a new agent that was not aware of the season and it was done by mistake and Mrs. [redacted] was contact and informed of the err.
Mrs. [redacted] contact the customer service department to bank her week or set a date for the first 9 week of the year I at Stormy Point.

I do not accept their response because I specifily asked for red season and was told that they didn't have red season. We have used our home resort twice before in summer and never paid exchange fee. We are older people and would not buy winter travel time. We have papers stating that we can split our week into a 3 days and a 4 days stay. They will not do that with an exchange and why would we do that within the first 9 weeks of the year? The company is very deceptive. The person that made our reservation was not aware of the season (change) as I was not. They thought of a way to get more money. It is unacceptable. I want what we were promised and paid for.

I don't deny or ever have denied buying a yellow season.we did so because we were told that they didn't sell red season. Yellow was for them like red was for other timeshares. I knew about red season from meetings with other companies. I specifily asked for red and again told that yellow was their highest level. We could use it at anytime.it is stated in Stormy Pointe Village Purchasser Acknowledgement, line 6' that our purchase is subject to float time.I would like my float time honored and my canceled reservation back.

contract resale is not guaranteed as we have no control over the Broker or the resale market. ( copy enclosed)
Our loan officers are willing to take as much time as needed to answer any questions an owner may have in the contracts closing. The owners also has a five day right to look over the contract, ask any questions they may have or even cancel the contract with a full refund.
The maintenance fees are due every third year on the contract, the HOA will bill for 1/3 of the total fees every year. If the owner wants to pay by the year they may do so, if not they can pay in the use year with no problems or late fees. The owner can purchase time on off years to travel to Stormy Point or other resort.
Yes [redacted] did have to leave the Ihop that morning as his dad was in the intensive care unit with a heart attack. We have a lot of older folks that purchase at Stormy Point some of them into their late 80's and they use and enjoy the resort all the time.
We will make a onetime offer to release Ms. [redacted] from the contract with no refund.

We have looked into this matter and find the sale was done in May of 2015 and the resale listing is good until June of 2016, so the unit may still sell before the listing expires.
As per the contract the Resale Disclosure states...

that resale is not guaranteed, and if the unit is not sold they cannot cancel the contract with Summerwinds Resorts due to non sale.
The first year of use is set for the 2017 use year, the HOA will send out a billing every year for 1/3 of the next use years fees, this is why they received the maintenance fee billing in 2016 & 2016.
We will not cancel or refund this contract based on this complaint. We will be happy to help the [redacted] to understand the purchase and how to use it by calling customer service at X-XXX-XXX-XXXX.

I am not sure as to how Mr. [redacted] can say the program is not working for his, he has not made a payment to the lender, so he has been locked out of his use until the account is current.

Mr. [redacted] has never addressed the reality that his sales people and the loan closing officer lied to us! I asked many times about the [redacted] weeks. The answer was always that they were available always for any place any time. [redacted] said the only time they weren't available for [redacted] is if big event was happening in the area. The example [redacted] used was the ball drop in Time Square and then we'd pay maybe up to [redacted] We found out that there isn't a property available in Time Square. We talked about the [redacted] weeks in closing and the loan officer backed up the lies. [redacted] said we'd be able to get hotel rooms for [redacted] a night. Also untrue. Once we got access on line, which was one day after the right to rescind the contract, it was too late. I called Summerwinds and they told me that I was stuck. Mr. [redacted] the right thing to do is refund the down payment and discipline your employees. Address my complaint! You haven't addressed my complaint! The honest wholesome atmosphere of Branson is not present at Summerwinds.

Mr. [redacted] is right, we do have over 150 weeks for on [redacted] and they change every week, so he can get a [redacted] week and he can use as many as he wants. The problem is we cannot make something available if they have no units open or no units at all, so therefore the contract states subject to availability.
The contract VIP charter and the purchasers acknowledgment all state the extra weeks run from [redacted] to [redacted] and are subject to availability.
At this time Mr. [redacted] has stopped payment to the lender and is in default. So he will not be able to book any time until the account is current.
At this time the best offer I can make Mr. [redacted] is a release with no refund. If he would like to be released with no refund he may contact me at XXX-XXX-XXXX.
