The Complainant is a third party claimant who is pursuing a claim against our Insured's policy. Our Insured's property damage policy limit is $20,000, and in Illinois an insurance company has a greater duty to defend than to indemnify. Therefore, it was necessary for us to
wait for *** ***, the Complainant's insurance company, to send us their subrogation demand before we could make any offers of settlement. We just received the demand from *** *** on March 14, 2016, and with their the demand, the aggregate damages exceed our Insured's policy limit. Therefore, all claims, including the Complainant's claim for her rental out of pocket, will have to be settled on a pro rata basis. All claims will be evaluated, and the Complainant will be contacted with an offer

Founders Insurance Company policy states under PART I-LIABILITY:

vehicle without a reasonable belief that the person is entitled to do so;
Since the driver had a suspended
driver’s license, he should not have been operating a motor vehicle. A denial was issued to Mr*** on March

Please be advised that upon our notice of this loss, the handling adjuster immediately began an investigation into this matter. Our inspection of the complainant's vehicle revealed that the damages exceeded the value. Accordingly, the vehicle was deemed a total loss. The
complainant's file was subsequently transferred to our Total Loss Department where the actual cash value of the vehicle would be obtained and discussions of settlement would take place. On October 17, 2016, the handling adjuster spoke with the complainant and discussed settlement of this loss. After obtaining the necessary documents from the vehicle lien holder, payment was processed on October 21, and forwarded to the lien holder. In regards to the complainant's injury claim, an adjuster from our office will be in contact shortly to discuss the same. On December 29, 2016, the handling adjuster attempted to contact the complainant as the current mileage of the vehicle needed to be verified. A detailed message was left requesting proof of mileage. On January 25, 2017, the handling adjuster received the requested documentation is currently updating our valuation and preparing a settlement offer. The Complainant is a third party claimant pursuing a claim against our Insured's policy. Our Insured reported that he was involved in an accident on August 23, 2016. The handling adjuster began her investigation, and she spoke to the Complainant on August 24. The Complainant's
vehicle was inspected and an estimate written on August 25. The investigation was completed on August 29, and the Complainant's claim was settled on august 30. The settlement check was issued on September 1, and we consider this matter resolved

Complaint:
I am rejecting this response because: Founders insurance is still lying!!!!!!! I received a letter dated June 10, that reads my claim was turned over to Eva ***. Very, very unprofessional!!!! I am also being told to pay the storage fees, if Founders would not have drug their feet on this issue the storage fees would be very minimal. I am not paying the storage fees!!!!!!!

The Complainant is a third party claimant pursuing a claim against our Insured's policy. Our Insured reported a loss to us on March 12, stating that a tire blew out on his vehicle causing him to hit a parked vehicle, jump a curb, enter the Complainant's yard, and he also hit a
building. Claim forms were mailed to all parties whose property was involved, and our file reflects that on March the Complainant called and left a message for the handling adjuster. The adjuster returned her call and requested an estimate on her damage and photos. The estimate and photos were received from the Complainant on March 21, and she left a message for the adjuster on the same day. The call was returned on March 22, and the adjuster explained that we were in receipt of the estimate and photos, but an appraiser needed to review the estimate in conjunction with the photos for accuracy. The adjuster also explained that she needed to determine the damages sustained by the other claimants to ensure all claims could be settled within our Insured's policy limit. After review of the Complainant's estimate and photos it was determined that the estimate in the amount of $1,660 was excessive. The adjuster contacted the Complainant on March and explained this, and the adjuster requested another estimate. The adjuster also reiterated the need to determine the damages of the other claimants. On March the Complainant called and left a message for the adjuster who returned her call and left a message advising she was waiting for the demands from the other two claimants. On April the adjuster received a message from the Complainant requesting the status of her claim. The adjuster had not yet received the demands from the other claimants, so she called the Complainant to explain this. It should be noted that at this juncture we had not yet received the second estimate from the Complainant. On April 12 the adjuster received an estimate from one of the other claimants, but the adjuster still had not received the demand from the third claimant. That claimant was the owner of the vehicle our Insured hit, and he had gone through his own carrier. The adjuster contacted that carrier and was able to get an idea of the damages for the third claimant, and it appeared our Insured's limit was safe. The Complainant had not yet sent another estimate, so the adjuster contacted her and explained that without another estimate her offer was $1,000, which was rejected, and the Complainant advised that she would obtain another estimate. Upon receipt and review of the second estimate, the adjuster contacted the Complainant on May and settled the claim for the amount of the second estimate, which was in the amount of $1,065. The check has been issued, and we consider this matted closed

I am rejecting this response because:What they have said is not entirely true they did not finish my claim in a timely fashion until after I notified Revdex.com and All the faxes that I sent prior to sending email copies through my phone they kept saying they didn't receive and also my accident from May still wasn't settled and she has done the same as the others I continually paid per page over and over at Dmv to send papers and they kept saying they didnt receive Tia *** from the May case contacted me today after I called and called again then I finally got them to put me through to her manager thats why she called me today and said she still hasn't viewed my papers she doesn't know when she will get to them after she tried to tell me she was still waiting for hospital records so when I told her I sent them multiple times she finally looked and said well I just havent had time to view them They are very slow at this company constantly give you the run around make you keep paying for faxes that they dont reimburse you for and lie over and over so no I am still not satisfied with this company until they resolve all my settlements.But I would like to thank the Revdex.com for getting my car and rental reimbursement for the other claim moved along

reported to Founders Insurance Company on August 3, by the complainant. A coverage issue was identified concerning the driver of our insured vehicle and a coverage investigation commenced. Our investigation revealed that the driver of our insured vehicle would not have had a reasonable belief that he was entitled to operate a motor vehicle. Accordingly, On September 5, 2017, coverage was denied based upon an exclusion in our insured's policy. Both the complainant and his legal counsel were contacted and advised of the same. Please refer to Part III of our insured's policy, Limit of Liability, which states in part: "The Company's limit of liability under Part III shall not exceed the smallest of the following: (b) the amount necessary to repair the damaged property using, at the sole discretion of the Company, parts made by or for the vehicle's manufacturer, aftermarket crash parts or non original equipment manufacturer (Non-OEM) aftermarket crash parts or like kind and quality parts..." Accordingly, Founders Insurance Company may utilize LKQ parts to repair our insured's vehicle and these parts were clearly marked on the vehicle's damage estimate. Additionally, our insured is free to have vehicle repaired at a shop of their choosing however they would be responsible for any difference in parts prices or labor costs. *** *** located at 18th Avenue in Rockford IL can repairs the vehicle for the amount offered.
