adjuster contacted the complainant on July 18, 2016 and extended a settlement offer in the amount of $1993.79.  This amount reflected the estimate amount of $2493.79 less the complainant's $500.00 deductible.  The complainant voiced her acceptance of this amount and the handling adjuster explained that they would be contacting the shop to authorize repairs.  Payment was subsequently processed and forwarded to the repair facility.  The complainant also inquired about a rental vehicle and was advised that she did not purchase that coverage with Founders Insurance Company and was referred to her agent.  On August 15, 2016, the handling adjuster was contacted by the complainant who advised that nobody has contacted her regarding the repairs.  The handling adjuster contacted the repair facility who advised that they attempted to contact the complainant without success but they would attempt to schedule her in for repairs.  On August 17, 2016, the handling adjuster contacted the repair facility who advised that they did make contact with the complainant to schedule repairs however the complainant advised that she would contact them once she returned from vacation.  Repairs to the complainant's vehicle have been authorized since July 18, 2016.  We would request that the complainant contact  [redacted]'s Auto Body to schedule her repairs.  Should you have any additional questions, please feel free to contact me.

of the damages do not show the lift gate or rear bumper of the vehicle. The pictures submitted only show underneath the rear bumper. We cannot accurately determine the damage.If our insured later cooperates we may be able to reverse our denial and provide coverage, but at this time the denial stands as the insured is in violation of policy conditions.

Founders Insurance Company on October 11, 2016.  Our inspection of the complainant's vehicle revealed that the damages exceeded the value.  Accordingly, the vehicle was deemed a total loss.  Upon completion of our investigation into this loss, the complainant's file was referred to our Total Loss Department on October 25, 2016 where the actual cash value of the vehicle would be obtained and discussions of settlement would take place.  On November 1, 2016, the handling adjuster contacted the complainant and extended a settlement offer.  Our offer was accepted and payment was subsequently processed.  Founders Insurance Company does apologize to the complainant for any inconvenience that the claims process may have caused him.  Should you have any additional questions, please feel free to contact me.

I am rejecting this response because:I was told that an amount of approximately $3200 was the original estimate and that a check would be sent out by Angie [redacted]. Then, I was sent to their Special Investigations Unit and the investigator closed the case in my favor. After this I was told that a check would be sent out again. Thereafter, calls went unreturned for weeks. When I finally got in touch with the manager Arthur Shipp,  he told me that someone would call me the next day. I received a call approximately two days later and I was told that only the left side of my vehicle would be fixed. This insurance company has made excuse after excuse, not to pay for the vehicle. My car was hit into my garbage cans in the rear of my house. They are saying that this damage couldn't have happened by a garbage can. They never came out to my residence to complete an investigation. They are just making up excuses not to be responsible for my damaged vehicle.

I am rejecting this response because: This responds does not make any sense, your policy states, "while used as public livery" I was not driving uber at the time of the accident. You are a bunch of scammers. That won't even refund my money sense I violated your policy. You have ben ignoring my lawyer also. The [redacted] vehicle is a 2000 [redacted].  Our insured struck the passenger side of the vehicle.  The vehicle was determined to be a total loss, but in this case the vehicle had unrelated prior damage that exceeded the value of the vehicle.  The vehicle is in very poor condition...

and has over 200,000 miles.  An offer of basic transportation has been extended and rejected.  We mailed out the offer letter and forms in case Ms. [redacted] changes her mind.  We regret that we cannot offer more as the valuation of the vehicle is less than the prior damage, not caused by this accident.  If Ms. [redacted] wishes to accept the total loss settlement she may contact us and return the paperwork.

I am rejecting this response because: After numerous failed attempts at getting in touch with the assigned adjuster or her supervisor I decided to file this complaint with the Revdex.com. It wasn't until I received confirmation from the Revdex.com that Founders Insurance had received the complaint that the supervisor decided to reach out and the adjuster had finally  responded to my emails the day after the supervisor called. During the call is when the supervisor attempted to rephrase everything told to me upon initial contact. A police report was not filed because their insured begged me not to call, being in an already high crime area I agreed not to have police come if his insurance was valid and this is stated in the recorded statement I had given the insurance company back in April 2016. Initially I was told that they'd spoken with their insured and only needed more information regarding the vehicle owner instead of their insured. Once given  the information that the vehicle was not available to their insured at all times (which per the adjuster would make the claim valid) they requested the information of the vehicle owner instead of handling the claim themselves. According to their CSR the insured gave them the information of the vehicle owner and they were basically putting the accident off on them. This in my opinion is why the insured and the vehicle owner stopped responding to the insurance or myself. I gained all of this information after filing this complaint and the company had no choice but to respond. Otherwise,  I would still be leaving messages and sending emails that were going ignored for weeks.

The Complainant is a third party claimant pursuing a claim against our Insured's policy.  Unfortunately, our Insured has failed to report the loss or otherwise cooperate with our investigation, which is a breach of contract.  Therefore, we have denied coverage and our position remains the same.

Please be advised that our investigation into the damages being claimed by the complainant are to both the left and right rear quarter panels.  The main impact to the complainant's vehicle shows a side-swipe type of impact to the left quarter panel.  Based upon this type of impact, it was determined that the right side damages are not related to this loss.  Accordingly, our settlement offer in the amount of $2437.45 remains available to the complainant.  This amount reflects the left side damage estimate of $2795.86 less the complainant's $250.00 deductible, less betterment of $108.41 due to prior bumper damage.

message for the handling adjuster.  The adjuster retuned her call on April 5, and during the conversation the adjuster reiterated the need for the Complainant to send us two estimates, and the adjuster also requested photos.  The Complainant stated that she had already submitted the estimates, but they were not on file, which the adjuster explained.  On April 19 the Complainant left the adjuster another message requesting a return call.  We still had not received the estimates and photos.  The adjuster returned the Complainant's call on April 20 and explained again that we needed two estimates and photos.  The Complainant claimed she had not been informed of this, and the adjuster reminded her of their April 5 conversation.  We received the claim form completed by the Complainant on April 20 but we not the estimates and photos.  We received one estimate and photos on April 22, and we received the second estimate on April 25.  The estimates are inconsistent and include damage that may not be present.  Adjustments are being made, and after this is done, the Complainant will be contacted with an offer.

We are sorry that the insured has been ill and hospitalized.  Please be advised we  have moved the insured vehicle since his lien holder will not allow him to retain eh vehicle.  We await the paperwork from his lien holder which ahs not yet been sent that the line holder is contacting his GAP carrier.  Until the paperwork is returned, we cannot issue payment to resolve the claim.
