loss was reported to Founders Insurance Company by the complainant on October 15, 2016.  Upon completion of our investigation, the handling adjuster attempted to contact the complainant on October 24, 2016 to discuss settlement.  Unfortunately a message had to be left for a return call.  On November 1, 2016, the handling adjuster spoke with the complainant and a settlement offer was extended.  The complainant rejected our offer advising of a difference in estimates.  We requested that he submit his estimate for our review.  Our review of the complainant's estimate found that it was not accurate and our previous settlement offer would stand.  On November 17, 2016, the complainant accepted our offer and payment was processed.  Should you have any further questions, please feel free to contact me.

The Complainant has been contacted and a settlement agreement has been reached.  The check has been issued, and we consider this matter closed.

Please be advised that the complainant in this matter is not our consumer.  Our consumer is Sheri [redacted] and the complainant was driving her vehicle at the time of this loss.  Upon our notice of this loss, the handling adjuster immediately began an investigation into this matter. ...

Our insured submitted an estimate for damages to their vehicle.  However, this estimate contained new OEM parts which is not warranted on our insured's 1997 vehicle.  Accordingly, the insured's estimate was revised to utilize LKQ (Like, Kind and Quality) parts.  Please note that our insured's policy allows for the use of LKQ and aftermarket crash parts.  Our insured was contacted and a settlement offer based upon our revised estimate was extended.   This offer was accepted and payment processed on September 12, 2016.  Please feel free to contact me with any additional questions.

Please be advised that the handling adjuster attempted to contact the injured party, [redacted], on October 14, 2016.  A detailed message was left on her voicemail providing her with our mailing address, fax number, claim number and the adjusters direct phone number.  Detailed medical records and itemized bills were requested.  Upon our receipt and review of the requested information, Ms. [redacted] will be contacted to discuss this matter further.

There indeed was a policy issue I hadn't had any knowledge of until last week.My 9 conversations with the company were from my persistent calling and never really got me anywhere but again the policy issue was an unknown at the time. since that has been resolved founders has infact acted in timely fashion. And while it is 9/14 and I still don't have my car I was told this morning that I have been authorized for repair. [redacted] has been extremely helpful in the masher but I must say several of Founders reps were rude to not only myself but my to representative as well. A [redacted] in particular.I have yet to get the rental car because first I needed authorization which I jus recieved today which is appx.a month later.And while I am satisfied with the outcome, the process of this matter was not a "customer friendly" one. And after a horrible accident like that Customer service should be immediate and prestine.No matter what the issue as my full coverage auto insurer it should never take 30 days for repair & rental authorization.Thank you for your time.

I am rejecting this response because:I am incurring the cost of renting a car, I do not feel I should have to pay this up front. The expense will be incurred when you prepay for the car. Also after talking to several shops, they will not guarantee the outcome of using after market parts. The shops that Founders is recomonding, have many complaints against them. And based on estimAtes received from reputable shops, the after market parts and cost per hour that Founders is willing to pay is inadequate to properly repair the vehicle. I have attempted to share the estimates with Founders, they refused to even look at them.

The claim involves a vehicle that was struck while parked.  Coverage and liability was accepted. The parked vehicle owned by [redacted] was determined to be a total loss. We acknowledge there was some delay in getting an offer to the [redacted] as receipt of the valuation was...

delayed.  We apologize for any inconvenience.  We were also advised that they had contacted their own carrier.  The offer has been extended.  The vehicle is a 2001 [redacted].  The vehicle has unrelated prior damage that exceeds the value. The [redacted] have been given a total loss offer for basic transportation.  We were advised by the [redacted] that their carrier had made them a higher offer.  They care certainly within their right to accept the higher offer if they so choose and allow their carrier to resolve.

My last attempt to contact was on 9/9/2016, I left message at [redacted] regarding vehicle milage and questioning why the truck had not yet been removed. Please be advised that correspondence was mailed to the complainant advising him that his vehicle was a total loss and that Eva [redacted] would be his total loss adjuster however, as previously stated, the complainant's file was transferred to the Total Loss Department on June 30, 2016.  In regards to the complainant's statement regarding storage fees, please be advised that no fees are being assessed to the complainant's claim.

investigation into the facts surrounding this loss revealed that the complainant's actions were the proximate cause of this loss.  Accordingly, the handling adjuster contacted the complainant on January 19, 2018 and left a detailed message advising that Founders Insurance Company is denying liability for this loss.  Correspondence was also mailed to the complainant advising of our liability decision.  Founders Insurance Company does apologize to the complainant for any inconvenience that this claim process may have caused her.  Should you have any additional questions, please feel free to contact me.

investigation commenced.  Our investigation revealed that due to inaccuracies on the application for insurance, Founders Insurance Company has rescinded the complainant's policy making it null and void.  The complainant was advised of this decision on November 5, 2015 and correspondence advising of the same was sent out.  Should you have any further questions, please feel free to contact me.

All of our recommended shops guarantee their repairs.  Regarding the Complainant's demand that we pay for a rental in advance, we only offer rental reimbursement.  Therefore, our offer remains the same for the damage to the Complainant's vehicle, and our position on the rental also remains the same.

We always appreciate when people provide us with feedback, both positive and negative as we strive to always create a positive claims experience.  In this case the complainant is a third party property damage owner with a total loss vehicle.  We received notice of claim on 1/10/17 and...

spoke with Mr. [redacted] spouse Jessica [redacted] on the same day 1/10/17.  The adjuster outlined the appraisal procedures and assigned an independent appraisal company to inspect their damaged vehicle.  On 1/13/17 the vehicle was inspected and determined to be a total loss.  On 1/16/17 the file was transferred to total loss and the adjuster called and advised that the vehicle was a total loss.  On 1/18/17 the total loss adjuster attempted to reach Ms. [redacted].  On 1/25/16 Ms. [redacted] father called and the call was returned; and the offer outlined. Ms. [redacted] then called on 1/25/17 and the offer was outlined again.  With regard to the valuation, the offer was based on the value less the salvage.  We are not required to take vehicle salvage.  We understand that the complainant has rejected the settlement offer and will proceed through his own carrier.  We will work to resolve the claim with his carrier.  We apologize for any frustration or inconvenience and thank the complainant for bringing this matter to our attention.

I am rejecting this response because:  no client who is not at fault should have to wait six days short of a full month to receive payment on their vehicle, therefore incurring the cost of a rental vehicle on your paying client resulted in $1900.00 in the expenseTo pay for a rental car due to the negligent amount of time it took Founders** Insurance to issue payment so that I could purchase a new vehicle.    This accident was not my fault, I expect to receive back my $500 deductible, along with compensation of at least half of the rental car that I had to pay for for almost a month .     This accident was not my fault, you will receive your money back through the at fault party, there was no reason for this to take this incredibly long amount of time for you to issue me a payment when I am your paying customer!!!   Your rude disregard  of horrible customer service is not acceptable for any customer out there especially when an accident is not their fault and they had nothing to do with just being a victim, you should be there to help stand up for them not cost them more money !!!!!I would like my $500 deductible returned to me and I would also appreciate being compensated for half of my rental car which would be $800 plus my $500 deductible.   I would like my $500 deductible returned to me and I would also appreciate being compensated for half of my rental car which would be $800 plus my $500 deductible ... if we cannot solve this in this manner I will continue to move forward and file a small claims against Founders** insurance and publicize everything as much as possible on your horrible customer service

We have not denied the Complainant's rental out of pocket.  Again, rental is on a reimbursement basis, and he was informed of this.  He has not sent us a copy of his rental receipt, but when he does it will be evaluated for settlement of this aspect of his claim.

was not recovered, so the file was transferred to our Total Loss Department on June 5, 2015 to prepare for settlement. During the waiting period we continued to communicate by phone and e-mail. When the file reached the Total Loss Department a valuation was run to determine the value of the vehicle, and an offer was tendered. After obtaining the necessary paperwork from the Complainant's lien holder and from him, the claim was settled.
