time of your order clearly state that you were to have a one week trial period starting from the date of your order processing in which you could cancel your account to avoid further charges.  They also indicate that “you must take affirmative action to avoid further charges or you will be charged in the amount of $94.31 eight days from the date of your order processing for the product.”  These terms were presented to you in multiple places on our website when you ordered our product. Additionally, you were sent an order confirmation email after your order was completed that provided a full written version of the terms you agreed to. When you ordered the product you also checked a box indicating that you had read and agreed to the terms of the offer. When a customer checks that box we must assume that they have actually done what they are stating they did. If there was any confusion with the terms you could have called our customer service team and they would have been happy to assist you.According to our records we have not received any contact from you prior to filing this complaint. Our company has been unable to successfully charge you for anything other than the trial processing ($1.03) and shipping ($3.87) charges.In response to this complaint I have arranged for you to return the portion of your trial shipment labeled “Complete Program” back to us, unless you intend to keep the product and pay for it. Please follow the return instructions below to avoid being charged $94.31 for the product you received. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.The solution proposed by Action Pro White is not clear enough to proceed.  There were 2 trial products shipped to me, and I was charged $92.13 for each one.  The instructions do not clarify if I can ship both back together under the given RMA number.  And, the company doesn't clearly state what amounts they will credit me back.
Furthermore, the company said my account has been closed and would have no further charges.  But, today, 4/21/14, there is a NEW pending charge on my credit card for $105.22!
I tried to send a reply e-mail to the company to resolve these concerns, then realized it was a "no-reply" message they had sent me.  So I called them; when I started telling them that my account has been closed, the customer service rep rattled something I couldn't understand, then HUNG UP on me, in spite of my saying, "wait, please say that again ...".
So, I am pasting here (below), the e-mail I tried to send to the company, as it's obviously the only way to communicate with them.

In response to this offer, and your response to the Revdex.com, I need to make a couple of points.
1.      
 I did not see anything on your web offer about being
charged $92.13 for each product shipped … it was marketed as a “free trial”
where the customer only pays shipping and handling.
2.      
Regarding your week or 10 day trial period to avoid being
charged $92.13 for each product:  I was NOT given a trial period at
all!  I was charged $92.13 for each of the two products before even
receiving them!
3.      
You stated on 4/17/14 (below) that my account was cancelled and
there would be no further charges or shipments.  Yet, today, 4/21/14, you
have initiated a charge on my credit card for $105.22!  Here is a cut and
paste of the pending transaction:

I would like clarification of who you really are.  I
ordered the free trials, two products, from you at the same time, on the same
website.  One was Action Pro White, the other was Smile Pro Direct. They're
supposed to be used together ... according to your marketing.
(Both are pictured in the attachments.) 
But, I’ve been billed under two different
company names … ActionPro and BTSmile Pro, both in Scottsdale, AZ but with
different phone numbers listed.  I have been able to talk with a rep from
Action Pro White (who initially told me that no refund would be made); 
but I have called the number for BTSmile Pro twice and left detailed messages,
but no one ever returns my calls.
I am assuming you are one and the same company.  So please
advise and confirm that the two products pictured below can be shipped to the
Henderson, NV address you gave me, under the given RMA number.  Neither package
has been opened.
Then, I expect to be credited as follows:
              
    $92.13 for the Action Pro White
      
    $92.13 for the Smile Pro Direct
         
    $105.22 for the charge that is pending as of today 4/21/14.  (This charge
                               should be cancelled immediately, not just credited after the products are received back.)
Please advise ASAP so I can get these products returned immediately.  Thank you.

I did not get a RECIEPT at the time of the sale hence a bogus operation nor have any contacts or emails been returned to me I have changed my card information and again this is not acceptable in any normal net charge the legit company will give you a page providing information so you can make a final decision to accept or abort. I do not accept this company as legit also they gave my credit card information to other companies and the spam and phone calls are ludicrous.

The first time we heard from you regarding the cancelation of your account was on September 18, 2014 after you had been shipped and charged for your second package. Your account was immediately canceled and you have not received any shipments or charges since then.At that time we issued you a 60% refund back on to your card. I apologize but you are not eligible for any additional refunds. However, in an effort to maintain our standard for customer satisfaction I have issued a refund in the amount of $39.03 which is the remaining product price from your September shipment. We'll also enter you into our Action Pro White Pro White Club. With the Pro White Club you'll get a package of Action Pro White Teeth Whitening Pens so you can maintain your whiter teeth. (8) days from the date of order processing, and unless you decide to take an action to cancel (by calling our customer service center at [redacted] or [redacted]), we'll conveniently bill your credit card $94.31 for the full 30 day Action Pro White System. The cancellation and return policy is described in detail below. Plus, you'll also get a package of Action Pro White Teeth Whitening Pens about every 30 days for the same monthly in-home price you paid for the original Action Pro White System plus $10.91 in shipping, all conveniently billed to your credit card.

That is the full product price of the January shipment minus $10.91 for shipping costs, which per the terms that you agreed to is not refundable.  As stated in our purchase terms you may only return the most recent shipment for a refund.So, in summary, we have issued you a refund for $92.13 but your account is not eligible for any further refunds. a refund.

The Teeth whitening product takes time to determine the whitening affect.
In addition, the product was ordered on-line . It was received by us 5 -7 days later. My account was charged $92.12 10 days after ordering on line. This promotion is a rip-off. There is no way to determine in 3 days whether you want to continue or cancel. It is a scam.
I read on the internet another person was scammed exactly the same way and posted it on the internet.
Action Pro White is scamming customers by advertising a FREE TRIAL sample, but charges customer accounts exactly 10 days after sending
the product. This leaves the customer 3 days or less to cancel after receiving the Whitener.
IF THIS IS NOT A SCAM, THEN I DON'T KNOW WHAT A SCAM IS.  The B.B.B. is financed by our Tax dollars to protect citizens against scams like this. I want B.B.B. to investigate Action Pro White to see how many other "Trial" customers have been ripped-off by this same scam !

must assume that they have actually done what they are stating they did. If
there was any confusion with the terms you could have called our customer
service team and they would have been happy to assist you.
According to our records the first
contact we had requesting the cancelation of your account was on March 20, 2014.
At the time you canceled your account, we issued you a return merchandise
authorization number (both through the automated system and through a follow up
email) so you could return your shipment to avoid any further charges.  Using this method, you will incur no charges
for the product.   An email was sent to
your email address with full instructions to return your package.
That email reads as follows:

This email is being sent to confirm that your account is cancelled. You will no
longer receive charges or shipments.
The Trial portion of the product is yours to keep. If you do not wish to be
charged for the included Complete Program portion of the shipment, then that
portion of the shipment must be returned to us unopened and undamaged by the
due date below. Returns will not be recognized without an RMA number.
Your RMA number is [redacted].
This is valid for only one package. Your package must be received back to our
warehouse before 2014-04-04 to avoid being charged $92.13 for the Complete
Program.
Please write the RMA number prominently on the outside of the shipping package.
You will not receive credit if you do not use this RMA number.

Ms. [redacted],We recently received your complaint from the [redacted] regarding your Action Pro White account. We take complaints very seriously and we hope this response will provide you with additional information. According to our records, we received your order...

on April 4, 2014.The terms of the offer that you agreed to at the time of your order clearly state that you were to have a one week trial period starting from the date of your order processing in which you could cancel your account to avoid further charges.  They also indicate that “you must take affirmative action to avoid further charges or you will be charged in the amount of $92.13 ten days from the date of your order processing for the product.”  These terms were presented to you in multiple places on our website when you ordered our product. Additionally, you were sent an order confirmation email after your order was completed that provided a full written version of the terms you agreed to. When you ordered the product you also checked a box indicating that you had read and agreed to the terms of the offer. When a customer checks that box we must assume that they have actually done what they are stating they did. If there was any confusion with the terms you could have called our customer service team and they would have been happy to assist you.Since we did not hear from you during your trial period, you were charged $92.13 on April 14, 2014. The first time we heard from you regarding the cancelation of your account was when you used our automated phone system on April 16, 2014 after you had already been charged. Your account was immediately canceled and you have not received any shipments or charges since then.At that time we reminded you of the terms of the offer that were agreed to at the time of your order which state that once the trial period has ended, product from the initial shipment is not eligible for a return or a refund.I apologize but you are not eligible for any refund as your trial period expired prior to contacting us to cancel. However, in an effort to maintain our standard for customer satisfaction I have made an exception and will issue a $55.00 refund back on to your card. Follow-up to Revdex.com Complaint #10137563
As per Action Pro White's instructions, I mailed all materials to them on August 11, 2014 and they were received on August 13, 2014 (USPS Tracking # 9**SSN[redacted]SSN**2). After not hearing from them for almost two weeks, I contacted them on August 28, 2014 to inquire about the refund. I was told by one of their Customer Support Agents (CSA) that I had "failed" to include the RMA # on my returned package and that they were unable to provide a refund but that they would send me more of their product. After explaining that the RMA # was included on the shipping label and that her recommendation was not an option, she said she would talk with her supervisor. After a few mintes on hold, she retracted her previous statement and said that she would refund me up to 35% of my original total. I stated that was not an option and that I would need to speak with her supervisor. She then put me on hold and transferred me to [redacted]. Without rehashing my entire conversation with the CSA, [redacted] stated, yet again, that I had not included the RMA # on my package and I, yet again, stated that I had. Finally, I stated that I had followed their instructions that were included in the original Revdex.com complaint, that I had not used their product, so they would not be needing to assess a restocking fee and that if they did not provide a full refund after meeting all of their requirements I would be weighing my options as my next course of action; and that it would be more than contacting the Revdex.com. After it appeared that the company was not going to budge, [redacted] and I concluded our call. Approximately five minutes after the call, [redacted] called me back and stated that his management said they would provide me with a full refund and that it should be transferred to my bank account within 5 - 7 business days: the refund hit my bank account on August 29, 2014.
