Complaint: [redacted]
I am rejecting this response because:
A rear end collision is always the rear drivers fault. I will pursue legal action.

The Complainant is a third party claimant pursuing a claim against our Insured's policy.  On October 5, 2016 [redacted], the driver of the Complainant's vehicle, reported that he was involved in an accident with our Insured, and the handling adjuster began his investigation. ...

He needed to verify the facts of loss, but he was unable to contact our Insured to do so.  The Complainant provided a video of the accident, which proved to be inconclusive.  A police report was ordered, which we did not receive until November 9.  The police report confirms our Insured's culpability in this matter, so the Complainant will be contacted to settle his claim.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.    Compensation was received on 2/1/2016.Thank you for your assistance Revdex.com.  Had there been better communication from Founders to me regarding the reason for the claim taking three months to resolve I feel a complaint would not have been filed in the first place.
Sincerely,
[redacted]

The Complainant is a third party claimant making a claim against our insured's policy.  We accepted 100% liability on behalf of our insured, and one of our staff appraisers wrote an estimate on the Complainant's vehicle in the amount of $673.21.  We tendered an offer to the Complainant in...

that amount and the offer was rejected.  The Complainant's vehicle is a 2010 Honda Odyssey, which does not warrant an new bumper, so the estimate was written with an after market rear bumper.  Our offer remains open to the Complainant if he chooses to accept it.  It should be noted that after market parts are of the same quality as new parts and in some cases are of better quality.  Regarding the Complainant's request for a rental vehicle, we did accommodate him and honor his request for a van due to his circumstances.  However, we have no direct bill arrangement with any rental company, so a the rental will be on a reimbursement basis.  It should be noted that from a legal standpoint, damages are not recoverable unless an expense is incurred.

Our file reflects that the adjuster contacted the Complainant on May 2, 2016 and made the settlement offer.  The check has been mailed and we consider this matter closed.

Please be advised that Founders Insurance Company has completed our investigation into this matter.  Our investigation revealed that the complainant's failure to disclose prior violations on their motor vehicle record was a misrepresentation of their application for insurance.  Accordingly, Founders Insurance Company has rescinded the complainant's policy making it null and void.  The handling adjuster contacted the complainant on May 16, 2016 and advised her of our position in this matter.  Should you have any further questions on this matter, please feel free to contact me.

Upon first notice of loss the handling adjuster conducted a coverage and liability investigation.  Upon completion of his investigation it was determined that coverage for this occurrence would be afforded, and it was also determined that our insured was 75% responsible for this accident. ...

This decision was based on our investigation of the circumstances surrounding the accident and the modified comparative negligence laws of the state of Illinois.  The Complainant's 2003 [redacted] 4 was deemed a total loss, and the total loss adjuster is working on getting him an offer.  Regarding his personal injury claim,  when he has completed his treatment he needs to forward all of his bill and associated medical records so that the claim can be evaluated.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and they still have yet to respond to me about the offer made to pay for the actual value of the vehicle. They stated it would take one day and its been 3 with zero contact or call back of if they are going to pay the full amount they offered and when I will be receiving payment since it had been 6 weeks since the accident.
Sincerely,
[redacted]

they need to provide documents to support there finds. also if I had collision damage coverage with them they should have cover the cost of the repairs. They were properly being paid there fee every month just to tell me the coverage they suggested I get doesn't cover my vehicle. founders reaped me off for my money and is coming with excuses as to why they wont fix my car. I have presented all the evidence there was to provide including a police report of the incident. the details they are claiming are negligent do to the fact that my key was in mypossession when the vehicle was taken. the car had been started with a my key all day on the day of the incident.

Upon our notice of this loss, the handling adjuster immediately began an investigation into this matter.  This loss was reported to Founders Insurance company by the complainant.  Please be advised that the complainant in this matter is not our consumer.  Mr. [redacted] is a third party...

claimant pursuing a claim for property damages against our insured's policy.  Accordingly, in order to proceed forward with this matter, a statement was needed from our insured.  Unfortunately, our initial attempts to contact our insured were unsuccessful.  Our investigation into this matter continued. Upon completion of our investigation, the handling adjuster contacted the complainant on February 23, 2016 and presented a settlement offer in the amount of $1487.83.  This amount reflected 100% of the complainant's damage estimate.  The complainant accepted our offer and payment was processed.  Should you have any additional questions, please feel free to contact me.
