of $685.28. The account is for cellular services established on May 24, 2012, until [redacted] considered the balance delinquent on June 16, 2012.  The billing address associated with the account is [redacted] and the phone number is [redacted].  Afni attempted to mail the initial notice of the account to the consumer on January 24, 2017.  Afni received notice that the address was incorrect and did not receive an updated address until April 8th. Afni mailed a new initial notice on the account on April 9th.  On March 19th, Afni furnished the credit reporting agencies with notice of the account.  On March 22nd, the consumer spoke to an Afni representative and disputed the account.  In response, Afni ceased communication and initiated an investigation.  On March 23rd, Afni received a dispute from the credit reporting agencies, reviewed all relevant information, and responded appropriately.  On March 26th, Afni updated the credit reporting agencies on the disputed status of the account.  On June 30, 2017, Afni received this complaint.  In response, Afni ceased communication and initiated another investigation.   Afni has attached copies of the account billing statements to this response; these are provided as validation of the account.    To address the consumer’s concerns, the account has not been purchased by Afni.  Afni received the account from [redacted] and acts as an agent on behalf of [redacted]; therefore, the consumer would not have a contract with Afni.  On July 2nd, Afni sent a request to the credit reporting agencies to remove the account from the consumer’s credit report.  However, this does not mean that the account is not due and owing, simply that Afni will no longer furnish the account to the credit reporting agencies.  Afni trusts this response has addressed the consumer’s concerns, but if questions remain, or if she would like to discuss the account, she may contact a Regulatory Specialist at [redacted].

I am rejecting this response because: This is not me, its evident that someone has utilized my information as in identity theft and has the account in question under my name. This is not my account period!!! I will repeat that I DO NOT HAVE any kind of contract with AFNI.

I am rejecting this response because: I have submitted this Fraud Package along with the requested information several times. Each time the rep states that I need to send in additional information. This account was open fraudulently and I have been more than fair with this company. As you can see there were never any payments made on the account what so ever. I have provided pay stubs, bank statements, rental lease, as well as a photo copy of my identification for this to be removed from my credit report. The last rep stated that it would be removed immediately and yet it still remains on my credit report. I refuse to send in anything else. This needs to be removed or [redacted] needs to provide proof of me living at this address. Besides the bill that they have. This is not proof that I live here. I want to see a signed contract or agreement that has my signature on it. If this was open online, I would like the IP address that was used to open this account. I would like to know what measures did this company use before allowing services to be operated at this location? Did the technician ask for a copy of identification? I have a number on my credit report that request that I be called before extending credit. This method was not used. So therefore, I reject this statement.

Initial Consumer Rebuttal /* (3000, 7, 2015/07/30) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I copied all of the info they require, about 100 pages, when I wanted to fax it, I couldn't find the form to sign so they can do a Fraud Investigation. It wasn't attached to this info as stated. I called AFNI to see if they can fax one to me or e-mail, they said they can't do either, but will mail one which takes 7 to 10 business days. I am afraid this will go over my allowed time to have the resolved. They said they could have faxed it if they hadn't already put in a request to have it mailed. I find this hard to believe. I hate giving all of my personal info to a place like this. It appears I have no rights and there is nothing to protect me They want proof of residence, which is a lot of personal info, such as pay stubs, bank statements and the such. They want a copy of my Driver's License and other I.D. I don't feel like I can trust this place and am feeling very put out and taken advantage of. I have lived in Arizona since 2010 and this debt took place in 2012. These collection companies have all the rights and authority and the consumer has nothing on their side. When I spoke with [redacted] in [redacted] 2015, which is the first time I knew anything of this account. They wouldn't accept anything I had to say, but were willing to accept a lesser amount to pay this off. They couldn't even find an account in my name at [redacted] because they had already sent it to a Collection Agency. I explained this isn't mine as I live in [redacted], they were not interested. At that time the account had been sent to [redacted] Credit System Acct # XXXXXXXX and now it belongs to a different Collection Agency, AFNI, Acc: XXXXXXXXX and they couldn't find it under that number, I had to give more personal info to them. This is very frustrating and has taken a lot of my time . The biggest thing I don't understand is why [redacted] would open an account without proof of I.D. and residence,

I am rejecting this response because: AFNI has lied directly on this matter they have called several different times even after being provided with a POA from my lawyer they have called my husbands phone they have called both of our children’s phones AFNI has been told to stop calling us and call [redacted] Law at the number provided on their power of attorney form.  They continue to violate the law and deserve severe punishment I am sure the law states that after proving I owe the debt and being provided a power of attorney to contact who is resolving all of our debt they can not legally call us. There is a healthy fine that comes along with this violation and I would like to receive the $1000.00 fine with in ten days from today 02-16-2018.  I will pursue further legal action with my legal team if AFNI tries to continue with collection attempts or phone and or written contact to anyone at our address.  If AFNI has any questions they call the [redacted] Law Office at [redacted]

I am rejecting this response because: I am rejecting this response because: the verbiage in the letter states that the balance is still owed. The way the letter reads it states that AFNI is not a debt purchaser they are just a collector for the original creditor [redacted]. This debt has is not owed to [redacted] to be collected by AFNI. The debt or bill sent to me recently is not a valid debt. It has been disputed several times and the last customer service representative I spoke to advised that my account was closed with a zero balance. I request to resolve this matter that my file is closed, not put in dispute. The balance is zero. I agree with you terminating call collections activities. I agree also that AFNI request the credit bureaus to delete their trade line from my credit bureau file. Fair Debt Collection practices Act, allows me to defend myself against predatory collectors by contacting the consumer protection agency.
