order on November 26, 2014 and shipped your package the same day.The terms of the offer that you agreed to at the time of your order clearly state that you were to have a one week trial period starting from the date of your order processing in which you could cancel your account to avoid further charges.  They also indicate that “you must take affirmative action to avoid further charges or you will be charged in the amount of $92.13 ten days from the date of your order processing for the product.”  These terms were presented to you in multiple places on our website when you ordered our product. Additionally, you were sent an order confirmation email after your order was completed that provided a full written version of the terms you agreed to. When you ordered the product you also checked a box indicating that you had read and agreed to the terms of the offer. When a customer checks that box we must assume that they have actually done what they are stating they did. If there was any confusion with the terms you could have called our customer service team and they would have been happy to assist you.Since we did not hear from you during your trial period, you were charged $92.13 on December 6, 2014. The first time we heard from you regarding the cancelation of your account on December 10, 2014 after you had already been charged. Your account was immediately canceled and you have not received any shipments or charges since then.Our representatives issued you a return merchandise authorization number to allow you to return your product for a full refund upon receipt. You were also sent the following email: Dear [redacted],This email is being sent to confirm that your account is cancelled. You will no longer receive charges or shipments. The RMA number you requested is **-[redacted]. This is valid for one package. Under the Return Policy, you may only return one package for credit. The package must be received before 2014-12-25 to qualify for credit. If your return is received opened or damaged there will be a $19.60 repackaging fee.Please write the RMA number prominently on the outside of the shipping package. You will not receive credit if you do not use this RMA number. Our return shipping address is:[redacted]Once your package is received, a credit will be issued back to your credit card. Please note that returns are typically processed in one business day once we receive your package and it can take another day or two with your bank before it shows up on your credit card account. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I am not satisfied because 10 days is not enough time to determine whether or not the product is acceptable and works for you. The Teeth whitening product takes time to determine the whitening affect.

In addition, the product was ordered on-line . It was received by us 5 -7 days later. My account was charged $92.12 10 days after ordering on line. This promotion is a rip-off. There is no way to determine in 3 days whether you want to continue or cancel. It is a scam.

I read on the internet another person was scammed exactly the same way and posted it on the internet.

Action Pro White is scamming customers by advertising a FREE TRIAL sample, but charges customer accounts exactly 10 days after sending

the product. This leaves the customer 3 days or less to cancel after receiving the Whitener.

IF THIS IS NOT A SCAM, THEN I DON'T KNOW WHAT A SCAM IS.  The B.B.B. is financed by our Tax dollars to protect citizens against scams like this. I want B.B.B. to investigate Action Pro White to see how many other "Trial" customers have been ripped-off by this same scam !

The difference between the two options that were presented to you were: You could return your product for a full refund upon receipt of the item or you could receive an immediate $55.00 and keep the product. Our representative noted the account that you did not want to bother with the hassle of returning the product, which is why you accepted the $55.00 refund. I apologize that your mail filters caused issues with receipt of your confirmation email. We provided the purchase terms on the same page where credit card information was entered so that every customer is able to read and agree to the purchase terms prior to submitting their order.

We agreed to provide you with an immediate refund of $92.13 once your product has been returned back.Your return was received within the return deadline date and a refund of $92.13 has been issued back to you on July 6, 2015. regarding your Action Pro White. According to our records, we received your order on June 20, 2016.  
The terms stated: (8) days from the date of order processing, and unless you decide to take an action to cancel (by calling our customer service center at [redacted] or [redacted]), we'll conveniently bill your credit card $92.13  for the full 30 day Action Pro White System. The cancellation and return policy is described in detail below. Plus, you'll also get a package of Action Pro White Teeth Whitening Pens about every 30 days for the same monthly in-home price you paid for the original Action Pro White System plus $10.91 in shipping, all conveniently billed to your credit card.
 
These terms were presented to you in multiple places on our website when you ordered our product. Additionally, you were sent an order confirmation email after your order was completed that provided a full written version of the terms you agreed to.

Your intervention in this matter is very much appreciated.  Various members of the Action ProWhite customer service team have told me that I could expect a refund in 3-5 business days no less than four times, once in an email and three times by phone. Hopefully, this time, they will finally make good on their word and this will be the end of it.  However, I cannot understand why they are unable to verify my return.  All three team members who promised me a refund did so after following the tracking number I provided to verify that the product had been received.  I am able to provide it to them again if they would like proof of receipt.  At any rate, a partial refund is certainly better than no refund.  Thank you again for your assistance in this matter.

I ordered the action pro white product over two weeks ago but after noticing they charged my debit card $92.00 I called to send the product back so I could receive a refund. They told me they could not give me a full refund but they could give me a 60% refund and I could keep the product. I was ok with this and I was promised the refund to be in my account on Monday may 5th but I did not receieve the refund today. I called to ask them why I didn'treceive the refund and the gentlemen would not give me a reason why but told me he would take it to the billing department and I will have to wait another 5-7 business days. I do not understand how this company did not issue my refund when it was promised. I asked to speak to a supervisor and I was told they didn't have any supervisors working which I find that very hard to believe considering I am a manager at a small subway and we have 4 managers in our one store. I feel that they do not want to give me the refund I was promised since they have no answers for me and this is the second time I have been told to wait 5-7 business days for the refund.

Follow-up to Revdex.com Complaint #10137563
As per Action Pro White's instructions, I mailed all materials to them on August 11, 2014 and they were received on August 13, 2014 (USPS Tracking # 9**SSN[redacted]SSN**2). After not hearing from them for almost two weeks, I contacted them on August 28, 2014 to inquire about the refund. I was told by one of their Customer Support Agents (CSA) that I had "failed" to include the RMA # on my returned package and that they were unable to provide a refund but that they would send me more of their product. After explaining that the RMA # was included on the shipping label and that her recommendation was not an option, she said she would talk with her supervisor. After a few mintes on hold, she retracted her previous statement and said that she would refund me up to 35% of my original total. I stated that was not an option and that I would need to speak with her supervisor. She then put me on hold and transferred me to [redacted]. Without rehashing my entire conversation with the CSA, [redacted] stated, yet again, that I had not included the RMA # on my package and I, yet again, stated that I had. Finally, I stated that I had followed their instructions that were included in the original Revdex.com complaint, that I had not used their product, so they would not be needing to assess a restocking fee and that if they did not provide a full refund after meeting all of their requirements I would be weighing my options as my next course of action; and that it would be more than contacting the Revdex.com. After it appeared that the company was not going to budge, [redacted] and I concluded our call. Approximately five minutes after the call, [redacted] called me back and stated that his management said they would provide me with a full refund and that it should be transferred to my bank account within 5 - 7 business days: the refund hit my bank account on August 29, 2014.

This company advertises a "FREE TRIAL" of a teeth whitening product. However they fail to mention the fact that there is only an 10 DAY trial period until cancellation is invalid. They they charge approx $92 promptly after that trial period. Also, when called by an associate of this company, I was informed it was a 30 DAY TRIAL period until cancellation was needed. Therefore I did not worry about cancelling quite yet until my bank account dropped $92 overnight!!!!!!

Needless to say, I called and attempted to resolve the issue with a less than willing customer service representative. She informed me that this was a "legit business" and "no one was being scammed here". She also spoke to me as if I was a complete mn.

Overall, I believe this company is scamming people and drawing them in just to take their money with misinformation and a lack of honesty!!

I believe they should be shut down and ALL people who were scammed out of they money should be REFUNDED!!!!!!!

Your refund has already processed and unfortunately you are not eligible for any additional refund. Your account remains canceled and you will not receive any further shipments or charges. In response to Action Pro White's claims, please be advised the I NEVER placed an order with this company. I did place an order with [redacted] for a teeth whitening product which was cancelled in accordance with the terms outlined and sent to me by that company. I never placed an order with Action Pro White and am now being charged for an order that I did not place. In addition, I have not received any product from Action Pro White. I did receive an order from [redacted] when I ordered what was advertised as a "free" trial product. The order with Bella was placed on July 9 and was subsequently cancelled in accordance with the terms agreed to. I NEVER placed an order with Action Pro White so how am I being charged by this company? It appears that [redacted] and Action Pro White are related companies and are engaging in fraudulent practices to obtain funds from credit card companies. When I spoke with the Action Pro White customer service representative this week I advised him that nothing short of a full refund would be acceptable as I never placed an order and never received a product from this company.
